Abstract

Adanya kenaikan batas usia perkawinan pada UU No 16 Tahun 2019 diharapkan dapat menekan terjadinya perkawinan anak, namun pada faktanya masih ada pengecualian berupa dispensasi kawin. Penelitian ini bertujuan untuk menganalisis fungsi dispensasi kawin di Pengadilan Agama dan upaya optimalisasi dispensasi dalam rangka pencegahan perkawinan anak di Indonesia. Adapun metode penelitian yang digunakan adalah penelitian kepustakaan (library research) dengan pendekatan yuridis normatif yang dianalisis secara deskriptif kualitatif. Hasil dari penelitian ini menunjukkan bahwa dispensasi kawin memberikan peluang untuk menyimpangi batas usia minimum perkawinan sehingga kemudian dijadikan celah hukum untuk melegalkan perkawinan anak. Banyaknya permohonan dispensasi kawin yang dikabulkan oleh hakim menyebabkan hakim dianggap lalai untuk mempertimbangkan dampak negatif dari perkawinan anak. Adapun upaya optimalisasi dispensasi dalam rangka pencegahan perkawinan anak dapat dilakukan dengan beberapa cara, yaitu standarisasi regulasi dispensasi kawin dalam menentukan alasan mendesak, pengesahan RUU Hukum Terapan Peradilan Agama yang mengatur sanksi pidana bagi pelaku perkawinan anak, optimalisasi peran pemerintah sebagai pembuat kebijakan, dan optimalisasi peran orang tua dalam memberikan pendidikan karakter dan penanaman budi pekerti pada anak. Abstract

Kasus anak berhadapan dengan hukum mengalami peningkatan dari tahun 2020 hingga 2023. Penyelesaian kasus anak yang berkonflik dengan hukum tidak boleh bertentangan dengan prinsip umum perlindungan anak, yaitu non diskriminasi, kepentingan terbaik bagi anak, kelangsungan tumbuh kembang anak, serta menghargai partisipasi anak. Anak berhadapan dengan hukum beresiko menghadapi stigma kriminal yang serius, yang berdampak pada masa depan mereka. Penelitian ini bertujuan untuk menguraikan tentang restorative justice sebagai salah satu cara penyelesaian  anak berhadapan dengan hukum demi tetap terpenuhinya hak-hak anak  serta perspektif hukum keluarga Islam dalam mengkajinya. Penelitian ini menggunakan  data-data kualitatif sebagaimana penelitian hukum normatif yang paparannya secara deskriptif kualitatif. Hasil penelitian ini menyimpulkan bahwa restorative justice merupakan solusi alternatif bagi perlindungan terhadap anak yang berhadapan dengan hukum atau anak yang berkonflik dengan hukum. Penyelesaikan persoalan hukum dengan cara-cara diversi dengan melibatkan banyak pihak secara komprehensif. Dalam implementasinya restorative justice menyebabkan semua hak-hak anak akan terpenuhi dan menjauhkan anak dari stigma negatif sebagai “anak nakal”. Hukum keluraga Islam sebagai bagain dari hukum Islam secara menyeluruh memandang restorative justice akan mendatangkan kebaikan bagi anak dan orang tua serta lingkungan keluarga dapat membantu memperbaiki situasi dan kondisi menjadi lebih baik. Abstract

Marriage is an institution that aims to create a harmonious family life in accordance with sharia principles. However, the presence of certain illnesses, including mental disorders such as Obsessive Compulsive Disorder (OCD), can affect the continuity of a marriage. OCD, which is characterized by recurring obsessions and compulsions, has the potential to disrupt household stability if not disclosed or adequately addressed before or during marriage. This study aims to examine the perspectives of the Shafi'i Mazhab and Hanafi Mazhab regarding the annulment of marriage due to Obsessive Compulsive Disorder (OCD). This study uses a juridical-empirical research method with a qualitative approach through a case study, which focuses on the decision of the Bogor City Religious Court Number 312/Pdt.G/2022/PA.Bgr. The literature used includes fiqh books from leading scholars such as Imam Nawawi, Ibn Qudamah, Imam Abu Hanifah, and Imam Sarakhsi, as well as Indonesian laws and regulations related to marriage annulment. The data was analyzed qualitatively using thematic analysis techniques to identify the main themes and relate them to relevant legal theories and principles. The results of the study show that there are fundamental differences in the approaches of the Syafi'i and Hanafi schools of thought towards marriage annulment due to OCD. The Shafi'i school of thought has stricter criteria, focusing on physical disabilities that are permanent and have a direct impact on sexual life, so that OC is not a cause of marriage annulment. In contrast, the Hanafi school has a more inclusive and flexible approach, taking into account the mental and emotional impact of OCD on a couple's ability to carry out marital duties. The Bogor City Religious Court's decision in this case demonstrates the application of positive law in Indonesia that accommodates mental health considerations as grounds for annulment, in line with the Hanafi school of thought.

