Abstract

Purpose: This study aims to empower the women cadres of Aisyiyah in the Gegerbitung branch of Sukabumi Regency through Qaryah Thayyibah training, focusing on enhancing their knowledge, skills, and economic welfare. Methodology: The research employed Participatory Action Research (PAR) methodology involving planning, action, and reflection phases. Data collection instruments included pretest and posttest evaluations, direct observation, and participatory discussions. The study also utilized training sessions, mentoring, and community engagement as part of the intervention. Results: The findings indicate a significant increase in participants’ knowledge and skills across health, education, religion, social, and economic domains. The mentoring program successfully enhanced the independence of participants in managing family economic enterprises such as banana and cassava chips production. Conclusions: The implementation of PAR-based training and mentoring effectively improved the capacity and welfare of Aisyiyah women cadres, fostering a self-reliant and prosperous community in the Gegerbitung area. Limitations: The study was limited by its focus on a single community branch and a relatively short mentoring period, which may affect the generalizability and long-term impact assessment. Contribution: This research contributes to community development, women empowerment, and participatory methodologies in social and economic welfare enhancement within Islamic community organizations.

Abstract

Pembatalan perkawinan pasca kematian suami menimbulkan implikasi hukum yang signifikan terhadap status perkawinan dan hak waris, terutama ketika perkawinan kedua dilakukan tanpa izin istri pertama maupun pengadilan. Penelitian ini bertujuan untuk menganalisis akibat hukum dari pembatalan perkawinan setelah kematian suami terhadap status hukum perkawinan dan hak waris dalam perspektif hukum positif dan hukum Islam. Metode yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan studi kasus Putusan Nomor 420/Pdt.G/2024/PA.Smi. Hasil penelitian menunjukkan bahwa pembatalan perkawinan oleh pengadilan setelah kematian salah satu pihak menyebabkan perkawinan tersebut dianggap tidak pernah ada sejak awal. Akibatnya, pihak istri kedua kehilangan hak-haknya, termasuk hak waris, karena tidak memiliki dasar hukum yang sah. Implikasi dari putusan ini menegaskan pentingnya prosedur hukum dalam menjaga keabsahan hak-hak keperdataan dalam lembaga perkawinan.

Abstract

The need for land in Indonesia cannot be separated from its people. This can be seen from how it benefits national development and is a source of livelihood that is integrated. However, the development of national development that is increasingly incessant makes the availability of land even thinner. Therefore, from this was born the land case, which today has transformed into a land mafia that has a motive to take over the land with various tactics and actions. The method used in this study uses normative juridical methods and primary data sources from the study of the community. The purpose of this study is to provide a historical analysis of the birth of the land mafia in the national land system. The findings show that the land mafia in Indonesia was born due to the loss of land owned by the people taken by the colonialists. In this context, the land mafia took advantage of the already unstable situation to take over the rights to land that should have been owned by the people, and arrived at the same polarization until now

Abstract

This study aims to examine the legal implications of the practice of divorce carried out without going through a formal hearing in a religious court, especially on the protection of the rights of divorced couples. A valid divorce according to Indonesia's positive law can only be carried out before a panel of judges through a judicial process, but in practice, there are still many people who impose talaq orally or through communication without submitting an official application to the court. This study uses normative juridical methods with a qualitative approach, as well as interviews in Cibitung District to understand the factors that cause this phenomenon. The results of the study show that divorce without a trial has an impact on the loss of legal protection for the rights of couples. In addition, legally invalid divorces hinder the registration of new marriages due to the absence of divorce certificates. The main factors that affect this phenomenon include low legal understanding. Therefore, systematic efforts are needed to increase public legal awareness and expand access to justice, so that the divorce process can be carried out in accordance with positive law and provide fair protection for all parties.

Abstract

This study aims to examine the implementation of Article 7 of Undang-Undang No. 1 of 1974 and Article 7 of Undang-Undang No. 16 of 2019 concerning the minimum age of marriage in suppressing cases of early marriage, especially in the Sukabumi City area. Although there has been a change in the minimum age from 16 years to 19 years for women, the phenomenon of child marriage still continues to take advantage of the gap in marriage dispensation from the courts. Through an empirical juridical approach and supported by field data and interviews with judicial officials, this study shows that the high number of marriage dispensation applications after the change in the law indicates that the law is still weak in practice. Social, cultural, and lack of legal education are also the main causes of the high dispensation of child marriage. Therefore, a more progressive legal approach and the active participation of all parties are needed to strengthen child protection and suppress the practice of early marriage across the board.

Abstract

Penyebab Perceraian di Pengadilan Negeri sungguh berbeda dengan penyebab Nullitas di Tribunal Gereja. Penyebab perceraian di pengadilan Negeri terjadi sebelum perkawinan, berlandaskan peristiwa atau kejadian dan berujung pada putusan perceraian. Sedangkan penyebab Nullitas Perkawinan di Tribunal Gereja terjadi sebelum dan saat perkawinan berlangsung, berlandaskan kapasitas pribadi dan berujung pada putusan bahwa perkawinan tersebut tidak sah atau tidak ada. Dengan demikian dapat dikatakan putusan perceraian di Pengadilan Negeri memutuskan berakhirnya perkawinan Katolik yang sudah ada. Sedangkan pihak Tribunal Gereja dengan Nullitas Perkawinan menyatakan bahwa sedari atau sejak awal perkawinan itu tidak ada atau tidak sah

Abstract

Child molestation is a serious crime that threatens the well-being and rights of children, causing serious trauma. In Indonesia, Law No. 35 of 2014 aims to protect children, with the Women's Empowerment and Child Protection Agency (DP3A) to handle cases. Data from DP3A Sukabumi shows 85 cases of child sexual violence throughout 2023 and 48 cases up to June 2024. This study finds DP3A Sukabumi faces several obstacles in providing legal protection for the victims. These include victims' fear of social stigma, lack of knowledge, distrust in the legal system, and threats from perpetrators,  which hinder reporting. Additionally, DP3A struggles with a shortage of human resources and limited budget, reducing its capacity to effectively manage cases and support victims.

Abstract

The problem of interfaith marriage involves the conflict between religious freedom and religious values and the constitution. Regarding interfaith marriage in Indonesia, Article 28J, Paragraph 2 of the 1945 Constitution highlights that legal restrictions may be placed on an individual's rights and freedoms. This research discusses how to ensure the protection of human rights without neglecting upheld religious values. This study uses a normative juridical analysis method of laws and regulations, legal norms and doctrines as well as previous articles on marriage and human rights. The results of the study found that the right to marriage is qualified as a derogable right (a right that can be restricted) by the 1945 Constitution. Although the right to marry is a human right, its implementation is not liberal and the religious aspect in the understanding of particularism greatly affects the protection and enforcement of human rights, including the right to marry.

Abstract

Divorce often creates new problems, one of which is related to child custody and visitation rights for parents who do not have custody. Prohibiting visitation by the custodial parent not only violates the rights of the non-custodial parent, but also disregards the child's right to receive affection from both parents. The purpose of this study is to examine the types of legal protection available to non-custodial parents who are prohibited from seeing their children. This study uses a normative legal research method with a statutory approach. Data collected from interviews with legal practitioners and parties who have experienced similar problems are included in this study. The results show that prohibiting parents who have custody from meeting their children is against the law and contrary to the principle of the best interests of the child. Parents who do not have custody rights can file a lawsuit to revoke custody rights, as stipulated in SEMA No. 1 January 2017. This study emphasizes the importance of the law in balancing the rights and obligations of parents after divorce for the best interests of the child.
