Abstract

Penelitian ini dengan judul “Implikasi Pada Kantor Pertanahan Kota Jayapura Atas Balik Nama Sertifikat Hak Milik Atas Tanah Untuk Menjamin Kepastian Hukum” ini merupakan hal yang sangat penting di mana seseorang yang mempunyai nama pada sertifikat merupakan pemilik yang sah, terkuat dan terpenuh atas tanah tersebut berdasarkan Undang-Undang Pokok Agraria Nomor 5 Tahun 1960. Tetapi kenyataannya pada Kantor Pertanahan Kota Jayapura masih banyak orang yang memiliki sertifikat hak milik atas tanah tersebut tetapi sudah beralih haknya ke orang lain, dengan kata lain bahwa sertifikat tersebut bukan haknya lagi. Oleh karena itu peneliti melakukan penelitian pada Kantor Pertanahan Kota Jayapura untuk mengetahui prosedur pelaksanaan balik nama sertifikat hak milik atas tanah di Kantor Pertanahan Kota Jayapura dan untuk mengetahui hambatan-hambatan dalam pelaksanaan balik nama sertifikat hak milik atas tanah di Kota Jayapura. Metode yang digunakan dalam penelitian adalah yuridis normatif dan empiris yaitu dimana suatu pendekatan yang mengacu pada undang-undang, bahan kepustakaan, peraturan-peraturan tertulis atau bahan-bahan hukum lainnya yang bersifat sekunder dan untuk melihat bagaimana penerapannya melalui suatu penelitian lapangan. Hasil dari penelitian ini mengungkapkan bahwa prosedur pelaksanaan balik nama sertifikat hak milik atas tanah di Kantor Pertanahan Kota Jayapura, yaitu melalui pendaftaran sertifikat hak atas tanah, pemeriksaan berkas di kantor pertanahan, pembayaran biaya pendaftaran hak atas tanah, dan proses pengerjaan, pencatatan dan persuratan dengan jangka waktu 7 (tujuh) sampai 20 (dua puluh) hari, serta penerbitan sertifikat. Sedangkan hambatan-hambatan dalam prosedur pelaksanaan balik nama sertifikat hak milik atas tanah di Kantor Pertanahan Kota Jayapura, yaitu hambatan internal dimana Sumber Daya Manusia (SDM) yang kurang, dan banyaknya permohonan yang masuk di Kantor Pertanahan Kota Jayapura. Adapun hambatan eksternalnya; yaitu banyaknya ahli waris yang tempat tinggalnya berjauhan, dan terdapat tunggakan pajak-pajak yang harus dibayarkan.

Abstract

Pengabdian ini dilakukan dengan judul Penyuluhan Hukum Tentang Peran Pejabat Pembuat Akta Tanah (PPAT) Dalam Pendaftaran Hak Milik Atas Tanah Untuk Menjamin Kepastian Hukum Di Kampung Nendali Distrik Sentani Timur Kabupaten Jayapura, kegiatan yang dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai Pejabat Pembuat Akta Tanah (PPAT) dalam hal pendaftaran hak milik atas tanah untuk menjamin kepastian hukum, sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penyuluhan hukum tersebut dengan tujuan untuk memberikan pemahaman dan pengetahuan kepada mitra atas peran PPAT dalam pendaftaran hak milik atas tanah untuk menjamin kepastian hukum serta memberikan pendampingan hukum kepada mitra dalam hal pendaftaran hak milik atas tanah. Metode pelaksanaan pengabdian ini dilakukan dengan cara penyuluhan hukum melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 27 januari 2024 yang dilaksanakan di Balai Kampung Nendali. Kegiatan ini di awali dengan persiapan dan koordinasi, kemudian pemaparan materi dengan memberikan pengetahuan kepada mitra mengenai peran PPAT dalam pendaftaran hak milik atas tanah. Adapun luaran dari pengabdian ini adalah memberikan pemahaman dan pengetahuan kepada mitra tentang peranan PPAT dalam pendaftaran hak milik atas tanah berdasarkan peraturan perundang-undangan yang berlaku dan faktor-faktor yang dialami oleh PPAT sehingga mengalami keterlambatan dalam pendaftaran hak milik atas tanah.

Abstract

Pengabdian ini dilakukan dengan judul Penerapan IPTEKS Tentang Cara Penyelesaian Sengketa Tanah Ulayat Perspektif Peraturan Menteri Negara Agraria/KBPN Nomor 5 Tahun 1999 Di Kampung Asei Besar Distrik Sentani Timur Kabupaten Jayapura, kegiatan yang dilakukan kepada mitra dikarenakan adanya kasus dari mitra tentang ketidakpahaman mengenai penyelesaian sengketa tanah ulayat berdasarkan peraturan perundang-undangan yang berlaku dan dimana para pihak yang bersengketa tidak ada yang mau mengalah atau mau menang sendiri sehingga dengan keahlian yang dimiliki pengabdi dapat melakukan penerapan ilmu pengetahuan dan teknologi tersebut guna agar para pihak yang bersengketa dapat mengetahui tentang adanya peraturan perundang-undangan yang mengatur dalam penyelesaian masalah hak ulayat masyarakat hukum adat. Metode pelaksanaan pengabdian ini dilakukan dengan cara penerapan IPTEKS melalui ceramah dan diskusi yang dilaksanakan pada hari sabtu, tanggal 7 Desember 2023 yang dilaksanakan di Balai Kampung Asei Besar dengan memberikan pengetahuan kepada mitra tentang pedoman penyelesaian masalah hak ulayat masyarakat hukum adat. Adapun luaran dari pengabdian ini adalah memberikan pemahaman kepada mitra tentang hal-hal yang menyebabkan sengketa tanah ulayat antar kampung yang satu dengan kampung yang lain dan melakukan pendampingan hukum kepada mitra untuk penyelesaian sengketa batas tanah ulayat didalam masyarakat hukum adat berdasarkan peraturan perundang-undangan yang berlaku. Selain itu juga target luaran berikutnya pengabdi akan publikasikan kegiatan ini kedalam jurnal nasional pengabdian masyarakat.

