Abstract

The research examines the role and the obstacles of village consultative council as patner of village head in establishing Village Regulation. This legal research is included in the type of empirical legal research. The approach used by the author is the qualitative approach. The legal sources used consist of primary legal material and secondary legal material. The technique of data collection is done by interviews and library research. The analysis technique used is qualitative data analysis. The result of the research shows that: (1) the role of the village consultative council in the formation of village regulations in Brahu Village, Siman District, Ponorogo Regency is not optimal enough to extend the hand of the village because the village regulations that have been estabilished in the past a year do not reflect the needs of the community and the community and the constrains effecting the legislative function of the village consultative council; (2) the factors that become obstacles in the preparation and stipulation of the protest, among other the poor quality performance of the village apparatus and village consultative bodies and the revised community in approving aspirations: (3) efforts to overcome them are provide legal drafting training to The Village Consultative Council and socialization to the public about The Village Consultative Council.

Abstract

ABSTRACTThis research aims to find out how was the management of Village Fund at Toriyo village in Bendosari sub-district of Sukoharjo District in supervision of the Village Fund Allocation in accordance with Law Number 6 of 2014 concerning Villages. Based on Government Regulation No 60 of 2014 juncto Government Regulation No. 8 of 2016 about Village Fund sourced from State Budget and Expenditure as well as analyze the obstacles that arise in the management of the Fund. The author of this research choose the empirical legal research with descriptive character using qualitative approach, research method that generates descriptive analytical data that is stated by the respondents according to their writing or orally also real behavior, that is researched and studied as a whole. This research uses the secondary and primary sources. While the sources collection technique carried out trough  interview and observation. Considering the result of research and discussion, it could be stated that the management of Village Fund at Toriyo village in Bendosari sub-district of Sukoharjo District were appropriate with the applicable law, but it still have obstacles that occurred because of the late report from the country side which got the stimulants fund of Village Fund at Toriyo village. The late report occurred because of the country side people still unfamiliar with the existence of Village Fund. So that, a socialization concerning on technical management of the Village Fund is needed. This socialization purpose is to adjust the implementation of the applicable Law concerning on Village Fund Management.Keywords : management; village fund; development.

Abstract

Penelitian ini bertujuan untuk menganalisis mengenai perbandingan didalam pengoptimalan fungsi Badan Permusyawaratan Desa dan faktor yang menghambat terlaksananya fungsi secara optimal di Desa Rejosari dengan Desa Kemasan, Kecamatan Polokarto, Kabupaten Sukoharjo. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan kualitatif. Bahan hukum yang digunakan berupa Bahan hukum primer terdiri dari perUndang-Undangan, catatan-catatan resmi atau risalah dalam pembuatan perUndang-Undangan. Bahan hukum sekunder yang digunakan dalam penulisan hukum ini antara lain meliputi buku- buku teks, internet, artikel ilmiah, jurnal hukum, yang berkaitan dengan permasalahan yang diteliti. Teknik pengumpulan data dengan melakukan wawancara dan studi kepustakaan. Teknik analisis data dalam penelitian ini menggunakan analisis data kualitatif dimana menggunakan tiga teknik yaitu reduksi data, penyajian, dan kesimpulan. Hasil daripada penelitian ini menunjukan analisis bahwa pelaksanaan fungsi legislasi, fungsi menampung aspirasi, dan fungsi pengawasan di kedua desa sudah berjalan cukup optimal dengan proses yang hampir sama. Faktor yang menghambat pengoptimalan fungsi Badan Permusyawaratan Desa di Desa Rejosari dan Desa Kemasan terdapat perbedaan.

Abstract

ABSTRAKPenelitian ini bertujuan untuk mengetahui secara jelas mengenai implementasi Peraturan Daerah Kabupaten Grobogan dalam kaitannya dengan Pengelolaan Badan Usaha Milik Desa (BUMDes) di Desa Jipang, Kecamatan Penawangan, Kabupaten Grobogan. Penelitian ini dilihat dari tujuannya termasuk jenis penelitian hukum empiris bersifat deskriptif dengan pendekatan kualitatif. Lokasi penelitian adalah di Desa Jipang, Kecamatan Penawangan, Kabupaten Grobogan. Sumber data berasal dari sumber data primer yaitu hasil wawancara dengan Ketua BUMDes Jipang. Sumber data sekunder yaitu buku, literatur, dan peraturan perundang-undangan, Setelah data diperoleh lalu dilakukan analisıs data kualitatif dengan model interaktif, hasil penelitian dan pembahasan disimpulkan bahwa Perda Grobogan Nomor 13 Tahun 2013 tentang Pedoman Tata Cara Pembentukan dan Pengelolaan Badan Usaha Milik Desa (BUMDes) dapat diimplementasikan dengan cukup baik di Desa Jipang. Hal ini dapat ditunjukkan dengan manajemen pengelolaan yang tertib dan transparan. Namun. implementasi Perda tersebut menghadapi hambatan karena masalah permodalan dan sumber daya manusia berpengalaman untuk mengelola BUMDes secara profesional.Kata Kunci : Implementasi, Peraturan Daerah, BUMDes, Hambatan.ABSTRACTThis study aims to find out clearly about the implementation of the Grobogan Regency Regional Regulation in relation to the Management of Village-Owned Enterprises (BUMDes) in Jipang Village, Penawangan District, Grobogan Regency. This research is seen from its objectives, including the type of empirical legal research that is descriptive with a qualitative approach. The research location was in Jipang Village, Penawangan District, Grobogan Regency. The data source comes from the primary data source that is the result of an interview with the Chairman of BUMDes Jipang. Secondary data sources are books, literature, and statutory regulations. After the data was obtained then conducted qualitative data analysis with an interactive model, the results of research and discussion concluded that the Grobogan Regulation No. 13 of 2013 concerning Guidelines for Procedures for Formation and Management of Village-Owned Enterprises ( BUMDes) can be implemented quite well in Jipang Village. This can be demonstrated by orderly and transparent management. However. The implementation of this regulation faces obstacles because of capital problems and experienced human resources to manage BUMDes in a professional manner.Keywords: Implementation, Regional Regulation, BUMDes, Obstacle.

