Abstract

Keluarga adalah suatu unit terkecil dari masyarakat yang terdiri atas kepala keluarga dan beberapa orang yang terkumpul dan tinggal di suatu tempat di bawah satu atap dalam keadaan saling ketergantungan. Keluarga merupakan lingkungan pertama dan utama bagi anak, sehingga kedudukan keluarga dalam perkembangan psikologi anak sangatlah dominan.Hal ini menunjukkan bahwa adanya hak dan kewajiban yang harus ditunaikan baik itu sebagai suami dan sebagai istri, begitu pula pemenuhan hak dan kewajiban antara suami - istri sebagai orang tua dengan anak yang berada dalam kehidupan keluarga tersebut. Bagi anak keluarga merupakan lembaga primer yang tidak dapat diganti dengan kelembagaan yang lain. Tujuan penelitian ini adaah Mendeskripsikan faktor penyebab perceraian suami istri di Desa Sulek Tlogosari Bondowoso dan Mendeskripsikan dampak perceraian orang tua terhadap psikologi anak di Desa Sulek Tlogosari Bondowoso Metode yang digunakan dalam penelitian ini adalah Penelitian ini menggunakan pendekatan kulitatif deskriptif. Dengan jenis Studi kasus. Teknik pengumpulan data dalam penelitian ini wawancara mendalam, observasi, dan dokumentasi. Analisis datanya menggunakan kondesasi data, penyajian data, dan penarikan kesimpulan, mengecek keabsahan data menggunakan triangulasi data sumber, metode, dan teori. Kesimpulan Penelitian ini adalah faktor penyebab perceraian suami istri di Desa Sulek Tlogosari Bondowoso adalah Kekerasan verbal, Ekonomi, Perselingkuhan, Kelalaian (tanggung jawab), Faktor Perselisihan campur tangan mertua. Sedangkan dampak perceraian orang tua terhadap psikologi anak di Desa Sulek Tlogosari Bondowoso adalah Marah (Range) atau (Qalb), Sakit-sakitan (Psikomatis) atau (Nafs), Kesedihan (Sorrow) atau (Qalb), dan Tidak Percaya diri (Hipotimia) atau (Qalb).

Abstract

Penelitian ini tidak akan selesai ketika berhadapan dengan konteks kebiasaan masyarakat yang membelenggu dan membudayakan praktek penikahan usia dini. Kebiasaan tersebut harus di atasi dengan evaluasi program pemerintah yang berdaya guna dan tepat sasaran. Penelitian ini menganalisis tentang pentingnya pendidikan perempuan sebagai motor pencetak generasi penerus bangsa, kesejahteraan keluarga dan pembangunan bangsa. Oleh karena itu, penelitian ini menjadi penting untuk dikaji sebagai bahan evaluasi program kebijakan pemerintah terkait kebijakan pembangunan perempuan dan pernikahan usia dini. Penelitian ini menggunakan metode kepustakaan. Hasil penelitian menunjukkan bahwa negara maupun agama memberi hak yang sama kepada perempuan dan laki-laki. Praktek pernikahan usia dini bagi perempuan memiliki beberapa konsekuensi yang harus dihindari yaitu pelanggaran hukum, pendidikan, resiko penelantaran anak, kesehatan reproduksi, kesehatan psikologis dan sosial. Dalam kompleksitas kehidupan pendidikan menjadi penting karena pendidikan memberi manusia bekal kehidupan dan manusia dapat menyederhanakan permasalahan kehidupan. Maka dari itu, perempuan harus berpendidikan agar memiliki keluarga sejahtera dan mencetak anak pembangun bangsa.

