Abstract

The concept of the welfare state upholds the existence of the legal system under the premise of legal certainty and the protection of basic human rights. Paragraph IV of the 1945 Constitution of the Republic of Indonesia emphasizes the existence of “state obligations” and “the government duty” to protect and serve all public interest. The normative basis of the Constitution was translated as the national principle to embody the public services. The Public Service Law Number 25 of 2009 is a formulation of legal certainty. However, the main problem that occurs in the public services is maladministration in bureaucracy. It is important to build interpretations of the authority attached to the bureaucratic system or on subjects who become government officials. By analyzing the Constitution, this article states that the government official dimensions must be considered as an interrelated issue, so that the articulate practice must be seen as inherent social conditions. Abstract

The ratification of Law 6/2023 creates a new norm for granting HGU, which is stated in Article 129 Paragraph (2) that the right: to cultivate; build use; and use, can be provided on top of HPL. Based on the closing provisions of Law 6/2023 Article 184 which states that all implementing regulations remain in force as long as they do not conflict with government regulations in place of this law, PP 18/2021 is still valid. The government regulation states that in Article 8 Paragraph (1) HPL can be granted HGU. This can result in abuse of authority as has occurred in the general transmigration program for West Java residents to Riau Province in East Tambusai Village, Kampar Regency, the Regional Government of Riau Province part of the transmigration management land was carried out in collaboration with PT Pancasurya Agrindo. The research carried out was to analyze the implementation of granting HGU applications above HPL to determine the basis and legal certainty of HGU above HPL. This research using the normative juridical research method found the problem related to the basis and the legal certainty of HGU above HPL. Legal certainty from HGU above HPL is not optimal if based on the analysis of existing cases, because the application article for the issuance of HGU above HPL does not provide space for people who object to the issuance of HGU certificates. Legal certainty will be implemented if the law related to the implementation of HGU above HPL is effective.

Abstract

Abstract As President whose own the prerogative rights in order to doing governmental affairs, besides Vice President, President also assisted by Minister, it is regulated on Article Number 17 of Constitution of the Republic of Indonesia year 1945. Nor, the authority of appoint the ministers in the cabinet, President also has the authority to appoint the Vice Minister but this authority only can applied on particular circumstances which regulated on Article Number 10 of Law No. 39 Year 2008 about Ministry of State. As the history told, that seat of Vice Minister is has existed since the first year of Presidency of Soekarno, after the Independent Day. Yet, by the time goes the issues about Prime Ministry has regulated in Law No. 39 Year 2008 about Ministry of State and also in Presidential Decree No. 47 Year 2009 about Formation and Organizations of State Ministries. As the factual in reality practical, the appoint of Vice Minister gain the Pros and Contras for the society, because it impress the public the imagination of being political appointee as a gift for support coalition of the cabinet. The existences of Vice Minister is to assisted the Minister with the urgency situation, supposed to assisted in particular circumstances. This article aims to understanding and explain the main issues by using normative constitutional research method and legal approach method. Abstrak Dalam hak prerogatifnya sebagai Presiden dalam menjalankan tugasnya, selain Wakil Presiden, Presiden juga dibantu oleh Menteri. Hal ini diatur dalam Pasal 17 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Selain kewenangannya dalam mengangkat Menteri, Presiden juga memiliki kewenangan dalam mengangkat Wakil Menteri, hal ini diatur dalam Pasal 10 Undang-Undang No. 39 Tahun 2008 Tentang Kementerian Negara. Dalam penerapannya dengan sesuai fakta terjadinya pengangkatan Wakil Menteri menuai Pro dan Kontra bagi para rakyat karena dalam pengangkatannya terkesan bahwa jabatan Wakil Menteri merupakan hadiah politik yang dimanfaatkan dan diberikan hanya untuk para koalisi pendukung kabinet. Dalam menyelesaikan permasalahan-permasalahan tersebut penelitian ini memberikan gagasan melalui rumusan masalah berupa pengkajian hukum mengenai urgensi dan fungsi pengangkatan jabatan Wakil Menteri, serta pertimbangan upaya hukum dalam memberikan batasan dalam pengangkatan Wakil Menteri melalui pengaturan hukum mengenai persyaratan dalam pengangkatannya. Artikel ini bertujuan untuk memahami dan menjelaskan permasalahan-permasalahan yang menjadi pokok utama pembahasan dengan menggunakan metode penelitian hukum normatif dan pendekatan undang-undang, pendekatan konseptual, serta pendekatan kasus. Dengan adanya pengaturan mengenai pengangkatan wakil menteri diharapkan untuk tidak dijadikan sebagai jabatan yang digunakan untuk mengakomodasi koalisi pendukung kabinet alias menjadikan posisi wakil menteri sebagai hadiah politik. Selain itu, dalam penerapannya Presiden selaku kepala pemerintahan semestinya mempertimbangkan syarat yang telah dijelaskan oleh Mahkamah Konstitusi supaya tidak terjadi rangkap jabatan yang dilakukan oleh Wakil Menteri. Maka dengan kesimpulan dalam penelitian ini membuahkan saran yaitu, seharusnya meskipun dalam kewenangannya Presiden mengangkat Wakil Menteri perlu adanya penilaian yang mempertimbangkan kefektivitasan dan keefisiensi keadaan suatu Kementerian dan seharusnya posisi Wakil Menteri harus memiliki syarat yang diatur secara tertulis dalam Peraturan Perundang-undangan. Guna menghindari terjadinya rangkap jabatan bagi Wakil Menteri, seharusnya pemberlakuan syarat Menteri juga berlaku bagi Wakil Menteri. Sehingga secara konstitusi terdapat batasan Presiden dalam kewenangannya.

