Abstract

The modern banking system may appear safe and easy to use, but it still has its drawbacks. The public was shocked by the loss of a number of customer funds, even though the customer who owned the bank account did not believe that he was the one making the transaction. Customers' confidence in the safety of their bank deposits was shaken by this incident. The theft of bank customers' money shows a widening repertoire of criminal tactics. The purpose of this study is to analyze legal protection and the form of bank accountability to customers for cash withdrawals without the knowledge of customers through tellers in view of the agreement at the time of application for making an ATM card. This research method is included in the category of normative legal research. The results of this study state that in cases raised customers get legal protection for the use of problematic ATM card transactions. So if customers who experience problems in conducting ATM card transactions, customers can be guided by Law no. 10 of 1998 concerning Banking and Law no. 8 of 1999 concerning Consumer Protection

Abstract

Crypto can be interpreted as a data series that results from the formation of an electronic system, namely Cryptography that uses a peer-to-peer method in its work system, a system used as a transaction in cyberspace (cyber) will generate data or can also be referred to as an electronic document. . And by definition a crypto asset is a form of asset because crypto itself is also interpreted as an item that can be owned by a certain person or group and has economic value, which can be used and owned by legal entities or individuals. Therefore, Crypto is included in digital assets. It is the basis of Crypto users to make it not only as a means of payment but also as an asset for investment. Based on Article 1 Number 2 of the Commodity Futures Trading Act, crypto can be categorized as a commodity. Crypto is characterized by high volatility due to high price fluctuations. Crypto is legally declared as a commodity that can be traded in futures trading, namely as a crypto asset that can be used as the subject of a contract and then demands further regulation to be regulated by CoFTRA as a legal entity that carries out crypto transactions. The legal relationship that occurs between parties in the use of crypto can be known as a legal relationship between business actors and consumers or known as Business to Customer (B2C). PT. Indodax in this case can be called a business actor who offers digital asset exchange services and sells various types of digital assets to consumers (in this case users who are official members of PT. Indodax). Legal relationships are formed from the existence of electronic contracts. This can be a form of legal protection for consumers and businesses themselves.

Abstract

The redistribution of land with erfpacht right in Galengdowo village is one of the agrarian reform programs in the form of distributing state land to cultivators by giving ownership right to the land they cultivate. These freehold land certificates can then be used as collateral to obtain business capital through Community Land Empowerment (CLE) which is aimed at becoming a pilot project for an agrarian reforma village producing coffee and dairy products by developing regional-level businesses to become national scale. This study uses an empirical legal research method that examines the implementation of law in society. The approach used is a qualitative approach based on primary, secondary and tertiary legal sources. The results of this study explain that the implementation of the redistribution of erfpacht title land in Galengdowo village has met conformity based on laws and regulations so that the land redistribution program can be said to have provided legal certainty and benefits to the people of Galengdowo village. mainly in the increase in revenue up to 125.7%. The implementation of the redistribution of erfpacht title land in Galengdowo village also encountered a number of obstacles, but these obstacles could be overcome properly through ideas from the Central and Regional Governments.

Abstract

Anak merupakan masa depan bangsa, hak serta perlindungan terhadap anak sudah tercantum dalam Undang-undang Dasar 1945 Setelah Amandemen (UUD) Pasal 28B Ayat 2. Seseorang masih dapat diketegorikan anak adalah ketika menginjak usia di bawah 19 Tahun, pada usia tersebutlah anak memerlukan perlindungan hukum karena seseorang yang masih dalam pengampuan atau ketegori anak belum mampu secara mandiri untuk melindungi dirinya sendiri. Wilayah Mojokerto memiliki status kasus kekerasan terhadap anak dan pernikahan dini yang cukup tinggi, hal ini menjadi dorongan bagi penulis untuk melakukan pengabdian masyarakat kepada masyarakat di wilayah Kabupaten Mojokerto dengan menggandeng Pengadilan Agama Mojokerto dan P2TP2A dengan tujuan dapat menekan angka pernikahan dini. Metode pengabdian masyarakat yang dilakukan oleh penulis melalui sosialisasi dengan hasil pengabdian berupa pemahaman terkait perlindungan anak dengan hasil peserta dapat memahami isi sosialisasi dengan dibuktikan aktif pada sesi tanya jawab dan pembahasan sesuai terkait substansi.

