Citizenship Status is a human right and is crucial for people to receive protection from the state. Human rights are a fundamental element of the state, and citizenship status creates a mutual relationship between citizens and their country. Everyone must have citizenship because the relationship between the state and the citizen grants legal certainty. This study aims to determine and analyze the legal protection of stateless persons living and settling in Indonesia. Additionally, this article examines what legal remedies are available to stateless persons to obtain citizenship status in Indonesia. This research is normative research based on societal norms. The research type is based on the absence of regulation concerning non-stateless persons in Indonesia in Law No. 12 of 2006 concerning Citizenship and Government and Regulation No. 2 of 2007 concerning the Procedure to Obtain, Lose, Cancellate, and Retrieve Indonesian Citizenship. Based on the research results, it can be concluded that stateless persons in Indonesia (pid) are protected by the principles of anti-apatride and the concept of maximum protection. Consequently, the government has the discretion to ensure that former citizens and their descendants who lost Indonesian citizenship can recover their status as Indonesian citizens. Sertipikat hak atas tanah merupakan alat bukti yang kuat sebagaimana dimuat dalam peraturan perundang-undangan, dan sertipikat tersebut sah sebagai alat pembuktian mutlak serta tidak dapat diganggu gugat di kemudian hari. Kalimat “tidak dapat diganggu gugat” tersebut yang kemudian berpotensi melahirkan ketidakadilan bagi pihak ketiga apabila ia merupakan pemilik sah atas bidang tanah yang dijadikan objek pengadaan tanah. Penelitian ini bertujuan untuk mengetahui kesesuaian undang-undang tentang pengadaan tanah untuk pembangunan guna kepentingan umum dengan sistem pendaftaran tanah di Indonesia dan akibat hukum jika ada pihak yang berkeberatan terhadap bukti kepemilikan benda pengadaan tanah untuk pembangunan untuk kepentingan umum. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Metode pengumpulan bahan hukum melalui studi literatur dengan analisis deduktif. Dari hasil penelitian dapat disimpulkan bahwa undang-undang tentang pengadaan tanah untuk pembangunan untuk kepentingan umum tidak sesuai dengan sistem pendaftaran tanah di Indonesia yang menyebabkan jika ada pihak yang berkeberatan dengan sertifikat sebagai bukti kepemilikan. objek pengadaan tanah, maka pihak tersebut akan kehilangan hak atas tanah beserta ganti kerugiannya. kerugian atas pelaksanaan pengadaan tanah apabila pihak yang berkeberatan dapat memberikan bukti-bukti lain yang dapat melemahkan kekuatan pembuktian sertifikat.Kata Kunci: Sertifikat; Pendaftaran Tanah; Pembebasan Tanah.A land title certificate is a strong piece of evidence as stated in statutory regulations, and the certificate is valid as absolute evidence and cannot be contested in the future. The sentence "cannot be contested" then has the potential to give rise to injustice for third parties if they are the legal owners of the plot of land that is the object of land acquisition. This research aims to determine the compatibility of the law regarding land acquisition for development for public purposes with the land registration system in Indonesia and the legal consequences if there are parties who object to proof of ownership of land procurement objects for development for public purposes. The method used in this research is normative juridical using a statutory approach and a conceptual approach. Method of collecting legal materials through literature study with deductive analysis. From the research results, it can be concluded that the law regarding land acquisition for development for the public interest is not in accordance with the land registration system in Indonesia, which causes parties to object to the certificate as proof of ownership. the object of land acquisition, then the party will lose rights to the land along with compensation. losses due to the implementation of land acquisition if the objecting party can provide other evidence that can weaken the evidentiary strength of the certificate.Keywords: Certificate; Land Registration; Land Acquisition.

