This article intends to know the status of the Hand Arrest Operation (OTT) carried out by the Corruption Eradication Commission (KPK) according to the views of legal practitioners. With a normative approach, this study examines the problems legal practitioners face more deeply. There is a difference between Hand-Arrest and Arrested Operations. It means that Hand Arrest Operations (OTT) and Being Arrested (TT) are the same if the procedure follows the rules set, namely Article 18 of the Criminal Code. It is in line with the views of practitioners of law.

Penelitian ini mengkaji implementasi Pasal 12 ayat 1 huruf a Undang-Undang Sistem Pendidikan Nasional (UU Sisdiknas) tentang hak siswa mendapatkan pendidikan agama sesuai agama yang dianutnya dan diajarkan oleh pendidik yang seagama, dalam konteks minoritas Muslim di Sulawesi Utara. Dengan menggunakan pendekatan kualitatif dan desain studi kasus, penelitian ini mengeksplorasi ketidaksesuaian antara amanat undang-undang dan praktik di SMP A (negeri) dan SMP B (swasta Kristen), di mana guru Pendidikan Agama Islam (PAI) tidak seagama dengan siswa Muslim. Analisis dilakukan melalui perspektif teori implementasi kebijakan publik, teori interseksionalitas, dan teori postkolonial. Temuan menunjukkan kompleksitas implementasi kebijakan di tengah keterbatasan sumber daya, keragaman perspektif pemangku kepentingan, dan dinamika relasi kuasa. Penelitian ini berkontribusi pada pengembangan teori dan praktik pendidikan multikultural yang responsif terhadap keragaman konteks Indonesia. Rekomendasi mencakup revisi kebijakan yang mengakomodasi konteks minoritas, penguatan kapasitas guru, dan kolaborasi multipihak. Implikasi penelitian ini relevan bagi diskursus pendidikan agama dalam masyarakat plural secara global.

IntroductionInheritance law in Islam traditionally prohibits inheritance between Muslims and non-Muslims. However, in the context of Muslim Minahasa families in Manado, Indonesia, interfaith dynamics within families challenge the strict application of this norm. Local customs emphasize familial unity and communal harmony, which often influence how inheritance is distributed, regardless of religious affiliation.ObjectivesThis study aims to explore how inheritance is distributed in Muslim families of Minahasa ethnicity when religious differences exist among heirs. It seeks to understand how Islamic inheritance law interacts with Minahasa cultural values and whether local customs override religious legal boundaries in favor of social cohesion.MethodThis research adopts a qualitative socio-legal approach, combining fieldwork and document analysis. Data were collected through in-depth interviews with five Muslim Minahasa families in the Lawangirung area of Manado and one mosque official. Additionally, selected inheritance court decisions were analyzed to understand how the legal system responds to interfaith inheritance cases in the local context.ResultsThe findings indicate that Muslim Minahasa families prioritize familial harmony over strict adherence to Islamic inheritance law. In cases where family members have different religions, inheritance is commonly distributed based on mutual agreement and moral obligation rather than formal legal guidance. Religious differences are not viewed as a disqualifying factor. Cultural values such as mapalus (mutual cooperation) and si tou timou tumou tou (the philosophy of living to empower others) play a central role in shaping inheritance practices. The application of wasiat wajibah (obligatory bequest) in court decisions provides a legal mechanism to accommodate non-Muslim heirs without fully departing from Islamic jurisprudence.ImplicationsThis study reveals a form of legal pluralism in which customary norms and religious values coexist and interact. It highlights the importance of cultural context in the interpretation and application of Islamic law. For policymakers, religious authorities, and legal practitioners, the findings offer valuable insight into alternative models of inheritance that prioritize social harmony in multi-religious families.Originality/NoveltyThis research contributes new knowledge to the discourse on Islamic law and legal pluralism by examining inheritance across religious boundaries within a culturally rich and religiously diverse community. It offers an ethnographically grounded understanding of how Minahasa Muslims reconcile Islamic principles with inclusive customary values, thereby promoting a harmonious legal and familial order.

