Abstract

Digital transformation fosters the massive utilization of Artificial Intelligence (AI) in creating literary, artistic, and musical works worldwide, including in Indonesia. The autonomous functioning of AI challenges the essential presumption that technology is merely a device in the hands of humans in the creation process of Works. This paper examines several legal issues and problems concerning the copyright-ability, authorship, and ownership of AI-generated works using a juridical normative approach. The result of the analysis shows that although the framework of Indonesia's copyright law is based on the principle of human authorship, the rapid development of AI must be balanced with an accommodating legal framework. In conclusion, the Indonesian government can open up the possibility of accepting AI's role in the creation of the work and formulate the limited artificial legal personhood of AI by granting exclusive rights, copyright protection, moral rights, and economic rights to individuals or groups of individuals who produce AI or whose contribution is required for AI function. This formulation is expected to encourage the utilization of AI also provide legal certainty and solve the problem concerning the lack of legal accountability for AI-generated works. In addition, the advancement of technical and legal support is needed in implementing this provisioning model.

Abstract

Technological advancements have catalyzed the emergence of the digital economy, where digital platforms, leveraging internet access, can penetrate multiple regions and accrue substantial profits unrestricted by national jurisdictions. This scenario presents advantages and convenience but simultaneously challenges a country's tax sovereignty. The traditional tax system, predicated on a company's physical presence for tax liability, finds itself ill-equipped to handle the digital domain's nuances. This research seeks to explore the potential and hurdles in implementing digital taxes in Indonesia, delving into the government's regulatory efforts within the framework of Society 5.0. From an academic standpoint, digital taxes illustrate the disruption in tax collection due to the absence of a tangible company presence. Thus, this study also aims to investigate the determination of tax sovereignty in the context of digital taxation, aspiring to enrich scholarly discourse. Employing a normative juridical approach, this study scrutinizes legal norms and rules while considering empirical facts from the field. The findings indicate that while the introduction of digital taxes in Indonesia holds significant promise and faces considerable challenges, governmental action to update and streamline digital tax regulations is imperative. Furthermore, the principles underlying digital tax proposals, such as Pillar One, require reinforcement to enhance their effective implementation.DOI: https://doi.org/10.22304/pjih.v11n1.a7

Abstract

Based on the Presidential Regulation on Electronic Government, the Srikandi application (Integrated Records Information System) is part of the General Application for government administration services applied nationally. After three years of implementation, in 2023 the application of Srikandi in Government Institutions (Central and Regional) is not yet optimal. Despite the target that by 2023, all Central Institutions will have implemented Srikandi, and by 2024, all Governments will have implemented Srikandi. The Srikandi application is subject to several regulations, one of which is Law Number 43 of 2009 concerning Archives that has previously regulated matters related to the electronic archival field. Some norms in the Presidential Regulation on SPBE are not harmonious with Law Number 43 of 2009 concerning Archives, especially regarding the substance of archive management, the authority of the National Archives of Indonesia, and the mandate for Srikandi application users. The research method used is Normative Juridical. The research analysis places norms, principles, and legal principles as a study, especially regarding SPBE regulations in the archival services field. The research results show that the mandate of Presidential Regulation Number 95 of 2018 regarding the Electronic Government is not in line with Law Number 43 of 2009 concerning Archives. This is related to norms that regulate the substance of archive management, the authority of archival management, and the users of the Srikandi application. Thus, this creates uncertainty in the implementation of the Srikandi application as a general SPBE application.

Abstract

Nuisance messages, a form of unsolicited communication, often occurs between drivers and users of online transportation application services. The transmission of such messages represent a violation of privacy, infringing upon users' autonomy to control the information they receive and potentially causing both psychological and physical harm. Despite the fact, Indonesian law lacks explicit normative regulations addressing nuisance messages. Facing this condition, online transportation application services must must ensure user safety by providing a mechanism for users to object and avoid receiving such messages. This study aims to address two primary questions. Firstly, what forms of legal protection are currently available against nuisance messages under Indonesian positive law? Secondly, how can online transportation application service providers implement the right to object in order to optimize the protection of user privacy and personal data? This study employed a juridical-normative method with descriptive analysis to address the questions. The results indicate that Indonesian positive law can only refer to whether messages are sent in good faith and whether spam messages are sent in bulk. These can cause misinterpretation for providers and users. However, nuisance messages sent during the provision of a service demonstrate bad faith on the part of the driver. Therefore, to protect users, online transportation application services should implement a right to object through an electronic contract, thereby granting users greater control and balance.
