Abstract

AbstractThis paper will explain about how indigenous people as minority group receive their recognition and accommodation by government, especially in implementation of international norm that pertains to indigenous peoples and recognized in the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) and Convention ILO 169. This paper will explore the issue in Latin Amerika region. To achieve the objective of this paper, author will explain in two main themes: First, the development of the political participation indigenous people in Latin American states. Second, the rights of indigenous people to their ancestral land through international norm FPIC (Free, Prior, and Informed Consent) that adopted in Latin America states. I argue that the development of indigenous people rights to their land in Latin America is supported by political participation of indigenous people in the government system in Latin America states.

Abstract

ABSTRACT This paper discusses the humanitarian intervention in Nigeria because the Boko Haram’s attack. Humanitarian intervention was carried out because there had been gross human rights violations in an area and the government's inability to solve them. Boko Haram attack has caused a humanitarian crisis in Nigeria. Unfortunately, Nigeria has been unable to solve the problem. Boko Haram is a separatist group that wants to replace Nigeria’s legitimate government to Sharia Law. Thus, humanitarian intervention is needed. This paper will explain three sub chapters of the discussion, such as: First, the political and economic conditions in Nigeria. Second, process of Boko Haram attack. Third, humanitarian intervention efforts in Nigeria carried out by international actors, such as: The African Union, some countries in Africa, the United States and some international humanitarian agencies. The research method used in this study is a descriptive qualitative method. Data sources from literature and internet studies. This paper finds that the humanitarian intervention consists of a military approach and a socio-economic approach. In 2020, humanitarian interventions focus on recovery in education, health issues, and assisting the shelter of refugees.

Abstract

Introduksi mengenai modernisasi mulai mengalami reorientasi pasca pertengahan abad ke-20. Keterlibatan pengaruh agama dalam narasi pembangunan mulai dikesampingkan, bahkan diasumsikan bahwa pengaruhnya dalam proses pembangunan sebagai ancaman. Dalam narasi modern, agama lebih dipandang sebagai private matters, bukan sebagai public matters untuk diturutsertakan dalam kemaslahatan umum. Tulisan ini mencoba menelusuri kemungkinan terlibatnya agama dalam agenda pembangunan dengan dinamika keberagamaan di Indonesia sebagai sekop pembahasannya. Melalui pendekatan deskriptif dengan menggunakan data dari studi pustaka, Penulis mengambil pembahasan utama yang memaparkan tiga agama dengan kasus yang berbeda, diantaranya: Islam di Indonesia, Protestan dalam perspektif Max Weber, dan Era Tokugawa di Jepang, yang menjelaskan tentang proses dan agenda pembangunan sebagai hasil dari ide-ide agama. Hasil dari penelitian ini menunjukkan bahwa keterlibatan ide-ide agama dan spiritualitas dapat berkontribusi terhadap proses pembangunan apabila modernisasi dipandang sebagai sesuatu yang konstruktif bukan sebagai konflik, serta di dukung dengan nilai solidaritas dari Ummat. Kata Kunci: Agama, Pembangunan, Islam, Etika Protestan, Agama Tokugawa

Abstract

Issues of LGBT boomed in Malawi in 2009 after an arrest of homosexual couple who held a wedding party. The criminalization was based on the Malawi’s Penal Code. In 2010, Malawian government also added an article on the Penal Code to criminalize lesbians. However, after the succession of Malawi President in 2012, the successor president, Joyce Banda suspended the policy criminalizing LGBT to await a review of the Parliament. Amid the suspension, under a different President, on April 2015 Malawi passed an LGBT Act of criminalization through Marriage, Divorce and Family Relations Act. The authors note that there had been an inconsistency of the Malawi government in applying policy criminalizing LGBT. The government implemented the policy of criminalization towards LGBT based on Malawi Penal Code, suspended it in 2012, and then 2015 re-issued policy criminalizing LGBT through certain act. This article explores the roles of conflicting interest groups between religious leaders (RLs) and domestic NGOs followed by politics “stick and carrot” on foreign aid of donor states in Malawi. These variables are subjects to analysis that affect the inconsistency of Malawi government to implement policy criminalizing LGBT.Keywords: Criminalizing LGBT, Penal Code, Inconsistency, Conflicting Interest Groups, Stick and Carrot AbstrakIsu LGBT mulai menggelegar di Malawi pada tahun 2009 pasca penangkapan pasangan homoseks yang tertangkap mengadakan pernikahan. Kriminalisasi didasarkan pada pasal-pasal di KUHP Malawi. Tahun 2010, pemerintah Malawi juga menambah pasal di KUHP untuk menkriminalisasi lesbian. Namun pasca bergantinya Presiden tahun 2012, Presiden pengganti, Joyce Banda menangguhkan kebijakan kriminalisasi pelaku LGBT untuk menunggu review dari Parlemen. Ditengah pengangguhan, tahun 2015, di bawah Presiden yang berbeda, Malawi mengeluarkan UU kriminalisasi pelaku LGBT melalui Marriage, Divorce and Family Relations Act. Penulis melihat bahwa terjadi inkonsistensi pemerintah Malawi dalam menerapkan kebijakan kriminalisasi LGBT. Pemerintah Malawi menerapkan kebijakan kriminalisasi LGBT berdasarkan KUHP Malawi, tahun 2012 menangguhkannya, dan kemudian 2015 kembali mengeluarkan kebijakan kriminalisasi LGBT melalui UU. Artikel ini hendak memaparkan peran kelompok kepentingan yang saling bertentangan (conflicting interest groups) antara religious leaders (RLs) dan NGOs domestik beserta politik “stick and carrot” dalam bantuan luar negeri negara-negara pedonor di Malawi. Variabel-variabel tersebut menjadi pokok analisis yang mempengaruhi inkonsistensi penerapan kebijakan kriminalisasi LGBT di Malawi.Kata Kunci : Kriminalisasi LGBT, KUHP Malawi, Inkonsistensi, Conflicting Interest Groups, Stick and Carrot

