Abstract

This paper discusses the application of al-qawâid al-fiqhîyah (legal principles) as deductive reason in legal reasoning through usûl al-fiqh approach. This paper seeks to answer a problem of how deductive reason using al-qawâid al-fiqhîyah is regarded as the source of Islamic law in the perspective of classical and contemporary religious scholars (ulama). Basing mainly on the legal approach, this paper argues that not all ulama are familiar with, and therefore, employ al-qawâid al-fiqhîyah in the making of Islamic legal opinion. This study concludes that the views of classical and contemporary ?ulama on this issue can be classified into three groups: a) those who categorically reject legal principles as direct reference of Islamic legal reasoning; b) those who permit the use of legal principles as evidence or reference in legal reasoning; and c) those in the middle position, permitting the use of legal principles as reference on the condition that this principle should be derived from the primary source of Islamic law (al-Qurân and Sunnah), not from the legal thought of jurists.

Abstract

Muslim scholars argue that the relationship between usul fiqh, philosophy, and logic is ‘alāqah ihtiyājiyyah manhājiyyah (methodological need relationship) because the legal ground in the theory of usul fiqh is not only derived from the scripture (naqlī) such as the Qur’an and Hadits but also from logic (‘aqlī). In order to have more understanding in the textual reason (naqlī), it requires logical reason or logical competence. This paper attempts to analyze critically and comprehensively such relationship so it will be revealed the position of philosophy and logic in Islamic law. This is important since Muslims still view that philosophy and logic are irrelevant with Islam. This study demonstrates that the relationship between philosophy and logic with Islamic law is very strong because the methodology of Islamic law (usul fiqh) accommodate them. So it is a methodological relationship. Thus, claiming that these two disciplines are forbidden in Islam, as Muslims may assume, is untenable. Abstract

The reform of ushul fiqh is perhaps the most significant achievement in the rebirth of Islamic philosophy. Only when people realize the phenomenon of stagnation of traditional fiqh can ushul fiqh be renewed. This awareness can only be built if people realize the need for reform of religious thought and practice it on a large scale. Many scholars propose a reconstruction of ushul fiqh, intending to show that religion can be used to solve everyday problems. Sheikh Ali Jum'ah, Izzudin Ibn Abdus Salam, and Ibn Ashur were prominent figures. Brilliant ideas and practical solutions seem to have entered the paradigm of Indonesian Islamic thought, especially the paradigm of ushul fiqh reform, which is still stagnant. Another weakness of fiqh and ushul fiqh is that there is no dynamic relationship between them and the social sciences, thus losing their relevance to the needs of the people. The mufti of Egypt, Sheikh Ali Jum'ah, also had the same view regarding the reformulation of Usul fiqh produced by previous scholars. So that Usul fiqh can be more developed and adaptive to new problems. Sheikh Ali Jum'ah's tajdid offer, namely: Restoring the old study form of ushul fiqh with an updated structure; Returning several views on several issues and using new opinions on existing problems, as well as reusing aqli in discussing these problems; Returning some views on the application of the rules to this science and in this application sticking to other views; Restoring this scientific structure by the novelty of the illat, and make this renewal according to the character of ushul fiqh according to their respective streams.

