Abstract

This research examines the transformation of constitutional law following the Constitutional Court's ruling on the elimination of the presidential threshold in Indonesian presidential elections. This ruling represents a fundamental shift in constitutional design, particularly regarding the presidential nomination mechanism and the dynamics of the party system. The research employs a normative juridical method, drawing on legislation, court decisions, and legal doctrine. The analysis focuses on the reconstruction of presidential nomination norms, their implications for strengthening the principle of popular sovereignty, and the consequences for the configuration of government in a multiparty system. The results indicate that the elimination of the presidential nomination threshold broadens the space for political participation, improves the quality of electoral democracy, and reinforces the people's position as holders of supreme sovereignty. However, this situation also creates the potential for political fragmentation and challenges in maintaining government effectiveness. The transformation of constitutional law stemming from this ruling emphasizes the need for the formulation of further regulations capable of maintaining a balance between political openness and government stability.

Abstract

Indonesia's post reform electoral system was designed to strengthen popular representation but has paradoxically become an arena for elite interest contestation. This study critically analyzes the ambivalence of legal politics regarding the open proportional system and electoral thresholds, focusing on Constitutional Court Decision No. 55/PUU-XXII/2024. Employing doctrinal legal research with statutory, conceptual, and case approaches, the analysis examines Law Number 7 of 2017 and the Court's jurisprudence. The findings reveal a structural paradox: the system normatively recognizes popular sovereignty but practically restricts political competition through high thresholds that benefit political cartels and incentivize high cost politics. Furthermore, the Constitutional Court’s open legal policy doctrine frequently metamorphoses into a shield for the legislative oligarchy, evading substantive constitutional correction. Ultimately, this article proposes a comprehensive reconstruction of electoral legal politics, shifting the paradigm from democratic containment to electoral justice. This reconstruction demands normative threshold reforms, structural political funding improvements, and the application of strict scrutiny by the Constitutional Court to safeguard citizens' rights against oligarchic capture, ensuring genuine constitutional democracy and equitable political participation.

Abstract

Low legal literacy in rural communities often hinders the effective implementation of legislation at the local level, potentially triggering disputes and reducing public compliance. This community service activity aims to enhance legal awareness among residents of Wantilan Village as a strategic pillar for regulatory enforcement. The method employed integrates Community-Based Research (CBR) and Participatory Action Research (PAR), encompassing interactive seminars, participatory discussions, and free legal consultation services. Program effectiveness was evaluated using pretest and posttest instruments administered to 85 participants. Results indicate a significant increase in legal awareness scores from an average of 42.5 to 78.3 (p < 0.01), with the highest improvement in knowledge of rights/obligations and compliance attitudes. A total of 24 consultation cases were successfully handled, primarily focusing on civil and village administration matters in a preventive manner. The findings confirm that a participatory educational approach effectively bridges the gap between formal legal norms and community practices. It is concluded that the program successfully strengthened the community’s legal awareness foundation. It is recommended that this model be developed into a sustainable village legal clinic integrated with village government programs and partner universities.

Abstract

Pendidikan karakter melalui program Tatanen di Bale Atikan (TdBA) di Purwakarta telah berhasil membentuk karakter siswa, namun integritas SDM sekolah sebagai penggerak utama program masih menjadi tantangan. Pengabdian ini bertujuan meningkatkan integritas guru melalui penerapan manajemen berbasis karakter berbasis nilai Pancawaluya Welulang, Wawuh, Wani, Welas, dan Wiwaha melalui sosialisasi dan pendampingan partisipatif. Kegiatan dilaksanakan di SDN 3 Tegaldatar, Kecamatan Maniis, Kabupaten Purwakarta, pada 3-5 November 2025, dengan sasaran Tenaga Pendidik. Metode kualitatif partisipatif digunakan, meliputi observasi, diskusi kelompok terfokus, dan analisis tematik. Hasil menunjukkan peningkatan pemahaman nilai Pancawaluya dari rata-rata 36% sebelum kegiatan menjadi 90% setelah intervensi. Seluruh guru merumuskan “Deklarasi Budaya Kerja Pancawaluya” sebagai komitmen kolektif untuk transparansi, kolaborasi, dan keteladanan. Temuan membuktikan bahwa pendekatan berbasis nilai lokal yang partisipatif efektif memperkuat integritas profesional dan dapat direplikasi di sekolah TdBA lain.