Tegar Jati Wicaksono, E0014396, Optimization Of The Implementation Of The Oversight Function Of The Regional People’s Representative Council Of The City Of Salatiga Against The Regional Budget In 2018 As Part Of The Study Of Law Number 23 Of 2014 Relating To The Regional GovernmentThe purpose of this research is to determine how the supervisory function of the Council of People’s Representation (DPRD) of the Regional Revenue and Expenditure Center (APBD) during fiscal year 2018 is respected in the context of the revision of the Law Number 23 of 2014 concerning the Regional Government. In addition to the supporting and inhibiting factors in the implementation of the DPRD supervision function of the city of Salatiga in the regional budget for the fiscal year 2018. This research is a descriptive empirical legal research. The types of data used are primary data and secondary data. The main sources used are direct interviews with the parties concerned. Secondary data sources include literature, legislation, journals, Internet articles and materials, and other related sources. The data collection technique used is a field study going directly to the subject of research and literature to obtain a theoretical basis for the research. Based on the results of the research and discussions, it was concluded that the implementation of the DPRD oversight function of the City of Salatiga on the regional budget for the 2018 financial year was conducted in accordance with the standards in force, but that its use did not work optimally. In exercising the APBD’s oversight function, the DPRD of Salatiga encountered various obstacles.

Abstract

This legal research aims to find out the configuration of human right protection for disability workers conducted at PT Pertamina Refinery Unit V Balikpapan and what are the constraints faced by the companies in providing protection to disability workers. This writing is a legal research based on empirical or non-doctrinal research in order to discover the real circumstances occurred on the research sites.The research uses primary data in the form of observation and interview, as well as secondary data in the form of Act No. 8 of 2016 on Disability, Act No. 13 of 2003 on Employment and Government Ordinance No. 43 of 1998 on Disability Welfare Efforts. The data was collected by library research of legal material relating to the research and data obtained from field observations and interviews to the Employment Section Head and to the disability workers in PT Pertamina Refinery Unit V Balikpapan. The results show 4 (four) kinds of conclusions. Firstly, the protection of disability workers is already running but have not been optimal yet. The disability workers have been granted the rights under applicable law. Secondly, PT Pertamina Refinery Unit V Balikpapan has not fulfilled the obligation to employ disability workers at least 2% of the total workers owned by the company. Thirdly, PT Pertamina Refinery Unit V Balikpapan also has not provide disabled facilities to disability workers. Last, the obstacles faced by PT Pertamina Refinery Unit V Balikpapan in providing protection to disability workers due to the absence of regulation from PT. Pertamina in applying laws and the lack of government socialization and supervision in the implementation of the law as well as lack of public understanding of the rights that should obtained by People with Disabilities (PwDs).

Abstract

Hukum Tata Negara Darurat mengatur bagaimana hukum memberikan ruang bagi negara dalam menentukan kebijakan melalui instrumen hukum dalam kondisi yang mendesak, memaksa, dan telah mengganggu stabilitas negara maupun ketertiban umum. Kondisi darurat negara pada masa pandemi Covid-19, pemerintah Indonesia menggunakan instrumen Peraturan Pemerintah Pengganti Undang-Undang (Perppu). Tindakan pemerintah tersebut apakah telah berdasar pada konstitusi dan memenuhi indikator kondisi darurat akan dianalisis dalam penelitian ini. Jenis penelitian ini adalah penelitian hukum yuridis normatif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis, yakni menganalisis hakikat keadaan darurat negara (state of emergency) sebagai dasar pembentukan perppu. Bahwa ketentuan hukum yang berlaku dan mengatur mengenai keadaan bahaya atau keadaan darurat ini adalah ketentuan pasal 12 dan pasal 22 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pemerintah Indonesia memilih tiga pendekatan utama pemberlakuan tindakan darurat dalam penanganan Covid-19, yaitu: 1) mengandalkan ketentuan dalam konstitusi yang mengatur mengenai keadaan darurat; 2) menggunakan undang-undang yang ada untuk memberikan dasar bagi tindakan darurat atau membentuk undang-undang baru; dan 3) pendekatan yang ambigu yang tidak memiliki dasar hukum yang eksplisit, seperti tindakan eksekutif yang tidak memiliki (atau tampaknya tidak memiliki) landasan hukum yang spesifik. Penetapan status darurat bencana nasional dan status kedaruratan kesehatan masyarakat merupakan opsi yang diambil pemerintah dalam menghadapai situasi darurat pandemi Covid-19. Pemerintah cenderung melihat bencana sebagai bagian yang terpisah keadaan bahaya berdasarkan Pasal 12 UUN NRI Tahun 1945.

