Abstract

The phenomenon of early marriage in Sukorejo Village is driven by parents' concerns about their children's behavior, readiness, efforts to reduce the family's economic burden, and low awareness of the importance of education. The implications of early marriage on family life include suboptimal child-rearing and education, as well as frequent conflicts that may lead to divorce. The community's views on early marriage fall into two categories: those who are opposed and those who support it. Those opposed argue that biological, sociological, and psychological immaturity can negatively impact the family life that is being built. Conversely, those who support early marriage believe it is a measure to preserve religious values and avoid free association and fornication. Additionally, some parents take pride in their daughters marrying early rather than becoming "old maids." Economic reasons also play a role, as marriage is seen as a way to gain a son-in-law who adds to the family's economic assets and supports its welfare.

Abstract

The Early marriage in Sukorejo Village, triggered by tradition, social pressure, and economic conditions, has an impact on children's education. This study aims to determine the effect of early marriage on children's education in the village, with a focus on aspects of formal education, access to further education, awareness of the importance of education, and psychological and emotional impacts. Qualitative research methods with a phenomenological approach were used to explore community views and the effects of early marriage. Data were collected through interviews, participant observation, and documentation. The results of the study showed that early marriage resulted in the termination of formal education, loss of access to further education, and decreased motivation to learn. The psychological and emotional pressures experienced by children who marry early also affect the effectiveness of their education. In addition, lack of education worsens employment opportunities and increases the risk of poverty. This study is expected to raise public awareness of the importance of education and readiness for marriage, as well as support to reduce the number of early marriages in order to improve the future of the younger.

Abstract

Indonesia is a country with diverse religions, where Islam, as the majority religion, provides comprehensive guidelines governing the relationships between humans and God, among individuals, and with the environment. In Islam, marriage is regulated in detail to ensure a relationship that is blessed and adheres to religious principles. In Java, the acculturation between Islamic marriage and Javanese customs has created a unique marriage tradition that integrates Islamic values with local wisdom. An example of this acculturation is the practice of sesajen in wedding ceremonies in Sukorejo, Ponorogo. This practice is a cultural heritage containing spiritual elements, influenced by Hindu traditions that have blended with Islam. This research aims to understand the origins of the cultural acculturation between Islamic marriage and Javanese customs and to assess the legal perspective on the practice of sesajen according to Islamic law in Sukorejo. The main focus is to examine how sesajen is accepted or conflicts with Islamic principles, and how this tradition adapts to the local context while preserving cultural and religious values.

Abstract

This research discusses the legal implications of a husband's marriage during his wife's iddah period, which is debated in Islamic law and positive law in Indonesia. In Islam, the iddah period aims to ensure the cleanliness of a woman's womb and provide an opportunity for reconciliation for divorced couples. However, classical Islamic law does not explicitly prohibit a husband from remarrying while his ex-wife is still in the iddah period. On the other hand, Circular Letter of the Director General of Islamic Guidance of the Ministry of Religious Affairs No. P-005/DJ.III/HK.007/10/2021 stipulates that marriages performed during the iddah period cannot be registered, as an effort to prevent covert polygamy. This research uses a normative juridical method with a legislative and conceptual approach, analyzing regulations related to marriage during the iddah period from the perspective of the Qur'an, Hadith, Compilation of Islamic Law (KHI), and Marriage Law No.1 of 1974. The results show a gap between classical Islamic law and state regulations, where positive law sets administrative restrictions on the husband's marriage during the wife's iddah period to provide legal certainty. This policy has consequences for the legal status of the marriage and the rights of the couple, including the status of the children in the marriage. This research provides insight into the differences between Islamic law and state regulations in the context of iddah marriages and their juridical implications, which are important for academics, legal practitioners and the public.

Abstract

In the current era of globalization, the role of government supervision in regulating the distribution of cosmetics must always be done by improving the quality of consumer protection. For this reason, the Indonesian Ulema Council (LPPOM MUI) has a strong task of researching, reviewing, analyzing and deciding whether food products and their derivatives, medicines and cosmetic products are safe for consumption. in terms of health and in terms of teaching Islam. For this reason, consumers must know what are the factors that influence consumer behavior towards cosmetic products that are not labeled halal? And what is the perception of the 2018 Islamic economic law students regarding cosmetic products that are not labeled halal?. The purpose of this study was to find out the perceptions of Islamic economic law students class 2018 about cosmetics that are not labeled halal in relation to consumer behavior. The nature of this research is field research. The type of research used in this research is descriptive and uses data collection techniques using interviews, documentation, and observation. In an interview with a 2018 Islamic Economic Law student, the data was processed using a qualitative analysis method using the inductive reasoning method. Based on the results of the study, the most dominant factor influencing consumer behavior in purchasing non-halal labeled cosmetic products by students of the Faculty of Sharia class 2018 INSURI Ponorogo includes several factors, namely close friends, self factors and environmental factors.