Abstract

Child marriage is still prevalent in Indonesian society, one of which occurs in Ilir Timur II District, as data found that there are still marriages that are registered but do not meet the age requirements for marriage determined by law. The purpose of this research is to understand the gender sensitivity of Religious Affairs Office employees in Ilir Timur II District Palembang City towards child marriage and understand the form of gender sensitivity of Religious Affairs Office (KUA) employees in Ilir Timur II District in minimizing the occurrence of child marriage. The method used in this research is qualitative research method, type of field research with normative-empirical approach. The results of this study state that the understanding of gender sensitivity on the part of employees of the Religious Affairs Office of the Ilir Timur II District emphasizes the importance of a deep understanding of gender roles and identities to prevent injustice in domestic life. In addition, the emphasis on Law No. 16 of 2019 which raises the minimum age of marriage for women to 19 years is also part of the understanding of gender sensitivity. The form of gender sensitivity of employees of the Religious Affairs Office (KUA) of Ilir Timur II District in minimizing the occurrence of marriage at the age of a child is by examining the marriage file in detail and socializing through lectures or counseling to increase public understanding and awareness in order to meet the requirements of sufficient age before marriage.

Abstract

Reforms to Islamic family law have been carried out by many Muslim countries. The aim of this reform is to produce legal products that suit the needs of modern society in the country. One of the countries that has reformed Islamic family law is the United Arab Emirates. The United Arab Emirates is reforming Islamic Family Law by re-interpreting the texts of the Al-Qur'an and Hadith and based on the principles of family law in the Maliki school of thought. This research aims to find out the dynamics of Islamic family law reform in the United Arab Emirates. This research is a type of library research. Data was collected using documentation techniques, namely collecting written data in the form of scientific articles resulting from research and books related to research. The results of this research found that the United Arab Emirates first codified family law in 1985. Then in 2005 it reformed its family law by issuing Federal Law Number 28 of 2005 concerning Personal Legal Status. In carrying out family law reforms, the United Arab Emirates uses the talfiq and ijtihad methods. The elements of reform in Federal Law Number 28 of 2005 concerning Personal Legal Status include; marriage, marriage agreements and registration, the age of consent to marry and kafa'ah, the relationship between husband and wife, divorce, and khuluk.

Abstract

Joint property is one of the important aspects of the marriage relationship regulated in Islamic law and positive law in Indonesia. In practice, the division of joint property often becomes a problem that triggers conflict during divorce. One of the legal instruments available to protect joint property is the application for marital confiscation, which is a legal action to secure property so that it is not misused by one of the parties during the divorce process. This study aims to analyze the provisions of marital confiscation against joint property claims and analyze the Maqashid Sharia perspective on the provisions of marital confiscation of joint property claims. The research method used is library research with a normative juridical research approach. The data analysis technique used is descriptive analysis which uses deductive thinking flow. The results of this study indicate that marital confiscation has an important role in maintaining justice and protecting the rights of joint assets in the division of joint property, and has provisions regulated in various laws and regulations. Marital confiscation arrangements can be found in several laws and regulations, including Article 190 of the Civil Code, Article 24 paragraph (2) letter c of Government Regulation No. 9 of 1975, Article 78 letter c of Law No. 7 of 1989 jo. Law No. 3 of 2006, and Article 823 Rv. According to the Maqashid Sharia perspective, the provision of marital confiscation against joint property claims can be interpreted as an effort to preserve joint property, offspring, soul, religion, and reason. This is in accordance with the principles of Maqashid Sharia which prioritizes the benefit of mankind in various aspects of life, including in the context of divorce.

Abstract

Interfaith marriage in Indonesia is a complex issue and often causes debate among the public. From the perspective of hifdzun nasl, which focuses on the protection and preservation of generations, interfaith marriages can be viewed from the point of view of potential conflicts in religious values that can affect the formation of children's character. This research aims to specifically analyze the principle of hifdzun nasl applied in the case of interfaith marriage and its impact on family stability and the continuation of Islamic values in offspring. This research uses a qualitative method with a normative-theological approach. The data is obtained through a literature study of the Qur'an, hadith, fiqh books, as well as the views of classical and contemporary scholars. The results show that in the perspective of hifdzun nasl, interfaith marriage has the potential to damage the continuity of aqidah and Islamic values in offspring. Thus, understanding hifdzun nasl is very important to see marriage as a bond that is not only limited to religious aspects, but also as a means to understand each other and create harmony in diversity. Therefore, people must be aware of the mafsadat of interfaith marriage in order to create a conducive environment for the sustainability of future generations.

Abstract

The Paga Rumah tradition in Teratak Panas weddings is one of the local cultural heritages that aims to maintain family honor and strengthen social relations. The Paga Rumah tradition aims to avoid bad things, such as hampering problems or witchcraft from other people, as well as ensuring that household appliances, such as plates and glasses, do not break. In Islamic law, local traditions that do not contradict sharia can be accepted as ‘urf. This research aims to examine the implementation of the Paga Rumah tradition in Teratak Panas and review the perspective of Islamic law (‘urf) on the tradition. The method used in this research is qualitative with a descriptive approach. The informants involved in this research are the people who are directly involved in the practice as well as traditional leaders in Teratak Panas. The results show that the process of implementing the Paga Rumah tradition involves the preparation of equipment by the shaman, reading prayers, and watering water containing a mixture of leaves around the house. The Paga Rumah tradition in Teratak Panas through the 'urf perspective can be guided by the extent to which the practices carried out are in accordance with sharia principles. If this tradition is carried out by paying attention to sharia principles and avoiding all forms of practices that are contrary to Islam, then the Paga Rumah tradition can be considered as 'urf shahih, which means a custom that is accepted and respected in society. However, if there are elements that contradict these principles, then this tradition is considered as 'urf fasid and must be reviewed to ensure its compatibility with Islamic teachings.
