Abstract

Impeachment is an accusation or indictment of the President or another country's high officials from his position. Impeachment is not new in the history of Indonesian constitution, but the change in the Constitution has caused a change in the constitutional system as well as related to the mechanism of the dismissal of the President and / or Vice President. how is the Impeachment reviewed globally, the history of impeachment in Indonesia and the implementation of impeachment in other countries, the impeachment process of the president according to the 1945 Constitution of the Republic of Indonesia. The process of impeachment in Indonesia after changing the constitution goes through three stages, namely impeachment in the House of Representatives, the Court The Constitution, and the People's Consultative Assembly. Abstract

The need for land has become a very important demand explosion due to the vast area of ​​the city of Jakarata which is already very dense. So that reclamation becomes one of the efforts in increasing the region as well as regional income. The purpose of this research is to provide a clear and formal explanation for both the regional government and the general public. The writing uses an empiric juridical method with a positive written legal approach that is applied to in concreto legal events in society. . This can affect the legal subjects holding rights from land reclaimed by the beach. The legal status of the legal subject to management rights is still regulated by general regulations so that it can lead to multiple interpretations of legal subjects that hold management rights from land reclaimed by the beach. Regional Governments should be able to prepare legal infrastructure in accordance with the existing laws and regulations and can also have a positive effect on the business world as well as the economic sector.

Abstract

In this study, the author considers 3 (three) reasons that are considered important such as philosophical aspects, aspects of criminal law theory, and political aspects of national criminal procedural law after describing 5 (five) previous legal scientific studies related to the implementation of supervisory judges and observers in the criminal justice system. This study aims to reflect on the legal principles of the kimwasmat institution and build models and patterns of implementing the kimwasmat institution. This research intends to answer 2 (two) legal issues: firstly, what are the legal principles contained in Article 280 of the KUHAP. Secondly, what is the model and pattern of implementation of the supervisory and observer judge institutions based on Article 280 of the KUHAP. This legal research uses the socio-legal research method, the materials of which are the results of interviews of judges in deliberate district courts, study of court official documents, relevant laws and regulations to legal issues, legal theory and social science theories. This study found, firstly, the function of kimsmat based on the principle of legal certainty and the principle of benefit which seeks to be married into the principle of certainty which is useful based on Pancasila. Finally, the classical bureaucratic model and the institutional model as well as the aspects of state administration to explain the management and control functions of the authority of the kimwasmat become the basis for the court to carry out criminal objectives.

Abstract

Pelaksanaan Pengabdian kepada Masyarakat ini bertujuan untuk memberikan edukasi kepada masyarakat Muncul mengenai peraturan tentang perjanjian dalam transaksi jual beli online dan/atau ketentuan hukum tentang transaksi online tersebut, memberikan pengetahuan kepada masyarakat tentang upaya hukum yang dapat dilakukan jika terjadi kerugian yang dialami oleh salah satu pihak dalam transaksi online. Melalui kegiatan pengabdian kepada mayarakat ini masyarakat kelurahan muncul  akan mendapatkan manfaat antara lain mengetahui keabsahan dari suatu transaksi jual beli online dan perlindungan hukum bagi konsumen sebagai debitor dalam transaksi jual beli online, meningkatkan pengetahuan masyarakat agar memahami hak-haknya sebagai konsumen apabila dirugikan dalam suatu transaksi jual beli online. Tahap Persiapan Tahap-tahap awal dalam PKM meliputi : Survey awal, pada tahap ini dilakukan survey ke lokasi, yakni di Kelurahan Muncul, Kecamatan Setu, Tangerang Selatan, Provinsi Banten. Setelah survey, maka ditetapkan lokasi pelaksanaan dan sasaran peserta kegiatan. Lokasi pelaksaaan kegiatan adalah di aula Kantor Kelurahan Muncul. Penyusunan bahan dan materi pelatihan yang meliputi, slide dan makalah untuk peserta kegiatan. Materi penyuluhan disusun dan disiapkan oleh  narasumber. Keabsahan dari suatu perjanjian tidak dinilai pada bentuk perjanjian yang dibuat, akan tetapi subyek dan objek perjanjianlah yang menentukan sah atau tidaknya perjanjian tersebut. Suatu perjanjian dapat dianggap tidak sah atau batal demi hukum karena adanya pelanggaran terhadap syarat-syarat perjanjian. Bentuk perjanjian atau kontrak akan menjadi hukum dan mengikat para pihak yang menyepakatinya, hanya mungkin terjadi apabila perjanjian atau kontrak tersebut telah memenuhi syarat-syarat sahnya suatu perjanjian. Berdasarkan pasal 1320 BW (Burgerlijk Betboek). Apabila terdapat hal-hal yang menjadi sebab cacatnya suatu perjanjian maka akan menimbulkan beberapa akibat hukum, antara lain : Perjanjian batal demi hukum atau dianggap tak ada perjanjian, artinya perjanjian secara mutlak batal sehingga tidak bermakna sama sekali. Perjanjian dapat dibatalkan, artinya Suatu perjanjian menimbulkan konsikuensi dapat dibatalkan oleh salah satu pihak yang merasa dirugikan. Pembatalan dilakukan dengan adanya pengajuan gugatan pembatalan oleh salah satu pihak ke Pengadilan Negeri.Kata Kunci : Perjanjian, Jual Beli, Online

