Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap Pejabat Lelang dalam kedudukan dan fungsinya. Penulis menganalisis suatu pelaksanaan lelang yang berujung pada penetapan tersangka, penangkapan, dan penahanan serta disidangkan dalam perkara pidana terhadap Pejabat Lelang Sdr. UAM sebagaimana tercantum dalam perkara pidana pada Pengadilan Negeri Denpasar Nomor 15/Pid.B/2016/Pn.Dps jo Kasasi Mahkamah Agung Nomor 1250K/Pid/2016. Disamping menganalisis perkara pidana dimaksud, penulis juga melakukan kajian terhadap bentuk perlindungan hukum terhadap Pejabat Lelang dalam kedudukan dan fungsinya dan faktor-faktor yang mempengaruhi.

Abstract

Sah atau tidaknya alat bukti yang digunakan sesuai dengan bahan Analisa yang didapatkan alat bukti surat yang dimaksud dalam dakwaan adalah alat bukti yang tidak sah menurut undang-undang. Rekapan hasil audit internal yang dilakukan oleh salah satu bagian dari perusahan tidak dapat dipertanggungjawabkan keabsahannya. Dalam teori relatif atau teori tujuan Negara menjatuhkan hukuman kepada penjahat sebagai alat untuk mencapai tujuannya, tujuan dari hukuman yaitu menakut-nakuti seseorang dari melaksanakan perbuatan jahat. Dari apa yang dikemukakan dalam teori tentang pemidanaan maka tidak akan terpenuhi tujuan hukum dalam perkara ini. Sebab apa yang perlu ditakut-takuti terhadap terdakwa. Terdakwa tidak merasa melakukan perbuatan yang dituduhkan.

Abstract

Illegal levies on Ternate High School 2 occur because of the active role of the Ternate High School 2 schools and the length of the process of disbursing School Operational Assistance (BOS) funds from the central government to regions for unexpected expenditure needs and funds that are not unexpected included in the BOS funds budget. This illegal levies case has been followed up at the investigation stage after a closed case process was carried out by the North Maluku Regional Police Special Criminal Investigation Investigator and from the results of the title it was concluded that the criminal element had been fulfilled by allegedly violating Article 12 letter (e) of the Law Number 20 of 2001 jo. Law Number 31 of 1999 concerning Eradication of Corruption. In addition, illegal levies have become individual behavior and have become a system of providing services to the community, as if these illegal levies have become prevalent.

Abstract

Penelitian ini bertujuan Untuk mengetahui prosedural pemberian remisi terhadap anak pidana di lembaga pembinaan khusus anak kelas II Ternate. Untuk mengetahui kendala-kendala yang dapat mempengaruhi pemberian remisi terhadap anak pidana di lembaga pembinaan khusus anak kelas II Ternate. Penelitian ini dilakukan di Wilayah Hukum Lembaga Pembinaan Anak Kelas II Ternate. Tipe Penelitian yang digunakan adalah tipe hukum empiris atau penelitian lapangan yaitu suatu penelitian yang dilakukan dilapangan atau di lokasi penelitian, suatu tempat yang dipilih sebagai lokasi untuk menyelidiki gejala objektif sebagai terjadi di lokasi tersebut, yang dilakukan juga untuk menyusun laporan ilmiah sedangkan teknis analisis data yaitu menggunkana metode pendekatan Kualitatif deskriptif analisis yaitu data yang dinyatakan oleh responden secara tertulis atau lisan serta juga tingkah laku yang nyata, yang diteliti dan dipelajari sebagai suatu yang utuh. Hasil penelitian dapat dilihat bahwa Secara keseluruhan LPKA Ternate telah melaksanakan proses pemberian remisi kepada anak pidana dengan baik atau sesuai dengan undang-undang yang berlaku namun ada Kendala-kendala yang dihadapi oleh Lembaga Pembinaan Khusus Anak Ternate yang mempengaruhi pelaksanaan pemberian remisi yaitu 1). Sarana prasarana atau fasilitas, yaitu jaringan internet yang tidak stabil di LPKA yang berpengaruh pada pengiriman berkas persyaratan pemberian remisi kepada anak. 2). Perilaku anak pidana dalam menjalankan proses pembinaan di LPKA Ternate yang mana tidak mematuhi aturan-aturan yang ada, dan melakukan pelanggaran-pelanggaran dalam proses pembinaan sehingga tidak mendapatkan remisi.

