Abstract

Setiap warga negara memiliki kedudukan yang sama di hadapan hukum (equality before the law) sebagaimanadijamin Pasal 27 ayat (1) UUD 1945, hak untuk memperoleh keadilan (access to justice) dalam proses peradilanadalah salah satu wujudnya. Selama ini, hak itu lebih dipunyai oleh mereka yang disebut “the have”, sedangkanyang “the have not” terutama bagi korban kejahatan, seringkali terabaikan. Penelitian ini merupakan penelitianempiris tentang hukum sebagai law in action. Kedudukan korban dalam Sistem Peradilan Pidana (SPP) seringkaliterabaikan, meskipun secara formal sudah diwakili oleh negara. Apabila korban adalah rakyat miskin. Access tojustice bagi mereka sulit diperoleh, kondisi ini diperparah dengan pemahaman yang keliru bahwa pemberianbantuan hukum sebagaimana ditentukan dalam UU No. 16 Tahun 20011 tentang Bantuan Hukum “hanya” ditujukanpada pelaku kejahatan yang juga miskin. Oleh karena itu agar asas equality before the law dan access to justice bagikorban kejahatan yang miskin dapat diwujudkan, perlu dilakukan beberapa hal. Pertama, merekonstruksi kedudukankorban dalam SPP agar tidak terabaikan; kedua, memperbaiki pemahaman mengenai konsep bantuan hukum agartidak berat sebelah bagi pihak-pihak terkait; dan ketiga, pemenuhan hak-hak korban kejahatan oleh aparat penegakhukum, baik diminta atau tidak. Apabila hal tersebut dilakukan, makan jaminan konstituti bukan lagi sebagai mitos.Kata kunci: equality before the law, access to justice, bantuan hukum, rakyat miskin, peradilan pidana

Abstract

The implementation of mediation in court still seems formalistic. This condition makes the process of a civil case proceed to Supreme Court. Accordingly, the interesting discussion would be the implementation of mediation in jurisdiction of Purwokerto District Court as well as potential factors which likely affect the implementation of mediation in jurisdiction of Purwokerto District Court. This is a sociological juridical research by applying qualitative analysis of which the target population is the judge, mediator and advocate who are selected through purposive sampling. Further, it is analyzed by employing triangulation analysis. The result shows that mediation in the Purwokerto District Court has implemented in accordance with the PerMA No. 1 Year 2008. Legal factors, law enforcement, infrastructure and facility factors have basically contributed to the implementation of mediation in Purwokerto District Court. However, the social factors and cultural factors play an important role in the success of mediation. Key words: mediation, mediator, dispute

Abstract

The new authorities of religious courts, particularly in Economics Sharia field still collide with other rules. This writing intends to identify the rules conflict  that exist. Based on the analysis, can be identified the rule conflict  relating to the authority of the judge occurs on the peace effort. Rules of conflict regarding peace with instrument PerMA No.1 year 2008 can be accessed by using the principle of lex superior derogat legi law priori, whereas with regard to the authority prosecuting Sharia Board of arbitration verdict temporarily can use the verdict of the Supreme Court of Cassation Number 56/PK/AG/2011, however this is still not final because we are not wedded to the binding force principle of precedent. The next rule of conflict is related with judgement authority to the bankruptcy matter. On this occasion, the author gives suggestions to immediately syncronize authorities prosecutes’ rules, so it can give birth to legal certainty. Keyword: authority to prosecute, peace, The National Syariah Board Of Arbitration, bankruptcy

Abstract

Procedure of private law in Indonesia have experiencing of some growths, for the example is the mechanism of suing which it's not arranged in Het Herzeine Indonesich Reglement, such as class action, legal standing, citizen lawsuit or actio popularis. This article is study to the difference characteristic of suing in procedure of private law in Indonesia. Pursuant to analysis result, the mechanism of ordinary suing is the mechanism suing by the plaintiff to the sued as effect of contempt of court or break a promise which it have generated loss to plaintiff. Class action is the mechanism of suing by numerous plaintiff which it raised by class representative, that representing his own and his group member, with demand in the form of indemnation. Suing of non government organization (NGO) or legal standing is the mechanism of proffering suing by NGO as collision effect or existence of contempt of court which done by the people which arranged in statues. Citizen lawsuit or actio popularis is a suing that raised by citizen to state, as effect of existence of contempt of court, in the form of neglected the civil rights. Abstract