Abstract

This article discusses disobedience of the Constitutional Court Decision Number 91/PUU-XVIII/2020 which was carried out by the Government by issuing Minister of Home Affairs Instruction Number 68 of 2021 Concerning Follow-Up of the Constitutional Court Decision Number 91/PUU-XVIII/2020 Regarding the Formal Review of Law Number 11 of 2020 concerning Job Creation which in essence states that it remains guided and implement Law Number 11 of 2020 concerning Job Creation and its Implementing Regulations. This instruction from the Minister of Home Affairs has violated one of the rulings stating that the legally binding force of Law Number 11 of 2020 concerning Job Creation must be temporarily suspended for 2 (two) years or until the process of its formation has been repaired. This study uses a statutory approach and a conceptual approach and is also evaluated descriptively and qualitatively. The conclusion of this paper is that disobedience to the constitution by the Government will have a juridical impact on not realizing legal certainty, impacting people's distrust of the Constitutional Court, as well as a bad example given by the President in terms of constitutional awareness, so that it is appropriate for the DPR RI to file an impeachment process against the president

Abstract

Urban green-space conflicts have emerged as a significant challenge for marginalized communities, exacerbating existing social and environmental inequalities in cities undergoing rapid urbanization and environmental transitions. This study explores the dynamics of access to justice for marginalized groups in the context of urban green-space conflicts, focusing on the barriers they face and the enabling factors that improve their ability to access legal remedies. Through a socio-legal research design, data was collected using surveys, case reviews, and stakeholder interviews, which were analyzed to identify key physical, socio-economic, and institutional barriers that hinder equitable access to green spaces. Findings revealed that marginalized communities often experience physical barriers such as limited proximity to green spaces, socio-economic disparities that prevent them from accessing legal resources, and institutional constraints, including discriminatory urban planning policies. Despite these challenges, enabling factors such as legal aid networks, participatory forums, and inclusive urban planning policies emerged as crucial elements in improving access to justice for these communities. Moreover, the study examined the impact of social and environmental transitions, such as urbanization and climate change, on justice outcomes, showing that these transitions can either exacerbate or alleviate barriers depending on how policies are implemented. The study emphasizes the need for policy reforms that promote equity in urban planning and legal aid systems, ensuring that marginalized communities are included in decision-making processes. Future research should explore the impact of environmental justice policies in global contexts and investigate new legal frameworks to address the specific needs of vulnerable populations.

Abstract

The constitutional court in Indonesia, namely the Constitutional Court of the Republic of Indonesia, does not yet have the authority to handle cases with the object of constitutional complaint, but in practice there are many applications that are actually constitutional complaint cases packaged in judicial review applications. Judicial Review in the field of the Constitution, is a review and/or test by a state power body to be able to cancel the decision of the law-making body (legislation) and/or the government body (executive). Judicial Review in this field in Indonesia is the competence of the Constitutional Court. With no authority owned by the Constitutional Court, which then became the reason for not accepting the application, of course it was felt that there was a need for an expansion of authority. So that the protection of the constitutional rights of citizens for violations committed by state administrators is true. This is in line with the Constitutional Court as the guardian of the constitution. In this study, the author uses a normative juridical research method. Normative legal research views that the study of legal norms, legal principles, legal systematics, and comparative law, is a mandatory part to be studied in relation to the authority of the constitutional court in judicial review.

Abstract

Digital platforms have become dominant actors in shaping public discourse, political communication, and democratic participation in Indonesia. While these platforms facilitate freedom of expression and access to information, their algorithmic governance also raises concerns regarding transparency, accountability, misinformation, and democratic integrity. This study aims to analyze the challenges of democratic media governance amid platform dominance and to formulate a legal reconstruction model that balances freedom of expression with algorithmic regulation. This research employs a normative juridical method using statutory, conceptual, and comparative approaches. Legal materials were collected through library research, including legislation, legal doctrines, academic journals, and relevant international regulatory frameworks, and were analyzed qualitatively using descriptive-analytical methods. The findings demonstrate that Indonesia’s existing media regulatory framework remains inadequate in addressing the legal consequences of algorithmic control exercised by digital platforms. The absence of comprehensive standards concerning transparency, accountability, and public oversight has weakened democratic governance within the digital public sphere. This study concludes that democratic media governance in Indonesia requires a reconstructed legal framework that strengthens platform accountability, promotes algorithmic transparency, protects freedom of expression, and ensures democratic oversight in the digital era.
