Abstract

Purpose – This paper seeks to examine the efficacy of predicting turnover for employees and entrepreneurs from Estonia, Latvia, and Lithuania using attitudes towards benefits, pay satisfaction, pay, gender, and age across a four-year time frame. Methodology/approach – A survey that included information on attitudes towards benefits and pay satisfaction was used to collect data from 153 Estonian, 157 Latvian, and 146 Lithuanian employees and 243 Latvian, 103 Estonian, and 109 Lithuanian entrepreneurs. Findings – It was found that . Attitudes towards benefits were generally significant predictors of turnover for employees and entrepreneurs over a four-year time period while satisfaction with pay was typically significant for employees but not for entrepreneurs. Novelty/value – As employee retention has been an important factor in the Baltic region over the last two decades it is vital to understand how to retain employees. Abstract

A notary is a public official who has the authority to draft authentic deeds and carry out other notarial functions as regulated in Law Number 2 of 2014 concerning the Position of Notary. One of the key responsibilities of a notary is to ensure that all appearing parties fully understand the content and intent of the deed being executed. This obligation becomes particularly important when a party does not understand the Indonesian language. Article 43 of the Notary Law explicitly stipulates that the notary must translate or explain the content of the deed to the appearing party in a language they understand, and if unable to do so, the notary is required to involve an official translator. This duty reflects not only the legal, ethical, and administrative responsibilities of the notary but also embodies the principles of justice and legal protection for all parties involved. This research employs a normative juridical method with a statutory and conceptual approach, utilizing primary, secondary, and tertiary legal materials. The findings indicate that the notary's responsibility to translate the contents of a deed is crucial for preserving the validity and evidentiary strength of an authentic deed. Failure to fulfill this obligation can result in the deed losing its authenticity and may lead to civil, administrative, and even criminal liability for the notary. Furthermore, the failure to translate the deed may constitute a breach of professional ethics, thereby undermining the integrity and public trust in the notarial profession.

Abstract

Pemulihan kerugian keuangan negara akibat tindak pidana korupsi seringkali mengalami hambatan ketika pelaku telah meninggal dunia. Dalam hukum perdata, pihak yang dirugikan tetap dapat menempuh upaya pemulihan melalui gugatan ganti rugi terhadap ahli waris pelaku tindak pidana korupsi. Penelitian ini bertujuan untuk menganalisis pertimbangan hukum hakim dalam mengabulkan gugatan ganti rugi pada Putusan Nomor 47/Pdt.G/2023/PN Nab serta tanggung jawab ahli waris setelah dikabulkannya gugatan tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual dan kasus dengan spesifikasi penelitian preskriptif analitis dari sumber data sekunder dengan metode analisis normatif kualitatif. Hasil penelitian menunjukkan Majelis hakim mengabulkan gugatan ganti rugi atas perbuatan melawan hukum pewaris karena telah memenuhi seluruh syarat dalam Pasal 1365 KUHPerdata sebagai dasar menuntut ganti rugi atas perbuatan melawan hukum yaitu ada perbuatan melawan hukum, ada kesalahan, ada kerugian, dan ada hubungan kausal antara perbuatan dengan kerugian. Tanggung jawab perdata dibebankan kepada enam anak dan seorang istri sebagai para ahli waris yang bertanggung jawab secara tanggung renteng atas pembayaran uang pengganti korupsi dalam upaya pemulihan kerugian keuangan negara sesuai Pasal 830 dan Pasal 833 ayat (1) KUHPerdata. Para ahli waris memperoleh hak dan kewajiban pewaris termasuk membayar uang pengganti sejumlah Rp2.153.796.475,- akibat korupsi yang dilakukan pewaris. Kata Kunci: Kewajiban Ahli Waris; Pemulihan Kerugian Negara; Tanggung Jawab Perdata.

Abstract

The existence of Micro, Small and Medium Enterprises (MSMEs) plays a significant role in contributing to the growth of the Indonesian economy. MSMEs are required to optimize their resources, especially non-physical resources, and utilize existing financial technology (Fintech) in order to be able to compete and develop at all times. Intellectual capital is increasingly recognized as a strategic asset that is considered important for sustainable profits. Business support by utilizing financial technology will improve business performance. The goal of this research is to investigate the impact of intellectual capital and financial technology components on the performance of MSMEs. The resulting sample was 66 respondents who were MSME business actors. The method used was Multiple Regression analysis. The results of the study found that customer capital and structural capital, which are elements of intellectual capital, affect MSME performance, while human capital, social capital, spiritual capital and financial technology do not affect MSME performance. Thus, the elements of intellectual capital owned by MSMEs need to be utilized optimally to achieve competitive advantage and maintain business existence.

