Abstract

Perwujudan hukum yang benar harus saling melengkapi dan tidak saling mengecualikan hakikat dari hukum terletak pada karakteristik dari hukumnya sebagai institusi yang menunjang dan melindungi nilai-nilai, hingga eksistensi hukum harus mampu memberikan perwujudan nilai-nilai menjadi kenyataan dan perwujudan tersebut teraplikasikan dalam proses bekerjanya hukum. Norma hukum yang mengatur dokter yaitu Undang-Undang No.29 tahun 2004 tentang Praktek Kedokteran memberikan suatu pendefinisian secara tegas mengenai standar profesi, yaitu batasan kemampuan (knowledge, sklill and profesional attitude) minimal yang harus dikuasai oleh seorang individu untuk dapat melakukan kegiatan profesionalnya pada masyarakat secara mandiri yang dibuat oleh organisasi profesi. Untuk itu, dalam menjalankan profesi dokter harus berdasarkan pada ketentuan norma tersebut sebab dokter dituntut pertanggungjawaban dalam menjalankan profesinya, bilamana terjadi hal-hal yang disebabkan oleh kelalaian dan kesalahannya dapat menimbulkan pertanggungjawaban hukum sehingga dituntut adanya proses hukum yang dapat berakibat administratif, perdata atau pidana, putusan pengadilan yang dapat menentukan hal ini. Putusan Mahkamah Agung Nomor 365 K/Pid 2012, salah satu bentuk pertanggungjawaban hukum yang harus dibebankan sebagai bentuk perwujudan dokter dalam menjalan profesinya, sekalipun pada akhirnya dengan putusan tersebut dapat berdampak pada kinerja dokter.

Abstract

Abstract

The State of the Republic of Indonesia is a legal state (rechstaat) where the principle of state law is to ensure the certainty, order and protection of the law aimed at obtaining the truth and not being a state based on power (machtstaat) or where power is subject to law. The development of the law in the life of the society requires legal certainty on the legal relationship of individuals and subjects of law. Law is one of the means that everybody needs to fill their lives, especially in the economic system that enters the era of globalization. The need is manifested in the form of clear legal products and has legal certainty and strict law enforcement action of law enforcement officials. The public's need for legal products as a written evidence tool in a courtesy proof resulted in every public lawsuit involving the parties to be included in a letter of law. If a particular article is made so as to be a means of proof, then the letter or article is called the act is a special writing made to be written evidence. The act as a written evidence tool in certain cases is a powerful evidence tool for parties bound thereto. It is clear that the authentic deed in society is a widespread public need in civil law as regulated by the KUHPerdata, especially on the need for written proof.

Abstract

Tanah dan bangunan adalah benda tidak bergerak (benda tetap) sehingga proses jual belinya berbeda dengan jual beli benda bergerak seperti kendaraan, televisi, dan lain-lain. Secara hukum, jual beli benda bergerak terjadi secara tunai dan seketika, yaitu selesai ketika pembeli membayar harganya dan penjual menyerahkan barangnya. Hal tersebut berbeda dengan jual beli tanah dan bangunan yang memerlukan akta otentik. Penelitian ini mengkaji tindakan hukum masyarakat awam yang menjadi polemik terkait jual beli tanah secara di bawah tangan. Penulis melakukan penelitian hukum normatif (normative law research) menggunakan studi kasus normatif berupa produk perilaku hukum. Teknik analisis yang digunakan adalah inventarisasi hukum positif, asas-asas dan doktrin hukum, penemuan hukum dalam perkara in concreto, sistematik hukum, taraf sinkronisasi, perbandingan hukum dan sejarah hukum. Kajian ini menyimpulkan bahwa praktik jual beli tanah secara di bawah tangan adalah sah dan mengikat secara hukum serta pembeli juga dapat untuk memproses peralihan hak/balik nama Sertifikat Hak Milik (SHM) dari penjual kepada pembeli.

Abstract

This article was written with the aim of knowing and analyzing the policies of the Majalengka Regency Government in providing assistance to people who are self-isolating due to being exposed to or confirmed positive for Covid-19, besides that this paper will also try to describe about how the mechanism for providing assistance as well as analyzing weaknesses and solutions to these problems.This paper is a normative juridical writing made with two main approaches, namely the empirical approach and the case approach.The results of the study indicate that the policy of providing assistance for people who are self-isolating in Majalengka Regency is given by providing cash assistance worth Rp. 45.000,00 (forty five thousand rupiah) with details of 3 (three) meals/improvement of nutrition per day multiplied by Rp. 15,000.00 (fifteen thousand rupiah), wherein the amount is given for 10 days of self-isolation period. If it is calculated as a whole, then the total compensation given to residents/communities who do self-isolation is Rp. 45.000,00 X 10 days, which is Rp. 450,000.00 per one citizen identified as positive for Covid-19. However, the facts on the ground show that there are still many community members who do not and do not know about the program, this is due to the existence of a mechanism for providing assistance that focuses on managing the residents, not the government, so it is necessary to reconstruct/change the distribution mechanism which emphasizes the importance of government activities. in the distribution of assistance to the people of Majalengka Regency who were confirmed positive for Covid-19.

