Abstract

The government's obligation is to manage land for public and private purposes in accordance with the mandate of Article 33 Paragraph (3) of the 1945 Constitution which states that land, air and natural resources are controlled by the state for the greatest prosperity of the people. The relocation of Rempang residents became news that was conveyed because it received resistance from local residents and was a resonant action as a result of Presidential Decree Number 41 of 1973 which stated that the management rights of Batam Island were handed over to the Batam Authority, which means that the entire island area located on Batam Island was handed over with rights status management to Batam authorities. The legal issues raised by the author are first, how is the relocation of Rempang residents over control of state-owned land and second, what are the legal consequences of the relocation of Rempang residents over control of state-owned land. The aim to be achieved by this author is to analyze the implementation of the relocation of Rempang residents over control of stateowned land and to analyze the legal results of the relocation of Rempang residents over control of state-owned land.

Abstract

One of the information provided by the The General Election Commission a curriculum vitae of legislative candidates in the legislative elections. Historical life list information is useful for voters as material for consideration in determining their choice according to their preferences. In this article, we will examine how public information disclosure is implemented, especially the curriculum vitae of legislative candidates in the 2024 Legislative Election and how it will affect the The General Election Commission if it does not implement election information disclosure. The method used in this writing is normative juridical with a statutory and contextual approach. The research results show that in the 2024 Legislative Election the percentage of legislative candidates who open their curriculum vitae is greater than the legislative candidates who do not open their curriculum vitae. This phenomenon is caused by the absence of binding regulations that require legislative candidates to open a curriculum vitae. The General Election Commission gives each legislative candidate the freedom to open or not make a curriculum vitae. This step is a form of The General Election Commission effort to carry out public information disclosure. The General Election Commission will be subject to criminal sanctions if it does not carry out information disclosure in accordance with Public Information Openness Law.

Abstract

Kewenangan pengujian peraturan perundang-undangan (judicial review) yang sama-sama diberikan kepada Mahkamah Konstitusi (MK) dan Mahkamah Agung (MA) menimbulkan problematika khusus di dalam sistem kekuasaan kehakiman di Indonesia. Permasalahan tersebut terlihat jelas utamanya dalam implementasi kewenangan baik yang dimiliki MK maupun MA, sebagaimana tidak jarang norma hukum yang dihasilkan oleh putusan MK dan MA saling bertolak belakang. Dengan menggunakan metode penelitian yuridis normatif, artikel ini berupaya untuk mendiskusikan bagaimana kekuatan mengikat putusan pengujian undang-undang pada MK terhadap putusan pengujian peraturan perundang-undangan di bawah undang-undang pada MA. Selain itu artikel ini juga hendak memberikan gambaran bagaimana menyelesaikan problematika pertentangan putusan antara pengujian peraturan perundang-undangan dibawah undang-undang pada MA dan pengujian undang-undang pada MK. Artikel ini berkesimpulan bahwa perlu dilakukan integrasi pengujian satu atap peraturan perundang-undangan dibawah MK. Puncaknya, artikel ini merekomendasikan untuk melakukan sinkronisasi dan harmonisasi dengan cara melakukan perubahan terhadap UUD NRI 1945, Undang-Undang Kekuasan Kehakiman, Undang-Undang MA dan Undang-Undang MK.

Abstract

The concept of the welfare state upholds the existence of the legal system under the premise of legal certainty and the protection of basic human rights. Paragraph IV of the 1945 Constitution of the Republic of Indonesia emphasizes the existence of “state obligations” and “the government duty” to protect and serve all public interest. The normative basis of the Constitution was translated as the national principle to embody the public services. The Public Service Law Number 25 of 2009 is a formulation of legal certainty. However, the main problem that occurs in the public services is maladministration in bureaucracy. It is important to build interpretations of the authority attached to the bureaucratic system or on subjects who become government officials. By analyzing the Constitution, this article states that the government official dimensions must be considered as an interrelated issue, so that the articulate practice must be seen as inherent social conditions.
