Abstract

Purpose – This paper seeks to examine the efficacy of predicting turnover for employees and entrepreneurs from Estonia, Latvia, and Lithuania using attitudes towards benefits, pay satisfaction, pay, gender, and age across a four-year time frame. Methodology/approach – A survey that included information on attitudes towards benefits and pay satisfaction was used to collect data from 153 Estonian, 157 Latvian, and 146 Lithuanian employees and 243 Latvian, 103 Estonian, and 109 Lithuanian entrepreneurs. Findings – It was found that . Attitudes towards benefits were generally significant predictors of turnover for employees and entrepreneurs over a four-year time period while satisfaction with pay was typically significant for employees but not for entrepreneurs. Novelty/value – As employee retention has been an important factor in the Baltic region over the last two decades it is vital to understand how to retain employees. Abstract

A notary is a public official who has the authority to draft authentic deeds and carry out other notarial functions as regulated in Law Number 2 of 2014 concerning the Position of Notary. One of the key responsibilities of a notary is to ensure that all appearing parties fully understand the content and intent of the deed being executed. This obligation becomes particularly important when a party does not understand the Indonesian language. Article 43 of the Notary Law explicitly stipulates that the notary must translate or explain the content of the deed to the appearing party in a language they understand, and if unable to do so, the notary is required to involve an official translator. This duty reflects not only the legal, ethical, and administrative responsibilities of the notary but also embodies the principles of justice and legal protection for all parties involved. This research employs a normative juridical method with a statutory and conceptual approach, utilizing primary, secondary, and tertiary legal materials. The findings indicate that the notary's responsibility to translate the contents of a deed is crucial for preserving the validity and evidentiary strength of an authentic deed. Failure to fulfill this obligation can result in the deed losing its authenticity and may lead to civil, administrative, and even criminal liability for the notary. Furthermore, the failure to translate the deed may constitute a breach of professional ethics, thereby undermining the integrity and public trust in the notarial profession.

Abstract

Pemulihan kerugian keuangan negara akibat tindak pidana korupsi seringkali mengalami hambatan ketika pelaku telah meninggal dunia. Dalam hukum perdata, pihak yang dirugikan tetap dapat menempuh upaya pemulihan melalui gugatan ganti rugi terhadap ahli waris pelaku tindak pidana korupsi. Penelitian ini bertujuan untuk menganalisis pertimbangan hukum hakim dalam mengabulkan gugatan ganti rugi pada Putusan Nomor 47/Pdt.G/2023/PN Nab serta tanggung jawab ahli waris setelah dikabulkannya gugatan tersebut. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, konseptual dan kasus dengan spesifikasi penelitian preskriptif analitis dari sumber data sekunder dengan metode analisis normatif kualitatif. Hasil penelitian menunjukkan Majelis hakim mengabulkan gugatan ganti rugi atas perbuatan melawan hukum pewaris karena telah memenuhi seluruh syarat dalam Pasal 1365 KUHPerdata sebagai dasar menuntut ganti rugi atas perbuatan melawan hukum yaitu ada perbuatan melawan hukum, ada kesalahan, ada kerugian, dan ada hubungan kausal antara perbuatan dengan kerugian. Tanggung jawab perdata dibebankan kepada enam anak dan seorang istri sebagai para ahli waris yang bertanggung jawab secara tanggung renteng atas pembayaran uang pengganti korupsi dalam upaya pemulihan kerugian keuangan negara sesuai Pasal 830 dan Pasal 833 ayat (1) KUHPerdata. Para ahli waris memperoleh hak dan kewajiban pewaris termasuk membayar uang pengganti sejumlah Rp2.153.796.475,- akibat korupsi yang dilakukan pewaris. Kata Kunci: Kewajiban Ahli Waris; Pemulihan Kerugian Negara; Tanggung Jawab Perdata.
