Abstract

Ijtihad in the field of zakat has been started since the launch of Yusuf Qardhawi writings, Fiqh al-Zakâh. Zakat which has been traditionally interpreted, broken down by Yusuf Qaradawi to create newcategories, namely zakat stocks and bonds. The objectif of research is to finding Yusuf Qardhawi’sthought about zakat stocks and bonds. This type of research is study of literature, and the research are descriptive. Qardhawi’s opinion, factories and buildings can be analogous to agricultural land, so that zakat must be paid 10% or 5% of net revenues. Meanwhile for trading company, its zakat taken from its appropriate at the prevailing market price plus a profit. Bond issued zakat taken when bonds were already in the hands of the owner for a year or more. The bonds that bring interest, such as obligatoryzakat issued trading, must be paid 2.5%.Ijtihad dalam bidang zakat telah dimulai sejak Yusuf Qardhawi meluncurkan karya tulisnya, Fiqh al-Zakâh. Zakat yang selama ini dimaknai secara tradisional, didobrak oleh Yusuf Qardhawi dengan membuat kategori baru, yaitu zakat saham dan obligasi. Tujuan penelitian untuk mengetahui pemikiran Yusuf Qardhawi mengenai zakat saham dan obligasi. Jenis penelitian adalah penelitian kepustakaan dan sifatnya penelitian deskriptif. Menurut Qardhawi, pabrik dan gedung dapat dianalogikan dengan tanah pertanian, sehingga harus dikeluarkan zakatnya 10% atau 5% dari pendapatan bersih.Sedangkan perusahaan perdagangan, zakatnya diambil dari sahamnya sesuai harga yang berlaku di pasar ditambah keuntungan. Zakat obligasi wajib dikeluarkan bila obligasi itu sudah berada di tangan pemilik selama satu tahun atau lebih. Obligasi yang mendatangkan bunga, wajib dikeluarkan zakatnya seperti zakat perdagangan, yaitu sebesar 2.5%.Kata kunci: Pemikiran Yusuf Qardhawi, Zakat Saham dan Obligasi.

Abstract

Islamic law came with the realization of the mission and the maximization maslahah and elimination and minimization madarrah. In fact, there are frequently used the slogan, "Where there is a law of God's where maslahah and wherever maslahah that's where the law of God". Once the close of Islamic law with maslahah, the scholars use maslahah as istinbat method, source, and destination of Islamic law. Lately to unveil the veil on a law prescribed destination is because there are elements of the benefit in it. Once the urgency maslahah that sometimes appears the statement that the possibility of a benefit will remain high even though contrary to scriptures, either Nas al-Qur'an, Hadith, and ijma '. Maslahah is looking good and benefit and avoid mafsadah (damage). Maslahah able to collaborate with other disciplines within the law establishes a case. Of note, the benefit of which is contained in it qualifies maslahah that could be used as evidence. For instance, cooperation between maslahah with medical science in the matter of abortion. Where basically the legal origin of abortion is prohibited, but because there is a greater benefit of the legal origin of abortion can be shifted into even sometimes required when there is a greater benefit in it

Abstract

Ibrahim Hosen is an expert on Islamic law whose opinions often controversial. He is known as a unique thinker and dare to be different through the argument he built. In the development of Indonesian Islamic law in the late 20th century, Ibrahim's contribution was deeply taken into account. He often comes up with brilliant ideas every emerging problem of actual Islamic law. His ijtihad of beer excluding the forbidden kamr, lottery, Porkas, and SDSB is not the same as gambling, and his response to the issue of lard in Indonesia, has raised many question marks among Islamic legal thinkers about his capabilities and independence in his ijtihad.A qualified educational experience makes him appear to be an expert in Islamic law who often issue a brilliant fatwa that often cross with the existing discourse. His mastery of the opinions of the madhab scholars and the principles of istinbat}, his expertise in using the arguments, and his understanding of maqasid al-syari`ah is reflected in the results of his ijtihad.Among his Islamic legal thought that is the imperative for those who can not afford to be ijtihad and ijtihad imperative for people who are able and qualify ijtihad. He also allows talfiq though only to seek relief. There are nine methods used to re-actualize Islamic law, among which are: contextualization of the Qur'an and Hadith, promoting maslahah mursalah, fiqh the qat'i etc. Some of his controversial fatwas are about the permissibility of Family Planning (KB), organ donation, euthanasia, and others.