Implementing marriage agreements in multi-ethnic communities presents complexities, particularly in harmonizing Islamic, customary, and favorable laws. The gap in understanding the concept of Syirkah Al-milk in classical fiqh and modern practice, as well as the lack of comprehensive studies on the implementation of marriage agreements in multi-ethnic areas such as North Sulawesi, creates an urgency to explore this phenomenon further. This study aims to analyze the implementation of marriage agreements from the perspective of Syirkah Al-milk and its dynamics in North Sulawesi's multi-ethnic communities. The study employed a qualitative approach with a multisite case study design across seven religious court institutions. Researchers collected data through semi-structured interviews with judges, religious figures, and traditional leaders, as well as non-participant observation and document analysis. They validated the data using method triangulation, member checking, and peer debriefing. The study found a significant gap between the concept of Syirkah Al-milk in Islamic law and its practice in society. Religious court judges face challenges harmonizing Syirkah principles with socio-cultural realities, particularly in recognizing non-financial contributions within marriage. Constitutional Court Decision No. 69/PUU-XII/2015 provides new flexibility in line with the principle of maslahah in implementing marriage agreements. The study concludes that a holistic approach integrating Sharia values, customary law, and positive law is necessary to develop a more adaptive marriage agreement system. Continuous efforts are required to increase public understanding of Syirkah Al-milk concepts and the benefits of marriage agreements.

Domestic violence (KDRT) often arises in a marriage, which then encourages the wife to sue her husband for divorce through the courts. In this case, the Compilation of Islamic Law (KHI) does not regulate the rights of a wife who sues her husband for divorce to obtain 'iddah, or mut'ah support. But the rules regarding this are in Book II of the Guidelines for Religious Courts and SEMA. This research is field research with a qualitative-comparative approach through a feminist perspective. The aim is to analyze the considerations of judges in deciding cases of divorce due to domestic violence in the Medan Religious Court and the Banda Aceh Sharia Court. The research found the fact that the considerations of judges in the Medan Religious Court when deciding cases of divorce due to domestic violence, do not consider the issue of 'iddah or mut'ah maintenance rights to the plaintiff (ex-wife) because this is not regulated in the KHI. This research concludes that, if analyzed from a feminist perspective, the decisions of the judges of the Medan Religious Court and the Banda Aceh Sharia Court tend to be unfair and discriminatory towards women. the principle of gender equality, where the law discriminates between the legal effects of divorce by the husband's will (talak) and divorce by the wife's will (divorce). Therefore, this research recommends that judges when deciding on a domestic violence case should not only adhere to one KHI but also consider other rules relevant to it.

Artikel ini bertujuan mendeskripsikan tentang perceraian yang dilakukan di luar pengadilan di Bolaang Mongondow Timur dengan menganalisa faktor-faktor penyebab serta bagaimana akibat hukum yang terjadi pasca perceraian diluar pengadilan. Penelitian ini adalah penelitian lapangan dengan pendekatan sosiologis. Hasil penelitian ini menunjukan sebagian masyarakat Bolaang Mongondow Timur melakukan perceraian diluar pengadilan karena dipengaruhi oleh rendahnya pendidikan, ekonomi keluarga yang tidak mampu atau tidak sanggup membayar biaya perceraian. Selain itu jarak Pengadilan Agama yang jauh membuat masyarakat Bolaang Mongondow Timur melakukan perceraian di luar Pengadilan. Hal ini berdampak pada tidak adanya status legal dalam hukum negara yang dapat berakibat pada tidak terpenuhinya hak-hak warga negara yang berkaitan dengan dampak perceraian dalam lingkup hukum kenegaraan Indonesia. Sedangkan terkait dengan administrasi, praktek perceraian tersebut tidak didaftarkan pada lembaga pemerintahan sehingga akan mengakibatkan tidak adanya penjelasan status baru dari pasangan suami istri dalam administrasi kenegaraan. Oleh karena itu perlu adanya sosialisasi dan bimbingan dari pemerintah setempat tentang perceraian, karena kurangnya pemahaman masyarakat terhadap yurisprudensi hukum Indonesia terutama di bidang hukum. Baik hukum agama maupun hukum positif.

