Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

Today the most popular infonnation for Indonesians is about pornography. In general, attitudes toward pornography can be classified into four major perspectives: conservative, feminist, postmodernist, and liberal. For adolescents pornography is a new world after they leave their childhood, and they should be protected from the hazard of pornography. They must be equipped with good knowledge and strong faith to Allah. One of the many ways of preventing teenagers from being negatively affected by pornography is education, especially providing sex education from an Islamic perspective. Historically there were subjects on sexuality in Islamic scholarship. This article aims at describing trends of adolescents' attitudes toward pornography, and proposes a concept of sex education in an Islam perspective in order to free them from negative impacts of pornography.

Abstract

Mayoritas perempuan di pedesaan tidak mempunyai pekerjaan yang tetap. Upah buruh di kampung sangat rendah, sementara kebutuhan hidup sangat bervariasi dan jumlahnya sangat banyak di atas penghasilan yang diperoleh. Permasalahan yang mengemuka dalam penelitian ini adalah, faktor apa sajakah yang menyebabkan perempuan di pedesaan mengambil keputusan untuk menjadi Tenaga kerja Indonesia? Penelitian ini bertujuan untuk mendeskripsikan tentang: 1) latar belakang para TKI berani mendahulukan resiko untuk mendapatkan keselamatan ekonomi di kemudian hari, 2) berbagai ketidakpercayaan Indonesia Migrant Worker dalam menyikapi janji­ janji pemerintah; dan 3) posisi Indonesia migrant worker dalam Rumah Tangga setelah mereka berhasil. Metode yang digunakan yaitu penelitian kuantitatif yang ditunjang metode kualitatif. Pengisian Instrumen, pengamatan, dan wawancara dilakukan antara tanggal 1­30 September 2017 di Bakauheni, Lampung Selatan, Provinsi Lampung yang melibatkan sampel berjumlah 30 orang. Penelitian ini menyimpulkan bahwa perilaku Indonesia migrant worker memutuskan untuk menjadi Indonesia migrant worker bukan dalam rangka menghindari resiko dan mendahulukan selamat, tetapi lebih dilatarbelakangi oleh perilaku ingin mendahulukan resiko dan mengharapkan selamat secara ekonomi di kemudian hari. Mereka mempunyai ketidakpercayaan terhadap kapasitas kepala keluarga, kapasitas sumber daya ekonomi yang dimiliki, kemampuan negara dalam menyiapkan lapangan kerja, pertumbuhan ekonomi yang terjadi. Setelah mereka berhasil mereka merasa mempunyai status sosial, posisi kedudukan di masyarakat, dan posisi dalam pembuatan keputusan yang lebih tinggi dibandingkan sebelum menjadi TKI.[The majority of women in rural areas do not have a permanent job. Labor wages in the village are very low, while the necessities of life vary greatly and the amount is very high above the income earned. The problem raised in this study is, what factors cause rural women to decide to become Indonesian workers? This study aims to describe: 1) the background of migrant workers dares to prioritize the risks to obtain economic safety in the future, 2) the various distrust of Indonesian Migrant Workers in responding to the government’s promises, and 3) the position of Indonesian migrant workers in the household after they succeed. The method used is quantitative research supported by qualitative methods. The instrument filling, observation, and interview were conducted between September 1 ­ 30, 2017 at Bakauheni, Lampung Selatan, Lampung Province involving 30 people as a sample. This study concludes that the behavior of the Indonesian migrant worker decides to become an Indonesian migrant worker not in order to avoid risk and to congratulate, but more on the backdrop of risk­seeking behavior, and expects economic survival in the future. They distrust the capacity of the head of the family, the capacity of the economic resources owned, the capacity of the state to prepare for employment, and the economic growth that occurs. Once they are successful, they feel that they have higher social status, position in society, and position in decision making compared with before they become Indonesian Migrant Workers.]

