Abstract

Profesi notaris merupakan suatu profesi mulia (officium nobile). Notaris terhimpun dalam sebuah wadah perkumpulan yang bernama Ikatan Notaris Indonesia (I.N.I) yang telah menyusun Kode Etik, sebagai pedoman berperilaku yang berisi norma atau kaidah moral atau aturan dalam suatu organisasi (perkumpulan) dan mengikat anggotanya. Kode Etik Notaris dibuat dengan tujuan menjaga martabat profesi notaris dan untuk melindungi klien atau warga masyarakat dari penyalahgunaan kewenangan dari seorang Notaris. Penelitian bertujuan untuk menganalisis bentuk – bentuk dan sanksi pelanggaran Kode Etik Notaris. Meskipun sudah ada koridor hukum dan kode etik, di dalam praktiknya masih saja terdapat oknum notaris yang melakukan pelanggaran terhadap peraturan perundang-undangan dan kode etik dalam menjalankan profesinya. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach). Sumber bahan hukum diambil dengan melakukan penelitian kepustakaan. Analisis bahan hukum dilakukan dengan cara mengutip pasal-pasal peraturan perundang-undangan yang relevan sedangkan pendapat para sarjana dikutip sebagai  landasan teori guna menjawab isu hukum yang dikemukakan. Dari hasil dan pembahasan dapat disimpulkan bahwa bahwa sebagai upaya menjaga kehormatan dan keluhuran martabat jabatan notaris, maka perlu penegakan kode etik terhadap oknum notaris yang melakukan pelanggaran dalam menjalankan profesinya. Untuk menjatuhkan sanksi terhadap oknum notaris yang melakukan pelanggaran harus melalui mekanisme yang diatur dalam Kode Etik Notaris dengan mempertimbangkan bobot/kualitas pelanggarannya.

Abstract

This study aims to analyze polygamy practices and their positive and negative impacts on family life as well as the psychological conditions of wives and children in the community of Paciran District, Lamongan Regency. This research employs a qualitative approach, with a conceptual and case study design. Data were collected through in-depth interviews, observations, and documentation involving polygamy practitioners, community leaders, and related parties. Data analysis was conducted through data reduction, data display, and conclusion drawing. The findings reveal that polygamy practices in Paciran vary, ranging from open to covert arrangements. Normatively, polygamy is perceived as permissible in Islamic law under strict conditions of justice and financial capability. However, in practice, polygamy tends to generate more negative impacts than positive ones, particularly affecting the psychological well-being of wives and children, including jealousy, emotional instability, domestic conflict, and declining family harmony. Nevertheless, a limited number of families demonstrate relative stability through equitable treatment and effective communication. This study highlights that polygamy requires strong psychological, economic, and moral readiness to prevent broader social and familial harm.

Abstract

Unregistered marriage (nikah sirri) is a complex legal phenomenon in Indonesia, as it is considered valid under Islamic law but not recognized by state law due to a lack of registration. This research aims to analyze the impact of unregistered marriages on the status of wives, children, and property from the perspectives of Islamic law and Indonesian positive law. The method used is normative juridical research with conceptual, legislative, and fiqh approaches. Primary data sources include Law Number 1 of 1974 on Marriage, the Compilation of Islamic Law, and the Quran and Hadith, while secondary data are derived from relevant academic literature. The findings show that according to Islamic law, an unregistered marriage that fulfills the pillars and requirements is valid, thus wives, children, and property have the same status as registered marriages. However, under Indonesian positive law, unregistered marriages have no legal force because they are not registered at the Office of Religious Affairs or Civil Registry Office, resulting in wives lacking legal protection of their rights, children only having civil relations with their mothers, and joint property cannot be submitted to court without marriage confirmation (itsbat nikah). This research recommends the need for socialization on the importance of marriage registration and stricter law enforcement to protect the rights of women and children.

