Abstract

Kegiatan pengabdian masyarakat ini dilatarbelakangi oleh urgensi penyelesaian sengketa hibah tanah di Kampung Teluk Tempudau yang timbul akibat dualisme sistem hukum. Permasalahan ini merupakan manifestasi dari inkonsistensi implementasi antara hukum positif nasional yang diatur dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah dengan hukum adat yang berlaku secara turun-temurun dalam masyarakat setempat. Metode pelaksanaan program ini terdiri dari tiga tahapan sistematis. Pertama, dilakukan survei permasalahan hukum melalui pendekatan yuridis-empiris untuk mengidentifikasi akar masalah dalam konteks pluralisme hukum. Kedua, distribusi instrumen pengukuran berupa kuesioner untuk mengevaluasi tingkat literasi hukum masyarakat terkait regulasi penghibahan tanah. Ketiga, implementasi program sosialisasi hukum sebagai bentuk intervensi edukatif yang bersifat preventif. Hasil analisis kuantitatif menunjukkan adanya transformasi signifikan dalam tingkat pemahaman masyarakat terhadap aspek yuridis penghibahan tanah. Data pra-sosialisasi menunjukkan distribusi pemahaman dengan kategori tinggi sebesar 27%, sedang 31%, dan rendah 42%. Pasca-sosialisasi, terjadi peningkatan substansial pada kategori pemahaman tinggi menjadi 50%, sedang 32%, dengan penurunan kategori rendah menjadi 18%. Program ini menghasilkan implikasi multidimensional: (1) secara preventif-yuridis, program ini dapat memitigasi potensi sengketa pertanahan, (2) secara sosiologis-yuridis, memperkuat harmonisasi sistem hukum dalam masyarakat, dan (3) secara institusional, menyediakan prototipe sosialisasi hukum yang dapat direplikasi pada komunitas serupa.

Abstract

Fenomena anak di bawah umur sebagai konten kreator di media sosial memunculkan tantangan baru dalam dunia hukum, khususnya terkait persetujuan digital (digital consent) atas publikasi dan monetisasi konten yang melibatkan anak sebagai subjek utama. Dalam banyak kasus, persetujuan diberikan oleh orang tua atau wali, tanpa keterlibatan langsung dari anak, yang secara hukum belum cakap untuk menyatakan kehendaknya sendiri. Penelitian ini menggunakan metode hukum normatif/doktrinal, yaitu dengan menelaah prinsip, asas, dan norma hukum positif yang berlaku, terutama dalam Undang-Undang Perlindungan Anak, Undang-Undang Informasi dan Transaksi Elektronik (ITE), dan Undang-Undang Perlindungan Data Pribadi. Penelitian ini juga mengkaji konsep the best interest of the child dalam perspektif hukum sebagai pijakan utama dalam pembentukan kebijakan perlindungan anak di ranah digital. Temuan penelitian menunjukkan belum adanya pengaturan hukum yang spesifik dan komprehensif mengenai validitas persetujuan digital anak dalam aktivitas ekonomi berbasis media sosial. Oleh karena itu, dibutuhkan perumusan norma hukum baru yang menjamin perlindungan anak dari potensi eksploitasi digital, serta mekanisme partisipasi anak dalam pemberian persetujuan atas konten yang menyangkut hak dan kepentingannya di dunia maya.

Abstract

The exoneration clause is a clause that limits or eliminates responsibilities that should be borne by business actors. This clause is often found in laundry service notes in Samarinda City, even though its application is prohibited in Article 18 of Law Number 8 of 1999 concerning Consumer Protection. This research uses a social-legal approach to analyze the application of exoneration clauses and the implementation of consumer protection regarding the use of exoneration clauses in laundry service notes in Samarinda City. The research results show that the use of exoneration clauses in laundry service notes is detrimental to consumers because consumers do not receive compensation. The less than optimal role of the Consumer Dispute Resolution Agency (BPSK) causes the public, both consumers and business actors, to lack understanding of their rights and obligations. Therefore, there is a need for deeper attention to the application of exoneration clauses so that consumers are protected.

Abstract

Unilateral cancellation of the agreement before the end of the agreement period is categorized as unlawful. In some cases of unilateral cancellation of lease agreements submitted to the District Court, there are differences in legal considerations by the Panel of Judges in interpreting elements of unlawful acts in unilaterally canceling agreements resulting in disparity in decisions. The research method used is doctrinal research based on a legal issue that is examined in several District Court decisions with a statutory approach and relevant legal theories. The results showed that the disparity in judges' decisions in Decision Number 760/Pdt.G/2017/PN.Dps, Decision Number 404/Pdt.G/2019/PN.Bdg, and Decision Number 196/Pdt.G/2020/PN. Jkt.Sel in its legal consideration, the Panel of Judges considered that not all unilateral cancellation of agreements can be categorized as unlawful acts based on certain things that prove that there is strong evidence and clear reasons for one party to cancel the lease agreement unilaterally. Efforts to minimize the disparity of the three decisions are the establishment of a more specific agreement clause that regulates provisions related to matters that cause the cancellation of the lease agreement, the Panel of Judges is more optimal in assessing the facts revealed in the trial, the use of jurisprudence and improving guidance and evaluation for judges by the Supreme Court.