Abstract

Start from the decline in awareness of Muslims because of imperialism and Western hegemony makes Muslims started to straighten ourselves out of recession. Since then buzzed the glory of the Islamic revival. Even at the point of life is the rise of Islam has become an international phenomenon. Awakening consciousness departs from the central theme: fight and beat back attacks from internal crash parties to discredit the foreign Muslims. This movement logosentrisme Islamic Estuary. It is believed as a shortcut only to get out of the crisis and degradation, with the triumph of Islam aspired. Revival movement is trying to grow back the spirit of faith, the stagnation of thought and jurisprudence, as well as movement (harakah) and jihad. This also brings resurrection exam for Muslims so that encourages them to find the causes of falls and the opprobrium that hit. Moving on from this consciousness, they find a new awareness, namely: changing the faith, activate thoughts, and stimulate the Islamic movements. In ndonesia itself has grown and developed a kind of revival movement is a movement, example as Ikhwanul Muslim, Hizbut Tahrir, the Salafi Movement etc. They apparently had a big hand in developing the movement to promote Islamic revivalism in Indonesia.

Abstract

Jeanne d'Arc has been the wellknown female hero in the Westem tradition. However, the opinion about this hero has varied according to how people interprete her existence. She was known using God's voice in order to convince the French army in defeating British troops. Some of the interpreters have argued that she used that voice to manipulate French troops in order to get her own glory. Others have argued that she was a real hero that passed over the French men's heroism. This article attempts to explore this female heroism from spiritual point of view. It is argued that the spiritual approach used by Jeanne d'Arc was not a manipulation but a strategy to negotiate power mostly handled by men in the arena of conflict.

Abstract

Indonesia as a legal state that concerns equality of rights between men and women in all fields one of them with the existence of legislation that contains the equality of rights. One of the interesting things is about equal access and opportunity for women to get a job. This is included in the work as a judge in the Religious Courts that began to be found even quite a lot of female judges throughout Indonesia. Logical consequences with the presence of female judges in Religious Courts is a lot of raises the number of perceptions and speculation about the validity of the judgment of women in the Community including in Malang where they are from different backgrounds still have different views in understanding the position and validity in the legal system of Indonesia and the Islamic legal system. From research conducted by the author can be known that the people of Malang City as they equate the validity of the judge’s decision with men, because the verdict certainly has a strong foundation and judges have been considered competent in the field. Then, those who differentiate the position and position of female and male judges tend to also differentiate the validity of the judges’ rulings. That is the decision of a female judge to be considered valid if in a collective decision, so that the individual’s decision is not absolutely valid. In this case they consider the verdict of a female judge if done collectively and in one of the assemblies there is a male judge.[Indonesia sebagai negara hukum yang memperhatikan kesetaraan hak antara laki-laki dan perempuan dalam segala bidang salah satunya dengan adanya peraturan perundangan- undangan yang mengandung kesetaraan hak tersebut. Salah satu hal yang menarik adalah mengenai akses serta kesempatan yang sama bagi perempuan untuk mendapatkan pekerjaan. Hal ini turut termasuk dalam pekerjaan sebagai hakim di Pengadilan Agama yang mulai ditemukan bahkan sudah cukup banyak hakim perempuan di seuruh Indonesia. Konsekuensi logis dengan adanya hakim perempuan di Pengadilan Agama ini banyak memunculkan banyaknya persepsi dan spekulasi mengenai keabsahan putusan hakim perempuan di Masyarakat termasuk di Kota Malang dimana mereka yang berasal dari berbagai latar belakang yang berbeda masih mempunyai pandangan yang berbeda- beda dalam memahami kedudukan dan keabsahannya dalam sisitem hukum Indonesia dan sistem hukum Islam. Dari penelitian yang dilakukan oleh penulisa dapat diketahui bahwa masyarakat Kota Malang sebagain mereka menyamakan keabsahan putusan hakim perempuan dengan laki-laki, karena putusan sudah pasti memiliki landasan yang kuat serta hakim sudah dianggap berkompeten di bidangnya tersebut. Kemudian sebagaian mereka yang membedakan posisi serta kedudukan hakim perempuan dan laki- laki cenderung juga membedakan keabsahan putusan hakim perempuan. Yaitu keputusan hakim perempuan dianggap sah jika dalam putusan kolektif, sehingga putusan individunya tidak sah secara mutlak. Dalam hal ini mereka menganggap sah putusan hakim perempuan jika dilakukan secara kolektif dan dalam satu majelis terdapat hakim laki-laki.]

