Abstract

Regulations in Indonesia country must be fulfilled and adhered to, all the provisions in the form of prohibition, injunction and the sanctions that are in the environment of Indonesian society are legal countries. This research aims to analyze the discourse of class action lawsuit practices in Indonesian with comparing civil law system. The research also intended to illuminate the development civil law system practices in the context of class action practices. The research is doctrinal research with normative legal research. The research compared some legal theories concerning to class actions lawsuit in civil law system. The research highlighted and emphasized that the actions and deeds are led to occur harmonious society without touching the rights of others. In civil law issues include problems between individuals and groups and from group to group and individual to individual, who violated the rights and obligations as a result of an agreement. Expanding the law does not rule out a new legal innovation that can make a person who made a report the other party violated his rights in the absence of a prior agreement to do. The research concluded that the class action suit or action lawsuit is a legal order that is embraced by the common law system, but countries that use civil law systems like Indonesia participate adopt this legal order.

Abstract

AbstractDigital breakthroughs in addressing societal concerns as a solution and sovereignty for the security of virtual asset owners underlie the idea of forming a Central Bank Digital Currency or CBDC. Using a normative juridical method based on literature research, complemented by deductive thinking analysis, as well as a descriptive method with supporting data from primary and secondary sources. The aim is to examine the existence of circulating cryptocurrencies in the presence of CBDC. The result of this research is the need for technology infrastructure readiness and governance to establish a central bank capable of supervising the movement of virtual money in Indonesia, preventive actions related to legal protection are necessary to ensure justice, security, and civility in the nation. However, conflicts arise from Article 2 of Law No. 7 of 2011, Article 34 letter a of Regulation No. 18/40/PBI/2018, Article 62 of Regulation No. 20/6/PBI/2018, and POJK 13 of 2018 refer to the prohibition of using other types of currency as a medium of exchange. In the end, CBDC is positioned to monitor risks to financial stability, monetary stability, and the global financial system. AbstrakKetidakadaan otoritas yang bertanggung jawab, membuat cryptocurrency digunakan sebagai sarana kejahatan seperti pencucian uang, kejahatan siber, kejahatan ekonomi, dan lain sebagainya. Terobosan digital dalam menjawab keresahan di masyarakat sebagai solusi dan kedaulatan bagi keamanan pemilik uang virtual, mendasari gagasan pembentukan Central Bank Digital Currency atau CBDC. Dengan menggunakan metode yuridis normatif didasarkan penelitian kepustakaan, dilengkapi analisis pikir deduktif serta metode deskriptif dilengkapi data-data pendukung dari sumber primer dan sekunder. Bertujuan untuk melihat eksistensi mata uang kripto yang beredar dengan adanya CBDC. Hasil dari penelitian ini adalah dibutuhkan kesiapan infrastruktur teknologi dan tata kelola untuk membentuk bank sentral yang mampu mengawasi pergerakan uang virtual di Indonesia. Dianggap hanya sebagai barang komoditas, seiring dengan perkembangan zaman dan berkaca dari beberapa negara pendahulu yang memberikan ruang bagi penggunaan cryptocurrency, maka tindakan preventif terkait perlindungan hukum agar rasa keadilan, keamanan, dan keadaban tetap terjaga dalam berbangsa dan bernegara. Namun, pertentangan dari Pasal 2 UU No. 7 Tahun 2011, Pasal 34 huruf a PBI 18/40/PBI/2018, Pasal 62 PBI 20/6/PBI/2018, dan POJK 13 Tahun 2018 merujuk pada larangan penggunaan jenis mata uang lain untuk dijadikan sebagai alat tukar. Pada akhirnya, CBDC diposisikan untuk memantau risiko terhadap stabilitas keuangan, stabilitas moneter, dan sistem keuangan global.

Abstract

Prinsip atau asas kelestarian dan keberlanjutan (sustainable development) merupakan prinsip yang lahir sebagai respon atas kerusakan lingkungan hidup. Prinsip pengelolaan lingkungan menjadi dasar dalam upaya pelestarian fungsi lingkungan yang berupa kebijakan, pengaturan, pemeliharaan, pengendalian dan tentu saja pengelolaan lingkungan. Pembangunan dijadikan sebagai salah satu cara untuk pemenuhan kebutuhan hidup manusia, perlu daya dukung lingkungan hidup yang optimal. Implementasi prinsip dan asas sustainable development telah mengalami perkembangan yang sedemikian kompleks, dimana lingkungan hanya sekedar dipandang untuk memenuhi kebutuhan hidup, sehingga kerusakan lingkungan menjadi pertaruhan. Tulisan ini akan membahas konsepsi dari asas kelestarian dan keberlanjutan serta pembangunan keberlanjutan dalam pengelolaan lingkungan hidup dengan menggunakan nilai-nilai Pancasila sebagai dasar acuannya. Hal ini karena pengelolaan lingkungan diperlukan untuk menciptakan pembangunan yang berkelanjutan yang tentu saja dengan perspektif lingkungan. Penerapan nilai-nilai Pancasila dalam pengelolaan lingkungan hidup untuk menjamin lingkungan yang lebih baik dan berguna sesuai yang diharapkan dalam tujuan pengaturan pengelolaan lingkungan hidup.

