Abstract

In the effort to eradicate terrorism, the security dimension is thick in the policy of eradicating terrorism. Civil society is worried about the material of the 2018 Law Number 5 concerning the Eradication of Criminal Acts of Terrorism, it is considered that the Act can reduce the level of state compliance with respect, protection, and fulfillment of human rights in eradicating terrorism, in addition to the effectiveness of the method of eradicating terrorism. The purpose of this study is to provide an overview and analysis of the form of the threat that has undergone a shift that requires the army as the main component of the defense system to reposition itself by placing itself in the right position in the midst of the dynamics of developing threats. The method in this research is normative juridical through a comprehensive study by taking sources from regulations and laws, while empirical juridical research is a study based on observations on threats involving the TNI. The theory used is the Theory of Authority and Theory of Rule of Law as the theoretical basis for the analysis of the main problems regarding the change of the army from a conqueror to a professional soldier. The military does not intervene in politics and conversely there is no political intervention in the military. Law of 2004 Number 34 concerning the TNI states that the Indonesian National Army was built and developed professionally according to the country's political interests, referring to the principles and values of democracy, human rights, civil supremacy, provisions of national and international laws that have been ratified.

Abstract

The realisation of human rights constitutes a crucial element in the establishment of social justice and the safeguarding of individual dignity. In Indonesia, legal policies pertaining to human rights have evolved since the advent of the reform era, with the advent of numerous regulations and the establishment of institutions dedicated to the protection of human rights. This research employs a literature study method to analyze the impact of legal policies on human rights enforcement in Indonesia. The study analyzes relevant regulations, legal precedents, and academic literature to identify challenges and opportunities in the implementation of human rights policies. The findings reveal that, although Indonesia has witnessed significant advancements in the legislative realm, persistent challenges persist in ensuring consistent policy implementation. These obstacles encompass deficiencies in law enforcement, shortcomings in institutional competence, and the influence of political dynamics upon policy implementation. Hence, enhancements in legal governance and the fortification of human rights institutions are indispensable to guarantee the effective enforcement of human rights in Indonesia.

Abstract

The objective of this research project is to conduct an in-depth examination of the role of law in environmental dispute resolution within the context of urban Yogyakarta. By employing a qualitative methodology, this study examines the factors affecting the implementation of environmental legislation and the efficacy of legal instruments in addressing disputes. This study seeks to elucidate the role of law in environmental dispute resolution in Yogyakarta, examine the obstacles and impediments encountered in the implementation of environmental law, and analyse the efficaciousness of the existing dispute resolution mechanisms. To this end, it employs qualitative methods, with a particular focus on primary data obtained through observation, interviews, and documentation. The findings demonstrate that, despite an adequate legal framework, the efficacy of environmental dispute resolution is constrained by challenges inherent in law enforcement, public awareness, and economic considerations.

Abstract

This research aims to show the importance of the role of higher legal education in anticipating the negative impacts of technological advances, especially in the industrial era 4.0. Using a descriptive qualitative approach, this research examines how law, which often lags behind technological developments, can be adapted through educational modernization. The findings show that technology, such as AI and e-learning, has the potential to increase efficiency in the teaching-learning process and the justice system. However, ethical challenges and the need to adapt curricula that integrate information technology are important issues. In conclusion, the modernization of legal education is urgently needed to ensure the law is in line with technological advances while maintaining human values.ABSTRAKPenelitian ini bertujuan untuk menunjukkan pentingnya peran pendidikan tinggi hukum dalam mengantisipasi dampak negatif kemajuan teknologi, khususnya dalam era industri 4.0. Dengan pendekatan kualitatif deskriptif, penelitian ini mengkaji bagaimana hukum yang sering tertinggal dari perkembangan teknologi dapat diadaptasi melalui modernisasi pendidikan. Temuan menunjukkan bahwa teknologi, seperti AI dan e-learning, berpotensi meningkatkan efisiensi dalam proses belajar-mengajar dan sistem peradilan. Namun, tantangan etis serta perlunya adaptasi kurikulum yang mengintegrasikan teknologi informasi menjadi isu penting. Kesimpulannya, modernisasi pendidikan hukum sangat dibutuhkan untuk memastikan hukum selaras dengan kemajuan teknologi sekaligus menjaga nilai-nilai kemanusiaan.

Abstract

This research aims to analyze the role of law as an instrument of modernization in sustainable rural development in Indonesia. The problem faced is the lack of legal protection for rural communities, especially vulnerable groups such as women and children, as well as the inability of existing legal policies to be effectively implemented in the field. This research uses a qualitative method with a juridical sociological approach, collecting data from document analysis of laws and policies related to village development. The results show that the involvement of village communities and the support of NGOs are essential to improve the effectiveness of legal protection and development sustainability. In conclusion, strong legal protection and government and NGO collaboration are needed to create inclusive and sustainable rural development.ABSTRAKPenelitian ini bertujuan untuk menganalisis peran hukum sebagai instrumen modernisasi dalam pembangunan pedesaan yang berkelanjutan di Indonesia. Persoalan yang dihadapi adalah kurangnya perlindungan hukum bagi masyarakat desa, terutama kelompok rentan seperti perempuan dan anak-anak, serta ketidakmampuan kebijakan hukum yang ada untuk diterapkan secara efektif di lapangan. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis sosiologis, mengumpulkan data dari analisis dokumen peraturan perundang-undangan dan kebijakan terkait pembangunan desa. Hasil penelitian menunjukkan bahwa keterlibatan masyarakat desa dan dukungan NGO sangat penting untuk meningkatkan efektivitas perlindungan hukum dan keberlanjutan pembangunan. Kesimpulannya, perlindungan hukum yang kuat dan kolaborasi pemerintah serta NGO diperlukan untuk menciptakan pembangunan pedesaan yang inklusif dan berkelanjutan.

