Abstract

Masyarakat masih banyak yang belum mengetahui apa arti gender. Banyak yang melihatnya hanya sebagai perbedaan seksual atau biologis antara pria dan wanita. Tujuan dari penelitian ini adalah: 1) mendeskripsikan pemikiran M. Quraish Shihab tentang gagasan gender dalam pendidikan Islam; 2) untuk mendeskripsikan apa itu KH. Husaein Muhammad memikirkan gagasan gender dalam pendidikan Islam; dan 3) untuk menjelaskan bagaimana ide mereka tentang gender dalam pendidikan Islam yang sama dan berbeda. Artikel ini menggunakan metode yang disebut "elaborasi deskriptif-komparatif" dan metode studi dari perpustakaan. Dari kajian yang telah dilakukan, dapat ditarik kesimpulan sebagai berikut: 1) M. Quraish Shihab mengatakan bahwa perbedaan jasmani antara laki-laki dan perempuan tidak ada kaitannya dengan kemampuan yang diberikan Allah SWT kepada manusia. Allah SWT memberi mereka kecerdasan dan kemampuan berpikir yang sama. 2) kondisi mental KH. Husein Muhammad berpikir bahwa hidup selalu menjadi lebih baik dan lebih besar. Wanita semakin pintar dan pintar, dan semakin banyak dari mereka yang lebih pintar daripada pria. Ini karena masyarakat telah membantu setiap orang mencapai potensi penuh mereka. 3) Kedua orang ini dikenal mendukung persamaan hak bagi laki-laki dan perempuan dalam Islam dan sekolah Islam. 4) Kedua orang ini memiliki pemikiran yang sama tentang persamaan hak bagi laki-laki dan perempuan. Perbedaan pendidikan dan cara berpikir kedua orang tersebut menjelaskan mengapa mereka memiliki pemikiran yang berbeda tentang kesetaraan perempuan dalam pendidikan Islam.

Abstract

Sujung village located in the district of Serang with 80% of the female population is migrant workers. Violence and abuse against the law happens to the workers. Counseling is necessary in order to provide education and legal knowledge for the workers. To that end, we was presented on the role of paralegals to support victims of violence against migrant workers in the Sujung village was given and paralegal training to support violence victims for migrant workers to improve public access to justice. The target audience were the migrant workers as many as 20 people, with the extension methods were lecturing, counseling and training. The material consists of a paralegal extension, recognize other forms of violence as a violation of human rights and access to legal aid for migrant workers in the Province of Banten by Legal Aid for the Poor Regulation 2014, Number 3.

Abstract

This paper analyzes the gap between data protection regulations and the implementation of the right to privacy in Indonesia from a juridical normative perspective. Despite the enactment of the Personal Data Protection (PDP) Law in 2022, significant challenges remain in ensuring the protection of personal data. These challenges include vague legal definitions, limited enforcement mechanisms, and insufficient provisions for regulating emerging digital technologies such as artificial intelligence and big data. Additionally, public awareness of privacy rights remains low, further exacerbating the ineffective implementation of the law. Through a comparative analysis with international frameworks like the GDPR, this paper highlights key areas for improvement in Indonesia's data protection landscape. Recommendations include establishing a centralized data protection authority, enhancing legal provisions for technological advancements, and increasing public engagement to ensure the effective protection of privacy rights in the digital age.

Abstract

This paper explores the impact of hate speech regulation on freedom of expression in Indonesia from a juridical perspective. The study focuses on the legal framework, including the Electronic Information and Transactions Law (UU ITE) and the Indonesian Penal Code (KUHP), both of which are central to the regulation of hate speech. Through an analysis of key statutes, court rulings, and case studies, this paper highlights the tension between protecting public order and safeguarding free speech. The findings reveal that vague legal definitions and broad enforcement of hate speech laws have led to selective prosecution, often targeting political dissent and criticism. These issues raise concerns about the erosion of democratic rights and the potential misuse of hate speech laws for political purposes. Recommendations are provided to clarify legal definitions, ensure proportionality in enforcement, and prevent the misuse of these laws in a manner that balances the protection of social harmony with the preservation of freedom of expression.

