Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

"Qur'anic" family is a family based on the basis of harmony (sakinah), affection (mawaddah), and love (rahmah). The ideal Qur'anic family is a family that is not only valuable for its own members but is also meaningful for its surrounding families. In other words, the Qur'anic family is individually, socially and vertically good family. The individually good family is reflected by the personal piety of the family members, and the socially good family could be seen from their concerns on amar ma 'riifnahi munkar (promoting good deeds and prohibiting bad deeds) and on distributing the zakat (tithe). In addition, the vertically good family is reflected by the family's piety to God and His messengers.

Abstract

Kekerasan seksual terhadap perempuan menjadi pergumulan bersama sebagai bangsa yang beradab. Tidak dapat dipungkiri bahwa kekerasan seksual terhadap perempuan terjadi di Indonesia dari tahun ke tahun kian meningkat. Bahkan, bentuk kekerasan seksual yang terjadi selalu bervariasi. Salah satu bentuk kekerasan seksual perempuan adalah kekerasan seksual berbasis budaya dan tradisi. Oleh karena itu, tulisan ini membahas kekerasan seksual berbasis budaya dan tradisi pada praktik adat Sifon oleh masyarakat suku Atoin Meto. Praktik adat Sifon merupakan tradisi khitan yang dilakukan seorang laki-laki sudah menikah untuk proses penyembuhan luka bekas khitan dengan cara menyetubuhi seorang perempuan yang terpilih. Perempuan yang disetubuhi disebut perempuan media Sifon dan laki-laki yang melakukan praktik Sifon disebut laki-laki Sifon. Tujuan tulisan ini menguak praktik adat sifon dari perspektif seksualitas feminis. Seluk-beluk kekerasan seksual terjadi dalam praktik adat Sifon, khususnya yang dialami oleh perempuan media Sifon.[Sexual violence against women has become a collective struggle as a civilized nation. It cannot be denied that sexual violence against women occurs in Indonesia from year to year. The forms of sexual violence that occur always vary. One form of sexual violence for women is sexual violence based on culture and traditions. Therefore, this paper discusses sexual violence based on culture and traditions in the traditional practice of Sifon by the Atoin Meto tribe. The traditional practice of chiffon is a circumcision tradition that is carried out by a married man for the healing process of circumcision scars by intercourse with a woman who is chosen. Women who have sex are called chiffon media women, and men who practice chiffon are called chiffon men. The purpose of this paper is to uncover the traditional practice of chiffon from the perspective of feminist sexuality. The details of sexual violence occur in traditional Sifon practices, especially those experienced by women in the Sifon media.]

Abstract

Marriage is essentially much more than an akad (agreement) allowing for sexual  relations between husband and wife, but is the vocal point of communal life. Therefore, marriage holds an important meaning in human life and forms the cultural patterns to create and control strong foundations in domestic life. In its secondary function, marriage becomes the pillar for a larger order in social life, from the communal to the national level. Therefore, legal and administrative order must be implemented, among them the registration of marriage. An unregistered  marriage causes negative consequences for the marriages itself, to the children  born from that marriage and the corresponding legal issues. Therefore, this article pushes for courage on behalf of the ulama to insert marital registration as a rukun (religious requirement) for marriage in accordance with Indonesian fiqh, to clarify that unregistered marriages are illegal and to push the Indonesian public to consider such instances with greater scrutiny.

Abstract

This paper aims to explain the construction of the discourse of sexuality in Act No. 1 of 1974 on Marriage and the Compilation of Islamic Law. Discourse of sexuality is constructed, namely: the heterosexuality of marriage, polygamy, the rights and status of husband and wife, the status of the child, guardian, dowry, and matters relating to the relationship between men and women. The construction of the discourse of sexuality in the Marriage Act and the Compilation of Islamic Law cannot be separated from a conflict of interest, understanding gender, and the spirit of nationalism. The construction put women’s position under men. This has implications for discrimination and subordination of women’s sexuality and overrides the rights of the child. In addition, it also resulted in resistance against the Marriage Act and the Compilation of IslamicLaw, such as judicial review against them, and increased family problems that lead to divorce, in which women are more often than not the plaintiff.

