Abstract

This study aimed to find out the coaching exercises for women perpetrators of narcotics crimes in Class II A Women's Detention Centers in Surabaya. This study uses empirical juridical research methods. Data analysis used is a qualitative approach to primary and secondary data. The results of research on narcotics women's psychoactive psychotherapy training at Class II A Women's Detention Center in Surabaya concluded that Class II A Surabaya Women's Detention Center carried out 2 (two) training programs for female psychopaths. The first is personality development where this coaching is more directed to the personality of each person with disabilities, this coaching itself includes spiritual development and physical training. The second is self-reliance coaching where this training is so that when the tired ones leave the Surabaya Class II A Women's Detention Center they can become even more independent with the provision of coaching results at the Class II A Women's Detention Center Surabaya.

Abstract

as regulated in Article 61 of the Presidential Regulation of the Republic of Indonesia Number 71 of 2012 concerning the Implementation of Land Acquisition for Development in the Public Interest. However, in this case, the Plaintiff as the party who has the right does not use legal remedies in the provisions mentioned above, so the Plaintiff is deemed to have accepted the decision of the land procurement committee by law. So this matter cannot be said to be an unlawful act, because there has been no rejection of the Plaintiff's objection to the results of the Inventory and Identification of Land Acquisition for the Medan - Binjai Toll Road Section I Clearance Project. As explained in the explanation above, the unlawful act committed by Defendants I, II and III regarding violating the law was wrong, because the Plaintiff had not yet held a deliberation regarding his objection, where it was clear that the implementation of land acquisition for development was in the public interest, objections to the results of the inventory and identification were rejected, the Chief Executive of Land Procurement made minutes of rejection. However, in this case no objection has ever been raised by the Plaintiff.

Abstract

Village is the smallest part of the state structure. A number of villages in Indonesia have distinctive features which contain traditional elements. One of the elements of this custom is customary law. In the community of Pakraman Bali Village, there are indigenous people in which customary law applies. This customary law is stated in awig-awig. If we look at the discussion then it is related to the legal structure, of course there is a connection related to that part of the legal system. The legal system in a state can be referred to as a national legal system in which the national legal system has parts or elements that each function and have a relationship, namely between one part and another. Likewise, there are laws that are part of the customary law community where the customary law community is part of the village which is an institution in the state structure. This then becomes an issue of how the position of awig-awig is in the national legal system. This research was conducted through an analysis of legal facts and legal doctrine, namely the theoretical and statutory approaches. This article is the result of research funded by the university, so it is the outcome product of this research. The discussion in this analysis shows that awig awig is written customary law, while what is generally understood so far is the unwritten law. In addition, the position in national law is recognized because it is the right of the customary law communities in Bali (adat in Pakraman Village, Bali). In addition, of course, awig-awig can be used as a source of material law, which is a social conception that exists in society, some of which are still applicable and some need conformity.

Abstract

The press and democratic life are two inseparable things. The existence of the press has a crucial role in conveying information, providing education to the public, and as a means of social control. Freedom of the press is not only recognized internationally, but every country is obliged to provide legal protection for it. The urgency of this research from a constitutional law perspective is that the press is the fourth pillar of democracy (the fourth of estate). This issue is discussed to discover the similarities and differences in press law provisions between Indonesia and Australia as well as to improve, update, or find answers to press law problems. This research applied normative methods with comparative, statutory, and conceptual approaches, as well as qualitative analysis. There are two aspects analyzed in this research, the first regarding the comparison of legal provisions regarding press freedom in Indonesia and Australia based on press system theory and the second regarding good positive legal benchmarks in providing legal protection for the press in Indonesia and Australia. The results of this research are that Indonesian press law provisions have protected press freedom compared to Australian press law provisions which tend not to protect press freedom and Indonesian positive law has fulfilled the elements of legal protection compared to Australian positive law which tends not to have fulfilled the elements of legal protection. Abstract