Abstract

The function of judicial power is to enforce law and justice in the framework of protecting society through justice system based on law in a democratic state of law. One of the important principles of state of law is the existing guarantee of judicial power implementation which is independent, free from the influence of other power to implement justice for law and justice enforcement. Accountability of judge’s performance and Supreme Court institution which is a control form for justice institution becomes an idea concerning the dilema of judicial power independence concept. The supervision of judge’s behaviour by Judicial Commission can hopefully cover the weakness intern supervision by Supreme Court. The judge supervision which can be realised by Judicial Commission includes judicial technic supervision, performance assessment, and judge’s behaviour supervision. This research concerned to the reinforcement of judicial supervision function by judicial commission and Supreme Court as a form of shared responsibility system. The research method used in this research is normative law research method with statute approach, conceptual approach and case approach. Sources of legal materials used are legislation and cases. The results of this study are: the supervision on the judge’s behavior by the Judicial Commission can hopefully cover the weakness of internal supervision by the Supreme Court. It becomes so appropriate that the suprevision on judge is also performed by the Judicial Commission, not only by the Supreme Court. The supervision on judge that can be performed by the Judicial Commission includes the suprevision of judicial technique, performance assessment, and supervision on the judge’s behavior.

Abstract

The constitutional rights of citizens are the main rights that should be protected and guaranteed by the state. However, in practice, there are still several violations of the constitutional rights of citizens in Indonesia, for example in the process of making legal products, namely laws and regulations, which do not include participation from citizens and the increasingly narrowing of citizens' right to freedom in expressing their suggestions and input in public. . Seeing the problems above, researchers try to provide recommendations by internalizing adjudicating Constitutional Question and Constitutional Complaint cases as one of the powers of the Constitutional Court. This research is very important as a basis for state officials in guaranteeing the constitutional rights of citizens in the future. This research uses normative legal methods and a statutory approach. The data collection method was carried out using library research. The results of the research found legal facts that the concepts of Constitutional Question and Constitutional Complaint had not yet been adopted as part of the authority of the Constitutional Court and found several dynamics of violations of citizens' constitutional rights. In practice, the Constitutional Court only has the authority to hear and decide cases where the applicant feels disadvantaged by the existence of the law, not by state officials. Researchers recommend synergies in increasing the accessibility of public services for handling Constitutional Court cases online as well as the implementation of adjudicating Constitutional Question and Constitutional Complaint cases in Indonesia.