Abstract

Porn or pornography is a treatment of obscene subjects in writing, pictures, mails, etc. Nowadays pornography and porno action have spread throughout the country and caused many moral and familial problems, such as illicit sexuality, infidelity and rape. With regard to porn issues, Qur'anic verses say to the believing men and women that they should lower their gaze and guard their modesty, that they should not display their beauty and ornaments except what ordinarily appear thereof. The believing women should draw their veils over their bosoms and not display their beauty except to their husbands, their fathers or young children who have no attraction of sexual engagement. The rule of modesty applies to men as well as women. A brazen stare by a man at a woman is a breach of refined manners. Where sexual engagement is concerned modesty is not only a good concept of expression, but also in creating balance between protecting the weaker sex and guarding the spirit of the stronger sex. Modesty is equally important for both men and women. Nevertheless the scripture requires that women should be given a greater amount of privacy, especially in terms of dress code, i.e. covering the bosom, than men on the account of sexual specificity and social context.

Abstract

Perempuan dalam Islam memiliki kesetaraan kedudukan dengan laki-laki sebagaimana tercantum pada surat al-Hujurat ayat 13, kaum perempuan pada masa Nabi dapat melakukan aktifitas di ruang publik. Namun pada kenyataannya masih banyak perempuan yang terkungkung budaya patriarki baik dalam ranah publik maupun domestik. Perempuan diposisikan sebagai kelas nomor dua dan dipertajam dengan pemahaman keagamaan yang bias mengenai peran dan kedudukan perempuan dalam Islam. Pesantren sebagai salah satu lembaga yang membingkai dengan pengajaran kitab kuning yang merupakan teks keagamaan klasik tentang posisi perempuan yang berada di bawah laki-laki yang terpapar dalam kitab Uqūd Al Lujain. Berdasarkan penelitian ini, kaum perempuan di Pesantren Raudlatul Muta’allimin Cilendek Cibeureum Kota Tasikmalaya memiliki peranan yang luas di ranah publik. Tetapi di rumah tangga mereka tetap di bawah laki-laki (suami). Kaum perempuan menempati posisi apapun bahkan struktur yang tinggi di masyarakat seperti menjadi kepala sekolah, tetapi ketika di rumah tetap mentaati suami dan kiprah apapun di ruang publik harus atas seijin suami karena suami merupakan pemimpin rumah tangga. Konstruksi sosial yang dilihat dari realitas sosial yang terjadi mengenai peran dan posisi perempuan ini tidak terlepas dari pengetahuan yang berupa pemahaman atas teks keislaman tentang peran dan posisi perempuan.[Women in Islam have an equal position with the man, as it is explained in Al-Hujurat:13 that women in the era of Prophet Muhammad has a big chance to do activity in public space. However, in reality, there are a lot of women who are still struggling under the patriarchy culture both in public and domestic spaces. Women are put in second class and doctrines with the bias religious understanding about the role and position of women in Islam. Islamic boarding school (pesantren) as one of the institutions frames the study of Kitab Kuning, a classic religious text which teaches that the position of women is under the men, it is explained inside of Uqūd Al Lujain as well. According to this research, women in Islamic Boarding House of Raudlatul Muta’allimin Cilendek Cibeureum, Tasikmalaya has a comprehensive role in public space. However, in the domestic sector, they are still under men. In public space, women can have an important position, such us a headmaster, yet when they are in home, they should obey with their husbands and all of the activities in public space should be permitted by their husbands, because of a husband as the household leader. The social construction of women’s role and position are influenced by knowledge from Islamic texts.]

Kemudian beliau melanjutkan studinya  ke Program Pascasarjana Fakultas Psikologi Universitas Indonesia (1961) dan Doktor Psikologi UI (1976). Adapun kegiatan penting yang pernah digelutinya adalah sebagai ketua Komisi Nasional Anti Kekerasan terhadap Perempuan (Komnas Perempuan, 1998-2004), mendirikan Pusat Studi Kajian Wanita UI, Anggota Komisi Nasional Hak Asasi Manusia (1996-2000), Tim Gabungan Pencari  Fakta (TGPF) kasus kerusuhan 13-15 Mei 1998, di mana kekerasan seksual menjadi bagian integral (23 Juli-23 Oktober 1998) dan Menulis banyak tulisan ilmiah dan artikel. Bukunya antara lain, Menjadi Perempuan Sehat dan Produktif di Usia Lanjut (2007). Beliau juga aktif di dunia olah raga dalam rangka penyiapan atlet putri di bidang bulu tangkis.

