Abstract

Generally, women have physical not as strong as men and always considered weak so often victimized by crime, aside from sexual slavery by ISIS. Sexual slavery by ISIS includes the category of crime against humanity and desecration of women’s dignity. Slavery is one of the most obvious signs to control and rule others. Therefore, legal protection is needed to alleviate the sadness and suffering women victims of sexual slavery by ISIS. This research aims to know the justification of ISIS thought to make women as sexual slaves and analyze the legal protection effort that can be given to women as victims of ISIS Sexual Slavery by the international organization and international convention. This research is normative legal research. The results of the research indicate the justification of ISIS thought to make women as sexual slaves is a woman who is made as sexual slavery is considered clean so that can enter the heaven. The legal protection effort that can be given to women victims of ISIS sexual slavery by international organization and international convention, one of them is proclaim the protection of human rights with annual review, closing all ISIS access to financial system, working with several countries, especially Canada and Germany in the emergency countermeasures relief programme for the victim, provide psychosocial support services shape training to overcome their problems, and establish social cooperation by encouraging the International Government to strengthen security in an area whose women are the most victims of ISIS sexual slavery.

Abstract

The Bank is the creditor holder of the right of security of material in the form of mortgage right, categorized as separatist creditor. Insurers' rights to land and other property related to the land, namely the right of Dependent, are the security rights imposed on the Land Rights referred to in UU no. 5 of 1960 on the UUPA. This separatist position can execute its right as if there was no bankruptcy". The right to sell on its own powers under Article 6 of the UUHT which is the embodiment of the right of the creditor's rights holder to the other creditor and does not require any further approval to the debtor to execute the guarantee goods. The Bank as a Separatist Creditor has a separate and irrevocable position and rights on the collateral pledged against it, whilst the preemptive right of wage workers with a pre-emptive right, when the enterprise is declared bankrupt or liquidated, wages and other rights of workers or workers constitute Debt which must be preceded by the payment, in Bankruptcy in Indonesia the position and the prefensity level is under separatist creditor. The notion of precedence here is not elaborated further and in detail that the wage bill must take precedence over any creditor, thereby leading to a legal confusion of both separatist creditors and other preferred creditors. Bank merupakan kreditor pemegang hak jaminan atas kebendaan berupa hak tanggungan, masuk sebagai kreditor separatis. Tanah sebagai jaminan dan benda-benda yang berhubungan dengan tanah dapat dikatakan sebagai hak Tanggungan yaitu hak jaminan yang dijadikan beban atas kebendaan sesuai yang tercantum dalam Undang-Undang Pokok Agraria ( UU No.5 Tahun 1960.) Kedudukan separatis ini bisa mengambil haknya seperti tidak ada putusan pailit. Adapun hak tersebut adalah hak untuk menjual sebagaimana benda tersebut hak miliknya sesuai ketentuan dalam Pasal 6 UUHT .merupakan perwujudan dari hak kreditor separatis terhadap kreditor lainnya dan tidak memerlukan persetujuan lagi kepada debitor untuk melakukan eksekusi atas barang jaminannya. Bank sebagai Kreditor Separatis mempunyai kedudukan dan hak yang terpisah dan tidak dapat dikurangi atas barang jaminan yang diagunkan terhadapnya, sementara hak prefensi upah buruh yang memilki hak didahulukan, dan bila perusahaan dinyatakan pailit atau likuidasi, pembayaran tagihan/utang dan tagihan lainnya dari pekerja harus mendapatkan prioritas karena dalam Kepailitan di Indonesia kedudukan dan tingkat prefensinya adalah di bawah kreditor separatis.

Abstract

Transnational crime related to financial, mostly done through the banking sector. The banking sector is one of the most widely used mode by the perpetrators of money laundering. It certainly can not be released with the development and progress of science and technology, especially in the field of communications that impact the financial system, including the integration of the banking system that offers traffic mekanmisme funds between countries which can be done in a very short time.Kejahatan transnasional yang berhubungan dengan finansial, banyak dilakukan melalui sektor perbankan. Sektor perbankan merupakan salah satu modus yang paling banyak dimanfaatkan oleh pelaku tindak pidana pencucian uang. Hal ini tentunya tidak dapat dilepaskan dengan perkembangan serta kemajuan ilmu pengetahuan dan teknologi khususnya di bidang komunikasi yang berdampak pula pada  terintegerasinya sistem keuangan termasuk sistem perbankan yang menawarkan mekanmisme lalu lintas dana antar negara yang dapat dilakukan dalam waktu yang sangat singkat.