Abstract

This paper analyzes the gap between data protection regulations and the implementation of the right to privacy in Indonesia from a juridical normative perspective. Despite the enactment of the Personal Data Protection (PDP) Law in 2022, significant challenges remain in ensuring the protection of personal data. These challenges include vague legal definitions, limited enforcement mechanisms, and insufficient provisions for regulating emerging digital technologies such as artificial intelligence and big data. Additionally, public awareness of privacy rights remains low, further exacerbating the ineffective implementation of the law. Through a comparative analysis with international frameworks like the GDPR, this paper highlights key areas for improvement in Indonesia's data protection landscape. Recommendations include establishing a centralized data protection authority, enhancing legal provisions for technological advancements, and increasing public engagement to ensure the effective protection of privacy rights in the digital age.

Abstract

The rapid growth of digital platforms has given rise to new challenges in the protection of privacy rights, particularly in cases of digital slander. This study explores the intersection of privacy protection and digital slander dissemination in Indonesia, focusing on the impact of post-truth dynamics. Using a normative juridical approach, the research examines Indonesia’s legal framework, including the 1945 Constitution, the Electronic Information and Transactions Law (ITE Law), and the Personal Data Protection Law (PDPL), to evaluate the effectiveness of legal mechanisms in safeguarding individuals' privacy in the digital space. The study identifies key gaps in privacy protection, particularly in the context of the post-truth environment, where misinformation and emotional manipulation often overshadow factual accuracy. Comparative analysis with international legal frameworks highlights best practices that could inform reforms in Indonesia. The study concludes with recommendations for legal reforms aimed at enhancing privacy protection and addressing the complexities of digital slander in the era of post-truth.

Abstract

This study examines the legal arrangements in Indonesia for handling the spread of false information through social media bots, employing a normative juridical analysis. The proliferation of disinformation through automated bots has become a significant challenge to public trust, social cohesion, and democratic processes. This paper explores the adequacy of existing legal frameworks, such as the Information and Electronic Transactions Law (ITE Law), the Indonesian Penal Code, and the Election Law, in addressing bot-generated false information. The study identifies key challenges, including technological limitations, legal ambiguities, and jurisdictional issues, and compares Indonesia’s regulatory approach with that of the European Union and the United States. The research highlights the need for clear legal definitions, enhanced platform accountability, improved enforcement capabilities, and greater international cooperation to effectively address this issue. The study concludes with recommendations for legal reforms and increased public awareness to mitigate the adverse impact of social media bots on public discourse in Indonesia.

Abstract

This study explores customary law’s role in managing natural resources in rural areas of Indonesia, focusing on its contribution to national defence and the preservation of national sovereignty. Adopting a qualitative approach based on a literature review, this research examines the interactions between customary law, state law, and local practices within the resource management framework. The findings reveal that customary law remains a vital institution in regulating access to and utilization of natural resources despite the challenges posed by modern development policies and globalization. The study identifies various adaptive mechanisms within customary law that allow it to evolve in response to socio-ecological changes, thus supporting sustainable resource management. Furthermore, the research highlights the importance of incorporating customary law into formal policy frameworks to enhance the effectiveness of natural resource management at local and national levels.

Abstract

The Indonesian criminal justice system faces various legal and practical challenges related to the uncertainty of the forum and coordination mechanisms between the general and military courts. Constitutional Court Decision No. 87/PUU-XXI/2023, read on November 29, 2024, established a new normative basis by integrating the Corruption Eradication Commission (KPK) into the Permanent Connectivity Team, allowing investigations and prosecutions of joint cases to take place in a single process. This study aims to analyze the extent to which this decision strengthens legal certainty in the connected justice system and identify implementation obstacles in the field. The method used is a normative legal approach with a statute approach, a conceptual approach, and a case law approach, supported by a critical review of the effectiveness of the Joint Decree (SKB) establishing the connection team, Standard Operating Procedures (SOPs), and the harmonization of the roles of the Military Prosecutor, Military Police, and the KPK. The results of the study highlight the legal uncertainty in the practice of connectivity between the military and general courts. Constitutional Court Decision No. Regulation No. 87/PUU-XXI/2023 provides a crucial foundation for integrating the Corruption Eradication Commission (KPK) into the Connection Team, enabling integrated case handling. However, its effectiveness remains hampered by technical regulations, inter-agency coordination, and the need for standard operating procedure (SOP) harmonization.
