Abstract

One form of protection given to teachers in performing their professional duties is legal protection. This legal protection includes legal protection against acts of violence, threats, discriminatory treatment, intimidation or unfair treatment of learners, parents of learners, society, bureaucracy or other parties. One of the educational problems faced by schools in general is the violence of teachers towards students who still often occur in the school environment.

Abstract

AbstractIn this study the objectives to be achieved are to find out the transfer of inheritance in Indonesia and to find out whether approval is needed by the heirs in the transfer of inheritance. This research uses a normative juridical method, namely by reviewing the provisions regarding legal certainty regarding the procedure for transfer of inheritance assets carried out by one of the heirs without the approval of the other heirs. The procedure for transfer of inheritance in Indonesia is by transferring the inheritance wherein the distribution of inheritance is an act of the heirs. Distribution is usually done by consensus or on a joint will and can be carried out voluntarily and harmony between the heirs. The heirs must know their respective rights according to law and if there is a transfer, there must be approval of the heirs. Transfer of inheritance must be carried out immediately after the testator dies, it should not be postponed unless there are certain circumstances that are not possible. This mainly avoids the possession of inheritance which will eventually lead to a dispute between the parties. Pembagian biasanya dilakukan dengan permufakatan atau atas kehendak bersama dan dapat dilaksanakan dengan sukarela dan kerukunan antara para ahli waris.Para ahali waris harus mengetahui haknya masing-masing menurut hukum dan jika ada pengalihan maka harus ada persetujuan ahli waris. Pengalihan harta warisan harus segera dilaksanakan setelah pewaris meninggal, tidak boleh ditunda-tunda kecuali jika ada keadaan tertentu yang tidak memungkinkan. Hal ini terutama menghindari adanya penguasaan harta warisan yang akhirnya akan terjadi sengketa di antara para pihak. Sehingga dalam hal ini masyarakat harus membekali diri dengan pengetahuan tentang waris, sehingga mengerti atas hak dan kewajiban masing-masing ahli waris, namun musyawarah disarankan sebagai salah satu jalan keluar yang lebih baik, tanpa proses pengadilan agar tidak terputusnya silaturahmi antar keluarga.Kata kunci: ahli waris; harta warisan; pengalihan

Abstract

The purpose of this study is to determine the legality principle according to positive criminal law in Indonesia and Islamic criminal law and to find out the comparison between the legality principle according to positive criminal law and Islamic criminal law. This type of research used in this research is using library research or known as literature research. The principle of legality in Indonesia's positive criminal law is a very fundamental principle. Because the principle of legality in criminal law is important to determine whether a criminal law regulation can be treated against a criminal act that occurs. In Islamic criminal law, the legality principle has a great influence on the judge's power, because the judge's power is very broad compared to the judge in positive law where the judge does not have sufficient power to act against the crime maker in accordance with the public interest. Comparison of the principle of legality between Islamic law and positive law. Whereas the application of the legality principle to positive criminal law and Islamic criminal law has similarities and differences. The similarity is that both apply the principle of legality in the legal process while the difference is that positive criminal law is the same in its application to offenses, whereas in Islamic criminal law there is a distinction between Jarimah qishas diyat, hudud, which is applied strongly, while in Jarimah ta'zir it is relaxed so that the benefit of society is fulfilled. In addition to having the similarities and differences above, the legality principle also has advantages and disadvantages, among others, in Islamic law the criminal provisions cannot be changed (added / reduced) because it is a provision from Allah which is standard, while in positive law the criminal provisions may change at any time. according to the times.

Abstract

In the Juvenile Criminal Justice System, the Child Special Guidance Institution (LPKA) is a forum for children to carry out their criminal period. As the next generation, children have an important position so they must get protection and guarantees for their rights. In this article, the author limits the discussion of the role of LPKA in providing guidance to children in conflict with the law. The sociological juridical research method is used with the aim of obtaining empirical legal knowledge obtained directly from the object. The implementation of special guidance for children in conflict with the law is guided by Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The role of LPKA is to provide guidance and supervision to children in carrying out their criminal sanctions. The results of research and discussion obtained at the Gorontalo City Children's Special Guidance Institute, children receive guidance and education. Coaching activities are carried out to shape the personality in the form of developing the potential of children according to the needs and conditions of children, while educational/school activities cooperate with the relevant education office. Children in conflict with the law can become good individuals and can face the future brilliantly.

