Abstract

Issues of ocean health have become serious threats due to the possibility of damage and quality deflation in Indonesian oceans. From a national defense Fatohoint of view, issues of Indonesian ocean health can fall into national vulnerability and caution. This paper, furthermore, aims to describe and draw justification for the urgency of values and implementation of blue justice to counter ocean health. Normative legal research was applied by means of qualitative analysis of legislation and conceptual variables. According to the research, threats to ocean health could have negative impacts on marine ecosystems, leading to defects in national economic, socio-cultural, defensive, and security systems. In response to the threats to ocean health, littoral societies, thus far, took part in minimum roles, and their existence was unheeded. To tackle the current problem, blue justice is presented, paying attention not only to ecological sustainability in its practice but also to a strong emphasis on social justice that includes relevant parties involved in the management of oceans. It must include littoral societies and fishermen as their lives are strongly dependent on marine resources, which is already and clearly defined in the legislation. In the implementation of blue justice, governments need simultaneous strategies with systematical, integrated, and sustainable efforts, especially in the prevention of any threats to ocean health. Implementing blue justice properly can lead the nation to a blue economy and ensure that oceans are well-protected for the next generation.

Abstract

Otorita Ibu Kota Nusantara merupakan lembaga baru yang dibentuk berdasarkan Undang-Undang No. 3 Tahun 2022 sebagaimana telah diperbarui dengan Undang-Undang No. 21 Tahun 2023 tentang Ibu Kota Negara. Otorita Ibu Kota Nusantara dipimpin oleh Kepala Otorita yang dipilih, diangkat, dan diberhentikan oleh presiden atas persetujuan DPR serta Kepala Otorita dalam kelembagaan setara dengan Kementerian. Terdapat permasalahan lembaga Otorita Ibu Kota Nusantara yaitu Kepala Otorita yang dipilih dan diberhentikan langsung oleh Presiden tidak mencerminkan asas otonomi daerah, yang mana status Ibu Kota Nusantara sebagai daerah otonomi khusus. Dengan demikian, peneliti mengangkat permasalahan bertujuan untuk meneliti kedudukan serta kewenangan Kepala Otorita berdasarkan perspektif otonomi daerah dan menjelaskan desain ideal kelembagaan Otorita Ibu Kota Nusantara perspektif otonomi daerah. Sehingga, metode penelitian yang digunakan yaitu metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konseptual. Hasil penelitian yang ditemukan adalah penyelenggaraan pemerintahan daerah di Ibu Kota Nusantara tidak mencerminkan otonomi daerah sebagaimana amanat konstitusi. Selanjutnya, desain kelembagaan Otorita Ibu Kota Nusantara tidak melibatkan Dewan Perwakilan Rakyat Daerah (DPRD) sebagai salah satu unsur dari otonomi daerah. Dengan demikian, perlunya kejelasan kedudukan Kepala Otorita dalam menyelenggarakan pemerintahan di Ibu Kota Nusantara dan perlunya asas desentralisasi dalam penyelenggaraan pemerintahan, karena berimplikasi dalam kewenangannya. Lebih lanjut, otonomi daerah sebagai desain yang ideal dalam penyusunan kelembagaan Ibu Kota Nusantara mengingat status dari Ibu Kota Nusantara yaitu otonomi khusus sebagaimana amanat UUD NRI 1945.

Abstract

This study aims to examine the following problems: First, how does the dissenting opinion influence the 2024 General Election Results Dispute decision on the Legitimacy of the Elected President-Vice President? Second, What are the implications of the dissenting opinion on the 2024 General Election Results Dispute decision on the legitimacy of the President-Vice President's office? This study uses a normative legal research method with a statutory regulatory approach and a conceptual approach. The analysis technique is descriptive qualitative, interpretative, and heuristic. The study of this research is the Dissenting Opinion by three Constitutional Court Judges in Decision Number 1/PHPU.PRES-XXII/2024 and Number 2/PHPU.PRES-XXII/2024. The results of the study indicate the influence of dissenting opinion on the legitimacy of the elected President and Vice President, for a good democratic society, a desired national ideal. In addition, interpreting the dissenting opinion regarding the General Election Results Dispute (Pemilu) as a reference for improving future elections to be better. The dissenting opinion in this case provides a new perspective and interpretation of the election contestation in Indonesia. One of the most fundamental causes of the 2024 presidential and vice-presidential election was the incumbent's irregularities or interference in the election agenda. Furthermore, concerns were raised regarding the lack of neutrality of state civil servants, the distribution of social assistance funds leading up to the election and during the campaign period, and political ethics. Consequently, an imbalance occurred in the presidential and vice-presidential nomination process, creating new problems in resolving the 2024 election dispute.