Abstract

Penelitian ini mengkaji sengketa perlindungan hak cipta merek dagang antara Geprek Bensu milik Ruben Onsu dan I Am Geprek Bensu yang dimiliki oleh PT Ayam Geprek Benny Sujono. Fokus utama dari studi ini adalah untuk memahami aspek hukum perlindungan merek di Indonesia serta mekanisme penyelesaian sengketa yang terjadi di Pengadilan Niaga. Metode yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif, dengan analisis data yang bersumber dari literatur hukum dan dokumen pengadilan. Hasil penelitian menunjukkan bahwa sengketa ini berakar dari pendaftaran merek yang dilakukan oleh kedua pihak, di mana I Am Geprek Bensu terlebih dahulu mendaftarkan mereknya pada 3 Mei 2017, sedangkan Geprek Bensu baru terdaftar pada 7 Juni 2018. Pengadilan Niaga memutuskan untuk membatalkan pendaftaran merek Geprek Bensu karena dianggap tidak memiliki itikad baik, mengingat Ruben Onsu sebelumnya pernah menjadi brand ambassador untuk I Am Geprek Bensu. Keputusan ini mencerminkan penerapan sistem "first to file" dalam hukum merek di Indonesia, yang memberikan hak eksklusif kepada pihak yang mendaftarkan merek terlebih dahulu. Studi ini juga menyoroti pentingnya pendaftaran merek sebagai langkah strategis dalam melindungi hak kekayaan intelektual dan mencegah persaingan usaha yang tidak sehat. Temuan ini diharapkan dapat memberikan wawasan bagi pelaku usaha mengenai pentingnya perlindungan hukum terhadap merek dagang serta konsekuensi dari pelanggaran hak cipta dalam konteks bisnis kuliner di Indonesia.

Abstract

This study aims to determine the extent to which knowledge sharing influences performance employee And How gender can moderate connection between knowledge sharing And performance employee. Study This use method collection data quantitative with collection data field use method questionnaire Which shared direct to employee part marketing PT. Kahatex. Analysis data using the Partial Least Square (PLS) approach. The research results show that knowledge sharing has a positive and significant effect on employee performance and gender has not been tested capable of acting as a moderating variable between the effects of knowledge sharing to performance employee. Abstract

Indonesian Migrant Workers (PMI) are Indonesian citizens who will, are or have done Work by Receiving Wages outside the Territory of Indonesia, this is regulated in Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers and its derivative Regulations. Indonesian Migrant Workers are Indonesian citizens who are still under the authority of the Indonesian government, however the position of Indonesian Migrant Workers abroad is very vulnerable to facing unpleasant cases such as Violence, Human Trafficking, Illegal Migrant Workers and various other cases. These cases trigger conflicts between Indonesia and the recipient countries of Indonesian Migrant Workers, due to the relationship between 2 different citizenships. So it is important for the Government of the Republic of Indonesia to provide legal protection efforts and Preventive Actions to Indonesian Migrant Workers who will go Abroad, both in terms of administration, readiness and the purpose of Indonesian Migrant Workers. The method used is the Normative Juridical Method, and the purpose of this study is to analyze how the Urgency of Legal Protection for Indonesian Migrant Workers in Anticipating Conflicts Between Countries. The results of this study explain that the role of the government in making regulations or international agreements with countries where Indonesian migrant workers work is very important in order to protect Indonesian citizens and prevent conflicts between countries that can occur due to problems caused by Indonesian migrant workers.