Abstract

real goal of marriage is to build a prosperous family, not just a connection between two genders. One of the pillars in marriage is the dowry. Dowry is a husband's gift to the wife. Uniquely in Indonesia, dowry in certain customs, the amount is determined. one of them is banjar custom in Senyerang Village. In determining the dowry they have a tradition known to be honest. In this study, it is categorized as field research, and is ethnographic research. This research not only describes certain characteristics, but also analyzes why and how these things happen. The data collection techniques used in this study were in-depth interviews, observations and literature studies. The results showed that the dowry and honesty in the Banjar community in Senyerang Village were different, the amount or amount of honesty was influenced by several factors, Among them: the level of education, the parents of women and the level of beauty. But everything remains within the agreement of both parties. The review of Islamic law analyzes the honest law that exists in the society, which is contained in the honesty, namely help and the law is okay as long as it does not bring mudharatan according to Islamic teachings.

Abstract

In medicine, technological development is an advantage to create a novel way that makes easier for couples to have children, its surrogate mother. That is conception outside the womb and baby’s seed planted in the womb of another woman who has been hired so the wife will not pregnant. Surrogate mother is a matter of debate for clerics because nasab mixed between a married couple and a surrogate mother that will sever the child’s nasab with the father. In addition, nasab’s decision resulted in a loss of the obligation of the father to provide his child’s rights as well as the living rights. The study was researched with two formula problems: 1) what was the status of the child of surrogate mother according to clerics of mazhab?, 2) how does the law of child’s living rights of surrogate mother according to cleircs of mazhab?. The study uses library research study methods through data sources of books, journals, and literature. Based on research, it can be summed up: 1) the status of the child of surrogate mother in Ali Akbar and Husein Yusuf’s view is viewed as an illegitimate child and is condemned as a adultery child in Islam; 2) the law of child’ living of surrogate mother according to mazhab Hanafi and Syafi’i was deemed unobligatory to the father because of failure of nasab, but in the maslahah mursalah theories if illegitimate child’s living was compulsory for the child’s welfare to adulthood.

Abstract

Abstract; There is in Kebondalem Village a tradition of Changing Kemul which is stiil being carried out by the people in the area there until now. The tradition of changing kemul is one of the traditions which is carried out after or at the thusandth day of the person who died, which is intended for. The deceased in the tradition of changing kemul there are several rituals that are carried out, namely in the form of offerings and sanding, and there are several other requirements. Therefore, the researcher will describe how the tradition of changing kemul is practiced in Kebondalem village? And how is ‘urfs review of the tradition of changing kemul? In order to provide additional insight regarding the legal basis as a reason for the survival of a tradition, which is not only due to following what is already in effect in society. In this study, the researcher used a gualitative descrptive research type which had primary and secondary data sources, with the existence of techniques in extracting data by way of direct and indirect interviews, as well as documentation. The results of this study revealed to the researcher that, regarding the practice of the chang kemul tradition in Kebondalem village, it belongs to the urf al-Am group in terms of urf al-Khas, in terms of its validity it belongs to the type of urf which is Sahih. Because in the sense that urf, which belongs to the tradition of changing kemul, does not conflict with texts or hadiths, and also does not bring harm to the people of that area.

Abstract

The existence of the pre-marital marriage guidance process is very important for the formation of the samawa family, the purpose of marriage and the importance of the perspective of maslahah mursalah in the marriage and the realization of a harmonious, peaceful and prosperous society both materially and spiritually, so that the problem formulation in this thesis is: 1 ) How is the implementation of Marriage Guidance for prospective brides at KUA, Balerejo District, Madiun Regency? 2) What is the perspective of maslahah mursalah on the implementation of Marriage Guidance for prospective brides at KUA Balerejo District, Madiun Regency? This study used a descriptive qualitative approach, with the type of research being case study research, located at the Office of Religious Affairs, Balerejo District, Madiun Regency. The data used were obtained from interviews, observation and documentation using qualitative data analysis techniques and checking the validity of the data obtained. Based on the results of the research, it was concluded that: 1) the implementation of marriage guidance for prospective brides of marriageable age is divided into 2 types, namely indirect guidance and face-to-face guidance (regular) conducted for 6 hours of lessons for 1 day with a minimum number of participants 10 pairs of prospective brides. 2) From the maslahah mursalah perspective on implementation From the maslahah mursalah perspective on the implementation of Marriage Guidance for prospective brides and grooms at KUA Balerejo District, Madiun Regency, in terms of law in Indonesia and according to the Shari'a and its continuity is relevant and in accordance with the rules and laws in our country.

Abstract

Hit and run can also be interpreted as consumers who have questions about goods or have ordered goods nd promised to pay at a predetermined time,but at maturity they still do not pay and eventually disappear without confirmation, some block sellers from being billed for payment. In general, this can cause losses that vary depending on the type of business sector and the product or service offered and the system used. So, entrepreneurs must prepare tactics to overcome, or prevent such customers. The motives underlying hit and run actions by customers cannot be ascertained clearly. However, business actors can only provide analysis or evaluate things that happened and the reasons a person took such actions. Ordering goods online with a pre order system at the Madina Moslem Wear store is done using the Instagram and Whatsapp applications by filing in the format specified by seller, such as filling in the name of the customers who ordered, ordered goods, whatsapp number and instagram account name. Then the seller gives the option to the customers to place an order for goods and a make a payment in advance or may also make a payment when the goods are available but with conditions not hit and run.