Abstract

The recovery of state financial losses from corruption remains a central challenge in Indonesia's anti-corruption framework. Despite the availability of various recovery mechanisms, questions persist regarding their effectiveness and conformity wth the principle of proportionality and national legal policy.   This study examines the application of proportionality in state loss recovery policies and formulates a future-oriented legal policy to enhance recovery effectiveness.   Employing a normative legal research method, this study applies Robert Alexy's proportionality test, suitability, necessity, and proportionality in the strict sense to assess criminal restitution, post-conviction asset confiscation, and administrative and civil forfeiture mechanisms.   The findings reveal that Indonesia's current recovery framework is fragmented and predominantly reliant on repressive, criminal-based approaches, resulting in limited asset recovery.   The novelty of this study lies in its proportionality-based formulation of civil forfeiture as an integrated administrative recovery model that prevents asset dissipation while safeguarding due process and property rights.   This study argues that proportionality does not weaken anti-corruption efforts, but rather provides a normative foundation for designing recovery policies that are effective, balanced, and capable of delivering measurable public benefits.

Abstract

This study explores the legal and moral dimensions of conjugal visits within Indonesia’s criminal justice system by examining their position under national law and the potential influence of Islamic morality on correctional policy. It highlights the existing gap between constitutional guarantees of human rights—specifically the right to family life and the satisfaction of biological needs—and the absence of explicit legal provisions allowing conjugal visits for prisoners. Employing a normative legal methodology, this research utilizes legislative, conceptual, comparative, and philosophical approaches, drawing upon sources such as the 1945 Constitution, Correctional Law, Criminal Code, international human rights instruments, and Islamic jurisprudence. The findings indicate that conjugal visits may be recognized as a conditional right aligned with humanitarian principles and rehabilitation objectives, provided that implementation follows strict ethical and procedural safeguards consistent with Islamic teachings that confine sexual relations to lawful marriage. Thus, the regulation of conjugal visits remains possible if framed as a limited privilege integrating human rights with Islamic moral principles. The study’s novelty lies in proposing a reconciliatory policy model that merges socio-psychological, juridical, and human rights perspectives, offering a framework for humane, religiously compliant, and socially appropriate correctional reform in Indonesia.

Abstract

The rise of fraudulent practices that end up in criminal acts and cause material losses to victims, for example the First Travel and Abu Tours cases in Indonesia, which have captured massive public attention, has shifted the orientation of punishment in criminal law, especially in property crimes from Lex Talionis towards Restitutio ad Integrum which emphasises restoration to the original state. This paper will analyse how the responsibility of the state and how the restorative justice approach in addressing the problem of fraud in Indonesia. The research method uses a normative legal research model with secondary data as analytical material. The results show that restitution and compensation instruments are an option in restoring victims of property crime. Restitution is the responsibility of the perpetrator to restore the victim, while compensation is the responsibility of the state as part of the state's role in realising the welfare of the people. Restorative justice as a means of resolving property crimes, especially fraud, offers an alternative that is oriented towards effective legal remedies to provide adequate legal protection for victims, although in practice there are still some fundamental changes.

Abstract

The implementation of criminal provisions for Road operators which resulted in accidents in South Halmahera District is not effective because until now there has been no complaints / reports and demands from the community to the South Halmahera Resort Police related to traffic accidents due to damaged roads. This is because the public does not understand the existing rules (criminal provisions in Article 273 of Law Number 22 Year 2009) due to lack of socialization and legal counseling to the public. Community ignorance of existing rules (criminal provisions in Article 273 of Law Number 22 Year 2009) and the non-proactive role of the police in following up on traffic accidents experienced by the community due to damaged roads and lack of socialization and legal counseling by the government to Public.

Abstract

Human longing for justice is essentially a longing for happiness, so efforts to fulfill various rights as witnesses of victims of theft crimes in Makassar City as a place of research have been conducted since 2017,2018 and 2019, actually show that the handling is carried out by the Police and the Prosecutor's Office especially in the victim's items found in the Police as well as the number of victim's items returned at the Prosecutor's Office, must be an important concern, but in fact, that victims of theft crimes are not like that .. This can be reflected in decisions by judges based on in the data in the last three years above, which convicted the perpetrators with imprisonment but none of the perpetrators were convicted to pay compensation to the victims. If the judge has the courage to make legal breakthroughs by punishing the perpetrator to pay compensation in the amount of the loss suffered by the victim, then, to be able to implement the legal objectives of justice related to the fulfillment of the victim's witness rights to personal property in a theft crime case can be realized

Abstract

Motorcycle riders in southern Halmahera Regency have not complied and obeyed the provisions of Article 293 paragraph (2) of the LLAJ Law concerning the obligation of motorcycle riders to turn on their lights during the day. This happened because in facing the disobedience of the driver, the South Halmahera Sat Lantas Police had not taken repressive measures such as giving a TOSS statement but the action taken was still limited to preventive action. The preventive measure is to disseminate information about the obligation to turn on lights during the day by motorcyclists. In addition, community ignorance and the low level of community discipline. Then the weak sanctions imposed by law enforcement.
