Abstract

This paper describes the political contestation in the election of leaders that has occurred in the last five years in Indonesia. Since the reformation era, conservative Islamic movements have gained wide freedom to spread Islamic political ideology such as the idea of upholding Islamic law. This was clearly seen in the 2017 Jakarta Gubernatorial Election and 2019 Presidential Election, where the conservative Islamic movement voiced practical political aspirations by involving the role of religion. The case that happened to Basuki Tjahaja Purnama (Ahok) who was suspected of committing blasphemy at the end of 2016, turned into a protest movement that held “Aksi Bela Islam I, II, III” (Action for Defending Islam I, II, III) which was able to mobilize all elements of religious organizations in Indonesia. This movement is also supported by the role of social media which adds to the massive Islamic populism movement to promote the enforcement of Islamic law through the political stage. This is a qualitative research that prioritizes bibliographic sources. The results of this study indicate that the voices of Muslims who are involved in the “Action to Defend Islam” add to the success of the conservatism process which has a dichotomy of political interests to realize religious authoritarianism by using the Qur’anic verses. However, this study also explains the characteristics of the attitudes of leaders in the history of Islamic civilization who uphold egalitarianism that does not conflict with the democratic system because the responsibility of a leader is to create prosperity and justice for all mankind.

Abstract

The Tariqa and Islam in general are not against worldly and materialistic pursuits. Even in Islam, there are strict rules governing matters related to economic life or what is called muamalah. The four pillars of the Idrisiyyah congregation which are growing rapidly in the Tasikmalaya region of West Java Province are the basis for the teachings of asceticism in the growth and empowerment of the Islamic economy. This article discusses entrepreneurship education in tarekat Islamic boarding schools with a study of the Idrisiyyah tarekat doctrine in developing the congregation’s economy in Tasikmalaya, West Java. This article uses case studies and qualitative research methodology. Primary data sources are obtained from interviews, observation, and documentation techniques, while secondary sources come from books, journals, theses, and articles that are relevant to the research topic. The research was conducted from March 14 to March 30 2023 at the Idrisiyyah Tasikmalaya Islamic Boarding School, West Java. Data analysis techniques utilize the methods popularized by the Miles and Huberman models, namely data collection, data reduction, data presentation, and drawing conclusions. The findings show that the Sufi concept and doctrine of the Idrisiyyah tarekat serve as the basis for the entrepreneurship education given at the Idrisiyyah Tasikmalaya Islamic Boarding School. The history of the involvement of the Prophet Muhammad in the field of trade is the cornerstone of the economic success of the Idrisiyyah order. In addition, there are principles that must be adhered to in living an economic life in the Idrisiyyah order, namely the principles of divinity, scripture, worship, agreement, imamate and leadership. (Tarekat dan Islam pada umumnya tidak bertentangan dengan pengejaran duniawi dan materialistis. Bahkan dalam Islam, terdapat peraturan ketat yang mengatur hal-hal yang berkaitan dengan kehidupan ekonomi atau yang disebut dengan muamalah. Empat pilar tarekat Idrisiyyah yang berkembang pesat di wilayah Tasikmalaya Provinsi Jawa Barat menjadi landasan ajaran zuhud dalam pertumbuhan dan pemberdayaan ekonomi Islam. Artikel ini membahas pendidikan kewirausahaan di pondok pesantren tarekat dengan studi atas doktrin tarekat Idrisiyyah dalam pengembangan ekonomi jamaah di Tasikmalaya Jawa Barat. Artikel ini menggunakan studi kasus dan metodologi penelitian kualitatif. Sumber data primer didapat dari wawancara, observasi, dan dokumentasi, sedangkan sumber sekunder berasal dari buku, jurnal, tesis, dan artikel yang relevan dengan topik penelitian. Penelitian dilaksanakan pada tanggal 14 Maret sampai dengan 30 Maret 2023 di Pesantren Idrisiyyah Tasikmalaya Jawa Barat. Teknis analisis data memanfaatkan metode yang dipopulerkan oleh model Miles dan Huberman, yaitu pengumpulan data, reduksi data, penyajian data, dan penyusunan kesimpulan. Temuan menunjukkan bahwa konsep sufi dan doktrin tarekat Idrisiyyah berfungsi sebagai dasar untuk pendidikan kewirausahaan yang diberikan di Pesantren Idrisiyyah Tasikmalaya. Sejarah mengenai keterlibatan Nabi Muhammad SAW dalam bidang perdagangan merupakan landasan keberhasilan ekonomi tarekat Idrisiyyah. Selain itu ada prinsip yang harus dipegang dalam menjalani kehidupan ekonomi di tarekat Idrisiyyah yaitu prinsip ketuhanan, kitabiah, peribadatan, perjanjian, imamah dan kepemimpinan.)