Medical disputes in the civil field are disputes that can occur between patients and doctor as a medical-professionals and are related to the full fillment of the rights and obligations of the binding relationship as a legal result in the provision of medical services. Medical disputes can lead to losses suffered by patients which can be in the form of limb disability, even death. The emergence of law and health provides a beneficial collaboration, where the health field can be used to face public health challenges and the law can be used to maintain peace and order in society. The regulation of health law in Indonesia contained in Law No. 36 of 2009 which has now been amended by Law No. 17 of 2023 provides differences in efforts to resolve medical disputes which are important to examine and are the focus of this research. The author's research was conducted using a juridical-normative legal methodology with a conceptual approach and a statutory approach. The civil aspect in the settlement of medical disputes is that there are losses suffered by patients due to negligence committed by medical personnel. Patients have the right to claim compensation which can be done by litigation or non-litigation. The parties involved in medical dispute resolution want a dispute resolution that is closed and provides a sense of security, especially on the part of medical personnel so that their reputation is not tainted, so they prefer to conduct non-litigation dispute resolution. Law No. 17 of 2023 provides several options for dispute resolution using Alternative Dispute Resolution which in Law No. 36 of 2009 medical dispute resolution can only be done by mediation.

Abstract

The application of law in Indonesia is based on the positive law applicable in Indonesia. There is an application of law in Supreme Court Decision Number 375 PK/Pid.Sus/2024 which is the object of the author's research by reviewing the suitability of the decision by comparing the decision with the positive law applicable in Indonesia. The verdict can be reviewed from formal law by referring to the Criminal Procedure Code as the legal basis, while from material law referring to Law Number 35 of 2009 concerning Narcotics. The application of the law in the Supreme Court Decision is reviewed from formal law by looking at the procedure when the applicant submits a request for a review to reopen a decision that has permanent legal force to be retried in court. The author conducts research on the application of formal law whether it is in accordance with the requirements and procedures contained in the Criminal Procedure Code and in accordance with the process of requesting a Judicial Review. The suitability of the application of material law is also examined by the author reviewing Law Number 35 of 2009 concerning Narcotics and also several related regulations. The purpose of the suitability of the application of law to a decision has an impact on the realization of the pillars of law stated by Gustav Radburch, namely justice, expediency, and legal certainty. The author in this study will examine the realization of the pillar of legal certainty in Supreme Court Decision Number 375 PK/Pid.Sus/2024.

Abstract

The Constitutional Court Decision Number 135/PUU-XXII/2024 ruled the separation of national and local elections, with the Court’s considerations emphasizing that previous electoral practices had led to excessive workloads for election organizers, political party pragmatism, the marginalization of regional development issues, institutional fatigue and casualties, as well as voter fatigue and a decline in the quality of popular sovereignty. This study examines the legal politics underlying the Constitutional Court’s decision and its juridical implications by employing both a case approach, which analyzes legal disputes in the electoral law domain, and a conceptual approach, which explores the transformation of electoral concepts. The findings demonstrate that the legal politics of Decision Number 135/PUU-XXII/2024 aim to enhance the quality of democracy, since democratic elections play a vital role in safeguarding state integrity, establishing representative institutions, and ensuring effective governance, all of which must be conducted in accordance with the general principles of democracy. Furthermore, the juridical impact of the decision highlights the urgency of strategic measures in electoral governance, particularly the need for immediate legislative revisions of the Electoral Law to guarantee voter accessibility, consolidate political parties, and rationalize the workload of election organizers, thereby providing a clear operational legal basis for the transitional period.