Parate eksekusi merupakan sarana eksekusi termudah dan cepat bagi kreditur untuk pelunasan piutang manakala debitur cidera janji. Akan tetapi di dalam prakteknya pelaksanaan parate eksekusi sebagaimana Pasal 6 Undang-Undang Hak Tanggungan Atas Tanah Beserta Benda-Benda Yang Berkaitan Dengan Tanah atau yang biasa disebut UUHT sering terkendala. Hal ini dikarenakan terdapat inkonsistensi mengenai mekanisme atau aturan formal dalam pelaksanaan parate eksekusi. Inkosistensi ini terlihat apabila Pasal 6 UUHT dihubungkan dengan Penjelasan Umum angka 9 jo Penjelasan Pasal 14 ayat (2) dan ayat (3) UUHT. Inkonsistensi dalam peraturan tersebut dapat menciptakan ketidakpastian hukum dalam masyarakat. Tujuan dari penelitian ini adalah untuk mengetahui inkonsistensi pengaturan parate eksekusi hak tanggungan dalam UUHT dan formulasi hukum yang tepat untuk mengatasi inkonsistensi terhadap pelaksanaan parate eksekusi objek hak tanggungan atas tanah. Metode yang digunakan adalah metode penelitian yuridis normatif, dengan menggunakan pendekatan perundangundangan dan pendekatan konseptual. Hasil dari penelitian ini adalah apabila dikaitkan antara ketentuan pada Pasal 6 dengan Penjelasan Umum angka 9 dalam UUHT bahwa Penjelasan Umum angka 9 jo Penjelasan Pasal 14 ayat (2) dan (3) UUHT tidak relevan apabila digunakan sebagai dasar hukum pelaksanaan parate eksekusi, dan formulasi hukum untuk mengatasi inkonsistensi ini yaitu dengan melakukan revisi materi muatan UUHT khususnya pasal-pasal yang bermasalah.Kata Kunci: Inkonsistensi; Parate Eksekusi; Formulasi Hukum.The execution parate is the easiest and speedy means of execution for creditors to repay debts when debtors are promised. This is because there are inconsistencies in the formal mechanisms or rules of the execution of the execution. The inconsistency is seen when chapter 6 is linked with the general explanation of Jo chapter 14 verse 2 and verse 3. Inconsistencies in the rules can create legal uncertainties in society. The purpose of this study is to identify inconsistencies in the arrangement of the parate, uuht, and proper legal formulations to overcome the tariff for the execution of the property-rights object. The method used was normatif juridical research, using a regulatory and conceptual approach. The result of this study is when a clause of chapter 6 is incorporated with the general explanation of the number 9 in the uuht that the general explanation of the number 9 is section 14 of verses 2 and 3 of the uuht is irrelevant to use asa basis for the law of executing the parliament of execution, and legal formulation to address this inconsistency by making a revision of the uuht content particularly the troubled chapters.Keywords: Inconsistency; Parate Execution; Legal Formulation.

Seiring meningkatnya kasus kekerasan terhadap anak di Kabupaten Demak pada tahun 2020, peran Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak sebagai lembaga yang melindungi anak sangat diperlukan untuk memperkecil kasus anak korban kekerasan. Penelitian ini menggunakan tipe penelitian yuridis sosiologis dengan menggunakan pendekatan undang-undang. Namun, setelah dilakukan penelitian, peran Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak masih kurang maksimal karena keterbatasan fasilitas dan penerapan peraturan yang masih kurang, sehingga menyebabkan belum maksimalnya peran dari Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak. Hasil dari penelitian ini dilihat melalui kewenangan dari Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kaupaten Demak, yaitu melalui upaya preventif dan represif bagi anak untuk mencegah dan menangani anak korban kekerasan dengan meningkatkan sumber daya manusia dan sarana prasarana untuk mendukung fasilitas agar memudahkan masyarakat mendapatkan edukasi dan melakukan pelaporan dengan tujuan pencegahan dini terhadap kekerasan terhadap anak. Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak telah bekerja sama dengan Forum Anak Demak (FADEM) sebagai pelopor kegiatan positif bagi anak di Kabupaten Demak yang didukung oleh kegiatan edukasi mengenai kekerasan oleh Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak agar memberikan pemahaman terhadap anak.Kata Kunci: Anak; Kekerasan; Dinas Sosial Pemberdayaan Perempuan dan Perlindungan Anak Kabupaten Demak; Forum Anak Demak.As cases of violence against children increase in Demak Regency in 2020, the role of the Demak Regency Women's Empowerment and Child Protection Social Service as an institution that protects children is very necessary to reduce cases of child victims of violence. This research uses a sociological juridical research type using a statutory approach. However, after research was conducted, the role of the Demak Regency Women's Empowerment and Child Protection Social Service was still not optimal due to limited facilities and inadequate implementation of regulations, resulting in the role of the Demak Regency Women's Empowerment and Child Protection Social Service not being optimal. The results of this research are seen through the authority of the Social Service for Women's Empowerment and Child Protection, Demak Regency, namely through preventive and repressive efforts for children to prevent and handle children who are victims of violence by increasing human resources and infrastructure to support facilities to make it easier for people to get education and carry out reporting with the aim of early prevention of violence against children. The Demak Regency Women's Empowerment and Child Protection Social Service has collaborated with the Demak Children's Forum (FADEM) as a pioneer of positive activities for children in Demak Regency which is supported by educational activities regarding violence by the Demak Regency Women's Empowerment and Child Protection Social Service to provide understanding to children.Keywords: Children; Violence; Social Service for Women's Empowerment and Child Protection Demak Regency; the Demak Children's Forum.

This article aims to find the ideal format to implement the Constitutional Court (MK) decision through the principle of erga omnes. The erga omnes aims to guarantee the protection of human rights for all citizens. However, the principle of erga omnes cannot be implemented properly due to the gap between adressat and the verdict issued by the MK. This inconsistency and disobedient will result in decline of the erga omnes. An ideal system is needed to improve the application of the Constitutional Court's decisions in accordance with the principle of erga omnes. The results showed that to maximize the principle of erga omnes requires cooperation between the MK and other state institutions or adressat. This can be combined with the implementation of judicial deferral and the provision of deadlines for the follow-up of decisions imposed on adressat as a representation of determining legal boundaries and certainty.