Abstract

Discussing about abortion as we discuss about human life. As human beings we should not live in a place of residence or take one's life away because this is not in accordance with maqashid al-shari'ah and Human Rights. Islam as an elastic and dynamic religion views abortion as not always blameworthy, but by first seeing one's legal status in having an abortion. The difference in „illat law will result in a different legal status. From this background, the writer is interested to explore further about abortion in the controversy of the jurists and the things that are the background of different views and understand further opinions about abortion law. Hanafi permitted abortion with the permission of his parents. The fuqaha Malikiyah forbid reserve abortion after semen in the womb, but some others confirm it. The majority of fuqaha Shafi'iyah allows abortion before the spirit is blown, while after the age of 40 days the law is haram. Imam al-Ghazali forbids the abortion of the fetus in all phases of development in pregnancy. The Hambali Madhab generally permits abortion before the blowing of the spirit. Ibn Jauzi forbade since before the blowing of the spirit in all phases of fetal development. The controversial contribution among the jurists in determining the law of abortion is motivated by differences in the arguments (al-ta'a rud al-adillah) between the traditions narrated by Bukhari and the traditions narrated by Muslims. Opinions that are more about abortion law are haram In addition to being against the right to life, abortion is one form of coverage and murder.

Abstract

Before Islam came, in many parts of the world women are subjected to humiliation andabuse. Women are considered as goods that can be traded, transferred, and inherited.Islam comes to improve the condition of women by elevating their status, giving themrights as men have rights over themselves and their assets, even women are no longerconsidered as inheritance assets, but as heirs who are also entitled to inherited property.Over time and the increasing education and knowledge possessed by women resulted inthe desire for women to get the same or equal rights as men. This condition seems tohave received support from many parties. This can be seen frome the emergence offemale warrior figures who passionately fight for women’s rights, such as: AminaWadud, Fatima Mernissi, Riffat Hasan, Rifa’ah Thahthawi, Qasim Amin and others.Among the few that are being discussed is: the creation of women, the concept ofnusyuz, distribution of inheritance, the existence of historical material control, lack ofwomen experts, very strong male hegemony, and against the developmentalismparadigm.

Abstract

Pregnant and breastfeeding women are one of the groups affected by the chitab of the fasting order as mentioned in surah al-Baqarah (02) verse 183. However, in the following verse, verse 184 of surah al-Baqarah (02) it is explained that for people who are sick or on the way (then not fasting), it is obligatory to change (qadha') fasting for as many days as the day left. Meanwhile, people who are hard to fast are obliged to pay fidyah. This difference of opinion is motivated by the view that pregnant and breastfeeding women are legally equal with menstruating women, childbirth, sick people and travelers. So that only obliged to replace the fast (qadha’) the fast only. While some other scholars view that pregnant and breastfeeding women cannot be the same as those who are sick but are equated with people who are hard to fast so that apart from being obliged to change their fast (qadha’), their fasting is also required to pay fidyah. This difference of opinion results in confusion in the community, especially for pregnant and breastfeeding women who are unable to carry out the Ramadan fast regarding the obligation to replace the fast (qadha’) the fast that was left alone or replace the fast (qadha’) fasting and pay fidyah.

