Abstract

Dengan hadirnya pelayanan telemedicine bukan tidak mungkin dalam penggunaanya yang bisa saja menyebabkan kerugian, khususnya untuk pasien selaku konsumen itu sendiri. Dengan itu perlindungan hukum pasien di sini sangat penting kehadirannya sebagai bentuk adanya kepastian hukum. Lalu apakah perlindungan hukum yang tepat untuk menyikapi pelayanan kesehatan online yang mungkin saja terdapat pihak yang bisa saja dirugikan. Metode yang digunakan dalam penelitian ini adalah yuridis empiris yang bersifat deskriptif yakni dengan memadukan bahan hukum dengan data lapangan berupa wawancara dan kuisioner yang dilakukan penulis secara langsung. Hasil studi menunjukan bahwa perlindugan hukum terhadap konsumen dapat timbul akibat dari hubungan hukum yang melahirkan hak dan kewajiban setiap pihaknya. Berkaitan dengan kerugian yang dapat timbul seorang konsumen dapat dilindungi segala bentuk kerugiannya dengan menuntut pertanggungjawaban baik secara litigasi maupun non litigasi dengan menggugat di luar pengadilan melalui BPSK maupun melalui pengadilan etik yang diselenggarakan oleh MKDKI/MKEK ataupun melalui peradilan umum secara perdata maupun pidana. Didasarkan pada penelitian penulis perlindungan terhadap pasien/konsumen dalam praktiknya masih belum memberikan perlindungan hukum yang baik, khususnya terhadap pasien sebagaimana sesuai ketentuan yang berlaku. Kata Kunci: Telemedicine, Pasien, Perlindungan Hukum

Abstract

This research aims to reveal legal protection based on health law related to the practice of stem cell therapy as a controversial genetic engineering product in Indonesia. This research used a qualitative method with unstructured interviews that focus on normative-empirical studies, supported by statute approach, case approach and various sources of literature studies. Stem cells therapy shows the potential to cure various types of diseases using genetic engineering technology developed by researchers as a hope for future health. This research found that the role and support of the Government in protecting subjects throughout the practice of stem cells therapy can be seen in the Government's commitment through efforts to improve and set standardized health services in accordance with health law and the 1945 Constitution. The implementation of stem cell therapy in Indonesia is limited to service-based research because the Government does not yet have minimum service standards as guidelines to ensure the safety of the procedure and its success rate. The issues that have been found need to be considered as evaluation material for the Government to immediately establish minimum service standards for stem cell therapy, so that all parties such as hospitals, laboratories, and cell banks have equal standards.

Abstract

The crime of terrorism is a serious crime that requires special guidance methods in handling it. Efforts to handle terrorism cases in Indonesia are carried out through special approaches, namely a hard and a soft approaches. Deradicalization is an action that seeks to develop the mentality of national and religious ideology. This research is empirical legal research that examines Law Number 5 of 2018 concerning the Eradication of Criminal Acts of Terrorism. The research method applied is descriptive, which aims to describe the actual situation. This data is then analyzed using a quantitative approach, which means the data is analyzed selectively and described before finding a solution to the problem. This data was analyzed to determine the effects of implementing guidance according to Law Number 5 of 2018 concerning the Eradication of Criminal Acts of Terrorism. Efforts to deal with Based on the evidence, it can be concluded that those who commit terrorist crimes in Indonesia are generally quite good. The obtained data shows that former prisoners in terrorism cases in Indonesia have returned to be good citizens. Although Indonesia is making good efforts to combat terrorism, much more needs to be improved. The government, law enforcement agencies and society have to work together in fighting terrorism and avoiding cases of terrorism in the future.

Abstract

This research stems from academic concerns about how legislative regulations maintain customers' security affected by crimes in electronic transactions and information in the banking sector, furthermore, regarding the legal protection of banking customers who are victims of information and electronic transactions crime. This study aims to determine and examine the legal protection of customers who are victims of information and electronic transaction crimes. The research method used is normative juridical research using a statutory and conceptual approach. The results showed that 1) Legislation protecting banking customers who are victims of information and electronic transactions crime in the banking sector has previously been regulated in Law Number. 8 of 1999 concerning Consumer Protection and Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions. 2) Legal protection of banking customers who are victims of information crime and electronic transactions consists of repressive and preventive legal protection. Repressive protection is given when preventive protection cannot prevent customers from Information and Electronic Transaction crimes. In Article 4, letter d of Law Number 8 of 1999 concerning consumer protection, consumers have the right to be heard for their opinions and complaints about the goods or services used. Furthermore, Article 32 of Financial Services Authority Regulation (Peraturan Otoritas Jasa Keuangan / POJK) Number 1/POJK.07/2013 on Consumer Protection in the Financial Services Sector states that financial services business actors are required to have and implement service and settlement mechanisms for consumers. In addition to repressive protection, there is also preventive customer protection listed in Article 4 of the consumer protection law, which states that banks have an obligation to provide guidance and education for customers as consumers

Abstract

Force majeure events are likely in Indonesian construction projects due to the country'ssusceptibility to natural disasters. Contractors are particularly vulnerable to defaults like completion delaysand financial losses due to damage. Legal protection through force majeure clauses is crucial. However,some Project Owners hesitate to define force majeure conditions due to a lack of understanding.Researchers aim to clarify force majeure concepts in agreements and construction contracts to ensure legalcertainty for all parties involved. This study employs a qualitative descriptive approach utilizing libraryresearch methods for data collection. Research findings indicate that construction service contract standardsin Indonesia, including those within the PUPR environment, the FIDIC Contract Form, and other projectcontracts, align with expert formulations and relevant regulations regarding the implementation of the ForceMajeure concept. Typically, the allocation of cost consequences resulting from a Force Majeure eventassigns responsibility to the Project Owner as the Creditor, rather than transferring it to the contractor.However, variations can occur based on the parties' agreement, which, if agreed upon, are legally bindingunder the Pacta Sunt Servanda principle, which facilitates the shifting of Force Majeure liability to thecontractor, prompting the contractor to consider it in their offer.

