Abstract

Penelitian ini menganalisis dan meneliti mengenai keterkaitan unsur sosial, aktivitas, dan budaya masyarakat terhadap kebijakan penerapan pariwisata di Kalurahan Jangkaran yang diantaranya terdapat konflik yang timbul dari internal masyarakat serta keterkaitannya dengan kebijakan dari pemerintah desa setempat, dan wewenang pemerintah kota atas implementasi dari Undang-Undang No. 10 Tahun 2009, perkembangan Kalurahan Jangkaran sebagai desa wisata terhambat karena implikasi dari kurang tegasnya pemerintah desa setempat dalam mengakomodir kerja sama antara pihak-pihak terkait di kawasan pariwisata tersebut. Adanya penelitian ini akan menjawab pertanyaan (1) Bagaimana kewenangan pemerintah desa dalam mengelolah wisata desa. (2) Bagaimana penyelesaian konflik pengelola wisata desa di kalurahan jangkaran. Penelitian ini menggunakan pendekatan empiris karena data-data berdasarkan survey langsung terhadap kondisi kawasan di Jangkaran dan adanya keterlibatan masyarakat dalam proses wawancara yang telah penulis lakukan.

Abstract

The conflict between the Regulation of the Minister of Environment and Forestry (LHK) No. P.106/MENLHK/SETJEN/KUM.1/12/2018 and the Regulation of the Minister of Trade (Permendag) No. 44 of 2012 has created significant legal uncertainty regarding the protection and trade of tengkawang seeds in Indonesia. The LHK Regulation does not include tengkawang seeds as a protected plant species, while the Permendag prohibits the export of tengkawang seeds. This study aims to analyze the normative conflict related to the regulations governing the export of tengkawang seeds and its implications for environmental conservation and the economy in Pontianak City. The research methodology used is normative analysis with a statutory approach. Legal materials were obtained through document studies of laws and regulations and literature reviews.The research results show that this regulatory conflict hinders the export of tengkawang seeds, harms business actors, and potentially increases illegal trade activities. Furthermore, this inconsistency also causes confusion among law enforcement officials and the general public regarding the protection status of tengkawang seeds. This study recommends harmonizing regulations between the Ministry of Environment and Forestry and the Ministry of Trade to ensure effective protection of tengkawang seeds while supporting economic growth through legal and regulated trade. Additionally, in accordance with the legal principle lex posterior derogat legi priori, the newer law should prevail. Moreover, as per the LHK regulation, tengkawang seeds are not classified as protected plant varieties, which legally allows them to be exported.

Abstract

Several cases of physical, psychological, and sexual violence against housemaids in Indonesia have been documented, despite the existence of laws that aim to protect them. The Law Number 13 of 2003 on the Ministry of Manpower and the Ministry Regulation Number 2 of 2015 on the Protection of Housemaids are insufficient to prevent unfair treatment of housemaids. This study investigates this issue by examining the situation of housemaids in Surabaya, East Java, Indonesia. Using a normative-empirical research approach, this article reveals that legal protection for housemaids in Indonesia is still uncertain due to two primary factors. Firstly, the lack of clarity in the rules requires the development of special laws that specifically address the protection of housemaids. Secondly, the lack of knowledge among housemaids renders them vulnerable to being underestimated and humiliated. The urgency of legal protection for housemaids in Indonesia is underscored by the prevalence of domestic violence and unfair compensation. Therefore, a comprehensive and exhaustive legal framework is necessary to provide a sufficient access to justice mechanisms for housemaids, including legislative acts that are specifically tailored to their needs. Furthermore, rehabilitation is a vital mechanism, particularly for housemaids who have suffered from violence. This can involve providing temporary shelters, counseling, and protection from retaliation.

Abstract

Korupsi pada tahun-tahun terakhir ini diributkan dengan banyaknya  yang terjerat kasus korupsi. Korupsi ini kemudian berbuah pada kerugian yang diderita publik, seperti kemiskinan dan kesenjangan sosial serta berdampak pada terhambatnya pelayanan publik. Sejak 2004 hingga Februari 2021, total sudah ada 126 kepala daerah yang ditetapkan Komisi Pemberantasan Korupsi sebagai tersangka. Tindak Pidana Korupsi yang yang terjadi di pemerintah, khususnya pemerintah daerah tidak lepas dari lemahnya fungsi pencegahan dari dalam. Berdasarkan data dari Komisi Pemberantasan Korupsi jumlah tindak pidana korupsi dari tahun 2004 sampai dengan 2019 terbanyak yaitu pada instansi pemerintah daerah (provinsi dan kabupaten/kota) sebanyak 500 kasus dari total 1032 kasus. Upaya untuk melawan atau memberantas korupsi tidak cukup dengan menangkap dan menjebloskan koruptor ke penjara, namun upaya preventif juga perlu galakkan. Upaya preventif dapat dilakuakan engan meperkuat Lembaga pengawasan yang ada di daerah seperti Aparatur Pengawas Internal Pemerintah (APIP), badan Pengawas Keuangan dan Pembangunan (BPKP) serta peran serta masyarakat juga diperlukan daam upaya ini. Selain tu juga diperlukan penanaman nilai-nilai integritas yang baik serta melakukan upaya pencegahan yang di pelopori oleh pemerintah daerah itu sendiri tanpa menunggu aksi yang dilakukan oleh Komisi Pemberantasan Korupsi.

Abstract

As we understand, the problem that occurs is how the revocation of political rights for convicted corruption perpetrators in Indonesia and what consequences will occur if the implementation of the revocation of political rights for corruption convicts from the point of view of human rights. The purpose of this study is to find out that the revocation of political rights for convicts of corruption from the point of view of human rights based on Court Decision Number 537 K/Pid.Sus/2014 An. Inspector General Djoko Susilo. The method used is a normative juridical research method, which is based on the decision of the Supreme Court, books on corruption and the severe opinions of legal experts. The revocation of political rights for convicts of corruption is not a form of violation of human rights, because convicts of corruption are mostly state officials whose duties and functions are to protect and help the community.
