Abstract

Penelitian ini bertujuan untuk menganalisis kepastian hukum terhadap Sanksi Denda Dalam Peraturan Walikota Jambi Nomor 21 Tahun 2020 Ditinjau Dari Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan. Rumusan masalah bagaimana substansi peraturan Walikota Jambi Nomor 21 Tahun 2020 memuat Sanksi administrasi Ditinjau Dari Undang-Undang Nomor 12 Tahun 2011 Tentang Pembentukan Peraturan Perundang-Undangan? Apakah Peraturan Walikota Jambi Nomor 21 Tahun 2020 Dapat Memuat Denda Administratif  Ditinjau Dari Undang-Undang Nomor 12 Tahun  2011 Tentang  Pembentukan Peraturan Perundang-Undangan. Hasil dari penelitian ini yaitu produk hukum yang dianggap bertentangan dengan yang lebih tinggi  menjadi batal demi hukum atau adanya ketidakpastian hukum dikarenakan dalam Undang-Undang Nomor 12 Tahun 2011 tentang peraturan perundang-undangan sebagaimana yang dimaksud pasal 15 ayat (1) mencantumkan bahwa ketentuan sanksi hanya dapat dimuat dalam Undang-undang; Peraturan Daerah Provinsi, dan Peraturan Daerah Kabupaten/Kota. Disisi lain, Peraturan Walikota Nomor 21 Tahun 2020 mencatumkan adanya ketentuan sanksi adminitratif, berdasarkan pembentukan peraturan perundang-undangan. Peraturan tersebut dianggap bertentangan dengan ketentuan yang lebih tinggi dan sanksi adminitratif menitikberatkan kepada badan/pejabat tata usaha negara yang secara hukum melanggar kewenangan di dalam menyelenggarakan sistem pemerintahan, oleh sebab itu peraturan Walikota Jambi secara hukum dianggap batal demi hukum dan ketidaksahaannya pengaturan sanksi tersebut diatur dalam peraturan kebijakan daerah di masa pandemi saat ini berdasarkan Undang-Undang Nomor 12 Tahun 2011 tentang peraturan perundang-undangan.

Abstract

This article aims to evaluate the effectiveness of the implementation of legislation in the management and protection of peatlands in Tanjung Jabung Timur Regency, as well as to identify the main obstacles and legal strategies that can be applied to overcome them. The background of the issue highlights that peatlands have significant ecological functions, particularly in maintaining environmental balance and mitigating climate change. Their existence faces serious threats due to land conversion, fires, and uncontrolled exploitation. The urgency of this research lies in the need to review the effectiveness of the regulations that have been implemented to ensure the sustainability of the peatland ecosystem functions, as well as the balance between utilization and environmental conservation. This research adopts a normative juridical approach with a descriptive-analytical method. The data used consists of secondary data obtained through a literature study of legislation, court decisions, scientific journals, and relevant policy documents. The novelty of this study lies in its specific focus on examining the implementation of legal regulations in peatland management in Tanjung Jabung Timur Regency, differing from previous studies that have been more general at the national level. The research findings indicate that the main obstacles in the implementation of peatland management laws include weak law enforcement, regulatory overlaps, conflicts of interest, and low public legal awareness. To address these challenges, optimal strategies are required, including strengthening coordination among state institutions, harmonizing regulations, enforcing strict sanctions, and utilizing technology for monitoring and law enforcement. With these strategies, it is expected that a balance between the utilization and protection of peatlands can be achieved in accordance with the principles of sustainable development.   Artikel ini bertujuan untuk mengevaluasi efektivitas implementasi peraturan perundang-undangan dalam pengelolaan dan perlindungan lahan gambut di Kabupaten Tanjung Jabung Timur serta mengidentifikasi hambatan utama dan strategi hukum yang dapat diterapkan guna mengatasinya. Latar belakang permasalahan menunjukkan bahwa lahan gambut memiliki fungsi ekologis yang signifikan, terutama dalam menjaga keseimbangan lingkungan dan mitigasi perubahan iklim. Keberadaannya menghadapi ancaman serius akibat konversi lahan, kebakaran, serta eksploitasi yang tidak terkendali. Urgensi penelitian ini terletak pada perlunya peninjauan efektivitas regulasi yang telah diterapkan untuk memastikan keberlanjutan fungsi ekosistem gambut serta keseimbangan antara pemanfaatan dan konservasi lingkungan. Penelitian ini menggunakan pendekatan yuridis normatif dengan metode deskriptif-analitis.  Kebaruan penelitian ini terletak pada fokusnya yang secara spesifik menelaah implementasi hukum dalam pengelolaan lahan gambut di Kabupaten Tanjung Jabung Timur, berbeda dari kajian sebelumnya yang lebih bersifat umum pada tingkat nasional. Hasil penelitian menunjukkan bahwa kendala utama dalam implementasi hukum pengelolaan lahan gambut meliputi lemahnya penegakan hukum, tumpang tindih regulasi, konflik kepentingan, serta minimnya kesadaran hukum masyarakat. Untuk mengatasi hambatan tersebut, diperlukan strategi optimal berupa penguatan koordinasi antar lembaga negara, harmonisasi regulasi, penerapan sanksi tegas, serta pemanfaatan teknologi dalam pengawasan dan penegakan hukum. Dengan strategi ini, diharapkan keseimbangan antara pemanfaatan dan perlindungan lahan gambut dapat terwujud sesuai dengan prinsip pembangunan berkelanjutan.