Abstract

Penelitian ini bertujuan untuk mengetahui analisis Pengaruh pemeliharaan pencegahan dan penggantian komponen mesin terhadap kelancaran proses produksi. Penelitian ini merupakan penelitian kuantitaf dengan teknik pengambilan sampel menggunakan metode purposive sampling. Sampel dalam penelitian ini 55 orang yang merupakan pemilik unit usaha percetakan. Penelitian ini dilakukan melalui dengan cara menyebarkan angket, Sumber data yang digunakan dalam penelitian ini adalah data primer dan data sekunder. Metode analisis data yang digunakan adalah analisis regresi linear berganda. Dari hasil analisis data yang dilakukan dengan bantuan SPSS (Statistic Product And Service Solution) diperoleh hasil variabel pemeliharaan pencegahan (X1) mempunyai pengaruh positif dan signifikan terhadap kelancaran proses produksi pada unit usaha percetakan di kawasan Kecamatan Sukajadi, Kota Pekanbaru, variabel penggantian komponen mesin (X2) mempunyai pengaruh positif dan signifikan terhadap kelancaran proses produksi pada unit usaha percetakan di kawasan Kecamatan Sukajadi, Kota Pekanbaru.

Abstract

Usaha Mikro, Kecil, dan Menengah (UMKM) merupakan tulang punggung perekonomian Indonesia. Namun, banyak pelaku UMKM baru di Kota Pekanbaru yang menghadapi kesulitan dalam mengakses sumber pembiayaan. Kegiatan pengabdian masyarakat ini bertujuan untuk memberikan edukasi dan pelatihan mengenai strategi pembiayaan cerdas bagi wira usaha baru. Melalui metode ceramah, diskusi, dan praktik, peserta diberikan pemahaman tentang berbagai opsi pembiayaan, seperti kredit bank, modal ventura, dan crowdfunding, serta cara memilih opsi yang paling sesuai dengan kebutuhan dan kondisi usaha mereka. Selain itu, peserta juga dibekali dengan keterampilan dalam menyusun proposal bisnis yang menarik bagi investor. Hasil dari kegiatan ini menunjukkan peningkatan pemahaman peserta tentang strategi pembiayaan cerdas dan kemampuan mereka dalam mengakses sumber pembiayaan yang tepat.

Abstract

Kegiatan ini dilakukan di kawawan Pantai Melawi, Kabupaten Bachok, Provinsi Kelantan, Malaysia oleh tim pengabdian kepada masyarakat diantaranya dosen Program Studi Manajemen Fakultas Ekonomi dan Bisnis yang berkolaborasi dengan Dosen Fakulti Keusahawanan dan Perniagaan Universiti Malaysia Kelantan kepada pelaku UMKM kuliner di Pantai Melawi. Dalam kegiatan pengabdian kepada masyarakat untuk mencapai tujuan ini dilaksanakan melalui metode pendampingan dan sosialisasi. Adapun langkah-langkah pendampingan yaitu perencanaan dengan melakukan koordinasi. Tahap ke-2 adalah pelaksanaan, kegiatan dilakukan dalam bentuk penyampaian materi dengan memberikan pengetahuan dan pemahaman tentang strategi pemasaran marketing mix/bauran pemasaran 4P. Berdasarkan hasil dari kegiatan pengabdian dapat disimpulkan beberapa hal, yaitu: (1) Kegiatan pengabdian kepada masyarakat internasional oleh Dosen Program Studi Manajemen Fakultas Ekonomi dan Bisnis Universitas Muhammadiyah Riau yang berkolaborasi dengan Dosen Fakulti Keusahawanan dan Perniagaan Universiti Malaysia berjalan dengan baik. (2) Mitra pengabdian dapat memahami dengan baik atas materi yang telah diberikan oleh tim pengabdian kepada masyarakat. (3) Pelaksanaan kegiatan pengabdian kepada masyakat berhasil dilakukan sebagai wujud pelaksanaan kerja sama antara Universiti Malaysia Kelantan, dengan Universitas Muhammadiyah Riau.