Abstract

Sexual violence against children in Central Java shows the highest percentage among other types of violence at 46.6%, while sexual violence against women is at 14.7%. This high incidence of violence is an important concern, especially in Semarang Regency, which is ranked third in Central Java. Sexual violence is vulnerable in public places, such as tourist attractions. Although cases of sexual violence that occur in Lerep Tourism Village have not yet surfaced, preventive efforts to prevent sexual violence against women and children need to be intensified. The solution offered through this community service proposal is the implementation of psychoeducation for youth organizations in Lerep Village related to sexual violence. This program is in line with the 8th mission of Lerep Village in efforts to provide services, protection, and social empowerment for vulnerable groups, the poor, the elderly, orphans / orphans, people with disabilities and pregnant women. Therefore, psychoeducation on sexual violence and types of sexual violence, knowledge about healthy relationships and handling sexual violence both legally and psychologically was prepared. This psychoeducation also aims to equip teenagers in Lerep Village who are engaged as agents of change in an effort to prevent sexual violence and handle it if it occurs in the Lerep tourist village.

Abstract

The rise of vigilantism in Indonesia, marked by public violence against alleged criminals that sometimes results in fatalities, reflects a significant misunderstanding of justice and a lack of specific legislation on vigilante actions. This behavior, akin to torture under Indonesian law, is fueled by public distrust in law enforcement. Research employing both the historical and current Criminal Codes, alongside a sociological analysis, highlights the government's crucial role in legally shaping societal behavior. Discussions on vigilantism involve examining its nature, the legal protections and assistance available, and shaping a societal view that considers both perpetrators and victims. These conversations aim to uphold human rights within the Pancasila ideology, striving for public order and justice that require collective understanding and effort. Addressing vigilantism effectively necessitates both preventive measures to discourage such actions and repressive responses to penalize offenders, ensuring that societal actions align with justice and human rights objectives.

Abstract

The purpose of this paper is to examine the challenges of enforcing the international legal framework on child soldiering. The paper reveals that, as the offense of child soldiering escalates, the multi-dimensional scope for protecting child soldiers spans various legal regimes under international law. It argues that, despite several prohibitive norms established in International Humanitarian Law (IHL), International Human Rights Law (IHRL), the International Labour Organization (ILO), and International Criminal Law (ICL), their application or enforcement against child soldiering remains ineffective and inadequate due to numerous impediments and challenges. This is because "law on paper," like a baby in the womb, must align with "law in action" to achieve adequate effectiveness. The methodology employed is doctrinal research. Major gaps were identified, and the paper provides comprehensive recommendations to enhance the enforcement of global treaties against child soldiering. The paper concludes with recommendations to address the technical and legal complexities associated with child soldiering.

Abstract

This study examines the legal recognition of electronic notarial acts in Indonesia and the regulatory inconsistencies among the Notary Law, the Electronic Information and Transactions (ITE) Law, and the Indonesian Civil Code. These inconsistencies prevent notaries from issuing authentic electronic deeds, weaken the evidentiary value of digital documents, and create legal uncertainty in electronic transactions. Using a normative juridical method with statutory, conceptual, and comparative approaches, the study analyzes Indonesia’s framework and compares it with Rwanda’s system, which expressly recognizes electronic notarial acts under Law No. 031/2016 through an integrated digital identity platform. The findings show that the physical presence requirement in the Notary Law and the exclusion of notarial deeds from electronic documents under the ITE Law are the main obstacles to electronic authentic deeds in Indonesia. The novelty of this research lies in its use of Rwanda’s regulatory model as a normative and comparative foundation for reconstructing Indonesia’s Cyber Notary framework. This study proposes revising the Notary Law and establishing a unified national digital notarial platform to strengthen the authenticity, integrity, and legal certainty of electronic deeds within Indonesia’s evolving digital legal landscape.
