Abstract

Entitas negara merupakan bentuk logis dari keberadaan manusia sebagai makhluk sosial. Namun, dalam dinamika kajian dan praktik politik dalam prespektif Islam, posisi negara selalu menjadi topik bincang serius. Apakah posisi negara vis a vis agama, atau negara menjadi bagian yang tidak terpisahkan dari realisasi pemahaman keberagamaan. Dari ruang diskusi ini kemudian, muncul beberapa spesifikasi keilmuan yang mengupas secara mendalam tentang negara, termasuk kedudukan negara dalam perspektif fikih. Dalam kajian relasi agama negara, para fuqaha telah mengupas dan menjelaskannya secara rinci, bahkan kajian tentang negara perpsektif fikih telah mengklasifikasi bentuk, tugas dan fungsi negara sebagai watsilah dalam menegakkan ajaran Islam. Kajian posisi negera perspektif fikih ini setidaknya memberi justifikasi bahwa persoalan politik—dalam hal ini—kedudukan negara dalam perspektif Islam menjadi sangat jelas, sehingga dapat memberi kejelasan dalam sumbang pemikiran tentang status negara dalam kaca mata agama, khususnya Islam.

Abstract

Dinamika masyarakat melahirkan berbagai hal baru yang bersinggungan dengan agama. Lahirnya Ijma’ adalah bagian dari tuntutan menjawab dinamika tersebut sekaligus menjadikan Islam selalu relevan dengan karakter kehidupan manusia secara khusus dan senantiasa senyawa dengan tabi’at alam secara umum. Tulisan ini mengelaborasi relasi antara ijma’ atau kesepakatan para ulama sebagai sumber hukum Islam dengan perkembangan masyarakat modern dewasa ini.

Abstract

The role of Muslims in politics today was diminishing. Muslims as just being a spectator in the political dynamics associated with the maintenance of state power. Religion and politics seemed to be two entities were no longer allowed to put together, even when using the label of religion in politics was often accused of being a seller sacred teachings in order to achieve a position of power. In fact, religion and politics in Islam were the two entities that could not be separated, since the foundation of the unity of the state was religion and politics into a medium in keeping religion itself. This paper would explain the importance of understanding the plenary about the relation between religion and politics. Understanding of religion should depart from the text of scripture which was then convinced by logical reasoning religious purposes, further supported by the socio-political reality in the state. Finally, the poin from this study stated that the political role of community revitalization step was very urgent to do with how to install, or at least to update again the understanding of Muslims about Islam and political integration in the reality of the state. Thus, the nature of Islam as a religion could be found.

Abstract

Before the establishment of Republic of Indonesia (NKRI), this archipelago has been lived by variety of traditional governance models that remain autonomous in its homeland, generally recognized as the smallest administrative units. The autonomy of the local government then crippled by the New Order Government policy with the issuance of the enacment No. 5 of 1979 called “Pemerintahan Desa”. Through this enacment, the smallest model of governments homonized into “Desa”. The Province of Jambi is one of the areas affected by the enactment No. 5 of 1979 about “Desa”. Previously, people in Jambi has a traditional governance model in some regions called Dusun. This traditional form of government then turned into the village after 1979. This paper discusses the dynamics of the smallest unit in Jambi administration with case studies in Bungo District. The discussion begins with a description of traditional governance model that exist in Jambi and amendment after 1979. The opportunities of applying traditional governance models back in the era of regional autonomy with the release of a case study Bungo Government Regulation No. 9 of 2007 on the Village Head being mention Rio, Village or Desa Being Dusun, Hamlet Being Kampung will also be discussed at the end of this paper. Formally, the birth of this regulation affect the reinforcement of the traditional Malay Jambi, among others in the form of leadership, conflict management and strengthening of indigenous socialization. Abstract

Abstrak: Masalah utama penelitian dalam artikel ini adalah signifikansi pendidikan tinggi dalam melakukan kegiatan pelayanan sosial. Lokus penelitian ini adalah IAIN Sulthan Thaha Saifuddin Jambi. Hasil penelitian menemukan bahwa kendala ketika melakukan kegiatan pelayanan sosial adalah konseptual dan metodologi ketika melaksanakan program pengabdian masyarakat di lapangan. Secara konseptual, pelayanan sosial program hanya diterjemahkan ke dalam mahasiswa kerja lapangan sosial, sedangkan metodologi kerja lapangan tidak membawa kreativitas baru atau inovasi. Masyarakat menuntut perguruan tinggi Islam untuk memberikan pelayanan sosial dengan tindakan lebih nyata seperti bimbingan bagi guru agama, bimbingan dalam pengelolaan dan pelaksanaan zakat dan manajemen masjid, serta bantuan teknis dalam melaksanakan kegiatan sosial-ekonomi. Kata kunci: Pengabdian Masyarakat, IAIN Sulthan Thaha Saifuddin, Pelayanan sosial.Abstract: The main issue to be explored in this article is how unsignificant a higher education in performing social services activities. The locus of this study is IAIN Sulthan Thaha Saifuddin Jambi. Barriers that occur when conducting social services activities including conceptual and methodological obstacles when implementing community service programs in the field. Conceptually, social services programs simply translated into college students social field work, while the methodology of field work does not bring any new creativity or innovation. Communities demand that the Islamic university to give social services with concrete actions such as guidance for religious teachers, guidance in the management and implementation of zakat and management of mosque, as well as technical assistance in carrying out socio-economic activities. Abstract

