Abstract

AbstractSharia tourism is not only related to religious values such as places of pilgrimage and religion but more towards lifestyle. Sharia tourism includes the availability of supporting facilities, such as restaurants and hotels that provide halal food and prayer rooms. Tourist products and services, as well as tourist destinations in Islamic tourism, are the same as tourism in general as long as they are not in conflict with Islamic values and ethics.Thus, halal tourism is supported by a series of interrelated components: travel, hotel, money market, lifestyle; medicines, cosmetics, and food. Food and cakes are one component that will not be overlooked in halal tourism destinations, even it can be said that there is no tourism without food. There is no halal tourism without halal food.Research on the implementation of halal certification by suppliers of Small and Medium Industries (SMI) in Cirebon Plered Cake Market is a qualitative research that reveals the facts about how the suppliers of SMI around Plered Cirebon whose products are consumed outside the district, between provinces and across islands addressing halal certification. This study also presents the factors of the low interest and intention of the suppliers to process halal certificates on their products and the factors that encourage them to be very enthusiastic to certify the cake or food products.Need breakthroughs and coordination from related parties; Government agencies, institutions, traders, so that the implementation of halal certification can run well so that it can support tourism in each region in Indonesia. Keyword: Syaria Tourism, Halal Sertification, Small Medium Industry  AbstractWisata syariah tidak hanya melulu terkait dengan nilai-nilai agama seperti tempat ziarah dan religi, tetapi lebih mengarah pada lifestyle.Wisata syariah mencakup ketersediaan fasilitas pendukung, seperti restoran dan hotel yang menyediakan makanan halal dan tempat shalat. Produk dan jasa wisata, serta tujuan wisata dalam pariwisata syariah sama seperti wisata pada umumnya selama tidak bertentangan dengan nilai-nilai dan etika syariah.Dengan demikian pariwisata halal ditunjang oleh rangkaian komponen yang saling terkait: travel, hotel, pasar uang, gaya hidup; obat-obatan, kosmetik dan makananan. Makananan maupun kue menjadi salah satu komponen yang tidak akan terlewatkan dalam destinasi pariwisata halal, bahkan dapat dikatakan tidak ada pariwisata tanpa makan. Tidak ada pariwisata halal tanpa makanan halal.Penelitian tentang pelaksanaan sertifikasi halal oleh supplier IKM di Pasar Kue Plered Cirebon, adalah penelitian kualitatif yang membeberkan fakta tentang bagaimana para supplier IKM di sekitar Plered Cirebon yang produknya dikonsumsi diluar kabupaten, antar propinsi dan lintas pulau menyikapi sertifikasi halal. Penelitian ini juga menyajikan factor-faktor rendahnya minat dan niat para supplier untuk memproses sertifikat halal pada produknya dan faktor-faktor yang mendorong mereka sangat antusias untuk mensertifikasi produk kue atau makananya.Perlu terobosan dan koordinasi dari para pihak terkait; Lembaga pemerintah, institusi, para pedagang, agar pelaksanaan sertifikasi halal dapat berjalan dengan baik, menarik sehingga dapat mendukung parawisata di masing-masing daerah di Indonesia. Keyword: Wisata Syariah, Sertifikat Halal, Industry Kecil Menengah