Abstract

Penelitian ini bertujuan untuk mengeksplorasi dan menganalisis prinsip-prinsip hukum ekonomi syariah yang berkaitan dengan pekerjaan dan karier wanita dalam Islam. Dengan menyoroti perkembangan terkini dan tantangan yang dihadapi, Penelitian ini memberikan wawasan mendalam tentang bagaimana hukum ekonomi syariah dapat membentuk lingkungan kerja yang adil dan setara bagi wanita Muslim. Penelitian ini menggunakan penelitan normatif, menurut Sudikno Mertokusumo penelitian hukum normatif meliputi asas hukum, kaedah hukum arti dalam arti nilai (norm), peraturan hukum konkrit dan sistem hukum. Metode yang digunakan dalam penelitian hukum normatif untuk mencari kaedah adalah metode penemuan hukum, antara lain adalah penafsiran, argumentasi, dan sebagainya. Kesimpulan penelitian ini ialah Al-Qur’an mengakui adanya perbedaan jenis kelamin (biologis) antara laki- laki dan Perempuan namun alquran memberikan ruang / tidak membedakan ganter antara laki laki dan wanita dalam dunia kerja dan karir, dan tantang budaya patriarki, ketidaksetaraan akses pendidikan masih menjadi problem dalam dunia kerja.

Abstract

Setiap produk harus memiliki jaminan halal, karena barang yang tidak haram halal akan lebih disukai sehingga dipilih oleh pelanggan, dan menaikkan permintaan. Hal ini disukai orang-orang islam dan non-muslim karena mereka percaya bahwa produk halal baik untuk kesehatan. Tujuan penelitan ini untuk melakukan analisa terhadap komitmen dan tanggung jawab pelaku usaha. Abstract

This study aims to analyze the legal strength of the binding sale and purchase agreement under the hand and analyze the legal protection for the buyer if the seller commits a Default on the binding sale and purchase agreement. This research is a doctrinal research. In practice, in the implementation of the Sale and Purchase Agreement, there are still many development actors who do not make the Sale and Purchase Agreement in front of a notary in the form of an authentic deed, but make it in the form of a deed under hand. A Sale and Purchase Agreement made with an authentic deed and a deed under hand has a fundamental difference in terms of its evidentiary strength. The Sale and Purchase Binding Agreement in its implementation in the community cannot always run smoothly, sometimes some factors limit the engagement in continuing or until it becomes invalid, The case can be known that PPJB can be asked for compensation if it is not by the agreement of the parties in the agreement, which in this case the seller commits a breach of performance, while the buyer, in this case, is in good faith by fulfilling what has been As stated in the PPJB, the Agreement can be cancelled if it is not by the subjective conditions or the objective requirements of the agreement as stipulated in article 1320 of the Civil Code.

Abstract

The rapid development of technology in Indonesia has significantly increased consumer demand for electronic devices, particularly iPhones, including those traded in the second-hand market. This phenomenon has encouraged the growth of second-hand iPhone trading activities conducted by business actors in Tenggarong City. However, in practice, various legal issues have arisen that are detrimental to consumers, particularly in the form of breach of contract resulting from the failure of business actors to fulfill their legal obligations. This study aims to analyze the forms of breach of contract in second-hand iPhone sale and purchase transactions, as well as the legal consequences for business actors who fail to apply the principle of good faith. The research employs a socio-legal approach using both normative and empirical methods. The findings indicate that business actors do not comply with their obligations as stipulated in Law Number 8 of 1999 on Consumer Protection, particularly Article 7 letter (a), which mandates business actors to act in good faith in conducting their business activities. Such violations are manifested in the failure to provide accurate, clear, and honest information regarding the condition of the second-hand iPhones sold, the failure to honor promises related to warranties or replacement of goods, and the avoidance of responsibility in addressing consumer complaints. Consequently, business actors may be held legally liable for breach of contract and violations of consumer protection laws, resulting in obligations to provide compensation and fulfill consumers’ rights in accordance with applicable laws and regulations.Keywords: Breach of Contract; Good Faith; Consumer Protection; Second-Hand iPhone Transactions

Abstract

This study seeks to examine the application of the actio pauliana lawsuit concerning the transfer of assets by bankrupt debtors, with a particular focus on Supreme Court Decision Number 26 PK/Pdt.SusBankruptcy/2020. This decision serves as a representation of the legal protection mechanism for creditors within the bankruptcy process. The research employs a normative juridical method, concentrating on the analysis of written legal norms pertinent to the annulment of the debtor's legal actions. The approach includes a statutory analysis to assess the alignment of the decision with Article 1341 of the Civil Code and Article 41 of Law Number 37 of 2004 on Bankruptcy and Suspension of Debt Payment Obligations. Data sources comprise primary data, including laws and regulations, court decisions, and bankruptcy legal documents, while secondary data is derived from literature, scientific journals, academic articles, and expert legal opinions. The findings indicate that in Supreme Court Decision Number 26 PK/Pdt.Sus-Bankruptcy/2020, the debtor's asset transfer was declared null and void as it satisfied all elements of actio pauliana. These elements include the execution of legal actions during the debtor's insolvency, resulting in creditor losses, absence of legal obligations, and lack of good faith by both the debtor and the asset recipient. Consequently, the transferred assets are reinstated to the bankruptcy estate as a means of restoring creditor rights in the debt settlement process. This research affirms that actio pauliana is a crucial instrument in ensuring legal protection for creditors and plays a strategic role in upholding proportional justice, legal certainty, and the integrity of the bankruptcy process in Indonesia.