This research aims to analyze the effectiveness of BAZNAS Kotamobagu City's productive economic empowerment program in improving the welfare of poor community groups. This qualitative research with a case study design uses primary data from in-depth interviews and secondary data from regulatory reviews and literature. The results show that the skills training program and provision of business capital by BAZNAS Kotamobagu City positively impact the financial independence of several poor families in the region. However, evaluating the program implementation also identified several substantial remaining challenges. First, the beneficiary selection process is still considered too bureaucratic and potentially subjective. Second, the low awareness of some communities in carrying out their zakat obligations so that the realization of zakat fund raising is relatively low. Therefore, it is recommended to improve the beneficiary selection system by utilizing data digitization to improve efficiency and validity. The principles of accountability, transparency and objectivity in the selection process by zakat managers also need to be upheld. On the other hand, it is necessary to intensify massive public socialization and education related to the urgency of paying zakat as well as the real impact of zakat on economic empowerment programs for the poor. Increasing this literacy is important to optimize the potential for collecting zakat funds in the region. With these improvements, the BAZNAS Kotamobagu City productive economic empowerment program model has the potential to be replicated and make a significant contribution to the national mission to alleviate poverty in Indonesia.

This study aims to analyze the validity of mystery box transactions from the perspective of fiqh muamalah (Islamic commercial jurisprudence) with a focus on the principles of gharar (uncertainty) and maysir (gambling). This qualitative research employs a literature review approach of 32 scientific articles (2001-2025) and is supported by interview data with mystery box consumers. Data analysis uses content analysis and thematic analysis techniques, organized into six discussion themes. Mystery box transactions do not meet the validity requirements of Islamic sale contracts as they contain elements of gharar (excessive uncertainty) due to unclear transaction objects and maysir (speculation) resembling gambling. This practice violates the principle of bayan (clarity), which is an essential requirement in contracts, and contradicts the concept of interadhin (mutual consent) in QS. An-Nisa verse 29. Although consumers are aware of the incompatibility of this practice with Sharia, entertainment motivation drives them to continue engaging in transactions. The absence of khiyar (inspection option) rights and potential seller exploitation further reinforce the fasid (invalid) status of these transactions. Conventional mystery box models are not Sharia-compliant and require fundamental modifications toward better transparency. Collaboration among consumers, business practitioners, regulators, scholars, and e-commerce platforms is needed to develop an alternative "halal mystery experience" that remains innovative yet compliant with muamalah principles, along with massive education on Sharia-based digital transactions for Muslim communities.

This research reviews Ahmad Rajafi's thoughts on Indonesia's Islamic family law reform movement. Utilising literature-based research with qualitative research and descriptive-analytic analysis, where the primary data source is Ahmad Rajafi's works. Then, the data is processed and analysed using two main theories: Social Evolution theory and Conflict theory. The results show that from a historical perspective, the Old Order reflected early attempts to remove colonial traces in family law, focusing on harmonisation between religion and national interests. The New Order involved conflict between religious groups over the 1974 Marriage Law, with concrete steps to achieve harmony between Islamic law and national interests by establishing the Compilation of Islamic Law. The Reformation era marked the debate on polygamy and the search for an Indonesian identity in family law, reflecting the complexity of Indonesia's journey towards a just and inclusive legal system. In the social evolution and conflict theory analysis, family law reform is not only linear but influenced by conflict and changes in social values. This process reflects an active struggle to achieve gender justice and maintain local identity in the Indonesian context. This research concludes that Ahmad Rajafi's thoughts on family law change not only reflect adaptation to social and cultural changes but also involve an active struggle to achieve gender justice and maintain local identity in the Indonesian context. This research delves deeply into the issue of law enforcement in Indonesia, focusing on the contribution of Rosdalina Bukido's thoughts. This research utilizes a qualitative research method based on literature studies by analyzing Rosdalina Bukido's works related to efforts to maximize law enforcement in Indonesia and applying Roscoe Pound's Sociological Jurisprudence theory. The results highlight the urgency of effective and just law enforcement in nation-building. Bukido emphasizes the role of judges as justice carriers, detailing the gap between theoretical law and daily practices. Internal and external factors influencing law enforcement are discussed, emphasizing consistency in legal principles, professionalism of law enforcers, and public perception of the law. Analysis of Bukido's ideas from the Sociological Jurisprudence perspective highlights the dynamic relationship between law and society. Her contributions include deep understanding of how law must be responsive to its social context and fulfill societal needs and aspirations. Hence, there are important contributions in Rosdalina Bukido's thinking in understanding and implementing law enforcement in Indonesia. The application of Sociological Jurisprudence provides a broader view of how law operates within society. The implications include the necessity of consistency in legal principles, professionalism of law enforcers, and changes in public perception to create a more just and effective legal system.