Abstract

Proceedings in the Religious Courts can be carried out directly or indirectly. Directly, it means that the litigants come to the court themselves to take care of their interests until they are finished. If the proceedings are indirect, then the litigating party can represent the case to the recipient of the power of attorney. The method taken is to make a special power of attorney in which the power of attorney authorizes the recipient of the power of attorney to take legal action regarding the case faced by the power of attorney. A special power of attorney can be in the form of an authentic deed or a private deed. The power of attorney can take various legal actions to represent the interests of the attorney in the case at hand in accordance with the special power of attorney that has been made. Special Power of Attorney is a power of attorney made to carry out certain very important legal actions which can only be carried out by the power of attorney himself and may not be authorized to another person even though using a special power of attorney. Based on Article 123 of HIR that a special power of attorney can only be given in the form of a valid letter. R. Soesilo interpreted it in the form of an authentic deed (notary deed). In addition, for those who think that a special power of attorney must be in the form of an authentic deed, in practice there are still differences of opinion as to whether it must be made before a notary or can be made before another official. As the example of practice in the Religious Courts that I described above, there are those who argue that a special power of attorney that will be used to carry out legal actions before a trial can be made enough before the clerk of the Court. Based on the explanation above, the writer is interested in formulating the problem as follows: How is the legality of a special power of attorney in pronouncing the divorce pledge? and How is the legality of the legalization and waarmeking of a power of attorney under the hand in pronouncing the divorce pledge?

Abstract

When there is a divorce between husband and wife, it creates obligations that must be obeyed by a husband and wife, and these obligations include a former husband who is obliged to provide a gift that must be given to the former wife who has been divorced, the gift is in accordance with the economic conditions of the former husband (according to his ability), The provision of nafkah is as a comfort during the 'iddah period, in Islamic Law the provision of nafkah is only during the 'iddah period, this is different from Asghar's opinion, according to him the provision of nafkah for divorced ex-wives, not only during the 'iddah period, but until remarriage or death. To answer these problems, the authors use theories based on the Qur'an, hadith, to see the verses relating to the provision of maintenance for ex-wives, then use maslahah and gender equality, to see the benefits and for the benefit of providing maintenance for the ex-wife. The criteria for women who are entitled to ongoing maintenance from their ex-husbands are for women who are unable to maintain themselves (poor), because they are very old, have no family or relatives, because it is far from a sense of justice if a woman who has been divorced returns to her parents or to her relatives. Asghar thinks that there are two key words in Surah al-Baqarah (2): 241, which relate to the provision of maintenance for ex-wives: Mata'ah and Ma'ru>f, the Qur'an says that they must not only be released in a good way (Ma'ru>f) but provisions (Mata'ah) are also provided in a good way as well, Asghar Ali Engineer's thinking has relevance to Law No. IX. Abstract

This research method provides a comprehensive bibliometric analysis of the human rights research landscape in gender studies, specifically focusing on the topics of equality and discrimination. Using data collection, analysis and visualization techniques, this research aims to identify key research themes, trends, influential authors and publications, as well as knowledge gaps within the field. This analysis uses VOSviewer software for network visualization, which allows mapping of thematic groups and interconnections. These findings offer valuable insights to inform policy decisions, guide future research, and encourage interdisciplinary collaboration in achieving gender equality and the advancement of human rights.

Abstract

Abstrak Penelitian ini membahas tentang relasi gender dalam konteks keluarga di mana istri memiliki peran ganda sebagai pekerja dan ibu rumah tangga. Penelitian menggunakan pendekatan kualitatif dengan metode studi kasus untuk mendalami dinamika hubungan suami istri dalam kondisi tersebut. Data dikumpulkan melalui wawancara mendalam, observasi partisipatif, dan studi dokumentasi terhadap tiga pasangan suami istri yang bekerja di Malaysia. Hasil penelitian menunjukkan bahwa komunikasi interpersonal memainkan peran sentral dalam menjaga keharmonisan rumah tangga di tengah peran ganda istri. Pasangan suami istri menunjukkan kemampuan untuk saling mendukung dan berkolaborasi dalam menghadapi tantangan, seperti keterbatasan waktu bersama akibat jadwal kerja yang berbeda. Kesetaraan gender tercermin dalam bagaimana pasangan menghargai dan mendukung peran masing-masing, tanpa terpengaruh oleh pendapatan atau karier istri yang lebih baik. Simpulan dari penelitian ini menegaskan bahwa pemberdayaan perempuan dalam dunia kerja dan pengakuan terhadap peran ganda istri dalam keluarga adalah aspek penting dalam mencapai kesetaraan gender. Implikasi dari penelitian ini juga merangsang pemikiran tentang inklusivitas gender dalam hubungan suami istri, yang dapat berdampak pada norma sosial yang lebih inklusif dan kesadaran masyarakat tentang pentingnya kerjasama dan dukungan dalam keluarga.Top of Form Kata Kunci : Relasi Gender, Pekerja Migran Indonesia, Tenaga Kerja Indonesia   Abstract This research discusses gender relations within the context of families where wives have dual roles as both workers and homemakers. The study employs a qualitative approach using a case study method to delve into the dynamics of husband-wife relationships under these conditions. Data were collected through in-depth interviews, participatory observation, and documentation studies of three couples where both spouses work at Malaysia. The research findings indicate that interpersonal communication plays a central role in maintaining household harmony amidst the wife's dual roles. Husband-wife pairs demonstrate the ability to support and collaborate with each other in facing challenges, such as limited time together due to differing work schedules. Gender equality is reflected in how couples value and support each other's roles, irrespective of the wife's higher income or career achievements. The conclusion of this study emphasizes that empowering women in the workplace and recognizing the wife's dual role in the family are crucial aspects in achieving gender equality. The implications of this research also stimulate thinking about gender inclusivity within husband-wife relationships, which can influence more inclusive social norms and societal awareness of the importance of cooperation and support within families. Abstract

