Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

This article is part of an effort to empower families with respect to the issue of interreligious marriage. Until this time, Indonesia still adopts a legal system of internal religious marriage. Therefore, interreligious marriage has not been accommodated in Indonesia, in spite of widespread practice. This is because  Islamic ulama(s) do not condone such marriages; as marriages are only seen to be valid if done within the same religion, a view adopted by the majority of Muslims. However, there are other views that allow for interreligious marriage. The reason being, that the prohibition of the Quran has temporal and conditional aspects, and that the application itself is not substantive in nature.  Therefore, the verse that prohibits such marriages arenaskh-ed (abrogated) by another allowing it. This allowance is in line with the freedom exercised by humans in religion. If humans have the freedom of religion, then they are also free to choose their life partners, and so goes the argument constructed by Mahmoud Mohammad Thaha, the philosopher from Sudan.

Abstract

The provision of women's rights to become witneses promoted by Islam during the life of the Prophet Muhammad was indeed a high achietlement considering the tradition of the era which did not recognize women's rights to become witnesses in legal affairs. The Prophet permitted women to act as witnesess not only on trade, but also in courts for public disputes. This is because the essential thing in the affair of giving witness does not lie in the type of the sex of the witness, but on the capacity, expertise of the witness in performing their task to attain justice. In short there is no preference in the sex of a witness; men and women have rights become witnesses as far as they have intellectual cabability to do so.

Abstract

The Qur'an is very appreciative toward children's issues. This can be seen from the number of Qur'anic verses addressing the affairs of children, especially their rights. In the real life, however, parents and governments have not paid adequate attention to the rights of children. This article aims to elaborate the rights of children as they are invoked in the Qur'an. By employing a mudlu'i method of interpreting the Qur'an, it can be concluded that the Qur'an has conceptualized children as folows: 1) they are God's gift whose presence should be gratified; 2) children are a trust (amanat) from  God whose rights should be guaranteed; and 3) children are as a test (fitnah) for parents' patience. In order to implement the idea of children as precious gifts who generate happiness and proud (qurrata a'yun), the rights of children should be respected. Some of their basic rights are: 1) to live a good life; 2) to receive breast feeding for up to two years; 3) to adhere to religion; 4) to have education free of violence; 5) to express their opinions.

Abstract

The phenomenon of the television industry that is focused on rating, sharing, and advertising makes television programs more focused on entertainment programs rather than educational programs. The audience groups of television are mostly housewives who stay more at home and they are as a key figure in the education of children in the family. Strengthening the literacy media in Tegalrejo becomes important as the demographic condition shows that mostly the household mothers have low education levels, heterogeneous, and relatively poor. They spend more time watching television without attempting to criticize the content of the program. Moreover, the impressions and attitudes of the housewife are heavily influenced by the frequency of watching television. Therefore, we need to strengthen their literacy media to prevent the negative effect of television and to shape the audience to be more critical and smarter in watching the television. This research uses community-based research (CBR), which actively involves the community. The implementation of strategy in media literacy training begins with the activities of related studies to gain a better understanding about the media literacy, the position and role of housewives in observing and selecting media content through seminars and workshops, pre- and post-test about media literacy. Furthermore, learn the discourse from various groups of societies related to their views and opinions on media literacy movement. After a series of activities have been completed, it was found the testimonies from participants about the broadcasting picture in Indonesia and an image, message, and their expectations for the improvement of broadcasting in Indonesia.[Fenomena industri televisi yang fokus pada rating, share dan advertising membuat program televisi lebih fokus pada program hiburan dan mengesampingkan program edukasi. Kelompok pemirsa televisi dari kalangan ibu rumah tangga tinggal lebih lama di rumah dan mereka adalah tokoh sentral dalam pendidikan anak-anak dalam keluarga. Penguatan media literasi di Tegalrejo menjadi penting karena kondisi demografi di daerah tersebut berpendidikan rendah, heterogen dan relatif miskin. Mereka menghabiskan lebih banyak waktu di depan televisi, menonton televisi di rumah tanpa ada usaha untuk mengkritik konten tayangan acara televisi dan sikap yang tampak pada ibu rumah tangga sangat dipengaruhi oleh jumlah frekuensi mereka menonton tayangan televisi sehingga perlu penguatan literasi televisi guna melawan dampak negative televisi dan mewujudkan penonton yang cerdas, kritis dalam menonton acara televisi. Penelitian ini merupakan bentuk penelitian yang melibatkan peran serta komunitas (Community Base Research). Strategi implementasi pelatihan literasi media diawali dengan kegiatan studi terkait untuk memahami literasi media, posisi dan peran ibu rumah tangga dalam melihat dan memilih konten media melalui seminar dan workshop, pra dan post-test tentang literasi media. Selanjutnya, wacana dari berbagai kalangan masyarakat terkait pemikiran mereka terhadap gerakan literasi media. Setelah serangkaian kegiatan selesai, ditemukan kesaksian dari peserta tentang gambaran penyiaran di Indonesia dan sebuah citra, pesan dan harapan mereka untuk penyempurnaan penyiaran di Indonesia.]

