Abstract

The state has failed to ensure legal protection for investigated suspects from violence committed by the police. Perpetrators of violence in Banyumas Police Resort were left untouched by law. This human rights violations continue to take place because they enjoy protection from their direct supervisors and police institutions.Hasil penelitian menunjukkan bahwa negara telah gagal memberi perlindungan hukum kepada tersangka dalam penyidikan dari kekerasan yang dilakukan oleh polisi. Pelaku kekerasan (penyidik) selama ini di Polres Banyumas tidak tersentuh hukum. Pelanggaran HAM ini terus berlangsung karena adanya pemberian perlindungan kepada mereka, baik dari atasan langsung maupun institusi Polri.

Abstract

ABSTRAK Era Industri 4.0 dan Masyarakat 5.0 mempunyai karakteristik yang berbeda dan berdampak pula bagi jenis viktimisiasi khususnya akibat cybercrime. Hal ini berkorelasi dengan karakter pada era tersebut antara lain digitalisasi, rekayasa intelegensia dan internet of thing,  Melalui penelitian kepustakaan dapat dijelasakan bahwa dalam perspektif viktimologi korban atas cybercrime. Korban cybercrime mengalami berupa kerugian materi, akibat psikologis akibat fisik dan  akibat sosial. Viktimisasi  cybercrime dapat dijelaskan dengan The Lifestyle-Routine Activities Theory  (L-RAT). Perlindungan hukum korban cybercrime mendasarkan Undang-Undang Nomor 19 Tahun 2016 Atas Perubahan Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik dapat dikatakan  tidak terdapat perlindungan hukum secara signifikan dapat dirasakan oleh para korbannya Seharusnya terdapat sanksi berupa restitusi dan/atau pemberian kompensasi. Hal ini selaras dengan karakter masyarakat 5.0 yang lebih menghormati keberadaan manusia. ABSTRACTThe Industrial Era 4.0 and Society 5.0 have different characteristics and this has an impact on the types of victimization, especially those caused by cybercrime. This correlates with the characteristics of that era, including digitalization, intelligent engineering and the internet of things. Through library research, it can be explained from a victimological perspective that victims of cybercrime suffer losses in the form of material losses, psychological suffering, physical suffering and social suffering. Cybercrime victimization can be explained by the lifestyle-routine activities theory (L-RAT). The legal protection of cybercrime victims is based on Law Number 19 of 2016 on Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions and it can be said that there is no significant legal protection that can be felt by the victims. There should be sanctions in the form of restitution and/or compensation. This corresponds to the nature of society 5.0 which is more respectful of human existence.

Abstract

The population in Indonesia’s correctional institution presents an alarming situation, because as of August 25, 2020, with a capacity to hold 133,169 prisoners, however, the total population stands at 232.585 prisoners. It is showing that the national prison population increased dramatically with an occupancy rate of 75 %. Not only is this causing a negative impact that can lead to prisonization that are counterproductive to the purpose of the imprisonment, but violating human rights. Many of the regulations contained in the criminal law such as restorative justice in the juvenile justice system or restorative justice formulated on Indonesian National Chief Police Regulation Number 6 of 2019 concerning criminal investigation are actually can be used to reduce the entry of the prisoner to the correctional institution but has not yet been done significantly. There are also many regulations to reduce the prison population such remission, leave before released or conditional release, but the methods do not appear to be able to significantly reducing population in the correctional institution and this condition leads to the violations of the human rights of prisoners and it is contradicting to the purposes of the imprisonment. Theoretical study using the library research method based on secondary data is conducted and concluded that a new form of criminal sentence can be suggested which has not been regulated yet in the country’s existing criminal law or formulated in Indonesia draft’s criminal code. A new form of criminal sentence is self-funded deprivation of liberty, which means taking someone’s freedom away based on a court judgment decided that someone is deprived of their liberty if they are legally proven guilty to have committed a crime. The enforcement of the self-funded deprivation of the liberty carried out by keeping the offender to stay in their house or in other designated places. The costs borne entirely by the crime offender and their families and the offender is also not permitted to leave home, and that the supervision from the correctional centers (BAPAS) and community may also be instituted.

