Abstract

Lembaga keuangan syariah merupakan komponen utama dalam penyelenggaraan sistem keuangan berbasis syariah. Keberadaannya kini telah diakui dalam kancah perekonomian dunia. Dalam konteks tersebut, lembaga keuangan syariah dihadapkan pada pasar atau perdagangan bebas yang menuntut adanya persaingan secara bebas dan minimnya hambatan tarif dan non tarif. Salah satu kekhasan pasar bebas adalah ekspektasi tinggi terhadap kualitas produk barang dan jasa serta bonafiditas lembaga-lembaga keuangan yang terlibat di dalamnya. Penelitian ini merupakan penelitian normatif-empiris terhadap peluang dan tantangan lembaga keuangan syariah dalam menghadapi pasar bebas. Hasil penelitian menunjukkan bahwa keberadaan lembaga keuangan syariah telah diakui secara internasional. Pasar bebas merupakan peluang bagi lembaga keuangan syariah dikarenakan probabilitas bagi meningkatnya pangsa pasar sangat terbuka. Namun demikian, pasar bebas juga menghadirkan tantangan tersendiri karena lembaga keuangan syariah dituntut untuk memiliki sumber daya yang profesional serta kelengkapan sarana dan prasarana pendukung. Untuk hal itu, diperlukan tindakan antisipatif agar lembaga keuangan syariah dapat bertahan di tengah era pasar bebas.Sharia financial institute was the core unit to implementatesharia economic system. It’s existence is well-recognized in the world economic dynamics. Towards free trade (free market), the institute of sharia financial should deal with the concept of free trade that insists free competition and minimizing the barrier of tariff and non-tarrif. One of the most preticular aspect of free market was the ultimate expectation of goods and services quality, besides the bonafidity of the parties in the market. The research was picking up normative-empirical method and is aiming to analyze the position and threats that should be dealt by sharia financial institution in free market era. The research found that it is well-recognized by the international economic communities.Freemarket is the main stage and opportunities for sharia financial institution to raise its market-share. Nevertheless, free market, simultaneously, presences a huge challenge for sharia financial institution in providing highly-qualified human resources and comprehensive infrastructure. Hence, it’s been urgently required some strategical and effective mission by the stakeholder to make sure that sharia financial institution could be exist for longtime period in dealing with free market.

Abstract

Kewenangan Peradilan Agama banyak bersentuhan langsung dengan kepentingan perempuan dan anak, terutama dalam perkara perceraian dan pengasuhan anak. Peradilan Agama berwenang mengadili sengketa di bidang hukum keluarga dan hukum ekonomi Syariah. Perkara-perkara yang termasuk dalam hukum keluarga seperti perceraian, gugatan nafkah, hak asuh anak, nafkah anak, dan perkara-perkara yang merupakan akibat perceraian, banyak bersentuhan dengan hak-hak perempuan dan anak. Dalam penegakan hukum terkait hak-hak perempuan dan anak, Mahkamah Agung telah mengesahkan Peraturan Mahkamah Agung Nomor 3 Tahun 2017 yang menekankan lembaga peradilan lebih memerhatikan aspek perlindungan hak-hak perempuan dan anak dalam memutus perkara. Penelitian ini merupakan penelitian normatif, dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach).  Hasil penelitian menunjukkan bahwa Peradilan Agama, dalam hal ini telah mengambil peran dalam melindungi hak perempuan dan anak melalui beberapa regulasi dan putusan perkara. Peradilan Agama berupaya memaksimalkan pelaksanaan putusan dengan mengimplementasikan kaidah-kaidah hukum yang responsif sebagaimana dikehendaki dalam Peraturan Mahkamah Agung Nomor 3 Tahun 2017 sehingga putusan tersebut dapat dieksekusi dengan baik. Selain itu, perlu adanya sinergitas lintas instansi agar upaya melindungi hak-hak kaum perempuan dan anak dapat terwujud secara lebih signifikan.The authority of Indonesia’s Religious Court has direct relation to women and children interest, especially in divorce and childcare cases. Religious court has the authority in adjudicating cases of family law and Islamic economy law. Divorce, livelihood, child custody, child allowances, and cases related to the direct consequences of divorce have significant matter to the women and children rights. In case of enforcing law that concern to the protection of women and children rights, Indonesia Supreme Court has enacted Peraturan Mahkamah Agung Nomor 3 Tahun 2017 that insist judicial institution to emphasize the protection of those rights in adjudication processes. The Religious Courts have taken a role in protecting the rights of women and children through several regulations and case decisions. This research is a normative study, using a statute approach and a conceptual approach. The results of the study indicate that the Religious Courts has a shot to implement comprehensively legal norms in Perma Nomor 3 Tahun 2017 as of the court decision more executable. Moreover, it is an urgent demand to hold an inter-institutions cooperation to raise the effectiveness of securing women and children rights.