Abstract

Gender is one of the core dimensions upholds the collective identity which is noticeably pertinence to the context of Muhammadiyah known as the modern Islamic organization in Indonesia. As the continuum of the above selection of dimensions, gender ideology of Javanese priyayi which reflects senior junior partnership is made available as the stock of knowledge for its identity, not only governs the micro-context of family relation but more obviously operates as the backbone structure of the organization. The endurance of such a structure is laid by the background of its founders who were mainly the elites of the Javanese santri-priyayi in its inception era and politically sustained by the macro-structure of the Indonesian state which has been primarily dominated  by the Javanese priyayi . This reciprocal influence is made possible for such a gender regime to operate within this organization over a hundred year existence with the legitimacy of religious teachings which is arbitrarily a selective mechanism of normative ground.

Abstract

This paper concerns the practice of, and discourse concerning child marriage and polygamy in contemporary Indonesia and the religious, social, and political contexts in which they are located. It focuses on the tale of Pujiono Cahyo Widayanto, who is more commonly knoum as Sheikh Puji, and his child bride Umi Hani Lutfiana Ulfa that has reverberated through the Indonesian media for more than a year. Sheikh Puji and Lutfiana have become icons in a high stakes symbolic and legal drama pitting socially and religiously conservative groups against progressive Muslims advocating reform of Islamic Family Law, the empowerment of women and modernity. Sheikh Puji has become an iconic figure in this struggle for three reasons: his flamboyant style, his defiant disregard and contempt for Indonesian civil law, and the fact he combines polygamy and child marriage in a single package.

Abstract

This article examines a number of Prophetic traditions Ouulits) dealing with wali (guardianship) in the context of marriage contract ('aqdun nikah) using a hermeneutical approoch. There are many approoches and assumptions with regard to studying the issue of wali. The author argues that it is necessary to link the study of waliwith that of Arabian culture. Having studied the discourse of wali mentioned in a number of hadits, as well as put them in the contexts of Islamic massage and Arabian culture, the writer concludes that the hadits dealing with wali have indeed a temporal function, and addressed to minors (children not reaching their adulthood) and those who lack capability to take care and manage their own lives. Thus the author suggests that patriarchal culture which discriminate adult, intelligent women to act as waliin the event of marriage slwuld be reviewed in order to create egalitarian society.

Abstract

Men and women have the same right horizontally and vertically. Both have the same respect in the God’s eyes (QS. At-Taubah [9]: 71-72), and are not discriminated and subordinated to one another. But the problems of injustice and discrimination against women always happen, in which – one of them – is reflected in the marriage law (UUP). Several articles of this law have a gender bias and discrimination to women, such as the definition of marriage which doesn’t reflect equality between men and women, marriage age, the legalization of polygamy, etc. These articles are indeed contradictory with Islam that always promote justice and equality to all human being. This paper will try to explore issues of gender biased in marriage law with an Islamic approach. It is an effort how to promote gender equality and justice as mentioned and learned in the religious teachings. Religion never tolerates violence.[Manusia memiliki hak sama secara horizontal dan vertikal. Baik laki-laki atau perempuan, keduanya memiliki penghargaan yang sama di mata Tuhan (QS. At-Taubah [9]: 71-72), dan semeskinya tiada diskriminatif dan atau subordinatif kepada salah satunya. Namun fakta dari data tersebut tak semulus dengan implementasinya. Ketidakadilan dan ketidakberpihakan kepada perempuan menjadi hal yang tidak bisa dinafikan dalam kehidupan. Hal itu – salah satunya – tercermin dalam beberapa pasal undang-undang pernikahan (UUP) yang bias gender dan mendiskreditkan perempuan, seperti definisi perkawinan yang terkesaan merendahkan perempuan, usia perkawi- nan perempuan yang harus lebih mudah dari laki-laki, poligami, kedudukan istri di mata laki-laki yang lebih rendah, dan juga problem-problem lainnya. Pasal-pasal ini tentunya menyalahi kodrat agama sebagai ajaran yang meng- haruskan keadilan dan kesetaraan. Maka sudah semeskinya problematika tersebut diupgrad agar sesuai dengan cita-cita agama. Oleh hal itu makalah ini akan mencoba membongkar isu-isu bias gender dalam undang-undang pernikahan dengan pendekatan hukum islami. Hal itu, sebagai usaha mengembalikan cita-cita agama sebagai aja- ran yang mengharuskan kesetaraan dan keadilan bagi seluruh umatnya, dan tidak sama sekali mengajarkan ke- kerasan kepada siapapun.]

Abstract

The classical ulama agreed that women are not allowed to be the head ofa state. This view was based on, among others, the context when they lived. Besides, there was an often quoted hadith stating that it was forbidden for the Muslim community to choose women as their head of state. This is of course a discriminative view, 'especially when is considered in light of current socio-political circumstances. This article is an initial attempt to scrutinize this very hadith both from its chain of transmission and from its content. There are two approaches  developed by the ulama in understanding hadith texts: some tended to explore the generality of the hadith texts, and some tended to analyze the context within which the texts were written