Abstract

Restorative justice is a pattern of dispute resolution which emphasizes the responsibility of the perpetrator for the consequences of his actions while at the same time paying attention to the position of the victim. This is not simply about punishing the offender; it is about obtaining justice through discussion outside of the criminal justice system to ensure the situation can be returned to its prior state. Islamic law offers a concept of restorative justice called islah, which is a technique to resolve conflicts between parties by forgiving one another. Salatiga City, the most tolerant city in Indonesia, is where this study is being conducted. The idea of restorative justice is used to resolve disputes through the role of a lurah (head of neighborhood), who is responsible for upholding communal order. It is intriguing to investigate whether the reality of restorative justice in Salatiga City can achieve the three main objectives of the law as outlined by Gustav Radburch: justice, benefit, and legal certainty. This study employs a qualitative methodology and a socio-legal research design. Interviews with the offenders, victims, and the lurah who served as the government's mediator resulted in the gathering of data. The findings of this study demonstrate that Salatiga City's restorative justice method to conflict settlement has achieved the goals of justice and legal advantage and can even foster good will among the parties. The absence of lurah's legal standing in the resolution of this issue, however, does not satisfy the requirement of legal clarity. For Salatiga City residents, a legal foundation is required for restorative justice-based legal dispute settlement

Abstract

Peran korban dalam terjadinya kejahatan (viktimisasi) cenderung tidak menjadi pertimbangan hakim dalam menjatuhkan putusan. Penelitian ini bertujuan untuk mengkaji victim precipitation dalam pertimbangan putusan hakim. Metode penelitian yang digunakan adalah penelitian hukum yuridis sosiologis dengan pendekatan kasus. Data primer bersumber dari wawancara hakim dan narapidana. Data sekunder berupa putusan hakim dan norma hukum positif. Hasil penelitian menunjukkan bahwa peran korban dalam terjadinya viktimisasi tidak menjadi pertimbangan hakim dalam menjatuhkan putusan terhadap pelaku. Peran korban belum dominan dipergunakan sebagai pertimbangan untuk meringankan pidana yang dijatuhkan kepada terdakwa. Secara normatif dalam Pasal 197 ayat (1) huruf f KUHAP dapat digunakan sebagai ruang bagi hakim untuk memasukkan victim precipitation dalam pertimbangan putusannya sehingga berdampak pada rasa keadilan. Dalam praktik, aspek yang dipertimbangkan oleh hakim untuk meringankan terdakwa lebih ke arah aspek sosiologis, antara lain masih muda, berterus terang, sopan, dan menyesali perbuatannya.

Abstract

The Sumba people has a culture called ‘capturing the bride’ (kawin tangkap), where a man captures the woman he will marry. But its practice has deviated and it became full of intimidation. This paper aims to analyze the ‘capturing the bride’ practice of Sumba people from the victimological perspective. This was descriptive qualitative research. Results show that the current form of ‘capturing the bride’ is a form of violence against women. The violence experienced by ‘capturing the bride’ victims is motivated by a created opportunity and a man’s idealized need to marry a woman. From the victimological perspective, based on Mendelshon’s theory on the degree of victims’ fault, the above victims are completely innocent victims. Based on Schafer’s concept on victim responsibility, they are categorized as biologically and socially weak victims. Then, if related to Fattah’s theory on victim involvement, they are categorized as non-participating victims.

Abstract

The phenomenon of online loans in Indonesia is becoming increasingly prevalent, accompanied by the proliferation of online loan provider services. However, this growth has also led to numerous instances of fraudulent practices within the online lending sector. This study aims to analyze the effectiveness of law enforcement and victim protection in cases of illegal online lending in Indonesia by comparing relevant laws and regulations. The findings of this study reveal that illegal online loans have severe consequences, resulting in victims suffering from material loss, psychological distress, physical harm, and social ramifications. Unfortunately, the current state of law enforcement falls short of delivering justice to the victims, as evidenced by the leniency of sentences imposed on offenders.

Abstract

This study aims to develop a model for the effective implementation of restitution criminal sanctions against individuals involved in trafficking in persons. The findings of this research hold strategic significance in terms of providing legal protection to victims and enhancing the concept of restitution. The study focuses on evaluating the effectiveness of imposing restitution sanctions on traffickers through judicial decisions in Indonesia. By employing a sociological juridical approach, this research examines legal norms and court rulings pertaining to prosecutors' charges against individuals involved in trafficking crimes. The analysis of these judicial decisions reveals that out of the cases reviewed, only seven included restitution sanctions, and none of the perpetrators fulfilled their restitution obligations. Instead, the offenders prioritized serving prison sentences over compensating the victims. Consequently, it is essential for prosecutors to prioritize the prosecution of perpetrators under the Law on the Eradication of Criminal Acts of Individuals. Furthermore, judges should consider utilizing the Law on the Eradication of Non-Criminal Persons and emphasizing imprisonment as an alternative to restitution.

