Abstract

An armed conflict between Israel and Palestine has been going since the Balfour Declaration and Resolution Number 181 of 1947 from Britain and the United Nations for the establishment of an Israeli state on Palestinian land. One attack called the Cast Lead operation by Israel against Palestine during December 27, 2008 to January 19, 2009 which killed many civilian casualties was a violation of Israel on the principle of proportionality in international humanitarian law. The principle stipulates that before the decision to make an attack is taken, consideration should be given to the military impact that might be experienced by civil society. This paper attempts to analyze Cast Lead operations from the principle of proportionality in Geneva Protocol I paragraph 51, 51 (5) and 48. This paper finds that Cast Lead attacks are a violation of the principle of proportionality in terms of time, focus, and attack technology. This study uses an explanative qualitative methodology and based on secondary data from books, journals, articles, magazines, laws document, and the internet.

Abstract

Human relationships with ethics become the main points of concern in everyday life. Eliminating ethics from political life can have implications for Machavellistist political practice. Islamic political ethics has a sacred basis of the revelation of God and the Sunna of the Prophet. Leaders in Islam are said to be khālifah or imâm. The Caliph is the successor of the prophet as a leader who obeys God's command and enforces the law justly. The wide-ranging moral values should be the basis and consideration of political actions and legitimacy. Principles of political ethics of Muslim leaders viewed from the thinking of classical Muslim philosophers. There are five principles of Islamic political ethics that must be owned by a leader as well as a politician as a power holder in a country: (1) Religion as the ethical basis of Muslim leaders; (2) The mandate in power; (3) Fair and wise in law; (4) Smart and competent in their field; and (5) Deliberation and tolerance.

Abstract

Konflik sosial-politik yang terjadi di Filipina telah menimbulkan suatu diskriminasi yang berlebihan. Terdapat kebijakan kontra dari pemerintahan Filipina terhadap struktur masyarakat Mindanao. Tindakan kontra yang diterapkan oleh pemerintah Filipina adalah memarjinalisasi masyarakat Mindanao dengan cara menciptakan kesenjangan ekonomi, sosial, pendidikan dan HAM. Muhammadiyah sebagai organisasi yang memegang salah satu prinsip Islam yakni Ukhuwah Islamiyah mencoba membantu menyelesaikan konflik tersebut melalui jalur damai. Pada tulisan ini penulis akan menganalisis strategi perdamaian yang dilakukan oleh Muhammadiyah atas konflik Mindanao.

Abstract

Pelanggaran Hak Budaya merupakan salah satu pelanggaran yang sering terjadi di masyarakat namun sangat jarang direspon oleh pemerintah karena seringkali dianggap sebagai hak yang tidak dapat dituntut di muka peradilan, bahkan pihak otoritas pemerintahan sendiri yang melakukan pelanggaran tersebut. Seperti yang terjadi pada suku Aborigin Australia. Suku Aborigin merupakan suku asli benua Australia yang telah menetap di Australia selama 60 ribu tahun lamanya. Sebelum akhirnya padatahun 1778, kolonial datang dan menginvasi benua Australia. Konstitusi Australia yang disahkan pada tanggal 1 Januari 1901, menyataka bahwa masyarakat pribumi Australia (Suku Aborigin dan Selat Torres) tidak terhitung sebagai populasi Australia. Dengan demikian dapat diartikan bahwa, orang-orang pribumi Australia tidak memiliki hak selayaknya hak warga negara Australia. Pada tahun 1967, terjadi referendum terhadap Konstitusi tersebut dan sampai sekarang proses referendum masih berlanjut. Adanya referendum membuka gerbang kesempatan bagi pribumi Australia dalam memperoleh hak-hak dasar mereka.

Abstract

Globalization is a phenomenon that cannot be avoided. Globalization of trade causes the trade economy of a country to be directly distributed quickly to other countries which causes the existence of international trade and free markets. The United States is a country that was initially very supportive and optimistic about globalization. All policies support globalization. As time goes on due to differences in situations and conditions in the world resulting in a shift in the view of the United States towards the existence of international trade. This paper aims to provide an overview of the transformation of the shift in America's view of globalization. Through a study of a number of literatures, the authors found that America's view of trade globalization experienced changes in the thinking of leaders and society towards the values and effects brought about by the current globalization in this era.