Abstrak Penelitian ini mengkaji kedudukan hak asuh anak setelah perceraian akibat salah satu orang tua murtad, baik menurut hukum positif maupun hukum Islam. Fokus utama penelitian ini adalah: Pertama, menentukan kedudukan hak asuh anak setelah perceraian karena murtad. Kedua, menelaah pola pemberian hak asuh dalam kasus peralihan agama. Metode penelitian yang digunakan adalah pendekatan normatif-empiris, yang mencakup penelitian lapangan di Pengadilan Negeri Bondowoso dan Pengadilan Agama Lombuk Timur serta kajian pustaka mengenai hukum positif dan hukum Islam. Hasil penelitian menunjukkan bahwa hak asuh anak tidak selalu diberikan kepada ibu, dan hukum positif memberikan ketentuan yang lebih luas dibandingkan hukum Islam. Penelitian membedakan peraturan dalam ketentuan perceraian, usia pemeliharaan anak, dan pihak yang berhak mengasuh anak. Dalam hukum Islam, hak asuh ibu bisa gugur jika ada faktor yang merugikan anak, termasuk jika ibu pindah agama. Pola pemberian hak asuh anak dalam perceraian akibat peralihan agama adalah: (a) syarat Islam sebagai prioritas utama, dan (b) jika tidak terpenuhi, syarat akhlak dan kemampuan mengasuh diperhatikan. Majelis hakim akan mengevaluasi kondisi orang tua untuk menentukan yang terbaik bagi anak, meskipun hak asuh diberikan pada orang tua yang murtad. Penelitian ini diharapkan dapat menjadi acuan dalam pembentukan dan pembaruan hukum, serta membantu hakim dalam ijtihad dan penemuan hukum, khususnya terkait hak asuh anak. Kata Kunci: Hak Asuh Anak, Perceraian.   Abstract This research examines the position of child custody after divorce due to one parent apostasy, both according to positive law and Islamic law. The main focus of this research is: First, determining the position of child custody after divorce due to apostasy. Second, examine the pattern of granting custody in cases of religious conversion. The research method used is a normative-empirical approach, which includes field research at the Bondowoso District Court and the East Lombuk Religious Court as well as a literature review regarding positive law and Islamic law. The research results show that child custody is not always given to the mother, and positive law provides broader provisions than Islamic law. Research differentiates regulations in divorce provisions, child maintenance age, and parties who have the right to care for children. In Islamic law, a mother's custody rights can be terminated if there are factors that harm the child, including if the mother changes religion. The pattern of granting child custody in a divorce resulting from a change of religion is: (a) Islamic requirements as the main priority, and (b) if these are not met, moral requirements and parenting abilities are taken into account. The panel of judges will evaluate the condition of the parents to determine what is best for the child, even if custody is given to the apostate parent. It is hoped that this research can become a reference in the formation and reform of law, as well as assist judges in ijtihad and legal discovery, especially regarding child custody. Abstract