Abstract

This research aims to determine, understand, and analyze elaboratively the effectiveness of implementing diversion and inhibiting factors faced by the police in resolving criminal acts that occur in the jurisdiction of the Banyumas City Police Department. The research method used in this paper is qualitative research with a sociological juridical approach, with analytical descriptive research specifications. The location of this research is at the Banyumas City Police Department. The types and sources of data in this research include primary data and secondary data. Primaries data were obtained through interviews and secondaries data were obtained through literature study which was described narratively and systematically. Based on the research results, it was concluded that the implemention of diversion in resolving criminal acts at the Banyumas City Police Department jurisdiction had been effective in cases that met the material and formal requirements as determined in statutory regulations such as Law Number 11 of 2012 concerning Juvenile Criminal Justice System, Government Regulation Number 65 of 2015 concerning Guidelines for Implementing Diversion and Handling Childen Who Are Not Yet 12 (twelve) Years Old, as well as Police Regulation Number 8 of 2021 concerning Handling Criminal Offenses based on Restorative Justice. Then, regarding the inhibiting factors faced by the police in implementing diversion at the investigation level, they consist of: Legal structure factors, namely the lack of understanding by internal resources, especially police officers at the lowest level (Polsek) regarding the mechanisms and rules for resolving criminal cases through diversion, Legal substance factors, namely the absence of internal police regulations that specifically regulate technical and administrative instructions for investigations (Standard Operational Procedures) relating to the implementation of diversion at the investigative level, (3) Legal culture factors, namely the community at generally, there is still a paradigm that the concept of justice for perpetrators of criminal acts is punishment or criminal imposition which focuses on the aspect of retaliation.

Abstract

Sistem Pemasyarakatan diselenggarakan dalam rangka membentuk Warga Binaan Pemasyarakatan agar menjadi manusia seutuhnya sehingga dapat diterima kembali oleh lingkungan masyarakat. Berkaitan dengan hal tersebut, lapas-lapas di Indonesia telah mengalami kelebihan penghuni yang akan meningkatkan resiko penularan HIV/AIDS. Oleh karena itu narapidana penderita HIV/AIDS harus mendapatkan perlakuan khusus daripada narapidana yang tidak menderita HIV/AIDS. Hal ini tidak hanya untuk kepentingan dirinya, melainkan juga kepentingan kesehatan narapidana lain dari penularan HIV/AIDS. Tujuan penelitian ini adalah untuk mengetahui pelaksanaan pembinaan terhadap narapidana penderita HIV/AIDS di LAPAS IIA Purwokerto dan mengetahui faktor penghambat dalam pelaksanaan pembinaan terhadap narapidana penderita HIV/AIDS di LAPAS IIA Purwokerto. Metode pendekatan yang digunakan dalam penelitian ini adalah yuridis sosiologis dengan spesifikasi penelitian yaitu deskriptif. Jenis data yang digunakan adalah data primer yaitu wawancara dan sekunder yaitu studi kepustakaan. Hasil penelitian  ini disajikan dalam bentuk  uraian-uraian  yang  disusun secara sistematis. Hasil penelitian menunjukan bahwa pembinaan terhadap narapidana penderita HIV/AIDS di LAPAS IIA Purwokerto disamakan dengan narapidana lain yang bukan penderita HIV/AIDS, sehingga pembinaan terhadap narapidana penderita HIV/AIDS  tidak  berjalan  secara optimal.  Adapun  faktor penghambat pembinaan narapidana penderita HIV/AIDS di LAPAS IIA Purwokerto dari struktur hukum yaitu tidak adanya dokter dan psikolog, ruangan khusus konsultasi bagi narapidana penderita HIV/AIDS, tidak diwajibkannya VCT bagi narapidana dan over population, dari   substansi hukum yaitu tidak adanya peraturan dan pembinaan khusus yang mengatur mengenai hak narapidana penderita HIV/AIDS dan dari budaya hukum yaitu HIV/AIDS dipandang sebagai aib oleh masyarakat, sehingga respon masyarakat lebih berorientasi pada labelling negatif terhadap penderita HIV/AIDS, termasuk di dalam LAPAS IIA Purwokerto yang kerahasiaan identitas narapidana penderita HIV/AIDS masih menjadi prioritas utama daripada pembinaan dan pencegahan penularan.Kata Kunci : Pembinaan, HIV/AIDS, Lembaga Pemasyarakatan