Abstract

Sampah merupakan masalah yang kompleks yang dihadapi oleh negara, salah satunya kota besar yang ada di Indonesia. Surabaya merupakan kota yang memiliki kepadatan penduduk berjumlah 3,15 Juta jiwa pada Tahun 2019 dengan laju pertumbuhan penduduk sebesar 2.07 persen yang dapat mempengaruhi laju peningkatan timbunan sampah fan penyumbang terbesar kedua di Indonesia, untuk menangani hal tersebut Pemerintah Kota Surabaya mengeluarkan Peraturan Walikota Nomor 16 Tahun 2022 tentang Pengurangan Penggunaan Kantong Plastik di Kota Surabaya. Penelitian ini memiliki tujuan untuk mengetahui pelaksanaan peraturan tersebut dalam rangka Zero Waste di Kota Surabaya. Metode penelitian ini menggunakan penelitian yuridis-empiris yang merupakan penelitian efektivitas hukum yang ada di masyarakat (Pasar Rakyat). Sumber data penelitian terdiri dari data primer dan sekunder yang di peroleh melalui studi kepustakaan, analisis dari wawancara, penyebaran kuisioner secara daring ke masyarakat di Pasar Rakyat, literatur dan peraturan terkait. Penelitian ini di dasarkan pada penelitian “Efektivitas Pembayaran Suroboyo Bus Menggunakan Sampah Botol Plastik” yang berkesimpulan bahwa hal tersebut belum efektif dalam pelaksanaannya. Berdasarkan hasil penelitian ditemukan adanya inefisiensi peraturan yang diterapkan di masyarakat dan masih marak di pergunakan di Pasar Rakyat, hal tersebut dikarenakan tidak adanya solusi pemerintah yang solutif, faktor masyarakat yang masih ketergantungan, serta penegakan hukum yang tidak tegas.

Abstract

Indonesia has legal regulations which are the result of a combination with Dutch law, one of which is civil law in Indonesia which is regulated in the Civil Code or the Civil Code. Over time, legal developments have undergone significant changes following the needs of today's society, one of which is the addition of misbruik van omstandigheden or abuse of circumstances as a new form of handicapped will in the Netherlands, on the other hand, the Indonesian Civil Code has not been added to the Civil Code, but in its implementation, many judges have used the doctrine of abuse of circumstances in deciding a case in court. This research will further discuss the terms of abuse of circumstances based on the study of the decision. The research method used in this study uses a qualitative analysis method with literature study and is a type and type of normative juridical research carried out by examining existing legal norms through library research with the aim of further analyzing the requirements of misbruik van omstandigheden. Based on the results of the research, it can be concluded that the decision of the Mataram District Court Number 234/Pdt.G/2020/PN Mtr has fulfilled the conditions for misuse of circumstances.

Abstract

Penggunaan perjanjian baku saat ini sudah banyak diterapkan dalam dunia bisnis, diantaranya adalah perjanjian parkir yang dituangkan dalam bentuk karcis parkir. Di dalam karcis parkir terdapat klausula baku pengalihan tanggung jawab: Pihak pengelola parkir tidak bertanggung jawab atas kehilangan dan/atau kerusakan kendaraan. Adanya klausula ini mengakibatkan permasalah pertanggung jawab pengelola parkir kepada konsumen.Penelitian ini mengangkat permasalahan, pertama, apakah hubungan hukum yang terjadi antara pengelola parkir dan konsumen?; Kedua, bagaimana peran kepolisian dalam menagani kasus hilangnya kendaraan bermotor di parkir 24 jam dengan mediasi serta tanggungjawab pengelola parkir terhadap kehilangan kendaraan dan atau barang milik konsumen di tempat parkir terkait adanya klausula baku pengalihan tanggungjawab dalam karcis parkir?. Penelitian ini bertujuan untuk mengetahui hubungan hukum apa yang terjadi antara pengelola parkir dan konsumen dalam transaksi bisnis perparkiran dan bentuk tanggungjawab pengelola parkir apabila terjadi kehilangan kendaraan dan atau barang milik konsumen di tempat parkir terkait adanya klausula baku pengalihan tanggungjawab dalam karcis parkir. Penelitian ini merupakan penelitian hukum normatif dengan analisis kualitatif. Penelitian ini menyimpulkan, hubungan hukum yang terjadi antara pengelola parkir dan konsumen adalah hubungan perjanjian penitipan barang (kendaraan), dan pengelola parkir wajib bertanggungjawab terhadap kehilangan kendaraan dan atau barang milik konsumen yang diparkir di tempat parkir yang dikelolanya. Abstract