Abstract

Penelitian ini membahas aktivitas diplomasi digital dalam manajemen bencana di Daerah Istimewa Yogyakarta dan Fukushima. Penelitian ini fokus pada tiga pokok bahasan: kebijakan penanggulangan bencana, peran lembaga pemerintahan dalam manajemen bencana, dan komparasi aktivitas diplomasi digital melalui twitter dalam 3 tahapan manajemen bencana, yakni pra bencana, pada saat terjadinya bencana, dan pasca bencana. Penelitian ini menggunakan konsep diplomasi digital dengan metodologi penelitian kualitatif. Teknik pengumpulan data melalui wawancara langsung, penulis juga menggunakan data sekunder yang berasal dari website resmi pemerintah, jurnal, dan berita online. Penelitian ini menemukan bahwa aktivitas diplomasi digital dalam manajemen bencana di DIY dan Jepang dilakukan secara terstruktur di lembaga pemerintahan. Aktivitas diplomasi digital di kedua bencana sama-sama memanfaatkan media sosial berupa twitter melalui media sosial, dan di dukung dengan website dan aplikasi yang dibuat oleh pemerintah. Di DIY menggunakan platform Whatshaap sebagai komunikasi virtual, sedangkan di Jepang menggunakan platform Line. Penelitian ini menemukan bahwa aktivitas diplomasi digital melalui twitter di DIY terjadi pasca bencana letusan gunung Merapi 2010 dan mitigasi bencana untuk mengantisipasi erupsi berikutnya dengan akun @pusdalopssleman dan @BPPTKG, sedangkan pada saat gempa bumi di Jepang tahun 2011 paling masif digunakan pada tahapan proses tanggap darurat sebagai respon membantu para korban dengan akun pemerintah @JPN_PMO.

Abstract

ABSTRACT This research discussedimplementation of military confidence building in  responding various threats that may arised in Indonesian cyber sovereignty. This study used qualitative approach with data collection through literature study and in-depth interviews namely Director for International Security and Disarmament Ministry of Foreign Affairs of The Republic of Indonesia, Deputy of Protection National Cyber and Crypto Agency of the Republic of Indonesia (BSSN), and Ministry of Communications and Informatics of the Republic of Indonesia. The results showed that implementation of military confidence building to upheld national resilence in cyberspace consisted of three aspects, namely the exchange of information and communication, transparency and verification, and military restraint in the field of cyber.ABSTRAK Penelitian ini  membahas penerapan military confidence building dalam merespon berbagai ancaman yang mungkin timbul di ranah kedaulatan siber Indonesia.Pendekatan yang digunakan dalam penelitian ini yaitu melalui pendekatan kualitatif dengan teknik pengumpulan data melalui studi pustaka dan wawancara mendalam dengan Direktorat Jenderal Kerja Sama Multilateral Kementerian Luar Negeri Republik Indonesia sub bagian Direktorat Keamanan Internasional dan Perlucutan Senjata Kementerian Luar Negeri, Badan Siber dan Sandi Negara (BSSN) Deputi Bidang Proteksi dan Kementerian Komunikasi dan Informatika Republik Indonesia.Hasil penelitian menunjukkan bahwa penerapan military confidence building untuk menegakkan ketahanan nasional di ruang siber dilakukan melalui tiga aspek yaitu pertukaran informasi dan komunikasi, transparansi dan verifikasi, dan pembatasan militer (military restraint) di bidang siber.

Abstract

An armed conflict between Israel and Palestine has been going since the Balfour Declaration and Resolution Number 181 of 1947 from Britain and the United Nations for the establishment of an Israeli state on Palestinian land. One attack called the Cast Lead operation by Israel against Palestine during December 27, 2008 to January 19, 2009 which killed many civilian casualties was a violation of Israel on the principle of proportionality in international humanitarian law. The principle stipulates that before the decision to make an attack is taken, consideration should be given to the military impact that might be experienced by civil society. This paper attempts to analyze Cast Lead operations from the principle of proportionality in Geneva Protocol I paragraph 51, 51 (5) and 48. This paper finds that Cast Lead attacks are a violation of the principle of proportionality in terms of time, focus, and attack technology. This study uses an explanative qualitative methodology and based on secondary data from books, journals, articles, magazines, laws document, and the internet.

Abstract

This paper will explain about the securitization process in addressing refugees issue in Sweden from 2010 to 2015. This research uses the concept of securitization from Barry Buzan. Some important things which Buzan explained to analyze the process of securitization, such as: Referent Object (Actors), Existential Threats (things or issues that become threats), will proceed to be “Securitizing Move” by “Speech Act”. This paper uses qualitative method which is arranged descriptively with support by secondary data. This paper found that the process of securitization on refugee policies in Sweden from 2010 to 2015 is supported by Sweden Democrats Party and gained the response of Swedish anti-immigrant society, they are conducting the “Speech Act” sustainably. The result is that Sweden’s open policy on refugees has changed by restricting and tightening policy of refugee.

Abstract

This paper would like to analyze the most vulnerable group that impacted in COVID-19 pandemic, namely refugees. Refugees or forced migrants are the groups that looking for safe places from their home country. Now, there are more than 70 million refugees in the world. This paper would like to explains how COVID-19 gives e ect for refugees in Bangladesh, Rohingya’s refugees in Cox’s Bazar. Second, this paper would like to explains the response of the government to handling this pandemic for refugee’s life and the role of organization that engages to help them. Also, this paper found out that government of Bangladesh try to help Rohingya’s refugees although threat of national security happen.
