Abstract

Sosial budaya mempunyai pengaruh penting dalam mewarnai produk-produk pemikiran hukum Islam khususnya hukum keluarga Islam, baik berbentuk kitab fiqih, peraturan perundang-undangan, keputusan Pengadilan Agama, maupun fatwa-fatwa ulama. Oleh karena itu, apa yang disebut hukum Islam dalam kenyataan sebenarnya adalah produk pemikiran hukum Islam yang merupakan hasil interaksi antara Yuris Muslim sebagai pemikir dengan lingkungan sosialnya. Meskipun Al-Qur?an dan hadist mempunyai aturan yang bersifat hukum, tetapi jumlahnya amat sedikit dibanding dengan jumlah  persoalan hidup yang memerlukan ketentuan hukum.Tidak dapat dipungkiri bahwa pemberlakuan hukum keluarga (hukum perdata) di Indonesia tidak lepas dari faktor sosial budaya, hukum Islam dan hukum adat merupakan hukum yang hidup di tengah masyarakat (living law) sehingga tidak dapat dibedakan pelaksanaanya atau pemberlakuannya apakah hukum Islam yang dijalankan atau hukum adat dalam hal ini  berlangsung secara turun temurun dalam masyarakat. Oleh karenanya hukum Islam dalam masyarakat di hari kemarin menjadi wajah budaya Islam.

Abstract

Judges have the authority to hear and decide divorce cases, which are delegated to them in Court autonomously and without influence from outside parties in accordance with applicable regulations. This research aimed to reveal the use of the Judge's ex officio rights regarding fair divorce decisions at the Palopo Religious Court. This research was empirical, using a normative and juridical approach. The data collection techniques used interviews, observation, and documentation. The data analysis technique was carried out in three steps, namely reduction, presentation, and drawing conclusions. The research results showed that the use of ex officio rights by the Judge of Palopo Religious Court regarding the verstek decision in a fair talaq divorce case was the determination of a decision outside the appellant’s petitum by the Judge by determining the level of living for the ex-wife due to the woman's lack of awareness to demand her rights after the divorce as evidenced by her absence at the trial, which is based on limitations. The execution of the Palopo Religious Court regarding the provision of mut'ah and iddah living in Decision number 25/Pdt.G/2023/PA.Plp was on consignment. The perspective of Islamic law regarding women's rights after divorce in decision number 25/Pdt.G/2023/PA.Plp and decision number 7/Pdt.G/2023/PA.Plp at the Palopo Religious Court was the provision of iddah, mut’ah, madhiyah, hadhanah and dowry owed to the ex-wife, according to the limitations.

Abstract

This study aims to examine the enforcement of underage marriage laws in Luwu Regency. This descriptive qualitative study uses a normative-empirical approach to interview, observation, and documentation methods. The results show that the reality of underage marriages in Luwu Regency is influenced by weak public awareness, lack of serious government supervision or education, and factors such as free association, tradition, family economic background, and patriarchal views. Underage marriage practices based on cultural reasons are subject to a criminal penalty of up to 9 years as outlined in Law No. 12 of 2022 on Sexual Violence Crimes, Article 10, Paragraph (1) and (2). The enforcement of underage marriage follows the legal framework of Law No. 16 of 2019, considering the minimum marriage age, and the Supreme Court Regulation No. 5 of 2019 regarding guidelines for adjudicating marriage dispensation requests. Substantively, underage marriage, from a traditional perspective, aims to preserve lineage rather than prioritize material concerns.

Abstract

The research explains the internalization of Maqasid Al-syari’ah in the Bugis traditional marriage process, because of various oblique views of Bugis marriage customs, it should be addressed wisely and wisely. This research is qualitative research using an Islamic legal juridical approach with qualitative descriptive analysis.  Data sources are primary data conducted through interviews with traditional leaders, religious leaders, community leaders, and secondary data taken from documents that have relevance to the research. Data collection techniques are observation, interviews, and documentation. The results showed that the meaning of the panai money marriage tradition, although not found in Islamic law, is not contrary to sharia and does not damage the faith. Because in it there is benefit, both for the wife and the husband. This kind of custom is called al-adah aṣ-ṣaḥiḥ or al-urf aṣ-ṣaḥiḥ, which is a good custom that can be used as a legal consideration. Islam as a merciful religion accepts customs and culture as long as they do not contradict Islamic shari'a and the custom has become a provision that must be implemented and is considered a rule that must be obeyed, then the custom can be used as a foothold as Islamic law recognizes the validity of customs in the interpretation of law, as the fiqhiyyah rule: al-adah muhakkamah which means that custom can be used as a legal footing. Abstract