Abstract

AbstrakKebijakan Mendagri untuk menghapus 3.143 Peraturan Daerah (PERDA) menimbulkan kontroversi dan pro kontra. Berdasar pasal ketentuan Pasal 251 UU No 23 Tahun 2014 tentang Pemerintahan Daerah, dan Instruksi Menteri Dalam Negeri Republik Indonesia Nomor 582/476/sj Tentang Pencabutan/Perubahan Peraturan Daerah, Peraturan Kepala Daerah Dan Keputusan Kepala Daerah Yang Menghambat Birokrasi Dan Perizinan Investasi, Mendagri seakan menjadi Sweeping Power untuk menghapus PERDA. Padahal jika diperhatikan peraturan-peraturan yang lainnya; UUD 1945, UU tentang Kekuasaan Kehakiman,  mekanisme penghapusan PERDA seharusnya menggunakan judicial review. Sebagai negara hukum (rechtsstaat) penghapusan perda harus memperhatikan asas legalitas dan menghindari kesewenang-wenangan. Banyaknya PERDA yang dihapus mengebiri semangat otonomi daerah dan desentralisasi kekuasaan. Tulisan berikut ini akan menjelaskan prosedur penghapusan Perda secara konstitusional  dan hubungannya dengan negara hukum (reschtsstaat). Keywords: Penghapusan, PERDA, Hukum. AbstractPolicy of the Minister of the Interior removed 3,143 local regulations (PERDA) caused controversy and pros cons. Based on the provisions of Article 251 article of law No. 23 of 2014 about local governance, and the instruction of Minister of Internal Affairs of the Republic of Indonesia Number 582/476/sj Of Revocation/Regional Regulations, regulatory changes to the head Area and the decision of the head area that Discourages Investment and licensing Bureaucracy, Minister of the Interior seems to have Sweeping Power to remove PERDA. But if considering of other regulations; Constitution, Law on the powers of the Judiciary, mechanisms of elimination of PERDA should use judicial review. As a legal State (rechtsstaat) removal of perda should pay attention to the principle of legality and to avoid arbitrariness. The large number of deleted PERDA castrate the spirit of autonomy and decentralization of power.   This article will explain the procedure for removal of Perda constitutionally and their relation to state law (reschtsstaat). Keywords: Removal, Regional Regulation, Law.

Abstract

ABSTRAK Undang-undang No 6 Tahun 2014 Tentang Desa mengamanatkan tentang perlunya pemberdayaan masyarakat desa dengan cara mengembangkan kemandirian dan kesejahteraan masyarakat dengan meningkatkan pengetahuan, sikap, keterampilan, perilaku, kemampuan, kesadaran, serta memanfaatkan sumber daya melalui penetapan kebijakan, program, kegiatan, dan pendampingan yang sesuai dengan esensi masalah dan prioritas kebutuhan masyarakat Desa. Di satu sisi jumlah desa yang sangat besar, semakin banyak desa menjadi kota potensi konflik yang akan terus muncul di desa, ditambah dengan rendahnya tingkat pendidikan dan kemiskinan, maka pemerintah desa urgen mengenal dan menggunakan mediasi sebagai alternatif penyelesaian sengketa. Di sisi lain jumlah kasus yang masuk ke pengadilan juga terus bertambah setiap tahun.Mengingat mediasi adalah cara penyelesaian sengketa secara damai yang tepat, efektif, dan dapat membuka akses yang lebih luas kepada Para Pihak untuk memperoleh penyelesaian yang memuaskan serta berkeadilan. Pengenalan dan penggunaan Mediasi oleh pemerintahan desa dapat dijadikan instrumen untuk meningkatkan akses masyarakat terhadap keadilan sekaligus penyelesaian sengketa secara yang sederhana, cepat, dan berbiaya ringan. Keberadaan mediasi di desa dapat memperkuat dan mengoptimalkan fungsi lembaga kemasyarakatan dalam penyelesaian sengketa; sekaligus dapat mengurangi jumlah kasus yang masuk ke pengadilan. Kata kunci: desa, mediasi, pemberdayaan Law No. 6 of 2014 on Villages mandates the need for empowerment of rural communities by developing the independence and welfare of the people by increasing knowledge, attitude, skills, behavior, abilities, awareness, and utilizing resources through the establishment of policies, programs, activities and assistance which corresponds to the essence of the problem and the priority needs of the village community.On the one hand, the vast number of villages, the more villages to be a city, the conflict will continue to emerge in the village, coupled with the low level of education and poverty. It’s urgent for village government recognizes and uses mediation as an alternative to dispute resolution. On the other hand, the number of cases that go to court also continues to grow every year.Whereas mediation is a peaceful, effective, and effective way to resolve disputes, and may open broader access to the Parties for a satisfactory and just settlement. The introduction and use of Mediation by village administrations can serve as an instrument to improve people's access to justice as well as settle disputes in a simple, fast, and costly manner. The existence of village mediation can strengthen and optimize the functioning of community institutions in settlement dispute; while reducing the number of cases that go to court.Keywords: village, mediation, empowerment