Abstract

Minister of Transportation Regulation Number 25 of 2020 on Transportation Control during the Idul Fitri Homecoming Year 1441 Hijri in the context of Preventing the Spread of COVID-19. This Regulation of the Minister of Transportation Number 25 of 2020 regulates the transportation system during the Large-Scale Social Restrictions (PSBB) implementation, especially related to the 2020 Idul Fitri Homecoming. The formulation of the problem in this study: first, how could the elements of actions be categorized as violations of criminal law norms? second, could the violation of the prohibition of homecoming be categorized as a violation in the criminal law?. The purpose of this study is to find out that violations of the homecoming ban have met the elements that can be categorized as violations of criminal law norms. The research method used normative legal research for this research and used the Theory of Legal Effectiveness for the theory. This study concludes that: First, an act that can be categorized as a violation of criminal law, then there must be elements of a criminal act, both from a theoretical and legal point of view. Second, that the Ministerial Regulation (Permen) cannot contain criminal provisions.

Abstract

A research on the relation between sufism, sharia, and the local culture is essential for some reasons. First, Islamic philosophy and customary law (or the law of the peoples) are perceived as opposing each other. Second, Islamic philosophy, also in Geertz’s theory, regards Islam merely as the structure of religious orthodoxy. Third: the structure of Islamic orthodoxy, often portrayed as a highly rigid one, is often (seen as) conflicting with sufism in the world of Islamic scholarship. This paper aims to determine the dynamic relation between the spiritual values ​​of Sufism and traditional values ​​surviving in the so-called Nusantara legal culture. It also elaborates on the extent to which a distinct epistemology typical to sufism may contribute to enriching the cultural space of Nusantara law. As normative legal research, this paper employs the principle of legal culture developed by Lawrence M. Friedman. It concludes that the spiritual values ​​of sufism are not conflicting with the principles of Islamic jurisprudence. It would also argue that the construction of Nusantara legal culture has a unique character resulted from dynamic interaction of traditional values, on the one hand, and sufism on the other.

Abstract

 In this study, the researcher aims to examine the practice of re-performing songs, commonly referred to as "song covers," as regulated under Indonesian Law No. 28 of 2014 on Copyright. The research focuses on three main aspects. First, it seeks to identify how copyright regulations are applied in the context of reusing copyrighted works, specifically in the form of songs, in accordance with the copyright law. Second, it analyzes the legal consequences imposed on copyright violators in this context. Third, it evaluates the compatibility of the Supreme Court Decision No. 41PK/Pdt.Sus-HK/2021 with the principles of Legal Protection Theory. This study employs a Normative Juridical approach, based on the principles of norms and laws applicable in Indonesia. The researcher uses this approach to refer to the legal norms and regulations in effect in the country. The research draws on legal materials from literature as both primary and secondary sources. Based on the analysis, the researcher concludes that anyone intending to upload song covers on social media platforms such as YouTube must comply with the economic rights held by the performers. Abstract

Asuransi terdiri dari berbagai jenis proteksi, salah satunya Asuransi Jiwa Pembiyaan Syariah yang memproteksi jiwa debitur Bank Syariah yang mengajukan pembiayaan kepada Bank. Jika debitur meninggal dunia, asuransi akan melunasi sisa hutang debitur kepada Bank. Pada akhir 2019, muncul wabah penyakit virus corona atau Covid 19. Sehingga, tujuan penelitian ini untuk meninjau hukum penolakan klaim asuransi dengan perdebatan status wabah penyakit dalam perjanjian asuransi jiwa pembiayaan syariah di masa Covid 19. Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif dengan pendekatan deskriptif, menggunakan jenis penelitian literature review. Hasil penelitian menunjukkan bahwa asuransi menganggap PANDEMI merupakan bagian dari EPIDEMI sehingga penolakan klaim kematian Covid 19 tetap dilakukan. Menjadi perdebatan dalam pemahaman pengertian wabah penyakit sehingga akibat dari penolakan klaim tersebut antara debitur dengan asuransi. Bank sebagai kreditur melakukan eksekusi jaminan dan nasabah/debitur yang mencari keadilan melalui sengketa di Pengadilan Agama guna menyelesaikan sengketa perdata ekonomi syariah dikarenakan perdebatan klausula baku penolakan klaim EPIDEMI dan PANDEMI.

Abstract

Urban forests hold potential as carbon sinks while also providing vital ecosystem services. This study aims to analyze the carbon sequestration potential of Cipayung and Munjul Urban Forests in East Jakarta and to offer policy recommendations for the Jakarta Provincial Government. Field measurements were conducted using Diameter at Breast Height (DBH) data, which were collected through stratified random plot sampling. Biomass was estimated using the IPCC (2006) allometric equation, combined with species-specific wood density values. The results show that Cipayung Urban Forest sequesters approximately 111.52 tons CO₂ eq, while Munjul Urban Forest sequesters 42.10 tons CO₂ eq. These differences are influenced by vegetation structure and species composition. Ecologically, urban forests contribute to local greenhouse gas reduction while supporting adaptation to extreme weather, including reducing urban temperature and improving water absorption capacity. Policy implications include the need for the Jakarta Provincial Government to strengthen urban forest protection regulations, integrate urban forests into spatial planning, and enhance participatory community-based management. The limitation of this study lies in its coverage, which was restricted to only two urban forests; therefore, future studies should expand to other urban green areas across Jakarta.Keywords - Carbon Sequestration, Jakarta, Urban Forest.
