Abstract

In an effort to create fulfillment of rights and special protection for children, the Convention On The Right Of The Child aims to encourage international cooperation among countries that have ratified the Convention On The Right Of The Child to improve a decent life for children, especially in developing countries. -developing countries and provide full protection for children to avoid crimes that can endanger their lives such as commercial sexual exploitation. The type of research used in this study is normative legal research, which is a type of legal research to find a rule of law, legal principles, or legal doctrines to answer the legal issues at hand. This research will describe to what extent the written positive laws are synchronous or in harmony with each other. Article 34 of the convention on the right of the child is the basis of international law regarding commercial sexual exploitation, in which it emphasizes that participating countries must strive to be able to provide protection to children, so as to avoid all forms of sexual exploitation, Indonesia as a country that has ratified the convention on the right of the child has attempted to develop national legal instruments to provide protection for children to avoid the dangers of sexual violence, but legal instruments have not been able to accommodate the dangers of commercial sexual exploitation of children, because there is still a lack of definition and cannot explain forms of commercial sexual exploitation in instruments existing laws.

Abstract

Undang-undang Nomor 28 Tahun 2009 Tentang Pajak Daerah dan Retribusi Daerah (PDRD) saat ini telah dicabut melalui Undang-Undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan Anatara Pemerintah Pusat dan Pemerintahan Daerah. Undang-undang Nomor 1 Tahun 2022 diberlakukan dalam rangka mengalokasikan sumber daya nasional secara lebih efisien. Pemerintah memberikan kewenangan kepada Daerah untuk memungut Pajak dan Retribusi dengan penguatan melalui restrukturisasi jenis Pajak, pemberian sumber-sumber perpajakan Daerah yang abru, penyederhanaan jenis Retribusi, dan Harmonisasi dengan Undang-Undang Nomor 1 Tahun 2022 Tentang Cipta Kerja.Jenis Penelitian yang digunakan adalah penelitian Yuridis Sosiologis, yaitu studi empiris untuk menemukan teori-teori mengenai proses terjadinya proses bekerjanya hukum dalam masyarakat. Adapun Teknik pengumpulan data meliputi: Wawancara, dan studi kepustakaan. Di dalam Undang-undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan antara Pemerintah Pusat dan Pemerintahan Daerah, diberlakukan dalam rangka mengalokasikan sumber daya nasional secara efisien, pemerintah memberikan kewenangan kepada daerah untuk memungut pajak dan retribusi  perpajakan daerah yang baru. Namun dalam penyederhanaan ini terdapat sumber retribusi yang dihilangkan dan mengakibatkan berkurangnya Pendapatan Asli Daerah.Dari hasil penelitian dapat disimpulkan bahwa, Presiden dan Dewan Perwakilan Rakyat Republik Indonesia harus melkukan evaluasi dan perubahan terhadap Undang-undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan Antara Pemerintahan Pusat dan Pemerintahan Derah dalam semangan pemberian otonomi Daerah sesuai denga napa yang dibunyikan dalam Pasal 18 Ayat (5) Unddang-undang Dasar Tahun 1945 yang menyatakan “Pemerintah Daerah menjalankan Otonomi seluas-luasnya, kecuali urusan Pemerintahan yang oleh Unddang-undang ditentukan sebagai urusan Pemerintah Pusat”.