Abstract

Determining children's rights and self detemtination has been problematic in the discussion of child welfare in Indonesia. Indonesian law regards children's rights as defined solely by the basis of age, regardless of a child's competence. This could be seen from the government policies that mention that children's rights are formulated as protection rights, which has been criticized as being a denial of the autonomy and capacity of the child, in the sense that they are considered incompetent and need to be taken care and protected by adults. However, in some cases the behavior of children from some populations demonstrates that they are more mature than the general population in their age range, so that their rights should not be based solely on the basis of their age without considering their competence and autonomy. Efforts to provide more and better defined legislation on child welfare in Indonesia have been an ongoing struggle for activists and various parties. The child liberationist formulations of children's rights seems to offer the greatest possibility for a child's autonomy in relation to children's rights, which is also a critique of the tendency to underestimate the capacities of children and the general belief in the lack child's competency in society.

Abstract

Relasi perempuan dan lelaki dapat disebut tidak setara. Ketidaksetaraan menyebabkan adanya penindasan atau tindak kekerasan. Menyikapi hal tersebut, perempuan melakukan resistensi. Tulisan ini meneliti bagaimana resistensi perempuan yang terdapat dalam prosa Indonesia. Objek material penelitian berupa tiga prosa berbahasa Indonesia, yaitu Timun Mas dan Buto Ijo, “Timun Emas’, dan “Meja Makan yang Menggigil”. Ketiga teks bersubjek perempuan dan berlatar tempat Indonesia. Resistensi perempuan terhadap kekerasan berwujud tiga kategori, yaitu diam, mengulur waktu, dan membinasakan. Diam atau mengulur waktu dilakukan karena kekuatan fisik perempuan yang lebih terbatas dibandingkan lelaki. Resistensi yang berwujud tindakan membinasakan dilakukan manakala pelaku kekerasan mengancam nyawa perempuan atau keluarga. Dalam membinasakan, perempuan menggunakan alat bantu. Selain itu, di akhir kisah terdapat sikap religius yang ditunjukkan dengan adanya keyakinan terhadap Tuhan dan rasa syukur atas karunia Tuhan. Resistensi perempuan menunjukkan bahwa perempuan bukanlah makhluk yang tidak berdaya.[The relations between women and men can be considered unequal. Inequality has caused oppression or violence. In response to the situation, women take the act of resistance. This paper discusses the form of resistance the women have done in Indonesian prose. The material object of the research consists of three prose in the Indonesian language, ie.e. Timun Mas dan Buto Ijo, “Timun Emas”, and “Meja Makan yang Menggigil”. The three prose take the women as the subject of the text and take Indonesia as the social context. The women resistance toward the violence manifests in three categories: silent, stalling for time, and destroying. They did it because women have less physical strength as compared to men. The last form of resistance is taken when the oppressor threatens the life of the women and their family’s life. In addition, at the end of the story, women show the religious attitude as they believe in God and praise to Him for the blessing. The resistance implies that women are not a powerless creature.]

Abstract

The drafting of the Draft Law on Gender Equality has brought criticism, many  of which based on reactionary-ideological grounds unsuitable to productive discussion, and it is indeed regrettable that such responses against the draft law were not made in an academic framework and in accordance with the principle of proportionality. In a democratic state, gender equality is a fundamental part rooted deeply in human rights, similar to racial, ethnic, class, special-needs and religious equality. Thus as a democratic nation state, Indonesia is obliged to fulfill the basic rights of each of its citizens without regard to origin or gender. Such rights encompass a variety of aspects: the right to life, security, health, education, economic, political and socio-cultural rights. All basic rights must be fulfilled equally to avoid discrimination. Thus, normatively, the 1945 Constitution of the Republic of Indonesia has guaranteed equality of all citizens, whether male or female.  In a global context, Indonesia has also ratified the CEDAW (Convention on the Elimination of all forms of Discrimination Against Women) through Law No. 7 of 1984. Indonesia’s commitment to improve gender equality is also written down in the MDGs (Millennium Development Goals). Therefore, through a philosophical-juridical-sociological viewpoint, gender equality (enshrined in law) is both a constitutional mandate and a contemporary demand