Abstract

This study examines the regulatory construction of sexual violence crimes under Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS Law) and analyzes the urgency of effective law enforcement in Indonesia. The research applies a normative juridical method using historical and statutory approaches to explain the background, development, and legal framework of the TPKS Law. The historical approach traces the evolution of legal protection for victims of sexual violence, while the legislative approach analyzes the substance, structure, and systematic coherence of the law within the national legal system. The findings show that the TPKS Law consists of 12 chapters and 93 articles that comprehensively regulate sexual violence crimes. These provisions include general definitions, classifications of sexual violence, related criminal acts, investigation and prosecution procedures, and court examination mechanisms. The law also explicitly regulates the rights of victims, victims’ families, and witnesses, including protection, recovery, restitution, and access to justice. TPKS Law prioritizes integrated women/children protection services at national and local levels, plus prevention, coordination, oversight, and community involvement. It includes funding, global partnerships, transitional clauses, and final provisions, notably launching SPPT-PKKTP for women violence cases.  Within this system, victims are positioned as legal subjects with the right to be heard, informed of legal processes, considered in the pursuit of justice, and restored from the impacts of violence. This victim-centered orientation represents a shift toward restorative-justice.

Abstract

Penelitian ini menganalisis tingkat kepatuhan manajemen kontrak atlet muda sepak bola Indonesia terhadap regulasi PSSI serta mengidentifikasi celah perlindungan hukum dalam kerangka UU No.11 Tahun 2022 tentang Keolahragaan. Menggunakan pendekatan kualitatif deskriptif dengan studi kasus multi situs di tiga akademi sepak bola, pengumpulan data dilakukan melalui wawancara mendalam dengan 18 informan kunci, analisis 25 dokumen kontrak aktual, dan observasi partisipatif selama empat bulan. Temuan penelitian mengungkap kesenjangan signifikan antara regulasi PSSI Nomor 1 Tahun 2023 dan implementasi praktis: hanya 12% kontrak memuat klausul jaminan pendidikan formal terukur, 8% mencantumkan batasan jam latihan sesuai UU Perlindungan Anak, dan 15% memiliki mekanisme exit clause yang jelas. Dualisme sistem hukum antara lex sportiva dan hierarki peraturan nasional memperparah ketidakpastian hukum bagi atlet di bawah umur yang belum memiliki kapasitas hukum penuh. Keberadaan Badan Arbitrase Keolahragaan Indonesia (BAKI) belum diimbangi aksesibilitas memadai bagi atlet muda dalam menyelesaikan sengketa. Penelitian merekomendasikan harmonisasi regulasi melalui amandemen Regulasi PSSI dengan mengadopsi prinsip FIFA Guardians Programme, sinkronisasi operasional dengan UU Keolahragaan, serta penguatan kapasitas lembaga penyelesaian sengketa untuk menjamin perlindungan holistik atlet muda sebagai subjek hukum rentan.

Abstract

This study examines the involvement of State Civil Apparatus (ASN) in practical electoral politics and its implications for democracy from a constitutional law perspective. ASN, as part of the state bureaucracy, are required to maintain neutrality to ensure honest, fair, and democratic elections. However, the reality on the ground shows that violations of ASN neutrality persist, manifested in support for certain candidates, both directly and through social media. The research method used is a normative juridical approach by examining laws and regulations related to ASN neutrality and case studies of violations that occurred in several elections. The results show that ASN involvement in practical politics not only violates regulations but also has negative implications for electoral integrity, the principle of equal political rights, and public trust in democracy. From a constitutional law perspective, ASN neutrality is part of the realization of the principles of the rule of law and constitutional democracy. Therefore, strengthening legal instruments, optimizing oversight functions, and implementing strict sanctions are needed to uphold ASN neutrality while strengthening the quality of democracy in Indonesia.

Abstract

This study aims to analyze the legal politics of Indonesia's criminal justice system from the perspective of contemporary constitutional law and to formulate the direction of its transformation toward a democratic, accountable, and substantively just system. The study employs a normative-doctrinal legal method with statutory, conceptual, and case approaches. Legal materials were collected through systematic library research and analyzed qualitatively using legal interpretation, norm synchronization, legal construction, and deductive reasoning techniques. The findings reveal that Indonesia's criminal justice legal politics faces three mutually reinforcing structural deficits: a regulatory deficit stemming from disharmony among statutes, an integration deficit arising from institutional fragmentation among the police, prosecution, judiciary, and correctional subsystems, and an oversight deficit due to weak checks and balances mechanisms. A comparative analysis with Germany and the Netherlands demonstrates a significant gap in due process implementation and constitutional rights protection. Transformation must prioritize regulatory harmonization, strengthening the integrated criminal justice system, and establishing independent oversight mechanisms to ensure Indonesia's criminal justice system genuinely delivers constitutional justice for all citizens.