Abstract

The self-declaration by Small Micro Enterprises (MSEs) for obtaining a halal logo has both advantages and disadvantages. Proponents argue that self-declaration makes it easier for MSEs to acquire a halal certificate, reduces the submission period, and streamlines the certification process. However, opponents argue that self-declaration violates certain laws, such as the UUJPH and the Consumer Protection Act. The Omnibus Law (UUCK) conceptually includes halal in the licensing cluster to facilitate business, but the Constitutional Court has deemed UUCK formally flawed and conditionally unconstitutional. Self-declaration simplifies the licensing process for obtaining a halal certificate specifically for SMEs. It waives certification fees, reduces processing time, and simplifies aspects of business licensing. MSEs can obtain a free certificate through self-declaration if their products meet certain conditions, including not being at risk, being made from natural ingredients, being halal, having a simple production process, having assistance with Halal Production Process (PPH), and being supported by an MUI fatwa. Progressive law recognizes that the law is not absolute or final, but an evolving process aimed at achieving justice and improving human lives. This article explores the intersection between self-declaration and Satjipto Raharjo's progressive legal theory. It highlights the shared objectives of realizing justice, assisting MSEs in obtaining halal certification, humanizing the law, facilitating licenses for MSEs, and adapting regulations to societal changes. The approach encourages breaking and making rules to create progressive laws and involves business actors and companions in the halal certification process, making the law responsive and participatory.

Abstract

The purpose of this study is to determine (1) the forms of bullying behavior (2) the factors causing the emergence of bullying behavior (3) the impact of bullying behavior (4) Efforts to handle bullying behavior using WDEP technique reality counseling. This study uses an approach with a clinical case study method. The results showed that 1) The forms of bullying carried out by NM were verbal bullying such as calling, calling by nicknames, and calling with parents' names, and physical bullying such as nudging and pinching. The intensity of NM bullying is 5-6 times a day which is done in the classroom and in the school canteen. Characteristics of victims of bullying NM are female 2) The factors that cause NM to do bullying are from parents, NM's personal self, and NM's association with naughty school friends, and supervision from the school on student activities that is still lacking. 3) The impact of bullying behavior by NM causes his learning achievement to decline and is shunned by his friends. 4) The handling effort is done by using WDEP technique counseling. The results of the treatment showed a decrease in bullying behavior. These changes occur because of a change in awareness within the counselee that focuses on current events or current conditions, on personal strengths or what the counselee wants, and encourages individuals to develop better behavior so that it can be useful for the future for the subject and for society. as well as country.

Abstract

Online gambling has become a global phenomenon, especially because of its easy access so that it can be reached by various groups, including students. The purpose of this study was to determine the factors that cause students to use online gambling and the obstacles to enforcing online gambling among students. This study uses a descriptive qualitative research type with a sociological legal approach. The results of the study indicate that several factors that encourage students to play online gambling are basically related to economic factors, perceptions of winning opportunities, boredom, friendships, and venting. The variety of these factors shows that many students are caught in online gambling. The biggest obstacle in enforcing the law on online gambling crimes comes from the awareness of the students themselves. Among them, some feel safe playing online gambling because of anonymity, minimal law enforcement, and some are even aware of the criminal risks but still play. Therefore, the relevant parties are deemed necessary to make several preventive efforts aimed at preventing the occurrence of gambling crimes. Strengthening legal regulations, especially by expanding the scope of online gambling crimes, will ensure that all parties involved in online gambling can be subject to appropriate sanctions. Active and targeted socialization will increase students' awareness of the dangers and consequences of online gambling, while financial literacy programs will help students to be wiser in managing their finances and avoid the risk of falling into gambling. With the combination of these three efforts, it is hoped that an environment free from the negative influence of online gambling will be created for students.

