Abstract

Undang-undang Narkotika nomor 35 tahun 2009 diundang pada tanggal 12 Oktober tahun 2009 oleh Presiden Dr. Susilo Bambang Yudoyono, diundangkan oleh Menkumham Andi Mattalata dicatat dalam Lembaran Negara Republik Indonesia tahun 2009 nomor 143, dan penjelasan atas undang-undang nomor 35 tahun 2009 ditempat pada Lembaran Negara Republik Indonesia nomor 5062 seluruh Warga Negara Indonesia Wajib mengetahuinya. Kepolisian Negara Republik Indonesia khususnya Daerah Jawa Barat sesuai dengan Peraturan Kepolisian Nomor 14 tahun 2018 tentang Susunan Organisasi Tata Kelola tingkat Poldaa dan Direktorat Reserse Narkotika yang dikepalai oleh seorang Deirektur, wakil Direktur, Bagian Pembinaan Operasional, Bagian Pengawasan Penyidikan dan Sub Direktorat mempunyai tugas dan wewenang melaksanakanpenyelidikan dan penyidikan tindak pidana penyalahgunaan Narkoba, termasuk penyuluhan,pembinaan, pencegahan dan rehabilitasi terhadap korban penyealahgunaan Narkoba. Kasus penyalahgunaan Narkoba dilakukan oleh anggota Polri dijawa Barat tiap tahun mengalami peningkatan baik sebagai Bandar, pengedar maupun sebagai pengguna yang dilakukan mulai dari pangkat Tamtama sampai pada tataran Perwira menengah dan pelakunya bukan saja anggota Polri Pria Polwan pun ada sebagai korban penyalahgunaan Narkoba. Para anggota Polri yang terjerat penyalahgunaan Narkoba sudah banyak yang diajukan ke peradilan umum dan sanksi Kode Etik Kepolisian dengan bermacam-macam hukuman baik menjalankan hukuman penjara maupun dipecat sebagai anggota Kepolisian. Internalisasi undang-undang nomor 35 tahun 2009 yang dilakukan oleh Direktorat Reserse Narkota sudah dilaksanakan sesuai dengan kewenangannya baik secara umum maupun secara khusus anggota Polri dan keluarganya (Bhayangkari), mulai dari tingkat Polda sampai dengan tingkat Polsek , namun karena kurangnya pemahaman dari undang–undang tersebut mengenai dampak dan akibat yang ditimbulakan serta lemahnya fondasi keimanan dari masing-masing anggota yang terjerat penyalahgunaan Narkoba sehingga tanda disadari sudah terperosok kedalam jerat narkoba yang susah dilepaskan. Peran keluarga sangatlah diperlukan untuk mendukung personil yang terjerat Narkoba dalam menyadarkan perilaku buruk yang terjerat penyalahgunaan Narkoba tapi yang terpenting adalah kesadaran, pemahaman terutama perundang-undangan yang mengaturnya, tentang akibat yang terjadi bukan saja menimpa dirinya sendiri juga keluarga rekan sekerja maupun atasan dari anggota Polri itu sendiri serta Institusi Polri sebagai alat Negara penegak Hukum. Kata kunci: Internalisasi, Polri, Narkoba.

Abstract

The Indonesian National Health Service (NHS) is part of Indonesia’s national social security system. Its implementation is full of problems, such as the rejection of patients, the NHS payment which is lower than the real health cost, sanctions, fines, etc. The Indonesian National Social Security System, especially the NHS services, was established by the state to give social protection to its citizens. The Black Swan Theory is based on the presumption that all swans are white, thus in this case, the Indonesian NHS is truly a program aimed to give social security in the health sector, just as the general conditions of social securities applied in other countries. This research studies this theory to explore the paradoxes which happen in the Indonesian NHS to find the black swan. In this case, the black swan is a paradoxical symbol regarding the regulations and the problems of the Indonesian NHS. This research uses the juridical-doctrinal or the normative method and is descriptive research with a qualitative approach. Based on the Black Swan theory, this research tries to find paradoxical, extreme, and unpredictable discrepancies in the Indonesian NHS. It is found that the Indonesian NHS is a black swan or unpredicted according to black swan theory. The objectives, practices, and regulations of this NHS are truly different from the NHS which is supposed to be given to the Indonesians. It transfers the government’s burden in establishing the health service and the rights of the citizens to the citizens, coupled with the threat of sanctions which is unknown in NHS. The applied Indonesian NHS has an extensive impact on hundreds of millions of Indonesian citizens.