Abstract

Poor regulation quality contributes negatively to the regulation and law enforcement in the life of the state. The indicator of the poor quality of regulation includes, among others, the large number of regulations requested for judicial review and effectiveness of the implementation of regulations. There are several regulatory issues in Indonesia today, including the existence of multiple interpretations; potential conflict; overlap, principle mismatch, weak implementation effectiveness, not harmonious/out of sync; inconsistent; create unnecessary burdens, both on the target group and the affected groups. Base on these regulatory conditions, regulatory reform is very important and urgent. Given this very basic regulatory issue, it is necessary to make improvements in the regulatory field from upstream to downstream which leads to quality, orderly and simple regulations known as regulatory reform. The purpose of the study is to examine regulatory reform in order to support Indonesia's national development. research is done by doing literature research, or commonly known as the literature study. The Study shows that in order for a regulation to be good, it must fulfill several principles, namely: good norm, good process, and good drafting. Regulatory reform implementation is carried out through a) simplification of existing regulations; b) reconceptualization of the procedures for establishing regulations; c) institutional restructuring of regulation formation; and d) strengthening/empowering human resources with integrity. Good quality of democratic political dimension and progressive legal quality are needed to improve the quality of regulation

Abstract

The main issue of this research is the enactment of Act No. 24of 2007 regardingDisaster Management, there is a body of disaster management (BNBP and BPBDs) nationaland regional scale is still in charge, and on the other hand there is an Act No.23 /Prp/1959regarding the State of Emergency. Type of research is a normative law of the statut or yapproac hand the conceptualapproachto find the link between the two laws. The   research found: (1) BNP Band BPBDmembership structure of the Steeringele mentis civilian officials, professional societies, andalso involves the military and police.(2) That the concept of disastersare handled by BNBP orBPBDs similar to the conditions of civil emergency due to natural disasters and social.Relationship between Act23/Prp/1959 with Act No. 24 of 2007, only in situations ofdisasterorstate of emergency status. Officials who have the authority to determine the statusof a state of emergency is the President, or the Governoror Regentequal to civil authorities inemergencies Act No.23/Prp/ 1959.(3) In an emergency situation, boththe law gives specialpowers to the rulers o fa state of emergency. Relations between the two laws is runningparalleland complementary.

Abstract

Regional Innovation is an important factor to encourage competitiveness and prosperity in the region. Innovation is a collaborative process to improve effectiveness and efficiency in the Region. Innovation cannot run sporadically and partially, particularly at the level of regulation and governance. Reflection on experience shows, government apprehensive to innovate in the Region. Criminalization of policy, euphoria of corruption eradication causing poor innovation in the Region, so it should be given the rule that provides the flexibility to innovate without diminishing accountability or in formulating innovation policy, should be based on the principles in the running of innovation. Through the juridical analysis of substance of the Law 23/2014, have been set related to regional innovation. There is the possibility of expanding the activities of government, with narrowing of the risk of criminal prosecution.

Abstract

Painstaking efforts and long process to make one product widely popular among the consumers force the producers to take an illegal short cut by doing a piracy or imitating a well-known brand. The damage is not only done to the license holder, but also to the consumers and the importing country. For the license holder, the practice will signi?cantly reduce the bene?t. The lower quality of the illegal product will also contribute to the decreasing image of the original products. This practice will make the consumers unsatis?ed, due to the product of lower quality, and it also reduces the revenue for the state. Legal protection for branded product, which are mostly imported, is badly in need, without denying the right of local producers to use the well-known branded in a good intention. Lamanya waktu yang dibutuhkan untuk menjadikan suatu merek terkenal secara luas dan dipergunakan oleh masyarakat, menjadikan beberapa produsen melakukan jalan  pintas dengan menjalankan perilaku bisnis curang yaitu dengan melakukan “pembajakan” atau  peniruan dari merek yang telah lama beredar di pasaran atau dapat disebut sebagai merek yang sudah terkenal. Adanya praktik curang ini, tidak hanya merugikan pemilik merek terkenal, akan tetapi masyarakat sebagai konsumen dan negara juga dirugikan. Bagi pemilik merek, kerugian yang dirasakan adalah menurunnya  pendapatan, dan apabila kualitas dari barang dan jasa yang ditiru lebih rendah, maka akan menurunkan citra produk tersebut di mata konsumen. Bagi konsumen kerugian yang dideritanya adalah mutu barang yang rendah, sedangkan bagi negara kerugian yang timbul adalah berkurangnya penerimaan pajak. Perlindungan hukum yang memadai terhadap merek-merek terkenal,yang kebanyakan adalah merek terkenal dari luar negeri mutlak diperlukan, tanpa mengurangi hak pengusaha pribumi yang memiliki merek yang sama dengan merek terkenal tersebut yang menggunakannya dengan itikad baik.