Abstract

This study was conducted to analyze the drivers of loyalty within the context of Islamic banking. Service quality, trust, and satisfaction were examined as exogenous variables influencing loyalty. Furthermore, this study adopted a comprehensive approach by investigating the role of satisfaction as a moderator and mediator in this relationship. The results showed that the exogenous variables significantly impacted loyalty and satisfaction, as well as moderated and mediated the links between service quality, trust, and loyalty. The implications were substantial, particularly for Islamic banks and regulatory authorities. To effectively retain customers in the face of competition, banks prioritized initiatives aimed at enhancing service quality, fostering trust, and monitoring customer satisfaction. Additionally, regulatory bodies contributed by formulating supportive policies and programs that encouraged these practices. The study also challenged conventional perspectives by conducting a thorough analysis of the multifaceted roles played by customer satisfaction, contributing to a framework for optimizing loyalty through quality and trust. Future analysis could build on the insights generated, analyzing the dynamics of customer relationships within the Islamic banking sector. This timely study elucidated pathways for sustaining the growth of Islamic banking.

Abstract

As public officials, Land Deed Officials (PPAT, Pejabat Pembuat Akta Tanah) must comply with the rules in the PPAT Position Regulation, including the primary duties, authorities, prohibitions, and PPAT Code of Ethics. This study examines the role of PPAT and the legal consequences of grant deeds canceled by the panel of judges in Supreme Court Decision Number 503K/Ag/2015. This type of research is normative juridical with statutory, conceptual, and case approaches. The data used is secondary data from primary, secondary, and tertiary legal materials. The results show that Muslim Indonesians are subject to the rules in the Compilation of Islamic Law and the Compilation of Sharia Economic Law and use the Religious Courts to resolve disputes. Grant legal acts must be legalized with a Grant Deed, which is the authority of PPAT. In making a Grant Deed, the PPAT must examine the origin of the granted property. The pillars and conditions of grants in KHI and KHES are cumulative and must be fulfilled. The grant can be canceled if one of the elements is not fulfilled. In the case of grant deed Number 112/II/GB/2003, the PPAT needed to fully carry out its role correctly. Despite having carried out duties by several articles in Government Regulation No. 37/1998 jo PP No. 24/2016, the PPAT violated Article 22 and the precautionary principle in the PPAT Code of Ethics. As a result, the grant deed was declared to have no legal force by the Panel of Judges of the Supreme Court. This research shows that violations by PPAT in making grant deeds can cause the deed to be invalid and null and void, eliminating legal certainty for the parties involved. PPAT's adherence to the rules and the precautionary principle is essential to ensure the legal validity of the deed made.

Abstract

The validity of a covenant must meet 4 conditions, namely an agreement that binds him, the ability to make an agreement, about a certain matter, and a lawful cause. One example is in the Supreme Court Decision Number 655 K / Pdt / 2014 and Review Decision Number 636 PK / Pdt / 2016, there are differences in decisions regarding the Deed of Sale and Purchase and the Deed of Granting Rights of Dependents on the basis of a mock agreement. This study aims to analyze the validity of the sale and purchase deed and the deed of granting dependent rights as well as the legal consequences for the auction winner based on a mock agreement. The research method used is normative juridical, with a statutory approach, a conceptual approach, and a case approach. The data used in this study are secondary data obtained from literature studies. The results of the research obtained are the Validity of the Deed of Sale and Purchase of land rights based on receivables in the Supreme Court Decision Case Number 655 K / Pdt / 2014 states that the Sale and Purchase Deed made by PPAT is invalid and null and void. This is because in making the Deed of Sale and Purchase by PPAT based on the temple agreement made by a Notary, it does not meet the material requirements of an authentic deed, namely the non-fulfillment of the elements of a halal cause as stipulated in Articles 1335 and 1337 of the Civil Code, thus it also cancels the crossing out of the name in the land certificate from the Plaintiff to the Defendant carried out by BPN. In the decision of Review Decision Number 636 PK / PDT / 2016 stated that the Deed of Sale and Purchase and Deed of Granting Rights of Dependents were valid and there was no pretend agreement. The winner of the auction based on the Minister of Finance Regulation No. 93/2010 on auction implementation guidelines is the buyer who submits the highest bid and is certified as the winner of the auction by the Auction Officer. Article 41 paragraph (1) of Government Regulation No. 24/1997 on land registration explains that the transfer of land rights through transfer of rights by auction can only be registered if proven by quotation of auction minutes made by auction officials.