Abstract

Indonesia is the second highest country in ASEAN in the prevalence of underage marriage after Cambodia and ranks 7th highest in the world for the absolute number of child brides. The tangent point of child marriage with the Religious Court enters through the case of marriage dispensation. As the authority of the Religious Courts, marriage dispensation is very dilemmatic and debatable because simultaneously the case is biased in value, between benefit, harmness, and community behavior. In sociology, society always changes and the difference is only in the nature or level of change. One of the fundamental aspects of the reflection of the Religious Court decisions that put forward efforts to prevent child marriages is to narrow the space for filing child marriage cases, examine the case more carefully by adding to the burden of proof, and the commitment of the parties to respond to the negative consequences of child marriages.

Abstract

Marriage dispensation is an application for a marriage permit made by the parents or family of a prospective husband or wife who is not yet 19 years old to enter into a marriage at the Religious Court. This paper briefly describes the justice of marriage dispensation and the children's best interests. The main topics discussed in this paper are the marriage laws and marriage dispensations according to the Law, the best interests of the child explained according to the Law, and to compromise between marriage dispensation and the child's best interests. The method used in this research is normative research by examining legal norms in legislation and decisions of the Constitutional Court. The content of this paper reveals that despite being deemed as contradictory to the Law as per the ruling of the Constitutional Court No. 22/PUU-XV/2017 dated 13 December 2018, which sets the minimum age for marriage according to Article 7 paragraph (1), child marriages facilitated by marriage dispensations persist in Indonesia. Furthermore, not every petition for marriage dispensation receives approval from the judicial panel. The decision on dispensation requests hinges on a thorough evaluation of the merits of the application and the potential impact on the child's future well-being, prioritizing the child's best interests.

Abstract

This paper explores the intricate process of interconnecting Sharia law with the legal systems of Europe, with a focus on the theoretical perspectives presented by Robert Alexy and H.L.A. Hart. It delves into the complexity and challenges associated with this integration and identifies key points of contention and opportunities. Notable challenges include overcoming the negative perceptions of Sharia law within Western legal circles, recognizing the diverse interpretations of Sharia, and harmonizing capitalist and Shariacompliant economic principles. The paper emphasizes the significance of interconnecting Sharia law with European legal systems, particularly within the realm of economic law, where concepts of justice, ethics, and Sharia's intricate provisions come into play. Using the theoretical frameworks of Alexy and Hart, the paper operationalizes the variables of "cause" and "effect" through comparative analysis to facilitate an effective and fair interconnection. It concludes by highlighting the importance of embracing an approach that balances the relevant aspects while minimizing legal uncertainties. In achieving this balance, the paper suggests strategies such as defining clear Sharia arbitration rules and ensuring the coexistence of Islamic banking practices with public interests. The evolving interaction between the two legal systems driven by the growing relevance of Islamic law necessitates a diverse legal landscape with various implications for Europe's everevolving legal framework.

Abstract

This study aims to gain a deep understanding of whether the issue of debts in the scope of sharia economics has been well accommodated in bankruptcy and debt settlement through the Commercial Court based on the Bankruptcy Law. This is normative legal research through literature study and case study, and it is enriched with interviews with sources at the Supreme Court. The results show that there has been an overlap in the court's competency to adjudicate based on applicable laws and regulations. There is no synchronization between the court's competency based on the Bankruptcy Law and based on the Religious Courts Law, especially regarding the settlement of debts within the scope of sharia economics. In the case study on the Commercial Court's decisions, it is known that its final settlements were made without sufficient consideration of sharia economics compliance principles. The Supreme Court, as the holder of judicial power, has attempted to fill the legal vacuum with its policies to synchronize so that the judicial process can run smoothly. Another solution to resolve the overlapping judicial competency arising from the Bankruptcy Law and the Religious Courts Law is to file a judicial review with the Constitutional Court, even though dilemmatic. The remaining issue is that the settlement of debt within the scope of sharia economics is still decided in the Commercial Court, not the Religious Court. The ultimate solution is to propose an amendment to the Bankruptcy Law to accommodate settlements within the scope of sharia economics.

Abstract

This study examines the practice of mu'athoh buying and selling at the Najma Mart Mini Market in East Lombok from the perspective of Islamic economic law. The background of this research is based on the phenomenon of transactions without verbal consent, but rather through direct actions such as the delivery of goods and payment. This practice is common in modern markets, but continues to generate debate regarding its legal validity in Islamic transactions. The purpose of this study is to analyze the implementation of mu'athoh buying and selling at Najma Mart, understand the underlying 'urf (community customs), and assess its compliance with the principles of Islamic economic law. The research uses a qualitative method with a case study approach, through observation, interviews with managers and customers, and document review. The results of the discussion indicate that the practice of mu'athoh buying and selling at Najma Mart has become a 'urf sahih' (authentic) accepted by the community. Transactions using a self-service system and payment at the cashier are considered valid by the majority of contemporary Islamic jurisprudence scholars, as long as the elements of object clarity are met and there are no elements of gharar or fraud. These findings confirm that Islamic law is flexible and contextual, able to adapt to modern economic developments without abandoning the values ​​of justice and transparency. Consequently, an understanding of muamalah law needs to consider social changes to remain relevant in contemporary economic practices.