Abstract

Abstrak Artikel ini bertujuan untuk mengetahui internalisasi nilai Pancasila melalui penguatan budaya Sunda di SMP Yayasan Atikan Sunda Kota Bandung. Artikel ini menggunakan metode penelitian deskriptif-kualitatif, penelitian dilakukan di SMP Yayasan Atikan Sunda Kota Bandung. Sumber yang digunakan untuk kepentingan penelitian ini adalah berasal dari sumber primer dan sumber sekunder, adapun teknik pengumpulan data menggunakan metode wawancara, observasi dan dokumentasi. Adapun teknis analisis data menggunakan model Miles dan Huberman yaitu pengumpulan data, reduksi data, penyajian data dan penarikan kesimpulan. Hasil penelitian menunjukan keberhasilan dalam proses internalisasi lima nilai Pancasila ke dalam diri peserta didik. Adapun internalisasi nilai Pancasila melalui penguatan budaya Sunda di SMP Yayasan Atikan Sunda Kota Bandung terlihat pertama dalam penggunaan bahasa Sunda dan tatakrama sehari-hari, lalu peserta didik juga diwajibkan menguasai seni pupuh sunda dan menjadi standar kenaikan dan kelulusan peserta didik di sekolah. Kedua, dilakukan melalui ekstrakulikuler bernuansakan budaya Sunda yaitu seni penca, seni tari, rampak sekar, sastra Sunda, angklung, gamelan atau karawitan dan seni ukir wayang. Ketujuh ekstrakulikuler tersebut mengandung nilai-nilai Pancasila yang secara sadar ditanamkan oleh para pembina ke dalam diri para peserta didik. Abstract This article aims to determine the internalization of Pancasila values through the strengthening of Sundanese culture at the Atika Sunda Foundation Junior High School, Bandung City. This article uses a descriptive-qualitative research method, the research was conducted at Atika Sunda Foundation Junior High School, Bandung City. The sources used for the purposes of this research are derived from primary sources and secondary sources, while data collection techniques use interviews, observation and documentation. The technical data analysis uses the Miles and Huberman models, namely data collection, data reduction, data presentation and drawing conclusions. The research results show success in the process of internalizing the five Pancasila values into students. The internalization of Pancasila values through strengthening Sundanese culture at the Atikan Sunda Foundation Middle School in Bandung City can be seen, First in the use of Sundanese language and daily etiquette, then students are also required to master the art of Sundanese pupuh and this becomes the standard for the promotion and graduation of students at school. Second, it is carried out through extracurricular activities based on Sundanese culture, namely the arts of pencak silat, dance, rampak sekar, Sundanese literature, angklung, gamelan or karawitan and wayang carving. The seven extracurriculars contain Pancasila values which are consciously instilled by the coaches into the students.

Abstract

This article aims to determine the practice of buying and selling paddy fields with paddy fields carried out in Tanjung Pauh Mudik Village, Danau Barat District, Kerinci Regency. The practice of buying and selling rice fields focuses on how prices are determined when buying and selling and how sharia economic law reviews the buying and selling practices. This research is qualitative field research which aims to understand the phenomenon of what the researcher observes. The approach used in this research is a sociological approach. The primary data comes from data related to the buying and selling of rice fields that occurred in Tanjung Pauh Village. Meanwhile, secondary data is supporting data, namely in the form of archives, documentation, and books related to the issue of buying and selling rice fields with rice fields. The data collection techniques used were observation, interviews, and documentation. The data analysis technique used is the Miles and Huberman data analysis technique which consists of data collection, data reduction, data display (data presentation), and conclusion drawing/verification (drawing conclusions). The results of the analysis concluded that the practice of buying and selling rice fields for rice fields carried out by the people of Tanjung Pauh Mudik Village has been carried out for a long time and no one knows since when they have been doing this. The factors that encourage people to sell rice fields in Tanjung Pauh Mudik Village include first, so that the rice fields, which are their main land for earning a living, are not lost or reduced. Second, to add or expand the rice fields they own. Third, improve the welfare of the population. The sale and purchase of rice fields and rice fields in Tanjung Pauh Mudik Village according to the perspective of sharia economic law is included in the barter buying and selling system. Buying and selling in this system is permitted as long as it meets the specified conditions and pillars. Most of the buying and selling of paddy fields and rice fields carried out in terms of sharia economic law has fulfilled the requirements and terms of barter buying and selling, although there are still some things that have not been fulfilled, including firstly in terms of the requirements for mitlan bi mitslin and in terms of the person who is entering into the contract (subject).