Abstract

Perceraian adalah tindakan hukum, di mana akan melahirkan beberapa akibat hukum. Sebagaimana Pasal 144 Kompilasi Hukum Islam (KHI), bahwa terjadinya perceraian ialah dapat disebabkan adanya suami yang menalak maupun istri yang menggugat cerai sebagaimana dituangkan dalam Putusan Hakim. Mantan suami dimungkinkan memiliki kewajiban dalam rangka membiayai hidup mantan istrinya yang dinamakan Mut’ah, nafkah Iddah (apabila istrinya tersebut tak Nusyuz), dan nafkah terhadap anaknya. Penelitian disini mengkaji tentang pelaksanaan pemenuhan segala hak istri pada perkara cerai talak di Pengadilan Agama Surabaya, berdasarkan Putusan No. 3617/Pdt.G/2022/PA.Sby serta untuk mengetahui, menjelaskan kendala-kendala dan upaya penyelesaiannya dalam pelaksanaan pemenuhan hak-hak istri pada perkara cerai talak di Pengadilan Agama Surabaya. Hasil penelitian ditemui bahwa pertimbangan Hakim mengenai penentuan segala hak istri setelah cerai ialah memperhatikan sisi nilai patut sekaligus nilai adil sekaligus melihat kemampuan dari mantan suami. Kendala dalam perwujudan segala hak bekas istri ialah ketidakhadiran bekas istri pada muka persidangan sehingga Majelis Hakim memutus perkara secara putusan “Verstek”. Kemampuan ekonomi dari bekas suami merupakan kendala tersendiri bagi majelis hakim karena bekas suami adalah keluarga miskin. Upaya dalam mengatasi kendala-kendala bila sudah diputus secara “Verstek” ada perlawanan berupa “Verzet” sehingga Termohon bisa meminta hak-haknya selama bisa membuktikan dalil-dalinya walaupun sudah diputuskan secara Verstek, segala hak istri tetap diberikan sebagaimana Perma Nomor 3 Tahun 2017. Majelis Hakim melaksanakan hak Ex-Officio demi menciptakan keadilan kedua belah pihak.

Abstract

Tujuan dari penelitian ini guna menganalisis eksistensi surat rekomendasi ORI dalam ruang lingkup sistem hukum positif di Indonesia dan kedudukan serta konsekuensi yuridis surat rekomendasi ORI sebagai objek KTUN. Tulisan ini tergolong penelitian hukum normatif yang dilaksanakan dengan menggunakan pendekatan konseptual serta peraturan perundang-undangan. Penelitian ini memberi kesimpulan bahwa SRO secara hukum positif diatur dalam UU No. 37 Tahun 2008 dan PO. Dalam dasar hukum positif tersebut ditemukan kesesuaian sifat SRO dengan KTUN yang berdasarkan Pasal 87 UU No. 30 Tahun 2014. Namun, konsekuensi hukum yang timbul adalah sulit untuk dilakukan pengujian atau penegakan hukum di PTUN karena terhalang Pasal 10 UU No. 37 Tahun 2008. The purpose of this research is to analyze the existence of ORI recommendation letters within the scope of the positive legal system in Indonesia and the position and juridical consequences of ORI recommendation letters as objects of KTUN. This paper is classified as normative legal research conducted using a conceptual approach and legislation. This research concludes that the SRO in positive law is regulated in Law No. 37 of 2008 and PO. In the positive legal basis, it is found that the nature of the SRO is consistent with the KTUN based on Article 87 of Law No. 30 of 2014. However, the legal consequence that arises is that it is difficult to conduct testing or enforcement at the State Administrative Court because it is hindered by Article 10 of Law No. 37 of 2008.

Abstract

Journalistic activities now largely take place through digital media, giving rise to a dilemma between the application of the Press Law or the 2008 ITE Law and the 2016 ITE Law. In fact, the 2021 Joint Ministerial Decree on the ITE Law has confirmed that the Press Law is lex specialis. This study aims to examine the scope of the Press Law and the ITE Law in facing the development of digital media, as well as to analyse the construction and harmonisation of the law to maintain press freedom. The study uses a normative juridical method with a legislative and conceptual approach. The results show that the two regulations are not yet fully able to keep up with changes in the digital media landscape. There is a conflict of norms between Article 15 paragraph (2) letter d of the Press Law and Article 27 paragraph (3) of the ITE Law, thus requiring legal harmonisation. Harmonisation can be carried out without amending the Press Law, but by revising the ITE Law to add an exception clause for press products published digitally.