This study aims to analyze the causes of the practice of buying and selling damaged money in the City of Sungaipuh, Jambi Province. This research is qualitative research that is descriptive qualitative in nature. Based on the results of research in the field, a picture is obtained that (1) The causes of the practice of buying and selling damaged currency in Sungaipuh City, Jambi Province include economic factors, family factors, situational factors and cultural factors; (2) The practice of buying and selling damaged currency by the community in Sungaipuh City, Jambi Province, is carried out at half the price or 50% of the nominal value of the damaged currency, there is a price determined unilaterally by the buyer and there are also buyers who do not set a price (negotiation). ; (3) In terms of Islamic economics, the practice of buying and selling damaged currency that occurred in Sungaipuh City, Jambi Province, is not permissible because it is included in the category of usury fadhl. This is because the money exchanged does not match the original nominal amount or there are additions. Penelitian ini bertujuan untuk mengetahui dan menganalisis penyebab terjadinya praktik jual beli uang rusak di Kota Sungai Penuh Provinsi Jambi.  Penelitian ini adalah penelitian kualitatif yang bersifat deskriftif kualitatif.  Berdasarkan hasil penelitian di lapangan, maka diperoleh suatu gambaran bahwa (1) Penyebab terjadinya praktik jual beli mata uang rusak di Kota Sungai Penuh Provinsi Jambi diantaranya adalah faktor ekonomi, faktor keluarga, faktor situasional dan faktor budaya; (2) Praktik jual beli mata uang rusak yang dilakukan masyarakat di Kota Sungai Penuh Provinsi Jambi ada yang dilakukan dengan setengah harga atau 50% dari nominal uang yang rusak, ada harga ditentukan secara sepihak oleh pembeli dan ada juga pembeli tidak menetapkan harga (negosiasi); (3) Praktik jual beli uang rusak yang terjadi di Kota Sungai Penuh Provinsi Jambi dalam tinjauan hukum bisnis syariah tidak diperbolehkan karena termasuk kategori riba fadhl. Hal tersebut dikarenakan uang yang ditukarkan tidak sesuai nominal aslinya atau terdapat tambahan.

Abstract

This research examined resolving customary violations of sumbang besak in Babeko Village, Jambi, by prioritizing restorative values in customary law. Research in the context of this social realm tried to look at customary law as a whole, whether it is still regressive or is influenced by the significance of restorative discourse, which has been progressive. The aim of this research was not only to find out the mechanism for resolving conflicts and imposing punishment but also to look at the role and concept of traditional law in Babeko Village restoring disturbed relationships. Using empirical research methods and an anthropological juridical approach, data was collected through interviews with traditional leaders, observations of traditional communities, and documentation and review of related literature. The findings of this research find out the strength of the Babeko Village customary legal system, which has successfully implemented a restorative approach by prioritizing the recovery of victims, violators, and affected communities. Prioritizing dialogue and reconciliation is important in resolving cases, to produce fair and sustainable results. This concept can then become a reference in the development of the national legal system, specifically in alternative dispute resolution models.