Abstract

The problem of alcohol abuse in various circles, both in society and among teenagers, has become a problem that continues to experience a very significant increase and tends to increase every year. When teenagers or people have the habit of consuming liquor, it can lead to crime, in various forms that vary greatly, for example juvenile delinquency, fights, the emergence of juvenile gangs, thuggery, immoral acts and others. Juridically there is no prohibition of liquor or alcoholic beverages, but only on the regulation of procurement, distribution, sale and control. The existing laws and regulations in Indonesia have not been able to fully accommodate to be able to control the circulation of alcoholic beverages because some of the regulations that have been spread have not been specifically and comprehensively able to suppress the circulation and even prevent alcoholic beverages in the community. As a result, regulations at the lowest level (regional regulations) can only carry out prevention locally at the provincial level which has regional regulations concerning the Control and Supervision of alcoholic beverages, such as Gorontalo Provincial Regulation No. 16 of 2015. The Gorontalo Provincial Government considers it very important that the control and supervision of the circulation of alcoholic beverages must be carried out in order to prevent disturbances to peace, order and public security.

Abstract

Free promiscuity has now become one of the behaviors that is very concerning. One of the negative impacts caused by adolescent behavior is pregnancy outside of marriage. Community service carried out by students as a form of implementation of the Tri Dharma of Higher Education carried out by the University of Gorontalo in the form of Community Service Lectures (KKP) which aims to contribute ideas and knowledge to students and students of Posiga High School and Milangodaa Village, Kec. Tomini Kab. South Bolaang Mongondow, North Sulawesi Province. The results showed that by holding socialization of the dangers of promiscuity students and students could realize and correct wrong behavior and find out other impacts that arise due to promiscuity.

Abstract

Procurement of goods and services through electronics (e-procurement) is a system that can be applied because it is more transparent, effective and efficient when compared to the conventional system of procurement of goods and services (face to face). In this article the author limits the study of the effectiveness of the application of law to the procurement of goods/services by the government which is carried out through conventional and electronic methods. In this paper, using a normative juridical method, namely analyzing the enactment of the rule of law and then describing it systematically. The current legislation regarding the procurement of goods and services through electronics can be said to be ineffective because the legal regulations have not specifically regulated this matter, both in substance and in technical implementation. So it is necessary to immediately establish a law that regulates the procurement of goods and services through electronics (e-Procurement). This regulation will be the basis for implementing e-Procurement, given the increasingly complex problems in the procurement of goods and services, these regulations continue to be adjusted and changes and improvements are made, both in terms of substance and technical supporting regulations.

Abstract

The implementation of discretion by the police seems to be against the law, but it is a way out that is indeed given by law to the police in order to provide efficiency and effectiveness for the greater public interest, furthermore discretion should not be eliminated. Discretion cannot be removed and should not be eliminated. Discretion is an integral part of the role of the institution or organization. However, discretion can be limited and controlled, for example by tightening written orders and the existence of programmed decisions that are at least able to formulate and demand discretionary action. The problem is, unprogrammed decisions often appear and open the door wide for discretionary making. That the mechanism for applying police discretion to traffic crimes committed by children at the Police investigation level is that the traffic police visited the scene of the case and then sketched the scene of the case, helped victims, recorded witnesses, secured evidence of accidents such as vehicles, driver's licenses, and STNK, for a further investigation process, After that an investigation is carried out by the police to make a case analysis and discretion is carried out if the accident that occurs is minor and the perpetrator is a child who causes a minor accident and a single accident that can be resolved with material compensation, then an agreement is made between the two parties for solving traffic accident cases.