Abstract

Background: Salah satu potensi Desa Kalangan di Kabupaten Bojonegoro adalah bunga mawar yang mana harga bunga ini kurang memberikan keuntungan bagi masyarakat karena kebutuhannya tergantung dengan adanya acara adat saja. Dengan adanya potensi tersebut, tim KKN Universitas Nahdlatul Ulama Sunan Giri (UNUGIRI) melakukan pelatihan pengolahan mawar menjadi sebuah produk makanan sehat yang bernilai ekonomi tinggi. Pengabdian ini bertujuan untuk meningkatkan pengetahuanpengolahan dan manfaat makanan dari bahan baku bunga mawar untuk meningkatkan produktivitas masyarakat Desa Kalangan dengan menaikan potensi yang ada di Desa Kalangan sebagai produsen Bunga Mawar. Metode: Target yang diberikan oleh tim KKN UNUGIRI adalah Ibu-Ibu PKK dari Desa Kalangan sebanyak 35 orang. Metode pelaksanaan pengabdian ini dilaksanakan melalui 4 tahapan selama 2 hari yaitu penggalian pengetahuan, sosialisasi, praktik pembuatan Selai Mawar, dan evaluasi akhir. Pengambilan data dilakukan pada seluruh peserta yang mengikuti pelatihan pembuatan olahan dari bunga mawar dan pemasaran produk secara e-commerce.Hasil: Hasil kegiatan yang diberikan telah menambah pengetahuan dan wawasan bagiwarga Desa terkait produk olahan bunga mawar, serta menambah pendapatan masyarakat ketika produk tersebut dijual di pameran produk desa yang diadakan di alun-alun Bojonegoro. Evaluasi pelatihan diperoleh 80% peserta mengalamipeningkatan pengetahuan dan wawasan terkait produk olahan bunga mawar. Kesimpulan: Diperoleh kesimpulan bahwa peningkatan potensi bunga mawar menjadi produk olahan dapat memberikan nilai tambah secara ekonomi bagi pendapatan warga Desa yang mana disarankan adanya inovasi lain seperti bibit parfum bunga mawar.

Abstract

Pasal 7 ayat (1) Undang-undang No. 16 Tahun 2019 sebagai revisi atas Undang-undang No. 1 Tahun 1974 menyebutkan bahwa perkawinan hanya diizinkan apabila pria dan wanita sudah mencapai umur 19 tahun. Hal ini berbanding terbalik dengan kondisi di Masyarakat Kecamatan Ngasem Kabupaten Bojonegoro. Angka nikah dini di Bojonegoro sangat tinggi, bahkan pada saat malem songo bulan Ramadhan tahun 2023 menembus 500 perkara dengan didominasi dari kecamatan Kedungadem, Temayang, Sekar dan Ngasem. Tujuan yang ingin dicapai dalam pengabdian ini adalah untuk menekan tingginya angka pernikahan dini di Kecamatan Ngasem Kabupaten Bojonegoro. Metode penelitian menggunakan metode Participatory Action Research (PAR) yang menekankan pada keterlibatan atau partisipasi remaja Kecamatan Ngasem dalam pelatihan pembuatan buket sebagai upaya pencegahan pernikahan dini. Langkah yang dilakukan meliputi: to know, to understand, to plan, dan to action and reflection. Hasil dari pelaksanaan pengabdian kepada masyarakat teridentifikasi beberapa faktor pemicu terjadinya pernikahan dini di Kecamatan Ngasem, yaitu: faktor lemahnya ekonomi, tidak adanya kegiatan yang dilakukan para remaja, terjadinya kehamilan di luar nikah, dan lain sebagainya. Melalui pelatihan ini, para remaja akan mampu mandiri secara finansial dan tidak terjebak pada pernikahan dini. Di samping itu, remaja akan mendapatkan skill atau keterampilan baru dalam pembuatan buket, mengingat buket akhir-akhir ini sangat diminati masyarakat untuk berbagai kebutuhan, seperti: kado wisuda, ulang tahun, pernikahan, dan lain sebagainya.