Abstract[English]:Practicing the values of Pancasila is very urgent to be realized by every citizen of the community so that in interacting with one another there is harmony in life. Pancasila as social control in the plurality of tribes, cultures, races, religions, languages in the Republic of Indonesia contains religious or spiritual values, ethical-moral values, social values, political values and the value of justice as goals. The local indigenous community of Tanah Luwu is a diverse society that can be said to be a miniature of Indonesia. There are Luwu tribe, Bugis tribe, Toraja tribe, Makassar tribe, Javanese tribe, Balinese tribe, Lombok tribe, Timor tribe and others. The religion also consists of Islam, Christianity, Hinduism, Buddhism, Confucianism, besides that the Land of Luwu has a wide area and includes trasmigran area so that the range of conflict occurs.Abstrak[Indonesia]:Pengamalan nilai-nilai Pancasila sangat urgen untuk direalisasikan oleh setiap orang warga masyarakat agar dalam berinteraksi satu sama lain terjalin harmonisasi hidup. Pancasila sebagai kontrol sosial dalam kemajemukan suku, budaya, ras, agama, bahasa di negara Republik Indonesia mengandung nilai-nilai agama atau spiritual, nilai etika- moral, nilai sosial, nilai politik dan nilai keadilan sebagai tujuan. Masyarakat adat lokal Tanah Luwu adalah masyarakat yang beragam bisa dikatakan miniatur Indonesia. Terdapat suku Luwu, suku Bugis, suku Toraja, suku Makassar, suku Jawa, suku Bali, suku Lombok, suku Timor dan lainnya juga agamanya terdiri dari Islam, Kristen, Hindu, Budha, Konghucu, di samping itu Tanah Luwu memiliki wilayah yang luas dan termasuk daerah transmigran sehingga rentang terjadi konflik.

Abstract

This research aims to describe the resolution of divorce cases for prisoners. The research uses qualitative with a normative juridical and sociological approach. The data source in the research comes from interviews with Heads of Correctional Institutions, Officers and Prisoners. The results of the research show that 1) Divorce processes involving prisoners as defendants often present decisions in the form of verstek decisions because prisoners or convicts are serving their sentences in prison. Because of their absence and without representing their attorney, the Legal Council will decide the case in verstek. The Defendant's limitations in attending the trial result in the principle of justice not being fulfilled for prisoners or inmates in defending their rights at trial. 2) The factors that influence the divorce of inmates at the Class II A Palopo Penitentiary are largely attributed to economic pressure, as well as a lack of social support from the community, which is why the wife asks for a divorce. 3) Efforts to facilitate the process of resolving inmate divorce cases at the Class II A Palopo Penitentiary are a) Meeting economic needs, prisoners' wives have difficulty financing the improvement in life skills that must be provided or facilitated. b) family and community support. c) Accepting that the Justice Council will decide the case in verstek because there are no provisions in the statutory regulations that regulate prisoners or convicts being able to attend divorce trials.

Abstract

Penelitian ini mengeksplorasi hukum waris islam untuk mengetahui, memahami dan menganalisis pandangan kompilasi Hukum Islam terhadap praktik pembagian warisan rumah kepada anak bungsu. Dengan menggunakan penelitian lapangan (field research) dan metode deskriptif kualitatif dengan melakukan studi kasus di Kecamatan Mungkajang Kota Palopo. Data penelitian diperoleh dengan cara observasi, wawancara mendalam dan dokumentasi. Hasil penelitian menunjukkan bahwa: Praktik Pembagian Warisan Rumah Untuk Anak Perempuan Bungsu di Kecamatan Mungkajang Kota Palopo sudah dilakukan sejak dahulu, yaitu dengan memberikan hak waris yang lebih besar dengan ahli waris lainnya. Pemberian hak waris dilakukan secara musyawarah anggota keluarga penerima hak waris serta bagian anak perempuan bungsu secara khusus diberikan berdasarkan asas keadilan, yang dilihat dari sisi kemandirian serta kematangan ekonomi yang sesuai dengan hukum faraid Islam. Pembagian waris tersebut sesuai dengan Kompilasi Hukum Islam (KHI) Pasal 183 yang berbunyi  “Para ahli waris dapat bersepakat, melakukan perdamaian dalam pembagian harta warisan, setelah masing-masing menyadari bagiannya”.