Abstract

This study discusses the concepts of Human Security and Islam with a case study of the death of Jamal Ahmad Khasoggi in October 2018, a senior journalist from Saudi Arabia. This event became an international spotlight and had an impact on the three countries involved, Saudi Arabia, Turkey and America which resulted in their relationship being in harmony. What are the theories and concepts of Human Security at the global level and what are the red threads of the concept of human security in Islam and the implementation of the Perspective of Human Security and Islam in the case of Jamal Ahmad Khashoggi. This research uses research literature method to collect secondary data. This research uses qualitative descriptive technique and analysis to obtain a complete picture of the answer to the problem under study. The results of the study show that the concepts of Human Security and Islam have a common goal of upholding the right to life and humanity. The death e of Jamal Ahmad Khasoggi violated the concept of Human Security, Islam and the universal value of humanity.

Abstract

This study was conducted to see the implementation of environmentally sustainable city development policies which are one of the pillars in the program of SDGs (Sustainable Development Goals) 2030 where local government is placed as the main actor. For the ASEAN regional level, the regional commitments of Regions for the development of environmentally sustainable cities are depicted in the ASEAN Socio-Culture Community Blueprint 2025. The review of this implementation aspect is aimed at identifying developments and challenges faced in the strategic policy of  the Palembang City Government as the main implementing actor towards environmentally sustainable cities in the long term, with the Australia- Palembang Project related the procurement of clean water and sanitation as a case study. In line with these objectives, this study uses qualitative research methods that are exploratory and descriptive in nature, where the depth and context of the data are important. This research results in the finding that the government of Palembang has been considered as an institution that has clear political objectives fully committed in the practice of city diplomacy to involve themselves directly even though it is limited to international cooperation through policy, and balanced communication between government agencies and AUS AID (as an international donor). The City Government is no longer seen as the object of implementing program plans formulated at the central level, but also has the opportunity to formulate a strategic plan or (bottom up) procedure based on the needs of local communities and the suitability of the model with environmentally sustainable city development.

Abstract

Indonesia is a country that can conduct dialogue and humanitarian diplomacy to the Myanmar government related to the issue of humanitarian crises that occur in the Rohingya ethnic group in Myanmar. This is evidenced by the acceptance of Indonesia as a dialogue partner in talks related to humanitarian diplomacy which aims to open up humanitarian space so that humanitarian assistance can be channeled to the victims of the humanitarian crisis that occurred. The policy of providing humanitarian assistance is inseparable from the dilemma faced by Indonesia both internally, bilateral relations, and international norms and rules. This paper aims to describe the dilemma faced by Indonesia in the policy of providing humanitarian assistance that departs from the historical proximity of Indonesia and Myanmar, the non-intervention rules of ASEAN, the international norms of Responsibility to Protect (R2P) and the Islamic identity in Indonesia which constitutes the majority?s identity which urges the government to take responsive actions to resolve the humanitarian crisis. Findings from the paper describe much that was done by Indonesia. Of the various dilemmas faced by Indonesia, the biggest supporting factor in actions taken by Indonesia is the insistence of Muslim identity to take action based on shared identity with victims of the crisis in Rakhine.

Abstract

This article attempts to understand the source of the reunification process in the Korean Peninsula. This is descriptive qualitative research using secondary data and utilises constructivism approach that offers norms and identity as the source of international relations. In addition, this article also using realism theory since the two countries often using hard strategies. In this preliminary studies found that the failure of Korean reunification is due to the difference of interest combined with the complexity of political identity between the two countries. Therefore, this is an important topic to examine at least to understand the construction of identity during the reunification process.

Abstract

This research is a new perspective in international relations research. This study tries to criticize the previous view that considers international law as a norm or principle that must be obeyed by the countries in this world. Yet in reality international law can be used as an instrument by countries to achieve their respective national interests. Departing from the above statement, this research focuses on the process of negotiating the West Irian problem after the Round Table Conference agreement in 1949 until the New York Agreement in 1962 was  signed between Indonesia  and the Netherlands. Through observation of the negotiation process, this study seeks to see patterns of relations between international and state law, especially in the process of negotiating the West Papua issue which took place after the Round Table Conference (RTC) in 1949 until the New York Agreement in 1962. Using a qualitative descriptive approach as a research method, and the perspective of realism in international law as   a theoretical framework, this research results in finding that there is a pattern in the relations of international and state law in the negotiations on the problems of West Papua in 1950-1962 which manifests in the form of utilizing international law as an instrument of achieving the interests of a country .