Abstract

Penelitian ini beertujuan untuk mengetahui efektifitas pelaksanaan Undang-Undang Republik Indonesia Nomor 41 Tahun 2004 tentang Wakaf ditinjau dari nilai produktifitas. Penelitian ini menggunakan pendekatan kualitatif, pengumpulan data melalui wawancara, observasi, dan dokumentasi. Berdasarkan hasil penelitian Penggunaan tanah wakaf yang ada di Kabupaten Tanjung Jabung Timur sudah sesuai dengan Undang-Undang Nomor 41 Tahun 2004 Tentang Wakaf, dari jumlah tanah wakaf yang ada berjumlah 433 digunakan dengan rincian: tempat ibadah sebanyak 144 tanah wakaf, makam/kuburan sebanyak 42 tanah wakaf, lembaga pendidikan sebanyak 7 tanah wakaf, dan sosial lainnya sebanyak 240 tanah wakaf. Pengelolaan pengembangan wakaf di Tanjung Jabung Timur masih sangat sederhana, sebagaian besar tidak ada pengembangan pengelolahan secara produktif ekonomis, jika tanah wakaf digunakan untuk pembangunan masjid hanya digunakan untuk pembangunan masjid saja walaupun tanah sisa dari lokasi pembangunan masjid sangat luas tidak dikelola secara produktif, dibiarkan saja semak belukar tanpa manfaat, yang selayaknya tanah wakaf tersebut dapat dikelola secara produktif. Implementasi regulasi wakaf di Kabupaten Tanjung Jabung Timur belum efektif, karena masih terjadi ketidaksesuaian antara das sollen dan das sein, regulasi wakaf yang terdiri dari Undang-Undang Nomor 41 Tahun 3004 tentang wakaf, dan Peraturan Pemerintah Nomor 25 Tahun 2018 tentang perubahan atas perubahan atas Peraturan Pemerintah Nomor 42 Tahun 2006 belum dilaksanakan secara efektif.

Abstract

This study aims to examine the relevance of classical Islamic legal categories in defining the status of non-Muslims within the context of Indonesia’s pluralistic and democratic state. The research is motivated by recent debates surrounding the use of the term kāfir ("infidel") and the need to reassess traditional terminologies such as ahl al-dhimmah, ahl al-ḥarb, al-muʿāhid, and al-mustaʾmin in light of contemporary constitutional values. Using a qualitative approach within a library-based research design, the study analyzes classical fiqh texts and Indonesian constitutional and statutory legal documents. Through thematic content analysis, the study evaluates the compatibility of Islamic legal reasoning with modern legal principles. The findings indicate that classical classifications of non-Muslims were shaped by the political and imperial contexts of premodern Islamic governance. These categories are no longer fully applicable in the Indonesian nation-state, which is based on equality before the law and religious pluralism. In contrast, the concept of al-muwāṭinūn (citizens) aligns with the Islamic legal principle of murūnah (adaptability) and supports ijtihād (juridical reasoning) responsive to contemporary societal needs. The study contributes practically by offering a theologically grounded yet constitutionally relevant vocabulary for citizenship that enhances civic inclusion and legal equality. It demonstrates how Islamic jurisprudence can evolve to support pluralistic nationhood. This research provides an original contribution by contextualizing classical fiqh within Indonesia’s constitutional framework, an area underexplored in existing literature. By bridging Islamic legal ethics and Indonesian law, it offers a normative model for redefining non-Muslim citizenship in Muslim-majority democracies.

Abstract

Abstract: The Implementation of Supreme Court Regulation (PERMA) No. 1/2008 on Mediation in Jambi Religious Court and Its Implications to the Increase of Divorce Cases at the Agency. This study discusses the low rate of the  implementation of Supreme Court Regulation (PERMA) No. 1 of 2008 on Mediation in Jambi Religious Court, including its implications to the increase of divorce cases at the institution. The study concludes that the application of mediation in Jambi Religious Courts is not effective in addressing the high rate of divorce cases. Such a phenomenon is caused by several factors namely: First, The PERMA provisions is still relatively weak. Second, the application of rules in the Jambi Religious Court deviates from the PERMA Third, Mediation facilities are inadequate. Fourth, Mediators are not so  serious in reconciling the parties. Fifth, the parties coming before the Court generally ask for judge's decision and not to be reconciled. Abstrak: Implementasi PERMA Nomor 1 Tahun 2008 Tentang Mediasi di Pengadilan Agama Jambi dan Implikasinya pada Perkara Cerai Gugat. Penelitian ini membahas tentang rendahnya penerapan Peraturan Mahkamah Agung (PERMA) Nomor 1 Tahun 2008 tentang Mediasi pada perkara cerai gugat di Pengadilan Agama Jambi, termasuk implikasinya terhadap peningkatan kasus cerai gugat di lembaga tersebut. Hasil penelitian menyimpulkan bahwa penerapan mediasi pada perkara cerai gugat di Pengadilan Agama Jambi tidak efektif dalam mengatasi tingginya tingkat cerai gugat di lembaga tersebut. Hal ini disebabkan oleh beberapa faktor: Pertama, Ketentuan PERMA yang masih lemah. Kedua, Ketidaksesuaian antara penerapan di Pengadilan Agama Jambi dengan aturan yang terdapat dalam PERMA. Ketiga, Fasilitas mediasi yang kurang memadai. Keempat, Kurangnya keseriusan mediator dalam mendamaikan para pihak. Kelima, Para pihak yang datang ke Pengadilan umumnya hanya untuk meminta putusan hakim dan bukan untuk didamaikan.