Pembentukan BUMDes diharapkan dapat menjadi penggerak ekonomi lokal didasarkan dari kebutuhan, potensi, dan kapasitas desa, untuk dapat meningkatkan kesejahteraaan masyarakat. Pasal 87 angka (1) UU No. 6 Tahun 2014 tentang Desa mengamanatkan bahwasanya setiap desa dapat mendirikan BUMDes namun berdasarkan pantauan hasil di lapangan bahwa hingga saat ini Pemerintah Desa Kemantren belum mendirikan BUMDes karena adanya beberapa kendala. Penelitian ini bertujuan mengkaji implementasi pengaturan mengenai BUMDes ditinjau dari UU No. 6 Tahun 2014 tentang Desa di Desa Kemantren Kecamatan Tulangan Kabupaten Sidoarjo serta untuk mengetahui faktor-faktor yang menjadi kendala dalam pembentukan BUMDes ditinjau dari UU No. 6 Tahun 2014 tentang Desa di Desa Kemantren Kecamatan Tulangan Kabupaten Sidoarjo sesuai asas hukum rekognisi dan asas hukum subsidiaritas. Metode penelitian yang digunakan adalah penelitian hukum empiris dengan pendekatan kualitatif. Pengumpulan data dilakukan dengan cara wawancara, kepustakaan/dokumen dan observasi. Kendala yang dihadapi Pemerintah Desa Kemantren dalam mendirikan BUMDes meliputi kurangnya pemahaman Pemerintah Desa Kemantren tentang BUMDes, terkendala dana dan biaya, kurangnya ide-ide pada Pemerintah Desa Kemantren dalam mengolah potensi desa, Pemerintah Desa Kemantren belum menemukan sumber daya manusia yang dirasa mampu dalam mengolah BUMDes. The formation of Village-owned Enterprises (BUMDes) was expected to be a local economic driver based on village needs, potential and capacity, to improve community welfare. Article 87 number (1) of Act No. 6 of 2014 on Villages mandates that every village can establish a BUMDes, but based on monitoring results in the field, to date the Kemantren Village Government has not established a BUMDes due to several obstacles. This research aims to examine the implementation of regulations regarding BUMDes in terms of Law No. 6 of 2014 concerning Villages in Kemantren Village, Tulangan District, Sidoarjo Regency and to determine the factors that are obstacles in the formation of BUMDes in terms of Act No. 6 of 2014 on Villages in Kemantren Village, Tulangan District. Sidoarjo Regency is in accordance with the legal principle of recognition and the legal principle of subsidiarity. The research method used is empirical legal research with a qualitative approach. Data collection was carried out by means of interviews, literature/documents and observation. Obstacles faced by the Kemantren Village Government in establishing BUMDes include the Kemantren Village Government’s lack of understanding about BUMDes, constraints on funds and costs, the Kemantren Village Government’s lack of ideas in processing village potential, the Kemantren Village Government has not yet found human resources that it feels are capable of developing BUMDes.

Abstract

The development of economic globalization in a country requires a role and strengthening in order to synergize commitments through predetermined steps to harmonize economic stability and is expected to be able to face the country's economic crisis. Beneficial Ownership (BO) has the opportunity to commit a criminal act of money laundering through nominee mode so that the original identity is not known by placing dirty assets in the form of shares in the corporation so that the corporation acts as a vehicle for the crime. This research is conducted through the normative juridical method. Research using library materials by examining a legal regulation, doctrine from experts, or theories that intersect with the subject matter of discussion. The results showed that the form of responsibility looks at who is related to money laundering. The theory of corporate liability is included in limited liability. In principle, limited liability is intended for legal subjects in corporations that commit criminal acts regardless of the mistakes made but meet the elements of the Article in criminal law. Because the position of beneficial ownership is not yet effective and is still gray in the corporation, in beneficial ownership criminal liability uses strict liability, which is the punishment of criminals on the condition of considering the criminal acts committed with the rules of criminal imposition (legality) without seeing the inner attitude of the perpetrator.

Abstract

Norms are behavioral guidelines in the Indonesian legal state. Norms continue to exist in the legislation and juridical consequences of constitutional court decisions, and in particular, that of the Constitutional Court. Legal norms have principles that are applied to a wider hierarchy of legal norms and the production of legislation. In essence, the Constitutional Court's rulings have consequences on the actions of the government and therefore the action of governance. Including decision norms in the Constitutional Court's ruling has juridical consequences for the hierarchy of regulations and state legal actions in carrying out the function of government. This article aims to find out how to apply decision norms if there an identical or related decision exists within a different judicial institution. In government institutions bound by the Constitutional Court's decisions, application of decision norms resulted in chaos for the application and enforcement of the law. The implementing agency is faced with the same legal product, namely a verdict in another judicial institution. This causes no legal certainty. Rather than a solution or outcome, implementing agencies are faced with an identical legal response yet no legal certainty. The absence of legal certainty has consequences for government institutions that are bound by the Constitutional Court's decision. By utilizing a hierarchy of legal norms, the issue of rigidity and uncertainty caused by decision norms can be resolved. Likewise, in the legislature, the Constitutional Court's decision is the source of making legal norms. As the Constitutional Court’s decision is the source of legal norm production in the legislature, espousing a hierarchy of legal norms will enable laws and regulations that are formed to reflect justice, certainty and benefit.