Abstract

The establishment of Law Number 1 of 2022 concerning Financial RelationsBetween the Central Government and Regional Governments as a result of the Law hasnot been able to provide a significant leap in improvement to the equitable distributionof public services and public welfare, and has not been optimally aligned andsynergistic in the APBD and APBN, so that national fiscal policy has not workedsignificantly in realizing state goals. The purpose of this study is to explain the legalpolitics of the establishment of Law Number 1 of 2022 concerning Financial RelationsBetween the Central Government and Regional Government in the Perspective ofRegional Autonomy.This research is a normative legal research with a focus on legal principles. Toanswer this research, the author uses qualitative analysis with literature study techniqueson primary legal materials in the form of laws and regulations, secondary legal materialsin the form of legal scientific research results, legal science books, and academicmanuscripts of Law Number 1 of 2022, as well as tertiary legal materials in the form oflarge online Indonesian dictionaries.This study examines and analyzes the urgency in the formation of Law Number1 of 2022 which repeals Law Number 33 of 2004 and Law Number 28 of 2009. Therepeal of the two laws resulted from the need to improve the implementation offinancial relations between the central government and local governments. It isrecommended that the President and the House of Representatives are expected toimmediately ratify and promulgate laws and regulations related to the generalprovisions of the HKPD Law, procedures for collecting taxes and regional levies,procedures for collecting Opsen, tax revenues directed at their use, types of additionalregional levies, and procedures for determining tax rates and levies so that the HKPDLaw can be fully implemented.Keywords: Legal Politics, Fiscal Decentralization, Regional Autonomy

Abstract

In the implementation of regional autonomy that uses the principle of decentralization,in fact it does not apply optimally. For example, the state budget provided by the centralgovernment with the aim of increasing the level of economy and welfare for the people ineach region. This is based on the provisions of Law 33 of 2004 concerning FinancialBalance between the Central Government and Regional Governments. Where in this caseit is stated that the regional government is obliged to deposit regional wealth that has beenobtained to the central government even from the results of natural wealth owned by thearea. Especially in the reality on the ground that the independence of each region to getthe word prosperous is very far from what was expected.It is the unclear format of regional autonomy that makes the central governmentimplement an excessive centralized system (overcentralization). Excessive centralizationhas destroyed the government system created by the New Order, the destruction of the NewOrder government through the reform movement has confirmed the intention of theIndonesian people to create a just and prosperous nation. Regional natural resources areexploited by the center and given unfairly and not transparently, regional privileges areundervalued and even generalized by the Central Government. The reform movement,which brought fresh air of democracy, has inspired some people to create an Indonesianstate structure within the framework of Federalism, this is in view of the emergence of thethreat of disintegration that has occurred as a result of the centralized system of unitarystate government and the many demands of regional governments for independence, suchas Papua, and others.This research will examine the main issues according to the scope and identificationof problems through a normative juridical approach. Based on normative researchmethods, the data sources used in this study are secondary data sources which consist of 3legal materials, namely: primary legal materials, secondary legal materials, and tertiarylegal materials. Abstract

Based on PERMA No. 1 of 2019 concerning Electronic Administration of Casesand Trials in Courts in Article 1 Number 7 states that electronic trials are a series ofprocesses of examining and adjudicating cases by courts carried out with the support ofinformation and communication technology. In this case, the community expects benefitsin implementing or enforcing the law. Because law is for humans, the implementation oflaw or law enforcement must provide benefits or uses for society. The implementation ofE-Court in the Court must provide benefits and convenience in its use, so that the publiccan feel the convenience of public services provided by the Court using this E-Court. Thepurpose of this research is to find out the extent of public service at the StateAdministrative Court in Pekanbaru.The type of research used is sociological legal research. As for the population inthis study are the Chairperson of the Pekanbaru State Administrative Court, the Registrarof the Pekanbaru State Administrative Court, the Pekanbaru State Administrative CourtJudge; Parties Seeking Justice. The research location is at the Pekanbaru City StateAdministrative Court. Data collection techniques using interviews, and literature, withqualitative data analysis.However, the implementation of E-Court still has several drawbacks. First, everyjustice seeker must be able to use existing E-court applications and these electronicdevices must be connected to the internet such as laptops, computers and smartphones.Second, when the application in court itself is disrupted, such as when the application isbeing maintained or the internet or power failure. So electronic registration of cases orE-court cannot be carried out. Third, at the time of the trial, only those registered withthe account who can see the E-court application can see the account at the court, that is,at the time of registration, the one who can see the trial program, if that party forgets theaccount, the trial program cannot be seen by other people.Keywords: State Administrative Court – E-Court -Public Service