Abstract

This legal study investigates the implications of the proposed renaming of West Java Province to Tatar Sunda Province, employing the approach of intuitive semantic dualism to address issues of language, territory, ethnicity, and national identity. The research draws on data from academic journals, books, media reports, and interviews, comparing secondary data with field opinions on the languages and bordering regions of the Sundanese dialect. The findings reveal that, although the Sundanese linguistic system was expected to play a crucial role in the renaming process and promote territorial unity, it falls short due to the inclusion of regions such as Banten, pre-independence Batavia, and bilingual border areas in the east and north. This geographic and linguistic complexity means that the name "Tatar Sunda" does not accurately reflect the distinct linguistic, cultural, and territorial identities of the Sundanese people as described by J. van Baal. Legally, while there are no barriers to the renaming policy, the proposed name fails to adequately represent the region's diverse identities. Consequently, the study recommends further exploration of more representative alternatives that align with the existing legal framework, ensuring that the name change is not only legally valid but also appropriately reflects the region's identity.

Abstract

Based on data obtained from the Cirebon City AIDS Commission (KPA), people living with HIV/AIDS (PLWHA) in Cirebon City until December 2022 amounted to 2,491 people. The number of PLWHA in Cirebon City from year to year the trend is increasing. One of the efforts to prevent and control STIs and HIV/AIDS among female sex workers is by empowering Peer Educators (PE). They are former sex workers who care about their friends by socializing the dangers of STIs and HIV/AIDS. In addition, PEs who already have life skills will share their experiences with female sex workers. The method used in this PKM is the participatory approach method. The PKM process is expected to be able to bring changes to the FSW group in Cirebon City.

Abstract

Numerous scholars have conducted interdisciplinary studies from theoretical and empirical viewpoints to tackle the complex corruption issue. Presenting opinions from other disciplines, this study provides a comprehensive and current analysis of the recent literature on corruption. More specifically, the writers clarified corruption by merging viewpoints from several fields, including criminology, psychology, and economics. Through an organized investigation of the origins and effects of corruption at the human, corporate, and societal levels, we may comprehend the elements that lead to corrupt behavior and its substantial influence.

Abstract

Background. The Sharia Savings and Loan Cooperative and Financing (KSPPS) as the Debtor in the Suspension of Debt Payment Obligations case Number 43/Pdt.Sus-PKPU/2020/PN Niaga Smg (PKPU 43/2020/Smg), submitted a peace proposal to the Creditors and was eventually approved by the Creditors, making it binding and must be fulfilled by the Debtor. Aim. This research examines the legal considerations of judges regarding the rights of KSPPS members as Creditors who file for annulment of the Homologation Agreement agreed upon by the Creditors and Debtor. Methods.This paper is the result of research using a normative juridical approach. Legal research based on the study of the Cancellation Decision of PKPU 1/2023/Smg, linked to legal norms and regulations. This research is descriptive-analytical in nature. Data analysis was conducted using qualitative analysis methods, related to the rejection of the annulment of the Peace Agreement/Homologation by the Assembly, with the consideration that the meeting of members could bankrupt the Cooperative. Result. KSPPS is considered to have failed to fulfill the contents of the Homologation, thus the Creditors have the right to file for the annulment of the Homologation through the commercial court proceedings mechanism and registered in the case register Number 1/Pdt.Sus-Pembatalan Perdamaian/2023/PN Niaga Smg ("PKPU No. 1/2023/Smg"). However, the annulment of the Homologation was rejected by the first-instance court and cassation because the Cooperative can only be declared bankrupt if approved by the Members' Meeting. Conclusion. The Supreme Court must be able to bridge the differences in interpretation by issuing guidelines for interpreting the provisions of Article 291 paragraph (2) of the K-PKPU Law, thereby achieving legal certainty. Implication. This research is useful as an example of overcoming the case of reconciliation of cooperative creditors and canceling agreements.

Abstract

This study aims to examine the legal review of Sundanese local wisdom, specifically the concept of Sandekala traditionally practiced by West Java community. The analysis evaluated the effect of government policies on the implementation of local wisdom values in the context of education, technology, and restrictions during the COVID-19 pandemic, with particular attention to the role in fostering environmental awareness post-pandemic. Moreover, this study examined how these policies complement or deviate from the legal principles underlying local wisdom and environmental sustainability. An analytical method was used to review legal journals and online discussions, investigating how shifts in the understanding and application of local wisdom values have occurred in response to government measures. Furthermore, there are also big myths about these values that cause problems for keeping local wisdom true and useful. The results showed the importance of matching government policies with local values, including Sandekala, as a form of customary law that remains relevant, and ensuring the continuity of inclusive cultural and legal practices while protecting the environment in the post-pandemic context. This study provides valuable insights into how policies can enhance local wisdom and ensure compliance with relevant legal frameworks. In conclusion, keeping local wisdom is not just culture but also part of sustainable and inclusive law in Indonesia. Local wisdom should be kept and studied using science and technology.