Abstract

The notion of justice has long captivated the minds of philosophers, religious scholars, politicians, and legal experts alike. One of the challenges in this realm is that there is no absolute benchmark for determining fairness; what seems equitable to one party may not resonate with another. As a result, perceptions of fairness tend to be subjective, often leaving certain stakeholders dissatisfied. This complexity fuels ongoing debates within various cases that emerge in both national and state contexts. In this article, we explore the intricacies of these debates through the lens of the recent Constitutional Court Decision No. 91/PUU-XVIII/2020 concerning the Job Creation Law, which many view as favoring employers over workers. The Court's ruling deemed the law conditionally unconstitutional, igniting discussions about its implications for justice. To analyze the impact of this decision on both workers and employers, we apply the frameworks of procedural, substantive, and distributive justice theories. Our research employs a normative juridical approach, examining the Constitutional Court’s ruling alongside relevant laws and legal doctrines.

Abstract

This article examines applying the general principles of good governance within the framework of administrative law as a strategy to promote more efficient and accountable regional budget management in the era of fiscal decentralization. This research aims to analyze how the General principles of good governance, as codified in Indonesian administrative legislation, can serve as a legal foundation to overcome normative and administrative barriers in realizing budget efficiency at the regional level. Using a normative legal research method through statutory and conceptual approaches, this article identifies key legal and institutional challenges, including overlapping regulations, weak bureaucratic capacity, and limited digital infrastructure. The study emphasises the implications of Presidential Instruction No. 1 of 2025 on the Efficiency of State and Regional Budget Expenditure, which mandates stricter fiscal discipline and performance-oriented budget allocation. The analysis focuses on several key regulations, including Law No. 30 of 2014 on Government Administration, Law No. 23 of 2014 on Regional Government, Law No. 1 of 2022 on Central Regional Fiscal Relations, and Government Regulation No. 12 of 2019 on Regional Financial Management. It also includes an examination of the role of digital systems, such as the regional government information system and the regional financial accounting information system. The findings affirm that the consistent implementation of the general principles of good governance, particularly transparency, accountability, legal certainty, and proportionality, when supported by regulatory harmonization, technological innovation, and inclusive public oversight, can significantly improve the effectiveness of regional financial governance and foster a democratic, accountable, and sustainable government administration

Abstract

Abstrak Remaja merupakan generasi penerus bangsa yang diharapkan mampu melanjutkan pembangunan nasional secara berkelanjutan. Salah satu tantangan yang dihadapi remaja saat ini adalah minimnya pemahaman tentang kesehatan reproduksi, yang menyebabkan tingginya angka perilaku berisiko seperti pergaulan bebas, aborsi ilegal, serta penyalahgunaan informasi seksual dari media digital. Kegiatan pengabdian ini dilakukan sebagai upaya promotif dan preventif melalui sosialisasi serta penyuluhan hukum kepada siswa-siswi SMAN 2 Sengeti, Kabupaten Muaro Jambi. Tujuannya adalah untuk memberikan pemahaman yang komprehensif mengenai hak-hak kesehatan reproduksi remaja dan konsekuensi hukum atas pelanggarannya. Metode yang digunakan dalam kegiatan ini adalah pendekatan partisipatif dengan pola Participatory Action Research (PAR) dan Mixed Methods Sequential Exploratory, meliputi tahapan penjajakan, pelaksanaan, dan evaluasi. Hasil kegiatan menunjukkan peningkatan pemahaman siswa terhadap isu kesehatan reproduksi, partisipasi aktif selama diskusi, serta tumbuhnya kesadaran kolektif untuk menjadi agen perubahan di lingkungan sekolah. Dengan demikian, kegiatan ini diharapkan dapat mendorong terbentuknya remaja yang sehat secara fisik, mental, dan sosial serta bertanggung jawab dalam menjaga hak dan kesehatan reproduksinya. Abstract Adolescents are the future generation of the nation, expected to continue national development in a sustainable manner. One of the challenges faced by adolescents today is a lack of understanding about reproductive health, leading to high rates of risky behavior such as casual sex, illegal abortion, and misuse of sexual information from digital media. This community service activity was conducted as a promotional and preventive effort through socialization and legal education for students at SMAN 2 Sengeti, Muaro Jambi Regency. The aim was to provide a comprehensive understanding of teenagers' reproductive health rights and the legal consequences of violating them. The methods used in this activity were a participatory approach using Participatory Action Research (PAR) and Mixed Methods Sequential Exploratory, including the stages of exploration, implementation, and evaluation. The results of the activity showed an increase in students' understanding of reproductive health issues, active participation during discussions, and the growth of collective awareness to become agents of change within the school environment. Thus, this activity is expected to encourage the development of adolescents who are physically, mentally, and socially healthy and responsible in safeguarding their reproductive rights and health.

Abstract

The right to collect forest products (forestry right) is one of the rights to land originating from customary land law which is then recognized as part of land rights that are permanent in the Agrarian Act Number 5 of 1960. The concept of the right to collect forest products is now interpreted as a right what big entrepreneurs can have in managing forests is of economic values, and not as a basis for the rights of indigenous/local peoples who have a living culture by relying on the existence of forest products. This different interpretation ultimately gave birth to policies and legal actions that deprived indigenous/local peoples of their rights to the forest as stated and recognized by the 1945 Constitution as part of protected customary rights. One of the indigenous/local people who use forest products as their source of life is the Suku Anak Dalam (Orang Rimba) community in the Sarolangun Regency area. The many functions of forest land conversion into industrial plantations, as well as the licensing of business use rights over customary forests make the living space and movement of these communities increasingly limited, even in the end giving birth to various land conflicts between indigenous peoples and forest entrepreneurs in the region. Therefore in the future a law is needed that regulates the right to collect forest products as permanent land rights and can provide justice to indigenous people through legal certainty, where the Suku Anak Dalam community is no longer seen as forest looters, or illegal occupation.