Abstract

The existence of human life is highly dependent on environmental conditions. Thus, the environment has an important role in the survival of society. However, humans need a business as an effort to survive. The existence of micro, small, and medium enterprises (MSMEs) is the largest part of the national economy. In Cirebon Regency itself, there are still economic activities that cause air pollution. How is the implementation of the Cirebon Regency Regional Government policy in an effort to tackle air pollution. based on the scale of micro, small and medium enterprises based on Law Number 32 of 2009 and how the application of sanctions by the Cirebon Regency Regional Government in overcoming air pollution. The purpose of this study is to determine the policy and implementation of sanctions carried out by the Cirebon Regency Regional Government in overcoming air pollution. This research method is normative juridical research, through a statutory approach and then described descriptively analytically. The results showed that the Cirebon Regency Regional Government conducted an environmental pollution program to tackle air pollution through two major sub-districts, namely first measuring air quality to find sources of pollution, second controlling pollution and environmental damage. The application of sanctions by the Environmental Service to air pollution perpetrators has not yet reached criminal sanctions because it does not yet have an Environmental Supervisory Officer. Sanctions carried out by the Service are administrative sanctions or commonly called reprimands. The Cirebon Regional Government requires business owners to have a UKL-UPL permit which is used as the basis for an environmental permit. The government is also obliged to preserve the environment in the Cirebon area.

Abstract

This research examines the prevalence of online fraud in e-commerce transactions conducted through the social media Facebook. Legal protections, as outlined in the Consumer Protection Law and the ITE Law, play an important role in addressing this challenge by providing avenues for victims to obtain redress and hold perpetrators accountable. Preventive measures, including public awareness campaigns and platform accountability, are critical to mitigating risks. This study underscores the need for collaborative efforts between government agencies, e-commerce platforms, and consumers to create a safer digital marketplace. The research contributes to the understanding of the dynamics of online fraud and offers insights to improve legal frameworks and enforcement strategies to protect consumers. Abstract

This study aims to examine the phenomenon of femicide in Indonesia, focusing on the murder case in Cirebon. Femicide, as a form of extreme violence against women, is often triggered by complex social, cultural, and economic factors. The research method used is descriptive qualitative with a sociological juridical approach, which includes news analysis and secondary data related to femicide cases. The results of the study indicate that the patriarchal structure that dominates society contributes to the high number of femicide, where many perpetrators are intimate partners of the victim. Law enforcement against perpetrators of femicide also faces significant challenges, including a lack of understanding of gender issues among law enforcement officers. This study recommends the need for more effective public policies and strict law enforcement to protect women and prevent future femicide.

Abstract

Tujuan dari penelitian ini adalah untuk mengetahui bagaimana anggaran desa dikelola dan bagaimana pemerintah mengawasi keuangan daerah. Untuk membiayai penyelenggaraan pemerintahan, pembangunan, pembinaan masyarakat, dan pemberdayaan masyarakat, Dana Desa merupakan bagian dari Anggaran Pendapatan dan Belanja Negara yang diperuntukkan bagi desa dan disalurkan melalui Anggaran Pendapatan dan Belanja Kabupaten/Kota. Lemahnya pengawasan baik oleh pemerintah daerah dan DPRD, maupun masyarakat dan wakilnya di lembaga swadaya masyarakat menjadi akar penyebab banyaknya kasus korupsi dan penyalahgunaan wewenang yang terjadi di desa. Pengelola dana desa rentan melakukan pemalsuan data kebutuhan anggaran karena pengawasan yang kurang memadai. Akibatnya, informasi yang akurat mengenai dana desa dan pemanfaatannya tidak diperoleh. Teknik kualitatif yang dipadukan dengan metodologi studi kepustakaan dan yuridis sosiologis.