The legal protection to health care, especially for the poor directed to apply the principles of holistic, unity, evenly, acceptable and achievable. Therefore, this article is useful to explain the rules, policies and barriers that occur in its implementation. Based on the classification, there are 3 part in implementing legal protection and health services include arrangement of the essence of health development, funding and health service delivery. Policies that have been implemented in Banyumas includes a health card namelly jamkesmas, jamkesda, and jampersal. In fact, there are resistance from the aspect of substance, structure and legal culture that affects all three models of its implementation. Key words: legal protection, health care, the poor

Abstract

Globalization development through the market economy system has created injustice for humankind,encouraging Muslims to implement the Sharia in their economic activities. The rapid growth of shariaeconomy in Indonesia, ultimately affects the financial industry, including the banking that implicatesregulation and organizational structure causing two banking systems, namely conventional banking andsharia banking. Based on the description, this paper discusses the national banking law that applies two rulesof law in Indonesia. To address these legal issues, conceptual approach, statutory approach and historicalapproach are used. Based on the analysis, since the enactment of Law Number 21 Year 2008 on Sharia Banking,the existence of sharia banking is getting stronger. Therefore, in Indonesia there is a dual bank system in onerule, namely banking law. Both banks are responsible to bank Indonesia as national central bank.Conventional banks may conduct business activities based on sharia principles, but not so for sharia banks.Keyword: conventional bank, sharia bank, sharia principles

Abstract

Law Amendment of Religious Court Year 2006 brought revolutionary change toward the competencies of the religious court. Law of Religious Court mentioned that Religious Court is only for Muslims. Furthermore, several questions appear such as are they only Muslims who are able to have any case in Religious Court, how is about people who are non-Muslim or how is about other law subjects in form of legal entity whether they can have any case or not. This paper discusses the subjects and the objects of right claim in religious court. Based on the analysis, the judiciary for law subjects who are Muslims or obey to Islamic laws in muamalah matters is done based on Islamic principles. That is what is called as Islamic personalization. This needs to be emphasized that Islamic personalization is an absolute competence in which if it is broken, it will cause right claim become NO (niet ontvankelijke verklaard).Keywords: Islamic personalization, right claim, religious court

Abstract

Religious court as forefront in economic sharia dispute resolution in litigation has not ideal place to perform their duty since there are still regulation conflicts such as implementation of encumbrance right execution which still becomes a domain in district court. As explained, this article discusses phi-losophical foundation of Religious Court competence to resolve economic sharia issues. In regard to this, conceptual approach, law approach and historical approach are respectively used. Based on the analysis, basic competence of religious court is Islamic personality principle which carries the use of Islamic law elements (sharia principle) in its legal relationship. From the analysis the implication is drawn that as long as a dispute belongs to economic sharia, then it is Religious Court which is com-petent to handle including court decision.Keywords: law enforcement, economic sharia dispute, absolute competence, court decision implementation

Abstract

Continuation of the environment at the end of this century has more attention, not only in Indonesia but also throughout the world. Sustainability of the environment this time was viewed as an obligation of the world community. This matter then pushing the environment damage becomes a deed of contempt of court, so it can be a reason to submit the suing. This article study about the solving of environment dispute by extrajudicial procedure and solving of environment dispute by judicial procedure. Based on the analysis, the pollution and destruction of the environment resulted in the loss of certain parties, such as community, the environmental organizations and government. This can be resolved through extrajudicial or judicial procedure. Solution of extrajudicial dispute can be done by mediation, and conciliation of arbitration.