Abstract

This research aims to critically analyze and deconstruct the rules and theoretical rules of ijtihad and its implementation in resolving contemporary Islamic inheritance law issues that develop in the Supreme Court. The focus of this research is on the wasiat wajibah (compulsory testament) as an alternative for non-Muslim heirs. This field research uses a descriptive-analytical method to explain the conception of ijtihad comprehensively. The primary data for this research came from interviews and observations. Interviews were conducted with several Religious Court Judges and Religious High Court Judges. Meanwhile, observation was conducted in several religious courts and high religious courts. Secondary data came from library data such as Supreme Court decisions on compulsory testaments for non-Muslim heirs. In addition, this library data is also supported by classical books (yellow book), scientific articles, internet websites, etc., related to the research topic. In several of its decisions, this study found that the Supreme Court has carried out modern ijtihad in Islamic inheritance law by providing an alternative law in the form of a compulsory testament for non-Muslim heirs to enjoy the inheritance of Muslim heirs. This alternative law is a product of the ijtihad of judges through the renewal of ijtihad methodology in the context of legal discovery (rechtvinding), which aims to distribute a sense of justice to parties prevented from getting inherited property.  The birth of several Supreme Court decisions, such as decisions number 16 K/AG/2010, 218 K/AG/2016, and 331 K/AG/2018, which provide legal alternatives in the form of compulsory testaments for non-Muslim heirs, is a historical necessity that must be interpreted positively for the sake of future history.

Abstract

This article aims to discuss the religious dimension in political conflict and violence in Indonesia Indonesian society is heterogeneous, especially in religious affiliation. A series of cases of violence in Indonesia involving religion, such as the events in Pekalongan (1995), Situbondo (1996), Poso (1998), Ambon (1999), Tasikmalaya (1996), Sukabumi (2008), and also other violence in several parts of Indonesia . This incident caused various kinds of losses both in terms of community facilities and the many casualties that fell. This is based on an excessive commitment to the religious aspects of Indonesian society... The method used in this article is a qualitative research method that consists of library research. Thus, the data obtained comes from literary sources such as books, scientific articles, research reports, and so on. The data analysis technique is a qualitative data analysis technique of Miles et al. The results of the study show that the religious dimension is the main factor in the various events of political conflict and violence in Indonesia. These religious-based conflicts are used by political elites to gain political power. The various religious and political conflicts and violence is due to hyper commitment in most religious societies and the factor of religious differentiation.

Abstract

The debates on the application of Islamic criminal law in various Muslim-majority countries are still ongoing. This is because these countries still adhere to a positive legal system. This phenomenon has spread to many things including implementing the punishment of cutting off the hands of corruptors as is the punishment for thieves in the provisions of Islamic criminal law. One of the obstacles, in this case, is due to differences of opinion on the use of the term "thief" to be applied to "corruptor". This article aims to analyze the punishment provisions for thieves as regulated in Surah al-Maidah verse 38 to be applied to perpetrators of corruption. This article is the result of qualitative research with a linguistic approach. The primary data source in this study is the Qur'an, whereas, the secondary data sources are articles, books, and other relevant documents. Data were collected through a literature study method which was then processed, analyzed, and concluded. This study found that the crime of corruption, seen from a linguistic perspective, has the same meaning as thievery; the perpetrator, therefore, can be sentenced to the same punishment (cutting off the hand). The punishment here is the most severe type that can be imposed on perpetrators of corruption, considering that the impact it causes is heavier and wider than the impact that arises in the crime of thievery. Certainly, this punishment is applied if it has met all the elements and legal requirements and is applied in a very strict manner.