Abstract

Female witness in Islamic Law as understood by the Islamic jurists is a half of that of male. The Quran also states it distinctly in 2:282. Of course, it seems to be discriminative against women. The question now, does that provision prevail temporally or universally? What is the historical situation proceeding the provision? According to the author, the provision that female witness is a half of that of male is temporal and not universal. It needs two women to bear witness to be equal with the male witness due to the lack of women experience in public matters. So if one is hesitate to bear witness, another is able to remind her. It is important to note that at the time of revelation, the roles of women in Arabia were generally restricted in domestic sector. Therefore, at this time when the women have equal chance with the men to reach higher study, work in public sector and be the president of a nation, it is supposed to treat female witness equal with that of male.

Abstract

The material object of this research is a modern Egyptian novel entitled “Zaynah” written by Nawal as-Sa’dawi. The formal object is feminism literary criticism focused on reconstruction of gender and islamic thought in literature. This novel describes the opression of women by religious legitimation and the efforts of the heroines to release them selves from it and also their obsession for getting the ideality of islamic feminism on future . This research aims to describes the opression of women by patriarchal system and its ambivalency, and to describes the deconstruction  on it and gets the description of the ideality of future islamic feminism. The result of this analysis reveals : (1) the opression religiously of the heroines based on the theologic assumtion that the woman had created from the man, so she is the second creation; (2) there are so many ambivalency on that opression. The religion is the resourches of ethics and also the opression, the heroes  have opressed the heroines by love and hate in the same time, they are very obedient to God; (3) the heroines deconstruct that patriarchal system by showing that the woman stronger than man, the woman can become the subject not object; (4) the ideality of islamic feminisme on future is described as islamic sosialism. This idea have get from Zaynah figure that characterized by: developing androgyni character as tawhid value that feminity and masculinity are important, doing the revolution for changing to good human life, and loving the own culture and local wisdom (eastern).[Objek material penelitian ini adalah novel modern Mesir yang berjudul Zaynah karya Nawal as- Sa’dawi. Objek formal nya adalah kritik sastra feminis yang difokuskan pada rekonstruksi pemikiran gender dan Islam dalam sastra. Novel ini menggambarkan penindasan yang dialami para tokoh perempuan novel dengan dalih agama dan perjuangan mereka untuk membebaskan diri, juga obsesi mereka untuk mewujudkan feminisme Islam ideal masa depan. Penelitian ini bertujuan untuk mendeskripsikan penindasan patriarkis tersebut dan ambivalensinya, dekonstruksi dan gambaran feminisme Islam ideal masa depan. Hasil penelitian menunjukkan bahwa : (1) opresi perempuan berdalih agama didasarkan pada asumsi teologis bahwa perempuan berasal dari laki-laki dan diciptakan untuk laki-laki, sehingga perempuan adalah makhluk sekunder (derivatif); (2) terdapat banyak ambivalensi dalam penindasan tersebut. Agama dipakai sebagai sumber etika juga sumber penindasan, mereka menindas perempuan dengan suka sekaligus benci, mereka senang menindas tapi sangat patuh beragama; (3) para tokoh perempuan novel mendekonstruksi patriarkis tersebut dengan menunjukkan bahwa perempuan lebih kuat dari laki-laki, perempuan dapat menjadi subjek tidak objek; (4) idealisasi feminisme Islam masa depan digambarkan dalam pandangan sosialisme Islam. Ini tersimbolkan dalam figur Zaynah yang bercirikan: mengembangkan sifat androgini sebagai nilai tawhid bahwa feminitas dan maskulinitas sama-sama penting, melakukan revolusi untuk perubahan bagi kebaikan hidup manusia (tidak hanya bagi perempuan), dan mencintai budaya dan kearifan lokal sendiri (dunia Timur)]

Abstract

This article focuses on children in Islam within historical and sociological perspectives. Children are the investment of both parent and society. They have to seriously take care of, shape, and develop the children's potentions. Historically, there was discrimination against woman children during the dark ages and, then Islam came and brought the idea of humanity and equality. The concept of humanity and equality places all children equally before God and society, in relation to their functions and roles. Infact, social, economic and cultural repression is the reason for the exploitation and violence against children.