Abstract

This service was carried out with the title IPR Counseling in a Human Rights Perspective in the East Arso District, Keerom Regency. This activity was carried out because the partners did not understand IPR from a human rights perspective in order to guarantee legal certainty, so that with the expertise possessed by the service team, they could carry out legal counseling in a manner The aim is to provide a link between IPR and Human Rights as well as legal protection for creative works in the fields of science, arts and literature or capabilities in the field of technology, creative works or inventions. The method of implementing this service is carried out by means of legal education through lectures and discussions which were held on Thursday, November 23 2023, which was held in East Arso District, Keerom Regency. This activity begins with preparation and coordination, then presentation of material by providing knowledge to partners regarding the relationship between IPR and Human Rights as well as legal protection for creative works in the fields of science, art and literature or capabilities in the field of technology, copyrighted works or inventions. The output of this service is to provide understanding and knowledge to partners about the relationship between IPR and Human Rights as well as legal protection for someone's creative work and Intellectual Property Rights are rights that originate from the results of creative activities, the ability of human thought which is expressed to the general public in various ways. form, which has benefits and is useful in supporting human life. Apart from that, it also has economic value which is a real form of the ability of intellectual work, which can be in the fields of science, arts and literature as well as in the field of technology.

Abstract

This research aims to find out the factors that cause the issuance of Original But Fake Certificates at the Jayapura City Land Office and to find out how to cancel Original But Fake Certificates or legally defective certificates at the Jayapura City Land Office. The approach method used in this research is the normative juridical approach, namely an approach that refers to laws, library materials, written regulations or other secondary legal materials. The results of this research reveal that the factors that cause the issuance of genuine but fake certificates at the Jayapura City Land Office are 2 (two) main things, namely the first is from the applicant himself with dishonesty by making fake documents from blank signatures to the parties involved. adjacent to the land, in other words it can be said that the applicant from the start had bad intentions with the intention of deceiving the land office by entering false data, secondly from the Land Office itself because of administrative legal defects such as procedural errors, errors in applying regulations. legislation, errors in the subject of rights, errors in types of rights, area calculation errors, overlapping land rights, incorrect juridical data or physical data or other errors of an administrative nature and how to cancel Original but Fake Certificates or legally defective certificates at the Office Jayapura City Land Affairs can be carried out by means of an application by the party concerned with a court decision which has permanent legal force.

Abstract

This research aims to determine the application of the principle of delimitation contradiction at the Jayapura City Land Office and to determine the resolution of land disputes resulting from the non-implementation of the principle of delimitation contradiction at the Jayapura City Land Office. The research method used is normative juridical and empirical, namely an approach that refers to statutory regulations, library materials, written regulations or other secondary legal materials and looks at their application through field research. The results of this research reveal that the application of the Delimitation Contradiction Principle at the Jayapura City Land Office can actually work well, but if it is related to technical problems in previous maps such as old registration maps that have been lost or have been damaged, there are often overlaps or overlapping plots of land and also what often happens in the field is that the bordering party is not present so BPN entrusts a sheet to fill in the measuring drawings, automatically this is where the application of the Delimitation Contradictory Principle does not work properly and the resolution of land disputes due to not implementing the Delimitation Contradiction Principle is where the BPN facilitates mediation between the two parties rather than having to go to court. If it is still not resolved, a procedural team is created whose members are from the structural work unit in accordance with the procedures for handling land disputes regulated in the Minister of State for Agrarian Affairs/KBPN Regulation No. 5 of 1999. The task of the work team is to receive and resolve land disputes that come to local work environment. So that the resolution of land disputes does not necessarily take place directly through litigation.

Abstract

This research aims to determine the factors that give rise to customary land disputes between the people of Kaptiau village and Mawesday village, and also to find out the form of resolution of customary land disputes through customary law among the people of Kaptiau village and Mawesday village. The approach method used in this research is a normative and empirical juridical approach, namely an approach that refers to laws, library materials, written regulations or other secondary legal materials, and to see how they are implemented through field research. or the reality that occurs at the research location. The results of this research reveal that the dispute that occurred between the people of Kaptiau village and Mawesday village began when a timber company wanted to build an oil tank in Kaptiau village, but the residents of Mawesday village claimed that the land to be built was still part of the community's customary rights. Mawesday village does not belong to Kaptiau village, so there were road blockades and clashes between the two villages, resulting in injuries caused by sharp weapons to residents of both villages. In resolving the customary land dispute between Kaptiau village and Mawesday village which has led to clashes and resulted in residents being injured due to sharp weapons from the two villages, the authorities (police) act as mediators or third parties whose job is only to assist the disputing parties in resolving the problem and did not have the authority to make decisions, with the presence of the tribal heads of the two villages to help resolve the problems that occurred regarding customary land.