AbstrakFeminisme merupakan gerakan yang bertujuan untuk mencapai kesetaraan gender dalam berbagaiaspek kehidupan, termasuk dalam bidang hukum. Dalam konteks hukum perdata Islam, konsepfeminisme sering kali dianggap bertentangan dengan prinsip-prinsip syariah. Artikel ini bertujuanuntuk menganalisis hubungan antara feminisme dan hukum perdata Islam, serta melihat bagaimanahukum Islam dapat beradaptasi dengan tuntutan kesetaraan gender tanpa menghilangkan nilai-nilaisyariah. Penelitian ini menggunakan metode analisis kualitatif dengan pendekatan normatif danhistoris. Hasil kajian menunjukkan bahwa meskipun hukum perdata Islam memiliki aturan yangberbeda antara laki-laki dan perempuan, terdapat potensi reinterpretasi hukum yang lebih adil daninklusif terhadap perempuan. Dengan demikian, feminisme dapat dipandang sebagai upaya untukmenyesuaikan hukum perdata Islam dengan perkembangan zaman tanpa meninggalkan prinsip dasarIslam.Kata Kunci: Feminisme, Hukum Perdata Islam, Kestaraan Gender, Syariah AbstractFeminism is a movement aimed at achieving gender equality in various aspects of life, including in thefield of law. In the context of Islamic civil law, the concept of feminism is often considered to be inconflict with the principles of Sharia. This article aims to analyze the relationship between feminismand Islamic civil law, as well as to examine how Islamic law can adapt to the demands of genderequality without disregarding Sharia values. This study employs a qualitative analysis method with anormative and historical approach. The findings indicate that although Islamic civil law has differentregulations for men and women, there is potential for a more just and inclusive reinterpretation of thelaw concerning women. Thus, feminism can be seen as an effort to align Islamic civil law withcontemporary developments without abandoning the fundamental principles of Islam.Keywords: Feminism, Islamic Civil Law, Gender Equality, Sharia

Abstract

Politik hukum di Indonesia merupakan arena strategis yang merefleksikan dinamika sosial, politik, dan budaya bangsa sejak masa kolonial hingga era reformasi. Evolusi politik hukum nasional menunjukkan proses panjang dan kompleks yang dipengaruhi oleh interaksi berbagai faktor, baik politik, ekonomi, sosial-budaya, maupun institusional. Pada masa kolonial Hindia Belanda, politik hukum bersifat eksploitatif dengan dominasi hukum kolonial, sementara hukum adat dan Islam ditempatkan secara subordinatif. Pasca kemerdekaan, arah politik hukum nasional diarahkan untuk membangun sistem hukum yang berdaulat berlandaskan Pancasila dan UUD 1945, meskipun masih dibayangi dilema antara mempertahankan warisan kolonial dan kebutuhan akan hukum nasional yang autentik. Masa Orde Lama menandai politisasi hukum untuk mendukung ideologi negara, sedangkan masa Orde Baru menegaskan politik hukum sentralistik dan otoriter dengan orientasi stabilitas dan pembangunan ekonomi, namun sering mengabaikan demokrasi dan hak asasi manusia. Reformasi 1998 membawa perubahan mendasar, menekankan supremasi hukum, demokratisasi, penghormatan HAM, serta pengakuan atas pluralisme hukum, termasuk penguatan posisi hukum adat dan dinamika hukum Islam dalam sistem hukum nasional. Faktor yang memengaruhi perubahan politik hukum meliputi struktur kekuasaan politik, keberagaman sosial-budaya, kepentingan ekonomi, kapasitas institusional, serta aspirasi masyarakat sipil. Meski telah terjadi kemajuan signifikan, tantangan besar tetap ada, seperti intervensi politik dalam penegakan hukum, korupsi, ketimpangan akses keadilan, dan konflik antara hukum nasional dengan hukum lokal. Dengan demikian, evolusi politik hukum Indonesia tidak hanya menjadi cerminan sejarah pembangunan hukum, tetapi juga menjadi dasar refleksi dalam merumuskan strategi pembaruan hukum menuju sistem yang lebih demokratis, berkeadilan, dan responsif terhadap kebutuhan masyarakat.