Abstract

The Village, has several community institutions, one of them is theVillage-Owned Enterprise (VOE). Based on Article 3 of the Regional Regulationof Indragiri Hulu Regency Number 5 of 2011 concerning Village-OwnedEnterprises, VOE is formed with the aim of gaining profit to strengthen theOriginal Village Revenue; Advancing village economy; Increase the villagecommunity welfare; and improve the management of existing village assets, suchas village treasury land management. From this objective, it can be seen thatVOE functions as an engine of the village economy and the welfare of the villagecommunity.This type of research is empirical juridical research or sociological legalresearch which is a research approach that emphasizes legal aspects related tothe subject matter to be discussed, associated with reality on the ground. Theresearch was conducted in VOE in the West Rengat sub district of Indragiri HuluRegency, while the sample population is all parties related to the problem understudy. The data sources used are primary data and secondary data, the datacollection techniques in this research are by observation, questionnaire,interview, and literature review.From the results of this research, there are three main things that can beconcluded: First, the implementation of the establishment of village-ownedbusiness entities in 6 (six) villages in the western Rengat sub-district of IndragiriHulu Regency has been carried out which have been poured into VillageRegulations but are problematic in the process of formation. Second, theobstacles in establishing a village-owned business entity include the low quality ofhuman resources (HR), which results in the inoperability of the basic duties andfunctions of the village head, the village apparatus not being empowered, lack ofcoordination with related parties and village deliberation, lack of publication ofVillage Regulations on VOE, and the absence of Village Regulations on thecapital participation of VOE. Third, the efforts going forward carried out by thevillage government related to the legality of VOE are to allocate a budget forhuman resource quality improvement programs, revise the Village Regulationsabout the establishment of VOE, conduct village deliberations, coordinate withrelated parties, and empower the potential of the village.Keywords: Establishment – Village – Owned Enterprises – West Rengat

Abstract

This research aims to describe the implementation of health services at thePanipahan Health Center, Pasir Limau Kapas District, Rokan Hilir Regency andto determine the implementation of Good Governance at the Panipahan HealthCenter, Pasir Limau Kapas District, Rokan Hilir Regency. This research isempirical or sociological legal research. The research location is in thePanipahan District, Pasir Limau Kapas District, Rokan Hilir Regency, namely thePanipahan Community Health Center. Based on research conducted, the resultsshow that health services at the Panipahan Community Health Center are carriedout based on Regional Government and Central Government Regulations andPolicies. The implementation of health services at the Community Health Centerconsists of services from the Individual Health Unit and the Community HealthUnit. The programs at the Community Health Center are KIA, Nutrition, HealthPromotion, Environmental Health and other programs. The flow of healthservices and service standards at the Panipahan Community Health Center havebeen adjusted to the services provided to the community to improve the level ofpublic health. Supporting factors in the implementation of health services at thePanipahan Community Health Center consist of organization, policy andmanagement. Meanwhile, the inhibiting factors are the implementation of healthservices at the Panipahan Community Health Center, namely human resources,infrastructure and funds/budget. The efforts made by the Rokan downstreamdistrict health service to improve services at the Panipahan Community HealthCenter are recruiting human resources and competency training for existinghuman resources, prioritizing development of facilities and infrastructure as wellas appropriate budget allocation.Keywords: Panipahan Community Health Center, Public Services, HealthServices.

