Abstract

Penelitian ini bertujuan untuk mengidentifikasi penerapan Asas Peradilan Cepat, Sederhana, dan Biaya Ringan oleh Pengadilan Agama Kabupaten Sumenep dalam menyelesaikan perkara perceraian di Kepulauan Masalembu, serta menganalisis implementasinya berdasarkan Teori Sistem Hukum Lawrence M. Friedman. Metode yang digunakan adalah penelitian hukum empiris dengan pendekatan sosiologi hukum. Analisis data dilakukan dengan model interaktif Miles dan Huberman, melalui tahapan pengumpulan data, reduksi, penyajian, dan penarikan kesimpulan. Hasil penelitian menunjukkan bahwa meskipun Pengadilan Agama Sumenep telah menerapkan e-Court sebagai upaya percepatan proses peradilan, penerapan asas-asas tersebut di Kepulauan Masalembu masih menghadapi banyak hambatan. Jarak yang jauh, akses transportasi terbatas, serta ketidakhadiran para pihak menyebabkan proses peradilan berjalan lambat. Masyarakat pun cenderung bergantung pada pengacara, yang meskipun mempermudah proses, justru meningkatkan biaya. Struktur hukum di Masalembu masih terbatas dari sisi infrastruktur, sementara pemahaman masyarakat terhadap substansi hukum seperti e-Court masih rendah. Budaya hukum yang belum mendukung efisiensi peradilan menjadi faktor utama penghambat penerapan asas peradilan cepat, sederhana, dan biaya ringan secara ideal di wilayah kepulauan tersebut.

Abstract

Permasalahan pernikahan usia dini di Lombok Timur merupakan fenomena kompleks yang melibatkan aspek sosial, budaya, ekonomi, dan pendidikan yang melekat dalam masyarakat setempat. Penelitian ini bertujuan untuk menganalisis Peraturan Dirjen Bimas Islam No. 373 Tahun 2020 tentang bimbingan pranikah dan implementasinya sebagai upaya pencegahan pernikahan usia dini di wilayah kerja Kementerian Kabupaten Lombok Timur. Metode penelitian menggunakan pendekatan kualitatif dengan teknik library research, mengkaji sumber-sumber dokumen regulasi dan literatur terkait, serta analisis konten dan tematik untuk mengidentifikasi kesenjangan antara kebijakan dan praktik di lapangan. Hasil temuan menunjukkan efektivitas kebijakan bimbingan pranikah masih terbatas akibat kurangnya keselarasan antara desain kebijakan dan implementasi lapangan. Pencegahan pernikahan usia dini membutuhkan pendekatan holistik yang mengintegrasikan regulasi formal dengan edukasi berbasis kearifan lokal serta partisipasi aktif komunitas. Penguatan kapasitas fasilitator, adaptasi materi sesuai dengan nilai budaya masyarakat, dan pengembangan metode pelatihan partisipatif menjadi faktor kunci keberhasilan. Selain itu, pelibatan multipihak melalui model whole community approach melibatkan tokoh agama, tokoh adat, lembaga pendidikan, dan organisasi perempuan serta investasi dalam infrastruktur edukasi dan teknologi. Kesimpulannya, bimbingan pranikah harus direformulasi secara transformatif, inklusif, dan berkelanjutan agar mampu menjawab tantangan struktural dan kultural secara simultan, sehingga mewujudkan pencegahan pernikahan usia dini yang efektif dan berkeadilan sosial di Lombok Timur.

Abstract

The purpose of this research is the obligation of maintenance that should be fulfilled by a husband who is currently serving a sentence. Maintenance is a responsibility that a husband must fulfilll toward his wife in financial form, as the term maintenance is related to material aspects. Meanwhile, non-material responsibilities, such as meeting the wife's sexual needs, are not included in the definition of maintenance, even if the husband does them for his wife. This research applies a qualitative method with a normative theological approach. The use of the qualitative method aims to provide a deeper insight into the issue being studied. The data analysis process uses an inductive approach, which involves developing general conclusions from specific ones. The research results show that the husband's obligation to provide maintenance while imprisoned remains in effect. If the husband serving the sentence is unable to provide for his wife, then that obligation will be suspended and must be fulfilled after the husband completes his sentence. Additionally, Wahbah Az-Zuhaili also emphasized that a wife has the right to file for divorce (khulu') against her husband after the husband has served a minimum of one year in prison due to his inability to fulfilll his financial responsibilities. The urgency of this research is to explain the obligation of spousal support for incarcerated husbands, considering the limitations of the husband's ability and the protection of the wife's rights from the perspective of Wahbah Az-Zuhaili, which is based on justice and the maqāṣid al-syarī‘ah.

Abstract

This study examines post-marital residential preferences among the Donggo community from the perspective of cultural sociology and Islamic law. The Matrilocal tradition that requires couples to live with the wife's family is still dominant, but has begun to shift along with increasing education, social mobility, and the influence of modernity. Islam, as the majority religion, provides a flexible normative basis, emphasizing the principles of justice, security, and comfort in determining a place of residence, without specifying a specific location. This study uses a qualitative approach with interview techniques, observation, in the Donggo community, Bima, NTB. The results of the study indicate a negotiation between customary values, aspirations of young couples, and sharia principles. Neolocal choices are increasingly developing among young couples as an expression of independence, although they are still faced with traditional social pressures. This phenomenon reflects complex social dynamics, where customary law and Islamic law interact adaptively in responding to changes in cultural values. Thus, post-marital residential preferences in the Donggo community illustrate shifts in social structure, cultural transformation, and the actualization of justice values ​​in the context of the Islamic family

Abstract

The mechanism for the Ijab Qobul in marriage by the groom is carried out verbally, however there are differences for grooms who have disabilities or for people with disabilities, where people with disabilities use several methods in carrying out the Ijab Qobul. The aim of this research is to find out what the efforts of the Religious Affairs Office (KUA) are in providing services for people with disabilities and what the guidance mechanism for preparing Ijab Qobul is for people with disabilities at KUA Ilir Timur 2, KUA Sukarami, KUA Ilir Barat 1, KUA Bukit Kecil. The research method used in this thesis is field research with qualitative research data. The data collection techniques are carried out using interviews and documentation. By using data analysis techniques, namely descriptive which describes and explains the main topics discussed in this research. Then use conclusion drawing in a deductive manner. The results of this research are that the Religious Affairs Office's efforts in providing services for people with disabilities, namely marriage guidance for people with disabilities, are carried out independently (individually). Because for people with disabilities who are deaf, they need a facilitator in sign language, while for people with disabilities they need a way for wheelchairs and also a special room for people with disabilities and there are also different solutions from each KUA of Palembang City in providing a mechanism for preparing Ijab Qobul for people with disabilities at KUA Palembang City.