Abstract

Penelitian ini membahas Analisis Kebijakan Pemerintahan Desa dalam Pemberdayaan Ekonomi Lokal Perspektif Hukum Ekonomi Syariah di Desa Sumber Mulya, Kabupaten Merauke, yang dilatarbelakangi oleh pentingnya peran desa dalam meningkatkan kesejahteraan masyarakat melalui pengelolaan potensi lokal berbasis otonomi desa sesuai UU No. 6 Tahun 2014. Penelitian ini bertujuan untuk mengevaluasi efektivitas kebijakan desa dalam pemberdayaan ekonomi masyarakat, sekaligus menilai kesesuaiannya dengan prinsip hukum ekonomi syariah. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan wawancara mendalam kepada pemangku kepentingan, observasi, dan studi dokumentasi kebijakan desa. Hasil pembahasan menunjukkan bahwa kebijakan desa telah diarahkan untuk memberdayakan masyarakat melalui musyawarah desa, pendampingan BRGM, penguatan kapasitas SDM, pengembangan UMKM, dan optimalisasi potensi sumber daya alam, sehingga meningkatkan pendapatan, membuka lapangan kerja, dan mendorong kemandirian ekonomi masyarakat. Penerapan prinsip hukum ekonomi syariah sebagian besar tercermin pada keadilan (al-‘adalah), amanah (al-amanah), kebolehan bertransaksi, dan kemudahan (al-taisir), namun prinsip Ilahiyah belum optimal karena masih terdapat praktik simpan pinjam berbasis bunga. Temuan ini mengimplikasikan perlunya peningkatan literasi syariah bagi aparat desa, pelatihan kapasitas berkelanjutan bagi masyarakat, penguatan evaluasi kebijakan, serta kolaborasi multi-pihak agar pemberdayaan ekonomi lokal dapat berjalan berkelanjutan dan sepenuhnya sesuai prinsip hukum ekonomi syariah.

Abstract

Perusahaan yang melakukan kegiatan sebagai lembaga keuangan bukanbank harus memperoleh izin dari OJK (Otoritas Jasa Keuangan) berdasarkanPasal 55 ayat (1) UU OJK. Ketentuan perlindungan konsumen dalam PeraturanOtoritas Jasa Keuangan dimulai dengan kewajiban-kewajiban pelaku usaha jasakeuangan, fasilitasi pengaduan konsumen dan pemberian fasilitas penyelesaianpengaduan oleh Otoritas Jasa Keuangan, pengendalian internal, pengawasanperlindungan konsumen jasa keuangan, dan sanksi. Otoritas Jasa Keuanganmemang secara khusus telah memberikan layanan penyelesaian aduan sengketakonsumen lembaga jasa keuangan melalui Peraturan Otoritas Jasa Keuangan No.1/POJK.07/2013 tentang Perlindungan Konsumen Sektor Jasa Keuangan.Namun, dengan adanya Peraturan Otoritas Jasa Keuangan No. 1/POJK.07/2014tentang Lembaga Alternatif Penyelesaian Sengketa di Sektor Jasa Keuangan,maka peran Otoritas Jasa Keuangan yang dulunya dapat memberikan fasilitaspenyelesaian pengaduan konsumen kini bertindak menetapkan peraturan,melakukan pengawasan, dan penindakan terhadap pelaku usaha sektor jasakeuangan yang melanggar ketentuan Peraturan Otoritas Jasa Keuangan tersebut.Perlindungan hukum bagi konsumen diperlukan demi mewujudkan kepastiandan jaminan hukum dengan tujuan untuk melindungi masyarakat yang dalam halini merupakan konsumen yang ditanggung saat melaksanakan kegiatanberinvestasi, misalnya resiko terjadinya kejahatan pasar modal. Kejahatan pasarmodal atau capital market crime merupakan pelanggaran hukum yang adahubungannya dengan pasar modal baik pelanggaran peraturan perundangundangan di bidang pasar modal itu sendiri, maupun pelanggaran peraturanperundangundangan di luar bidang pasar modal tetapi perbuatan. Kata Kunci: Perlindungan Hukum, OJK, Perlindungan Konsumen  Companies that carry out activities as non-bank financial institutionsmust obtain permission from the OJK (Financial Services Authority) based onArticle 55 paragraph (1) of the OJK Law. However, with the FinancialServices Authority Regulation No. 1/POJK.07/2014 concerning AlternativeDispute Resolution Institutions in the Financial Services Sector, the role of theFinancial Services Authority, which used to be able to provide facilities forresolving consumer complaints, is now acting to establish regulations,supervise, and crack down on financial service sector business actors whoviolate the provisions of the Financial Services Authority Regulation. Legalprotection for consumers is needed in order to realize legal certainty andguarantees with the aim of protecting the public, which in this case is a consumerwho is covered when carrying out investment activities, for example the risk ofcapital market crimes. Capital market crime is a violation of the law that has todo with the capital market, both violations of laws and regulations in the capitalmarket itself, as well as violations of laws and regulations outside the capitalmarket but actions. Keywords: Legal Protection, OJK, Consumer Protection
