Abstract

The aims of this study are to find out and analyze the effectiveness of Mediation in minimizing divorce rates in the Jambi City Religious Court; and to find out and analyze the factors of the failure of Mediation in minimizing the divorce rate in the Jambi City Religious Court. The method used in this research is empirical juridical. The results of the research are based on what has been carried out as follows: that the effectiveness of mediation in minimizing the number of divorce in the Jambi Religious Court is still not effective, seeing from the results of the research conducted the number of divorce cases from 2020 to 2022 has increased, empowerment of mediation institutions in resolving civil cases, especially regarding the matter of divorce at the Jambi City Religious Court as evidenced by the small number of successful cases in Mediation. Based on the factors of the unsuccessful Mediation in the Jambi City Religious Court, the absence of the parties themselves, as well as the parties who are selfish and do not apply principles to resolve their problems peacefully, the absence of the parties will make it difficult for the Mediator to resolve the problem by reconciling the parties and the Mediator does not understand the problems faced by the parties so that the Mediation process is still not effective in reconciling the litigants, especially divorce cases.

Abstract

The aims of this research are to find out and analyze whether (1) What are the elements of informed consent that are implemented at the Sungai Jambat Village Health Center. (2) What are the exceptions to the absence of informed consent in a therapeutic agreement at the Sungai Jambat Village Health Center. The methodology had been used was an empirical juridical legal research regarding the application or implementation of legal provisions directly to every legal event that occurs in society. The results of this research indicate that the implementation of informed consent at the Sungai Jambat Village Health Center has been legally enforced as law because it implements and fulfills the four elements of the agreement in Article 1320 of the Civil Code, agreed after receiving the information, competent because they are 21 years old. and guardianship if under age, a certain thing related with the medical action/treatment, and the object of the agreement is fulfilled, and the last requirement related with the legally reason has been eligible because the object of the agreement were the medical treatment that accordance and do not deviate from the law. Regarding the exception to the absence of informed consent, the Sungai Jambat Village Health Center stipulates the rule that in an emergency situation, as an effort to save the patient and requires immediate action, informed consent is not required and can be requested after medical action has been given.

Abstract

Food is a basic human need that cannot be neglected in everyday life. Without eating and drinking sufficient quantity and quality, humans will not be productive in carrying out their activities. Food issues also concern security, safety, and health, both physical and spiritual. Food safety is one of the important factors that must be considered in daily consumption. Thus, food must be available in sufficient quantities, at affordable prices, and must also meet other requirements, namely healthy, safe, and halal. So before the food is distributed it must meet the requirements of being truly safe for consumption. This means that food must not contain dangerous ingredients such as pesticide contamination, heavy metals, pathogen microbes, or be contaminated by ingredients that could disturb people's trust or confidence, for example being contaminated with dangerous ingredients. Food security in Indonesia is still far from safe, which can be seen from the food poisoning incidents that have occurred recently. In such conditions, consumers generally do not care or do not have awareness about the safety of the food they consume, so they do not demand much from producers to produce safe food products. This also causes food producers to increasingly ignore consumer safety in order to gain as much profit as possible. For example, there are still many food manufacturers who like to use textile dyes for various food and beverage products because of economic considerations.

Abstract

Indonesia is currently experiencing rapid development in the creative economy sector. Various industries such as design, fashion, art, music, film, and others have become the backbone of creative economic growth in this country. One of the most valuable assets in the creative economy is a brand. Brand protection is very important to ensure the continued growth of Indonesia's creative economy. This research aims to determine and analyze the importance of trademark registration in the development of small and medium enterprises in the creative economy of Indonesia and trademark protection in the development of small and medium enterprises in the creative economy. The research results show the importance of registering a trademark, including: To obtain legal protection, exclusive rights to use the trademark, as a publicity tool (promotion), and also as a business opportunity. Brand protection in the development of micro, small, and medium enterprises in the creative economy sector in Indonesia can be done in two ways, namely preventive protection and repressive protection.

Abstract

The implementation of trademark digitalization in Tirta Kencana Village, Rimbo Bujang District, Tebo Regency, aims to enhance the competitiveness of SMEs by integrating technology and Islamic economic values such as transparency, justice, and sustainability. This program includes digital training, the development of management and marketing platforms, and strengthening internet access. As a result, there was a 40% increase in revenue, a growth in the number of customers, and an improved understanding of digitalization and Islamic economics among business owners. Support from the community and digital infrastructure is expected to drive inclusive and sustainable economic growth in the village, while strengthening the competitiveness of SMEs in the local and regional digital markets.

Abstract

This community service program aims to improve the economic well-being of the residents of Tirta Kencana Village through the development of halal tourism and livestock market education. The strategies implemented include the construction of Muslim-friendly tourism infrastructure, community training on halal tourism standards, and education for livestock farmers to enhance livestock productivity and market access. Through the "Grand Design," the program maps the village's potential and designs sustainable management strategies. The results of this program demonstrate an increase in the community's capacity to provide tourism services and market livestock products, a rise in the number of visiting tourists, and increased income for the Village-Owned Enterprises (BUMDES) as drivers of the local economy. This program has also succeeded in raising community awareness of the importance of environmentally friendly tourism and the role of BUMDES in fostering the village's economic independence. With these efforts, Tirta Kencana Village is expected to serve as a model for competitive halal tourism villages at the national level.