Abstract

Indonesia's energy transition trends are faced with many challenges and require support in several life sectors. Thus, the pledge of legal certainty and justice through the policies and legal arrangements has become a crucial factor. The present research employed normative legal research with a statutory, historical, and conceptual approach. The purpose of the research was to examine the regulation about energy control in Indonesia all this time and the prospects to regulate energy development from the economic constitution perspective. This study uses a normative juridical method with statutory, historical and conceptual approaches. The results had indicated that such a perspective became an ideal concept to be a basis, reference, and control to the energy regulation in the future. The economic constitution also implied that the economy was built as a shared effort referred to the principle of kinship. Consequently, each of the energy development elements, i.e., policy, management, regulation, and supervision had to be carefully measured for the sake of human’s prosperity. The development and use of renewable energy as the core energy source were strongly consistent with the actualization of economic welfare and safety among the people, which remarked the key to indicating the existence of the economic constitution.

Abstract

The energy transition has been perceived as an urgent agenda, as the phenomena of climate change and environmental damage are increasing. Various arrangements and endeavors have been undertaken by many countries, including Indonesia, to overcome this challenge. One of these efforts is the formulation of a national energy transition policy. This paper aimed to examine policy directions and analyze gaps in the energy transition policy issues in Indonesia, as well as their relationship to ecological justice. The research method employed was a combination of normative legal research, statutory analysis, conceptual analysis, and historical analysis. The findings showed that (1) the direction of the national energy transition policy aimed at overcoming the impacts of climate change and environmental damage through the use and utilization of new and renewable energy (NRE). Various types of policies have been established, ranging from those related to bills to government regulations and those of the Minister of Energy and Mineral Resources. However, such policies had a dual orientation, which contained substance problems and overlapping arrangements. (2) The problems of the national energy transition policy would affect the fulfillment of access to justice, especially ecological justice. The transition from fossil energy to renewable energy could have a positive impact if the policy and implementation of exploring, exploiting, using, and utilizing renewable energy were truly oriented towards protecting and preserving the environment and social welfare. One indicator of the success of the national energy transition was the fulfillment of access to ecological justice as mandated by the Indonesian constitution.Keywords: Policy, Ecological Justice, Energy Transition in Indonesia, Introduction

Abstract

Salah satu penyebab yang paling mendasar atas permasalahan pengelolaan sumber daya alam adalah penyimpangan dalam agenda politik hukumnya. Akibatnya peraturan perundang-undangan di bidang pengelolaan sumber daya alam yang dibuat seringkali justru menimbulkan permasalahan baru. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan filosofis. Teknik analisa adalah deskriptif kualitatif, interpretatif dan heuristik. Hasil penelitian menunjukan bahwa konstruksi existing politik hukum pengelolaan sumber daya alam tidak berjalan sesuai dengan konstruksi ideal cita-cita bangsa yang memiliki karakter sosialis. konstruksi existing politik hukum pembentukan perundang-undangan sektor pengelolaan sumber daya alam nasional cenderung berkarakter “neo-liberalistik” yang mengarahkan dukungan pada swasta, hubungan antara pemerintah dan masyarakat juga hanya sebatas subordinatif sehingga keadilan yang berusaha diwujudkan adalah keadilan distributif (individual). Hukum progresif hadir menawarkan perspektif baru dengan berpegang pada prinsip bahwa agenda politik hukum pembentukan perundang-undangan di bidang pengelolaan sumber daya alam harus dilakukan secara responsif, partisipatif, dan holistik.

Abstract

This research seeks to elaborate on the urgency and the design offered to limit regulations governing regional head elections (Pilkada). The main problem identified is the distribution of regional election norms across various types of regulations, which causes anomalies, conflicting norms, and dualism of interpretation by judicial institutions, such as differences in decisions between the Supreme Court and the Constitutional Court. Using normative-juridical research methods and statutory, conceptual, historical, and case-based approaches, this research reveals that the limitation in question serves as the initial milestone in constructing fair, effective, and efficient legal frameworks to regulate Pilkada with legal certainty. Philosophically, limiting the proliferation of norms is necessary to maintain the integrity of the local democratic system through the dimensions of ontology, epistemology, and axiology. The results of the study indicate that the most ideal design for limiting regional election regulations consists of three levels: the 1945 Constitution of the Republic of Indonesia as the constitutional basis, the Law as the primary regulation, and the Regulation of the Election Organising Institution (especially the General Elections Commission) as the technical delegation regulation. This model is considered the most appropriate, as it covers everything from abstract norms to concrete technicalities, guarantees legal certainty, and minimizes the influence of elite political interests in shaping regulations. The implementation of this design is expected to realise a more democratic, accountable, and equitable regional election governance.