Abstract

This study aims to find out how is the implementation of Law Number 6 Year 2014 about Village related to the implementation on Inclusion Village in fulfilling Disability rights in Sukoharjo Regency. This legal research is descriptive empirical legal research with a qualitative approach. The type of data used includes primary data and secondary data. Data collection techniques are used based on data from observations and interviews with literature studies with related legal materials. The analysis technique uses qualitative data analysis techniques. Based on the results of research and discussion shows that the implementation of the Inclusion Village in Sukoharjo Regency is sufficient to provide the fulfillment of rights for people with disabilities which include participation, accessibility, and no discrimination, but not maximally yet. The implementation of the Inclusion Village has not received any monitoring or evaluation from the Village Community Empowerment Office because there is no legal authority in the form of a Regents Regulations mandating. Fulfillment of the rights of people with disabilities in Sukoharjo Regency is inseparable from barriers which include the lack of knowledge about people with disabilities, feelings of inferiority and closure both by persons with disabilities and their families, as well as activities that have not been include in the Regional Medium Term Development Plan.

Abstract

Penelitian ini merupakan upaya mendeskripsikan dan mengkaji permasalahan, pertama implementasi Peraturan Daerah Kabupaten Sijunjung Nomor 2 Tahun 2013 tentang Perlindungan Anak. Kedua faktor pendukung  dan  faktor  penghambat  Pemerintah  Kabupaten  Sijunjung dalam mengimplementasikan Peraturan Daerah Kabupaten Sijunjung Nomor 2 Tahun 2013 tentang Perlindungan Anak dalam rangka penerapan  kabupaten/kota  layak  anak  di  Kabupaten  Sijunjung.  Metode  penelitian  yang  digunakan adalah metode penelitian non-doktrinal atau penelitian empiris dengan menggunakan sifat penelitian deskriptif. Adapun pendekatan yang digunakan adalah pendekatan kualitatif. Dalam teknik ini peneliti cenderung  untuk memilih informan yang dianggap  mengetahui  informasi  dan  masalahnya  secara mendalam dan dapat dipercaya untuk menjadi sumber data yang akurat. Hasil penelitian menunjukkan bahwa   terdapat  beberapa   permasalahan  yang  belum   dipenuhi   oleh  Kabupaten   Sijunjung  dalam mengimplementasikan   Peraturan   daerah   Kabupaten   Sijunjung   Nomor   2   Tahun   2013   tentang Perlindungan  Anak  seperti  pelanggaran  terhadap  hak-hak  anak  dan  pemenuhan  hak  anak  belum terlaksana sebagaimana seharusnya dengan berbagai macam kendala seperti belum ada regulasi khusus terkait  pengembangan kebijakan kabupaten layak  anak,  kendala  kesadaran  masyarakat,  dan  kendala fasilitas serta instrumen dari pemerintahan. Oleh karena itu, perlu adanya keseriusan dan fokus yang diberikan   Pemerintah    Kabupaten    Sijunjung    dengan    segera    mengeluarkan   Peraturan    Daerah, menjalankan Rencana Aksi Daerah (RAD)  Kabupaten/Kota  Layak  Anak  dan  monitoring terkait  Gugus tugas Kabupaten/Kota Layak Anak Kabupaten Sijunjung dalam melaksanakan tugas pokoknya.

Abstract

ABSTRACTThe legal issue in this paper is the implementation of Karanganyar Regency Regulation Number 10 of 2015 concerning Village-Owned Enterprises related to the implementation of Village-Owned Enterprises named Sumber Mulyo in Berjo Village, Ngargoyoso District, Karanganyar Regency. This study also aims to determine the inhibiting factors and constraints that occur in the management of Sumber Mulyo Village Owned Enterprises in the framework of implementing the Karanganyar District Regulation Number 10 of 2015. The results of this study stated that the implementation of Regional Regulation Number 10 of 2015 Associated with Village-Owned Enterprises in Berjo Village, Ngargoyoso District whose implementation was in accordance with the mechanism of Regional Regulation of Karanganyar Regency Number 10 of 2015 and also in line with existing objectives. Obstacles in the implementation of the regional regulation are in line with the Human Resources (HR) both from the lack of awareness of the citizens and the lack of experts.Keywords : implementation; regional regulation; village; village-owned enterprises.