Abstract

This study aims to explore the role of the National Amil Zakat Agency (BAZNAS) of Jambi City in assisting individuals burdened with debt, including those who have fallen victim to online loans. Although the phenomenon of online loans has caused many people to face financial difficulties due to high interest rates and inhumane collection practices, the findings of this study show that, to date, no one has directly sought assistance from BAZNAS Jambi City as a result of being a victim of online loans. Generally, those seeking assistance from BAZNAS are individuals in debt to meet basic needs or cover medical expenses, with between one and five people receiving help each year. First, BAZNAS performs an identification step to make sure that the debt was used for legitimate purposes. Priority is given to impoverished individuals who are in genuine need. Through a descriptive qualitative approach and case studies in Jambi City, this research examines the effectiveness of zakat distribution by BAZNAS in assisting indebted individuals. The findings indicate that while zakat can alleviate financial burdens, its effectiveness needs to be enhanced through broader public education and more accurate identification mechanisms to reach more victims of online loans and others in financial distress.

Abstract

Itsbat nikah adalah penetapan hukum terhadap perkawinan yang telah sah secara agama namun belum dicatat oleh Pejabat Pencatat Nikah di Kantor Urusan Agama. Di Desa Delima, Kecamatan Tebing Tinggi, Kabupaten Tanjung Jabung Barat, masih banyak masyarakat yang melangsungkan pernikahan di bawah tangan tanpa pencatatan resmi, sehingga status perkawinan mereka belum diakui secara hukum. Pengabdian kepada masyarakat ini bertujuan memberikan penyuluhan hukum tentang implikasi itsbat nikah terhadap status perkawinan, khususnya terkait hak-hak suami istri dan anak yang lahir dari pernikahan tersebut. Melalui kegiatan yang dilaksanakan pada 12 Agustus 2024 di Kantor Kepala Desa Delima dengan metode ceramah, diskusi, dan tanya jawab, diharapkan masyarakat memahami pentingnya pencatatan perkawinan serta prosedur pengajuan itsbat nikah ke Pengadilan Agama. Hasil kegiatan menunjukkan peningkatan pemahaman masyarakat mengenai urgensi pencatatan perkawinan untuk memperoleh hak-hak legal, termasuk pengakuan terhadap status anak. Abstract

Midwives are required to practice within the scope of their authority as regulated by Minister of Health Regulation No. 28 of 2017 concerning Midwifery Practice Licensing. However,  in  reality,  many  midwives  provide  healthcare  services  beyond  their  authority, causing harm to patients. This study examines the legal relationship between midwives and patients under Law No. 17 of 2023 on Health and the civil liability of midwives in cases of unlawful acts (onrechtmatige daad) that result in harm to patients. Using a normative juridical methodology, the study finds that midwives must deliver healthcare services according to their competence, standards, and legal obligations. If malpractice occurs, resulting in harm to patients, midwives can be held civilly liable under Article 1365 of the Indonesian Civil Code, which regulates liability for unlawful acts. Dalam menjalankan praktiknya, bidan harus mematuhi kewenangan yang tertuang dalam Peraturan Menteri Kesehatan No. 28 Tahun 2017 tentang Izin dan Penyelenggaraan   Praktik   Bidan,   namun   faktanya   terdapat   bidan   yang   memberikan pelayanan kesehatan diluar kewenangannya yang sehingga menimbulkan kerugian kepada pasien. Penelitian ini bertujuan untuk mengkaji tentang hubungan hukum antara bidan dan pasien ditinjau dari Undang-Undang No.17 Tahun 2023 tentang Kesehatan, serta bentuk pertanggungjawaban perdata bidan dalam hal terjadinya perbuatan melawan hukum (onrechtmatige daad) yang mengakibatkan timbulnya kerugian bagi pasien. Penelitian ini menggunakan  metodologi  yuridis  normatif.  Hasil  penelitian  menunjukan  bidan  dalam praktik mandirinya wajib memberikan pelayanan kesehatan se%t44Tsuai kompetensi dan standar  serta  hak  dan  kewajiban  yang  ditetapkan.  Apabila  bidan  melakukan  kesalahan dalam praktik yang menimbulkan kerugian pada pasien, ia dapat dikenakan pertanggungjawaban secara hukum perdata. Pertanggungjawaban ini bersumber pada ketentuan perbuatan melawan hukum sebagaimana dijabarkan pada Pasal 1365 Kitab Undang-Undang Hukum Perdata.

Abstract

Artikel ini merupakan laporan hasil dari pengabdian kepada masayarakat mengenai arti pentingnya kepemilikan sertifikat tanah bagi masyarakat sekitar Kantor Dinas Pendidikan dan Kebudayaan Kabupaten Tebo. Kegiatan Pengabdian kepada masyarakat dilakukan dengan tujuan untuk meningkatkan pemahaman masyarakat tentang kepemilikan sertifikat tanah. Pelaksanaan Pengabdian ini sangat direspon oleh masyarakat setempat. Dari hasil pengabdian ini, masyarakat memahami pentingnya kepemilikan sertifikat tanah, proses peralihan ha katas tanah serta tahapan pendaftaran tanah. Pengabdian seperti ini dapat dilakukan secara rutin, baik di lokasi yang sama maupun di lokasi yang berbeda dengan sasaran masyarakat yang membutuhkan informasi terkait pengurusan serta kepemilikan sertifikat tanah.
