Abstract

Sociology cannot be directly used in distorting the scope of jurisprudence in terms of its independence, sociology of law is a middle way with various intersections. The complex reality in society gives many distortions whether the law can be independent or become a truly substantially open system, amidst the position of our legal development, which was previously the perspective of Dutch scientists and is currently required to accommodate “the laws that live in a society” So the role of legal sociology in law enforcement in society is very much needed. This research is qualitative descriptive research with the type of library research. The method used in this research is normative legal research methodology, which places law as a building block of ethical structures (namely regarding principles, ethics, regulations from statutory provisions, court decisions, agreements, and doctrine). In this research, the law is not an autonomous institution but is interdisciplinary in dealing with social phenomena to create social welfare. Law enforcement in society is an effort to realize respect for social norms. Through legal improvement, it must include preventive and repressive improvement stages, edit of morality, the behavior of law enforcement officials, and as an essential element is community involvement.

Abstract

Microplastics have emerged as a multidimensional threat, not only to environmental and public health but also to legal systems worldwide. Despite increasing scientific evidence regarding their ecological persistence and toxicity, legal responses—particularly in civil law and consumer protection—remain underdeveloped. This study examines the legal implications of microplastic pollution through the lens of unlawful acts (onrechtmatige daad) and consumer protection, using normative legal research methods grounded in statutory analysis, legal doctrine, and jurisprudence. The findings reveal that industrial negligence in plastic waste management may satisfy the legal elements of tort under Indonesian civil law (Article 1365 of the Civil Code), especially when microplastics harm ecosystems or pose health risks to consumers. Moreover, the absence of specific regulatory frameworks addressing microplastic content in consumer products indicates a critical normative gap that undermines the right to product safety and accurate information. This research argues that microplastic pollution constitutes not merely a technical or scientific issue but a legal crisis demanding comprehensive reform. It recommends integrating the precautionary principle into national legislation, setting enforceable safety standards, mandating microplastic content labeling, and enhancing producer accountability, drawing lessons from international instruments. The study also advocates for the establishment of independent testing bodies and robust monitoring mechanisms to support scientific evidence in environmental litigation.

Abstract

Every action taken by humans will always have consequences. If the action taken is a bad action and has an impact on others, then this action will result in sanctions. This results in the need for clear rules made by the government in a country, in order to create harmony in society in the nation and state. Indonesia, although it allows the death penalty for perpetrators of crimes stated in Article 11 of the Criminal Code, including corruption, in fact the death penalty is very rarely carried out in Indonesia, one of the reasons for the rare death penalty is that people still think about human rights. This study aims to analyze the death penalty for perpetrators of corruption of the Covid-19 pandemic funds in terms of human rights. This research is a juridical-normative type of research, namely legal research conducted by the method of reviewing library materials. Giving the death penalty to corruptors is very appropriate because it can be used as shock therapy because psychologically corruptors who are sentenced can be used as an example to influence other parties not to commit corruption. The results of the study revealed a discrepancy between the harsh legal basis and the commitment to human rights principles in the Indonesian legal system. In addition, the failure to apply the death penalty to corruptors of pandemic funds was influenced by various factors, such as the direction of legal policy taken by the government, pressure from the international community, and the low integrity of law enforcement officers. This study concludes that the threat of the death penalty has not been able to function effectively as a deterrent because it is not accompanied by consistent law enforcement. Therefore, this study contributes to the discourse on reforming corruption criminalization policies by emphasizing the need for a balance between the values ​​of justice, humanity, and legal effectiveness.

Abstract

Following the enactment of Law Number 5 of 2014 concerning the State Civil Apparatus (ASN), the Yogyakarta State Administrative Court (PTUN) has become a forum for civil servants to defend their legal interests and seek justice. Under this law, a civil servant must first exhaust administrative channels as mandated by Article 129. Specifically, to file a lawsuit with the Yogyakarta PTUN, a civil servant must first file an administrative objection. This step is a prerequisite for the dispute to fall under the court's authority. This research employs a normative legal methodology, using legal analysis that treats law as a system of norms. This system includes principles, ethics, regulations from statutes, court decisions, agreements, and legal doctrines. The study identifies six factors that hinder the resolution of civil servant disputes at the Yogyakarta PTUN. It demonstrates that the challenges in settling these administrative conflicts are influenced not only by the parties involved but also by judges, the nature of the verdicts, and socio-cultural variables.

Abstract

Perbuatan churning adalah perbuatan yang merugikan tertanggung dari segi penerimaan manfaat dan perbuatan tersebut dilarang oleh Asosiasi Asuransi Jiwa Indonesia maupun perusahaan asuransi seperti PT.Prudential Life Assurance. Penelitian ini bertujuan untuk mengetahui akibat hukum jika agen asuransi melakukan perbuatan melawan hukum (churning) dan bentuk tanggung jawab dari agen asuransi terhadap perbuatan melawan hukum di dalam asuransi. Adapun metode yang digunakan oleh penulis dalam penelitian ini adalah metode penelitian normatif. Berdasarkan hasil penelitian diperoleh kesimpulan bahwa, tanggung jawab agen asuransi terhadap churning adalah memberikan kerugian yang diterima oleh tertanggung biasanya berbentuk kerugian materiil berupa uang dari premi yang dibeli untuk polis baru atau dari premi selama masa aktif dari polis lama sebelum membeli polis baru, dan agen asuransi wajib mengganti kerugian berupa uang kepada tertanggung sesuai dengan nilai premi yang dibayarkan. Perbuatan melawan hukum (churning) yang dilakukan agen asuransi mendapatkan suatu akibat hukum berupa sanksi pencabutan sertifikasi keagenan dan dimasukkan ke dalam Daftar Agen Bermasalah menurut Asosiasi Asuransi Jiwa Indonesia sebagaimana diatur pada Bab III Pasal 3 huruf e Keputusan RAT AAJI No. 03/AAJI/2012 tentang standar kode etik keagenan serta tidak mendapatkan komisi, penghargaan dan jabatan yang diberikan perusahaan sesuai ketentuan Lampiran III poin VII dari perjanjian keganenan pada perusahaan PT.Prudential Life Assurance.Kata kunci - Agen Asuransi, Churning, Hukum Asuransi, Pernjanjian Asuransi.