Abstract

ABSTRAK Penelitian dilatarbelakangi adanya surat pernyataan di larang menikah bagi siswa-siswi Sekolah Menengah Pertama di kota Surakarta-Solo, kemudian di cabut kembali oleh pihak sekolah. Aturan sudah berlaku selama lima tahun, pencabutan dilatarbelakangi oleh keinginan dari orang tua murid. Faktanya tidak sedikit usia anak Sekolah Menengah Pertama saat sekarang sudah banyak yang menikah. Melalui metode penelitian hukum yang normatif mengkaji permasalahan berkenaan surat larangan menikah dan kemudian melihat alur kebijakan politik hukum yang melahirkan kebijakan terhadap batas usia perkawinan. Pembahasan memfokuskan pada politik hukum nasional tentang batas usia perkawinan untuk laki-laki dan perempuan dengan melihat fenomena di dunia Pendidikan. Dilihat dari usia minimal, kemudian seperti kegelisahan pemerintah melihat dunia pendidikan, lahirnya putusan Mahkamah Konstitusi disambut oleh lahirnya undang-undang untuk membatasi usia pernikahan menjadi sembilan belas tahun. Peraturan dalam bentuk undang-undang berkenaan dengan pembatasan usia minimal pernikahan pada dasarnya bukan merupakan undang-undang Apabila ada yang kelihatanya tidak setuju dengan aturan dilarang menikah di tingkatan Sekolah Menengah Pertama juga pada dasarnya memiliki tujuan yang sama yakni untuk mengantisipasi pernikahan dini. Kata kunci: kebijakan; perkawinan; politik hukum. ABSTRACT This research is based on the existence of a forbidden marriage for junior high school students in Surakarta-Solo City which was later withdrawn by the school. This rule has been in effect for five years, its repeal is motivated by the wishes of the parents of students. Facts in the field, many junior high school children are now married. Through the normative legal research method, it examines these problems and then looks at the flow of legal political policies that give rise to policies regarding the age limit of marriage. The discussion focused on legal policy that develops in society regarding the rules of marriage as seen from the minimum age, then like the government's anxiety in seeing the world of education, the birth of the Constitutional Court decision was greeted by the birth of a law to limit the age of marriage to nineteen years. Regulations in the form of laws regarding the minimum age limit for marriage are not laws that are coercive, pervasive as a form of anti-education and child protection in Indonesia. If someone seems to disagree with the prohibition rules for marriage at the junior high school level, they have the same goal, namely to anticipate early marriage. Abstract

This doctrinal research explained the practice of corporate crime modus. The primary data was interview result with Director General, who was share buyer, meanwhile, secondary data was company document that was related to the case, and it was analyzed qualitatively by hermeneutic interpretation techniques. Furthermore, research result showed that the impact of corporate crime law was the company must be liable in either criminal law or civil law although the managers of the company had changed.

Abstract

Penelitian ini bertujuan mengkaji karang taruna sebagai organisasi sosial berbasis kepemudaan yang memiliki peranan penting dalam mewujudkan tanggung jawab sosial pemuda di Desa Manis Kidul Jalaksana Kuningan. Seseorang bertanggung jawab secara hukum atas suatu perbuatan tertentu atau bahwa dia memikul tanggung jawab hukum, subyek berarti bahwa dia bertanggung jawab atas suatu sanksi dalam hal perbuatan yang bertentangan. Jenis penelitian yang digunakan adalah penelitian kualitatif, penelitian ini dilaksanakan di desa Manis Kidul Kecamatan Jalaksana Kabupaten Kuningan. Sumber data yang digunakan berupa data primer dan sekunder. Teknik pengumpulan data dengan wawancara, observasi dan dokumentasi. Hasil penelitian menunjukkan bahwa peran karang taruna dalam mewujudkan tanggung jawab sosial pemuda mengajak masyarakat aktif dalam keterlibatan program kerja yang berjalan atas dasar program kerja yang berlandaskan Peraturan Menteri Sosial N0 25 Tahun 2019 sehingga dapat mewujudkan Tanggung Jawab Sosial Pemuda terhadap peduli lingkungan masyarakatnya. Kata Kunci: Karang Taruna; Tunas Karya, Tanggung Jawab Sosial.

Abstract

In the context of regulation regional enforce, the first element as implementer in field is regional government. In this case the authority is given to the Civil Service Police Unit (Satpol PP). The civil service police unit has the job is help the Regional leader to create a peace and orderly, so that the administration of the wheels of government can run smoothly and people or society can do their activities safely. One of the objectives of Regional Regulations (PERDA) issued by regional governments (PEMDA) is to guarantee legal certainty, create and maintain public order and order. The Civil Service Police is a local government apparatus with the main jobs is enforce of regional regulations, organizing public order and public order. If connected with the performance of the civil service police Organizational of Cirebon district, so the evaluation performance is carried out based on the job that carried out. The purpose of this study is to describe how the performance of the civil service police of Cirebon district in the job of enforce the local regulation base on regional regulation in Cirebon district.
