Abstract

Law enforcement against the phenomenon of child neglect by parents is a complex problem. Awareness and obedience to the law can be used as a strategy for minimizing child neglect. As a solution in creating the next generation of the nation with superior character and producing quality and moral human resources. The core of the problem carried out in this study is first, identifying the phenomenon of child neglect in Bone Regency, and second, identifying law enforcement efforts against the crime of child abuse by increasing legal awareness. The research methods used are normative juridical and empirical juridical. The results of the study show that neglect of children in Bone Regency is in the form of physical, educational, emotional, and medical neglect caused by the weak influence of the synergy of substance, structure, and culture by Lawrence Friedman's law enforcement theory. Preventive law enforcement efforts for child neglect are carried out by regulations, but repressive efforts from law enforcement are still constrained by public legal awareness of the crime of child neglect. Repressive efforts need strategies to support law enforcement of child neglect crimes by parents in the form of the concept of post-responsibility to realize child protection.

Abstract

This research examines the problem of domestic violence within the Sinjai Police Department. The aim of the research is to reveal the views of Islamic law on the mechanism for resolving domestic violence using the theory of restorative justice within the Sinjai Police Department. Qualitative research method with a normative and empirical approach, supported by primary data sourced from interviews, observation and documentation. As well as, secondary data sourced from legislation, National Police Regulations, the Koran, and related literature. The research results show that: First, the mechanism for resolving domestic violence cases using a Restorative Justice approach at the Sinjai Police is through the stages of complaints/reports from the public, providing victim protection, then investigators taking statements from victims or witnesses, and conducting an investigation of the crime scene. After that a case was filed. Apart from that, investigators use mediation. If you agree to make peace, a statement letter will be made to maintain the unity of the family, and the investigation will be stopped as part of restorative justice efforts. Second, the mechanism for resolving domestic violence cases using restorative justice from an Islamic legal perspective as an effort to provide the best for perpetrators and victims in accordance with the justice they expect. Whether the decision to reconcile or divorce has also been regulated in the Koran and is in accordance with the restorative justice mechanism.

Abstract

Penelitian ini membahas kebijakan pembebasan bersyarat bagi pelaku extraordinary crime di Lembaga Pemasyarakatan Kelas II A Watampone dengan pendekatan yuridis empiris dan tinjauan Maqashid Syariah. Fokus utama adalah implementasi prosedural pemberian pembebasan bersyarat dan prinsip keadilan dalam hukum Indonesia berdasarkan UU No. 22 Tahun 2022 tentang Pemasyarakatan serta Peraturan Pemerintah Nomor 99 Tahun 2012 tentang Syarat dan Tata Cara Pelaksanaan Hak Warga Binaan Pemasyarakatan. Hasil penelitian menunjukkan bahwa secara hukum positif dan Maqashid Syariah, pembebasan bersyarat tetap menjunjung prinsip keadilan dan kesetaraan. Implikasinya mencakup pentingnya optimalisasi kebijakan tanpa intervensi serta perlunya sosialisasi publik mengenai perbedaan prosedur bagi pelaku extraordinary crime agar tidak terjadi kekeliruan dalam penafsiran keadilan hukum.

Abstract

The development of the relationship between constitutional law and human rights is fundamental in a rule of law state. Constitutional law is oriented towards regulating and simultaneously striving for the optimal protection of human rights. This research aims to examine the integration between constitutional law and human rights by conducting a comparative legal study between Indonesia and South Africa. This research is a normative legal study emphasizing historical, conceptual, legislative, and comparative legal approaches. The research findings indicate that the strengthening of human rights norms and the role of the Indonesian Constitutional Court have become crucial points, particularly the role and authority of the Indonesian Constitutional Court through its rulings aimed at protecting human rights. Similar developments also occurred in South Africa after the end of apartheid, with the establishment of the Constitutional Court and constitutional reforms as important steps in upholding the rule of law and human rights. The Constitutional Courts of Indonesia and South Africa both face issues such as weak implementation of rulings, political pressure, and slow legislative processes that accommodate the Constitutional Court's decisions. This research recommends that the integration of constitutional law and human rights should be optimized by strengthening the authority of the Constitutional Court, including the authority to ensure that Constitutional Court decisions are obeyed and implemented optimally to protect human rights.
