Abstract

Bangsa Indonesia merupakan bangsa yang majemuk karena terdiri atas berbagai suku bangsa, adat istiadat, bahasa daerah, serta agama yang berbedabeda. Keanekaragaman terdapat di berbagai wilayah yang tersebar dari Sabang sampai Merauke. Indonesia adalah negara yang melahirkan beragam suku bangsa dan dari suku-suku itulah yang membuat adanya ciri khas atau keunikan dari setiap suku yang berada di Indonesia. Bugis adalah salah satu etnik besar di Sulawesi Selatan. Kebudayaan Bugis-Makassar adalah kebudayaan dari suku bangsa Bugis Makassar yang mendiami jazirah selatan pulau Sulawesi. Suku Bugis sebagai salah satu suku terbesar di Sulawesi Selatan memiliki nilai kebudayaan tersendiri. Ada tiga wujud kebudayaan, yaitu sistem budaya, sistem sosial dan hasil nyata budaya yang satu sama lain berhubungan secara timbal balik dan saling berhubungan dengan struktur kebudayaan. Struktur kebudayaan yang dimaksud antara lain adalah sistem politik yang mengatur hubungan antara anggota masyarakat terutama yang barkaitan dengan pembagian tugas dan penyelenggaraan kekuasaan. Kekuasaan kerajaan yang dianut oleh bangsa Bugis zaman dulu adalah berbentuk monarchi atau kerajaan Kata Kunci : Hukum Adat, Suku Bugis

Abstract

The availability of medicines is an essential part of fulfilling patients' rights to safe, quality, and sustainable healthcare services, especially for National Health Insurance (JKN) or BPJS Kesehatan participants. However, in practice, drug shortages still occur, directly impacting patients. This study analyzes the impact of drug shortages at Karawang Regency Hospital on fulfilling the rights of BPJS Kesehatan patients and the role of local governments in addressing them. Using a normative juridical method supported by interviews and literature studies, the results show that drug shortages result in delayed therapy, worsening patient health conditions, and the incurring of additional costs because patients must purchase medicines independently. This condition contradicts the provisions of Presidential Regulation Number 82 of 2018 and Presidential Regulation Number 59 of 2024 and has the potential to violate the cooperation agreement between BPJS Kesehatan and hospitals. Therefore, strengthening the management of drug planning, procurement, and control by local governments is necessary to ensure the protection of patient rights and compliance with BPJS Kesehatan regulations.

Abstract

The dynamics of the wedding service industry are frequently confronted with various external and internal operational disruptions that culminate in a failure of contractual performance (default). This study aims to critically analyze the juridical qualifications of technical transportation constraints invoked as a force majeure defense in wedding service disputes, while concurrently evaluating the institutionalization of consumers' immaterial restitution rights pursuant to Article 19 of Law Number 8 of 1999 on Consumer Protection. Employing a normative juridical research method with statutory and case approaches, the findings demonstrate that internal operational friction, such as logistics fleet failures, strictly fails to satisfy the legal parameters of force majeure. Since such exigencies are inherently foreseeable, they must be mitigated through sound corporate risk management, thereby leaving the vendor fully liable for all subsequent damages. Given the non-repeatable nature of wedding ceremonies, performance failures inflict severe, irreversible immaterial injuries upon consumers, characteristically manifesting as enduring psychological trauma and the degradation of social dignity before the public. This study concludes that the current remediation framework suffers from a distinct legal gap, as informal, out-of-court settlements routinely marginalize moral and psychic losses. Consequently, a progressive legal interpretation alongside a standardized valuation mechanism for immaterial damages based on the principle of fairness (redelijkheid) is profoundly imperative to guarantee legal certainty and robust consumer protection.

Abstract

Workplace accidents are a serious problem in the manufacturing industry, impacting workers' physical, psychological, and legal aspects. This study aims to analyze legal protection efforts for workers who are victims of work accidents based on Law Number 13 of 2003 concerning Manpower, which regulates workers' rights to Occupational Safety and Health. The method used is empirical juridical with a qualitative approach, with data collection techniques through interviews, observations, and documentation studies. In practice, PT.A in Karawang has implemented various forms of legal protection, like the provision of personal protection equipment, occupational safety training, compensation, and participation in the employment social security program. The investigation's conclusions show that the level of implementation is still not optimal, approximately 60% of the implementation of safety procedures is effective, while the rest still face obstacles such as low worker compliance, administrative obstacles, and lack of supervision. In addition, approximately 40% of workers do not fully understand their legal rights related to work accidents. These findings indicate a discrepancy between industry practices and rules. Therefore, efforts are needed to increase supervision, worker education, and improve the administrative system to ensure that legal protection can run effectively and sustainably. Additionally, make sure the implementation of the rights of workers is running as well as in compliance with Law Number 13 of 2003 concerning Manpower, which governs Workers' Rights to Obtain K3 Protection.

Abstract

This study aims to juridically and normatively analyze the implementation of Complete Systematic Land Registration (PTSL) from the perspective of the principles of legal certainty and legal protection. PTSL is a strategic government program intended to accelerate land registration in order to provide legal guarantees for community land ownership rights. However, in its implementation, various problems are still encountered, one of which is the potential for land certificates issued through PTSL to become objects of land disputes.This study employs a juridical research method using statutory and conceptual approaches. The data used consist of primary, secondary, and tertiary legal materials analyzed qualitatively. The results of the study indicate that the legal regulations concerning PTSL already have a strong and hierarchical normative foundation, ranging from the 1945 Constitution of the Republic of Indonesia, Law Number 5 of 1960 concerning the Basic Agrarian Law (UUPA), Government Regulation Number 24 of 1997, to the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency Number 6 of 2018.Nevertheless, in practice there are still several weaknesses, including disharmony of legal norms, less-than-optimal verification of physical and juridical data, and limited legal protection for the community. In addition, certificates issued through PTSL still have the potential to become objects of land disputes due to the negative publication system adopted in Indonesia’s land registration system, which does not provide absolute legal certainty. Other influencing factors include overlapping land ownership rights, data inconsistencies, and the public’s limited understanding of land law. Therefore, the implementation of PTSL has not yet been fully capable of optimally guaranteeing legal certainty and legal protection for the community.