The constitutional rights of citizens are the main rights that should be protected and guaranteed by the state. However, in practice, there are still several violations of the constitutional rights of citizens in Indonesia, for example in the process of making legal products, namely laws and regulations, which do not include participation from citizens and the increasingly narrowing of citizens' right to freedom in expressing their suggestions and input in public. . Seeing the problems above, researchers try to provide recommendations by internalizing adjudicating Constitutional Question and Constitutional Complaint cases as one of the powers of the Constitutional Court. This research is very important as a basis for state officials in guaranteeing the constitutional rights of citizens in the future. This research uses normative legal methods and a statutory approach. The data collection method was carried out using library research. The results of the research found legal facts that the concepts of Constitutional Question and Constitutional Complaint had not yet been adopted as part of the authority of the Constitutional Court and found several dynamics of violations of citizens' constitutional rights. In practice, the Constitutional Court only has the authority to hear and decide cases where the applicant feels disadvantaged by the existence of the law, not by state officials. Researchers recommend synergies in increasing the accessibility of public services for handling Constitutional Court cases online as well as the implementation of adjudicating Constitutional Question and Constitutional Complaint cases in Indonesia.

In this study, researchers used the Yuridis-Normative legal research and writing methodology by using 3 (three) approaches, including conceptual approaches, statutory approaches, and comparative approaches. This research discusses the opportunities for Diaspora with Indonesian citizenship in the recruitment of Civil Servant Candidates for the Ministry of Education, Culture, Research and Technology. The legal issues raised in this research are as Diaspora with Indonesian citizenship are part of Indonesian citizens who are constitutionally valid so that their rights and obligations apply absolutely based on the 1945 Constitution of the Republic of Indonesia. The issues discussed are the recruitment mechanism to accommodate the participation of Indonesian Diaspora who apply in the general formation and the continuation of studies for Diaspora who have passed the CPNS recruitment. Moreover, in this case, the Diaspora is not regulated in general formations, but special formations.

The government's obligation is to manage land for public and private purposes in accordance with the mandate of Article 33 Paragraph (3) of the 1945 Constitution which states that land, air and natural resources are controlled by the state for the greatest prosperity of the people. The relocation of Rempang residents became news that was conveyed because it received resistance from local residents and was a resonant action as a result of Presidential Decree Number 41 of 1973 which stated that the management rights of Batam Island were handed over to the Batam Authority, which means that the entire island area located on Batam Island was handed over with rights status management to Batam authorities. The legal issues raised by the author are first, how is the relocation of Rempang residents over control of state-owned land and second, what are the legal consequences of the relocation of Rempang residents over control of state-owned land. The aim to be achieved by this author is to analyze the implementation of the relocation of Rempang residents over control of stateowned land and to analyze the legal results of the relocation of Rempang residents over control of state-owned land.

One of the information provided by the The General Election Commission a curriculum vitae of legislative candidates in the legislative elections. Historical life list information is useful for voters as material for consideration in determining their choice according to their preferences. In this article, we will examine how public information disclosure is implemented, especially the curriculum vitae of legislative candidates in the 2024 Legislative Election and how it will affect the The General Election Commission if it does not implement election information disclosure. The method used in this writing is normative juridical with a statutory and contextual approach. The research results show that in the 2024 Legislative Election the percentage of legislative candidates who open their curriculum vitae is greater than the legislative candidates who do not open their curriculum vitae. This phenomenon is caused by the absence of binding regulations that require legislative candidates to open a curriculum vitae. The General Election Commission gives each legislative candidate the freedom to open or not make a curriculum vitae. This step is a form of The General Election Commission effort to carry out public information disclosure. The General Election Commission will be subject to criminal sanctions if it does not carry out information disclosure in accordance with Public Information Openness Law.

Kewenangan pengujian peraturan perundang-undangan (judicial review) yang sama-sama diberikan kepada Mahkamah Konstitusi (MK) dan Mahkamah Agung (MA) menimbulkan problematika khusus di dalam sistem kekuasaan kehakiman di Indonesia. Permasalahan tersebut terlihat jelas utamanya dalam implementasi kewenangan baik yang dimiliki MK maupun MA, sebagaimana tidak jarang norma hukum yang dihasilkan oleh putusan MK dan MA saling bertolak belakang. Dengan menggunakan metode penelitian yuridis normatif, artikel ini berupaya untuk mendiskusikan bagaimana kekuatan mengikat putusan pengujian undang-undang pada MK terhadap putusan pengujian peraturan perundang-undangan di bawah undang-undang pada MA. Selain itu artikel ini juga hendak memberikan gambaran bagaimana menyelesaikan problematika pertentangan putusan antara pengujian peraturan perundang-undangan dibawah undang-undang pada MA dan pengujian undang-undang pada MK. Artikel ini berkesimpulan bahwa perlu dilakukan integrasi pengujian satu atap peraturan perundang-undangan dibawah MK. Puncaknya, artikel ini merekomendasikan untuk melakukan sinkronisasi dan harmonisasi dengan cara melakukan perubahan terhadap UUD NRI 1945, Undang-Undang Kekuasan Kehakiman, Undang-Undang MA dan Undang-Undang MK.