Abstract

The purpose of this research is to know the legal culture as the driving factor of the realization of regional bureaucracy reform in Indonesia. The method used is the method of normative juridical research with conceptual approaches, legislation, and case approach. Various cases of corruption and very bad service in investment activities have hindered and even damaged the image of the Indonesian nation even in today's highly dynamic world. The bureaucratic legal culture is considered the main factor causing such bad bureaucratic behavior. The legal culture of the royal heritage that is only devoted to highways is difficult to remove from bureaucratic behavior. Cultural heritage, was fertile in the new order era, even in the current reform era. Through the optimization of local culture combined with the autonomy and decentralization policy implemented with the principle of autonomy as widely as possible, it can be attempted to overcome the negative culture of bureaucratic culture into a bureaucracy that eventually can be realized good governance. Tujuan penelitian ini untuk mengetahui budaya hukum sebagai faktor pendorong terwujudnya reformasi birokrasi daerah di Indonesia. Adapun metode yang digunakan adalah metode penelitian yuridis normatif dengan pendekatan-pendekatan konseptual, perundang-undangan dan pendekatan kasus. Berbagai kasus korupsi dan pelayanan yang sangat buruk dalam kegiatan investasi telah menghambat dan bahkan merusak citra bangsa Indonesia bahkan di tingkat dunia yang sangat dinamis saat ini. Budaya hukum birokrasi dianggap sebagai faktor utama yang menyebabkan perilaku birokrasi yang buruk tersebut. Budaya hukum warisan kerajaan yang hanya mengabdi kepada raya ternyata sulit untuk dihilangkan dari perilaku birokrasi. Kultur warisan, ternyata subur di zaman orde baru, bahkan di zaman reformasi saat ini. Melalui optimalisasi kultur lokal yang dipadukan dengan kebijakan otonomi dan desentralisasi yang dilaksanakan dengan prinsip otonomi seluas-luasnya, kiranya dapat diupayakan dapat mengatasi budaya negatif kultur birokrasi menjadi birokrasi yang pada akhirnya dapat diwujudkan tata kelola pemerintahan yang baik.

Abstract

Supervision of child protection was legitimized within Policy of the Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali. In this study, there are two issues that will be examined namely how is the implementation of the Bali the Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali and how are the efforts being made to overcome obstacles in the protection and fulfillment of children's rights in Bali? This research uses the theory of the Van Metter and Van Horn Implementation Model. The research method used is to use a qualitative approach. Data analysis in the study was carried out interactively using interactive models from Miles and Huberman. The results of the study concluded that the implementation of the Bali Governor of Bali Regulation No. 48 of 2015 concerning the Commission for the Management of Children of the Province of Bali has not been effective in fulfilling and protecting children's rights. Regional Child Protection Organizing Commission has not been able to optimally carry out its duties as a supervisor of the implementation of child protection in the Province of Bali. Efforts are being made to overcome obstacles in the protection and fulfillment of children's rights in Bali by establishing communication and coordination and making a joint commitment in the form of an MoU with several parties organizing child protection in the Province of Bali. Pengawasan terhadap perlindungan anak di Provinsi Bali dilegitimasi melalui Gubernur Bali membentuk Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali melalui Kebijakan Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali. Dalam penelitian ini, terdapat dua permasalahan yang akan dikaji yakni bagaimanakah implementasi Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali dan bagaimanakah upaya yang dilakukan untuk mengatasi kendala dalam perlindungan dan pemenuhan hak anak di Bali? Penelitian ini menggunakan teori Model Implementasi Van Metter dan Van Horn. Metode penelitian yang digunakan adalah mempergunakan pendekatan kualitatif. Analisis data dalam penelitian dilakukan secara interaktif dengan menggunakan model interaktif dari Miles dan Huberman. Hasil penelitian menyimpulkan bahwa implementasi Peraturan Gubernur Bali Nomor 48 Tahun 2015 tentang Komisi Penyelenggara Perlindungan Anak Daerah Provinsi Bali belum efektif dalam memenuhi dan melindungi hak anak. Komisi Penyelenggara Perlindungan Anak Daerah belum bisa optimal dalam melaksanakan tugasnya sebagai pengawas pelaksanaan perlindungan anak di Provinsi Bali. upaya yang dilakukan untuk mengatasi kendala dalam perlindungan dan pemenuhan hak anak di Bali adalah dengan membangun komunikasi dan koordinasi serta membuat suatu komitmen bersama berupa MoU dengan dengan beberapa pihak yang menyelenggarakan perlindungan anak di Provinsi Bali.

Abstract

The legislative institution representing the majority of the people and the governmentis responsible to him. In order to reform the structure of the legislative institution inIndonesia into two rooms (bicameral) consisting of the House of Representatives(Dewan Perwakilan Rakyat (DPR)) and the Regional Representative Council (DewanPerwakilan Daerah (DPD)). By the bicameral structure of the legislation process isexpected to be held by double checking system that allow representation of theinterests of all the people can be achieved relatively wider social base through.Legislation function, related to the authority determine, the rules that bind andrestrict citizens to the legal norms. The Regional Representative Council (DewanPerwakilan Daerah (DPD)) function, which is supposed to be a counterpart to thepower of the House of Representatives (Dewan Perwakilan Rakyat (DPR)), looks nomore than “accessories” representation system in Indonesia, which is still thick withunicameral system. Bicameral representation system adopted in the composition ofrepresentative institutions Indonesia can be categorized as a soft bicameral system.With a power as given by the constitution of Indonesia, the Regional RepresentativeCouncil (Dewan Perwakilan Daerah (DPD)) as a representation of the regionalpeople’s institution do not yet get the goal at the purpose of this institutionestablishment.