Abstract

This study examines the normative conflict between statutory authority and administrative discretion in the establishment of Merah Putih Cooperatives under Indonesia’s 2025 national cooperative revitalization program. While the Law on the Notarial Office grants notaries general authority to prepare authentic deeds, administrative regulations require a specific designation as Cooperative Deed Officials (NPAK), creating legal uncertainty in practice. Unlike previous studies that focused on general cooperatives and the procedural role of NPAK, this research is the first to analyze the legal bottlenecks generated by state-driven digital transformation through the SABH/AHU Online system within the Merah Putih initiative. Using a normative juridical approach, this study evaluates the civil, administrative, and ethical consequences of deeds prepared by non-NPAK notaries. The findings demonstrate that although such deeds remain civilly valid, administrative rejection may prevent cooperatives from obtaining legal entity status, resulting in significant socio-economic losses at the village level. The findings reveal that digital administrative filtering has transformed ministerial discretion into de facto statutory limitation, generating legal uncertainty, delaying village economic programs, and causing measurable financial losses at the local level. This study proposes regulatory harmonization to restore statutory authority while maintaining administrative oversight. The policy implication emphasizes the need to prevent digital governance mechanisms from undermining hierarchical legal certainty in Indonesia’s cooperative development framework. This research offers policy recommendations for harmonizing statutory and administrative norms to ensure legal certainty, professional integrity, and the effective implementation of Indonesia’s cooperative reform agenda.

Abstract

Legal protection for Indonesian Migrant Workers plays an important role in efforts to combat human trafficking, which is still a serious problem in the world. This study examines various regulations related to Indonesian Migrant Worker policies and criminal sanctions for perpetrators of human trafficking. This study uses a normative legal method by examining various sources of law, both national law and international agreements such as the Palermo Protocol. The results of the study show that Indonesia has ratified various major international conventions and has passed Law Number 18 of 2017 concerning the Protection of Indonesian Migrant Workers and Law Number 21 of 2007 concerning the Eradication of Human Trafficking. These laws provide strong protection for migrant workers from the conservation, placement, and post-placement stages, and provide severe penalties for perpetrators of human trafficking. However, despite these various legal efforts, there are still many problems in law enforcement. This is reflected in the increasing cases of Human Trafficking, with 2,149 victims rescued in 2023. The study highlights the urgent need for better oversight, stricter conservation rules, and stronger law enforcement to prevent, cover and protect migrant workers.

Abstract

General Background: The rapid development of information and communication technology has facilitated the spread of criminal activities in digital environments, including the distribution of child pornography on social media platforms. Specific Background: Children, as rights-bearing legal subjects requiring special protection, are increasingly exposed to sexual exploitation within open and anonymous online spaces, raising significant legal concerns in Indonesia. Knowledge Gap: Although multiple legal instruments regulate this crime, there remains limited clarity regarding the practical implementation and coordination of these regulations in addressing accountability. Aims: This study aims to analyze the existing legal frameworks and examine the forms of criminal accountability for perpetrators distributing child pornography content on social media. Results: Using a normative juridical method with statutory and conceptual approaches, the findings indicate that Indonesia’s legal provisions are normatively comprehensive and have been strengthened through various laws and regulations; however, enforcement faces persistent challenges, including difficulties in digital evidence collection, perpetrator tracking, and inter-agency coordination. Novelty: The study provides an integrated examination of multiple legal instruments alongside practical enforcement barriers in the digital context. Implications: Strengthening law enforcement capacity and improving regulatory synergy are necessary to ensure effective and just child protection in digital spaces. Highlights: Legal provisions addressing the issue are comprehensive and increasingly reinforced. Practical challenges arise in evidence handling, perpetrator identification, and institutional coordination. Abstract

The Internet is developing quickly and significantly impacts every part of life. Thanks to the Internet, people may contact, communicate, and even conduct business with anyone worldwide quickly, cheaply, and effortlessly. Buying and selling transactions through electronic media are legal agreements or relationships carried out by networking computer-based information systems and communication systems based on telecommunications networks and services. This process is further made possible by worldwide internet computer networks. International society in general and Indonesian society in particular have greatly benefited from using electronic transaction media, or e-commerce, in the trade industry. Establishing an agreement occurs when two parties come to a consensus on a primary issue that serves as the agreement's goal. To agree on what has been agreed upon, both parties must be present in a meeting of wills. It is possible to comply with wishes orally or in writing. In today's world, where technology is widely used in business, a face-to-face meeting or written agreement is no longer necessary to express wants. Agreements between parties with different legal systems that are made online are nonetheless enforceable.