Abstract

The Village Consultative Body functions to establish village regulations together with the village head, accommodate and channel community aspirations. Based on these problems, the author is interested in knowing the existence of the Village Consultative Body (BPD) of Sukaramai Village, Kampar Regency and the inhibiting and supporting factors of the Village Consultative Body (BPD) of Sukaramai Village, Kampar Regency in carrying out its duties and authority. The research method in this thesis uses a type of sociological legal research, namely research on the effectiveness of law in society. The nature of this thesis research is researchdescriptivewhich systematically describes the facts and characteristics of the object being studied accurately. The data collection technique in this research is the interview method and literature review, then after the data is collected it is then analyzed to draw conclusions. Based on the research results, it can be understood that the existence of the Village Consultative Body (BPD) in Village government has existed since the enactment of the Regional Government Law under the Law on Villages which is in effect to date. Together with the Village Head, the BPD carries out government functions as a partner of the Village Government in supervising the running of the Village Government. In reality, the existence of many Village Consultative Bodies themselves have not carried out their roles and functions. Based on the research results, it shows that the Village Consultative Body (BPD) of Sukaramai Village in carrying out its functions of establishing village regulations, monitoring and accommodating community aspirations has not been optimal in its implementation due to a lack of understanding by BPD members of their duties and functions based on applicable regulations. The factors that influence the existence of the Sukaramai Village Deliberative Body are the first, the Inhibiting Factors, namely Facilities, Not understanding its function, the Community not understanding the function of the BPD and the Community, secondly the Supporting Factors, namely the Collaborative Relationship with the village government, the BPD member selection system and Income/Incentives. The efforts made by the Sukaramai BPD in carrying out its duties and functions include efforts from parties outside the BPD, namely those carried out by the Kampar Regency Government and efforts made by the Sukaramai Village BPD.

Abstract

Hak Asasi Manusia adalah hak dasar manusia, yang ada dan merupakan karunia Tuhan Yang Maha Kuasa, Hak Asasi Manusia merupakan hak natural oleh karena itu hak asasi manusia tidak dapat dicabut oleh manusia lain sesama makhluk hidup. Didalam Hak Asasi Manusia juga terdapat Hak Anak. Anak juga termasuk kedalam tunas, potensi, dan generasi muda penerus cita-cita bangsa, memiliki peran dan strategis dan mempunyai ciri serta sifat khusus yang menjamin kelangsungsan eksitensi bangsa dan negara masa depan. Perlindungan hukum terhadap anak merupakan tolak ukur peradaban bangsa karena wajib diusahakan sesuai dengan Nusa dan Bangsa. Perlindungan Anak yaitu untuk menjamin dan melindungi Anak dan hak-haknya agar dapat hidup, tumbuh, berkembang, dan berpatisipasi secara optimal sesuai dengan harkat dan martabat kemanusiaan serta mendapat perlindungan dari kekerasan dan diskriminasi. Jenis Penelitian ini adalah penelitian Sosiologis. Tujuan dilakukannya penelitian ini adalah untuk mengetahui perlindungan hak anak sebagai peserta didik di lingkungan sekolah dalam prespektif peraturan per Undang-Undangan dan konsep perlindungan hak anak sebagai peserta didik di dalam hal atribut dari sisi peraturan Per Undang-Undangan. Penelitian ini dilakukan langsung di salah satu sekolah yang berada di Kota Padang, Sumatera Barat, guna mendapatkan gambaran dan informasi yang lengkap dan jelas tentang masalah yang diteliti. Penelitian tersebut di lakukan di sekolah SMKN 2 Kota Padang. Guna untuk mendapatkan Infotmasi yang jelas tentang adanya anak di sekolah tersebut di suruh untuk memakai jilbab, sedangkan anak tersebut beragama Non-Muslim maka dari itu peneliti melakukan dengan mengajukan beberapa pertanyaan (wawancara). Berdasarkan dari hasil penelitian tersebut didapatkan kesimpulan bahwasannya benar adanya di panggil murid tersebut agar memakai jilbab di sekolah karena dominan di sekolah banyak nya anak yang tidak memakai jilbab. Tetapi anak tersebut tidak mau karena anak tersebut bukan kewajibannya untuk memakai jilbab di karenakan itu tidak sesuai keyakinan anak tersebut.