Abstract

Abstract: This article discusses legal provisions regarding the criminal act of trafficking in persons between Indonesia and China with the mail-order bride mode, which has recently occurred in various regions in Indonesia, and the criminal responsibility of the perpetrators of the trafficking in persons. The primary sources of this research are Law No. 21 of 2007 on the Eradication of Human Trafficking, the Criminal Law of the People’s Republic of China, Law No. 13 of 2017 concerning the Ratification of the Agreement between the Republic of Indonesia and the People’s Republic of China regarding Extradition, and the results of interviews with various party. The secondary sources come from scientific works that study or are related to the object of this research. Using juridical-empirical approach, this study results indicate that the criminal act of trafficking in persons with the order mode of the bride and groom between men with Chinese citizenship and women with Indonesian citizenship was committed by several parties, including Indonesian agents, Chinese agents, mail-order bride service users, and intermediary parties (makcomblang). The perpetrators of the crime of trafficking persons who are in Indonesia can be subject to criminal sanctions as stipulated in Law No. 21 of 2007 on the Eradication of Human Trafficking. Meanwhile, perpetrators who are domiciled in China can be subject to criminal sanctions through extradition based on an extradition agreement between China and Indonesia (July 1, 2009) which has been ratified by Law No. 13 of 2017 concerning the Ratification of the Agreement between the Republic of Indonesia and the People’s Republic of China regarding Extradition. Abstrak: Artikel ini mengkaji ketentuan hukum tentang tindak pidana perdagangan orang antara Indonesia dan Cina dengan modus pengantin pesanan yang akhir-akhir ini banyak terjadi di berbagai daerah di Indonesia dan  pertanggungjawaban pidana para pelaku tindak pidana perdagangan orang tersebut. Sumber utama penelitian ini adalah Undang-Undang Nomor 21 Tahun 2007 tentang Tindak Pidana Perdagangan Orang (TPPO), Criminal Law of the People’s Republic of China, Undang-Undang Nomor 13 Tahun 2017 tentang Pengesahan Persetujuan antara Republik Indonesia dengan Republik Rakyat Cina, dan hasil wawancara dengan berbagai pihak. Adapun sumber sekundernya berasal dari karya-karya ilmiah yang mengkaji atau berkaitan dengan objek penelitian ini. Menggunakan pendekatan yuridis-empiris, penelitian ini menemukan bahwa tindak pidana perdagangan orang dengan modus pengantin pesanan antara laki-laki berkewarganegaraan Cina dengan perempuan berkewarganegaraan Indonesia dilakukan oleh beberapa pihak, yang meliputi agen Indonesia, agen Cina, pengguna jasa pengantin pesanan, dan pihak perantara (makcomblang). Para pelaku tindak pidana perdagangan orang yang berada di Indonesia ini dapat dikenai sanksi pidana sebagaimana diatur dalam Undang-Undang Nomor 21 tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Sementara para pelaku yang berkedudukan di negara Cina dapat dikenai sanksi pidana melalui pemberlakuan ekstradisi berdasarkan persetujuan ekstradisi antara Cina dan Indonesia (1 Juli 2009) dan telah disahkan dengan Undang-Undang Nomor 13 Tahun 2017 tentang Pengesahan Persetujuan antara Republik Indonesia dengan Republik Rakyat Cina.

Abstract

The Indonesian creative industry stands at the intersection of cultural richness, technological advancements, and economic potential. This research undertakes a quantitative analysis to unravel the challenges and opportunities in implementing an Intellectual Property Rights (IPR) protection system for creative industry development in Indonesia. The study involves 100 respondents representing diverse segments of the creative industry. Findings reveal a nuanced landscape, with varying perceptions of the current IPR protection system, significant concerns about challenges such as piracy, and optimistic views on growth opportunities through digital platforms, collaborations, and global markets. Recommendations from creative professionals emphasize the need for legal reforms, increased awareness campaigns, and collaborative efforts. This research contributes valuable insights to inform policymakers, industry practitioners, and stakeholders in fostering a robust and dynamic creative industry in Indonesia.

Abstract

Consumer protection in the digital age presents unique challenges and opportunities, particularly in the context of emerging platforms like TikTok Shop. This study undertakes a comparative analysis of the legal aspects of consumer protection in e-commerce transactions and TikTok shops in Indonesia. Through a normative approach, key similarities, differences, challenges, and opportunities are identified, shedding light on the evolving regulatory landscape and its implications for consumers, businesses, and policymakers. Findings highlight the need for adaptive regulation, enhanced enforcement mechanisms, industry collaboration, and consumer empowerment to ensure a fair, transparent, and accountable digital commerce ecosystem.