Abstract

Hukum Islam yang dalam penetapannya tidak dapat terlepas dari dalil-dalil al-Qur’an dan Sunnah yang bersifat terbatas, sedangkan kehidupan masyarakat terus berkembang dan dinamis. Oleh karena itu, pembaharuan dalam teori penetapan hukum Islam melalui pintu ijtihad dipandang menjadi penting untuk memecahkan berbagai problem mayarakat. Sejak abad I sampai VII H perkembangan metodologis ilmu usul fikih telah melahirkan lima aliran, yaitu: al-Syafi’iyyah, al-Hanafiyyah, al-Jam’i (gabungan antara keduanya), Takhrij al-Furu’ ‘ala al-Usul dan al-Syatibiyyah (al-Maqasidiyyah). Diilhami oleh metode Syatibi inilah geliat pembaharuan metode istinbat dalam ilmu usul fikih mulai berkembang, sehingga muncul beberapa pemikir muslim kontemporer seperti Fazlur Rahman, Mohammed Arkoun, Hasan Hanafi, Muhammad Syahrur, ‘Abdullah Ahmad al-Na’im, Riffat Hassan, dan lain-lain. Mereka semua menyorot secara tajam paradigma keilmuan Islamic studies, khususnya paradigma keilmuan usul fikih dan merekapun menyerukan pembaharuan (reformasi) dalam teori penetapan hukum Islam. Ada titik temu dari beberapa ide-ide pembaharuan dalam teori penetapan hukum Islam, yaitu lima prinsip istinbat sebagai berikut: Fiqh al-Maqasid atau al-Maslahah (prinsip maslahat); Fiqh al-Taghayyur atau al-Tajdid (prinsip pembaharuan); Fiqh al-Taysir (prinsip kemudahan); Fiqh al-Awlawiyyat (prinsip prioritas), dan Fiqh al-Waqi‘ (prinsip realitas).

Abstract

Jeulamee was the nickname of dowry in Aceh, it was just that the term jeulamee had an exclusive meaning, that gold ‎is the only form of dowry that was traditionally recognized in Aceh. Another uniqueness was that gold was ‎measured by the size of the mayam. One mayam alone was equivalent to 3. 3 grams of gold. Jeulamee was a hot issue that repeatedly stuck out along with the holding of marriages in the community. When ‎it was heard that a marriage was about to took placed, the opinion of the jeulamee would followed him. The ‎screams of the youth in Aceh, “hana peng hana inong” (no money, no wife) seemed to voiced a cynical criticism ‎that only men with the title of financial freedom could marry. This studied aims to explained and analyze the ‎concept of jeulamee in Acehnese marriage from the perspective of Islamic Law. The typed of researched used was sociological legal researched, with a phenomenological approached and the data ‎analysis was descriptive-qualitative. Data was collected by used interview and observation techniques. The ‎results showed that the obligation of gold as a marriage dowry in Peunaron sub-district did not conflict with ‎Islamic Law, this was evidenced by the absence of the opinion of the four madhhab scholars who oblige and ‎forbid it, there was even a hadith of the prophet Muhammad SAW that allowed his companions to marry with a gold dowry. There were two arguments for the preservation of jeulamee, namely: first, materialistic idealist, that jeulamee was ‎a tradition that was created and had a good purpose, such as preventing divorce, motivating young people who ‎want to got married to worked hard, because wealth was a necessary provision to navigate life, and uplift and ‎glorify women; second, normative formalistic, that jeulamee was a law of agreement from the community ‎‎(becoming customary law) and did not deviate from the concept of dowry in Islam.

Abstract

Conditions in the household life of a mentally retarded couple have various challenges, if there are a variety of problems in the life of a mentally retarded couple that cannot be handled properly, it will be a source of problems in the household. In the midst of these problems, there is the Sidoharjo village government which provides assistance through various efforts in finding a way out of various problems to create a sakinah family for mentally retarded couples. This study aims to analyze the assistance provided by the Sidoharjo Village Government to mentally retarded couples in realizing a sakinah family from the perspective of Abraham Maslow's hierarchy of needs theory. The results of this study indicate: 1) the perception of a sakinah family, a mental retardation partner, when under any circumstances they can still live life together, always have peace. 2) the problem faced by the Sidoharjo village government during the mentoring is communication. Problems faced by mental retardation couples are divided into two parts, namely internal and external. 3) the assistance provided by the Sidoharjo village government can be seen by fulfilling the five needs identified by Abraham Maslow, namely the fulfillment of financial needs that come from the assistance of various parties, assistance when there are family problems, assistance in terms of administrative arrangements, in terms of interaction providing understanding to the community. related to the condition of the partners with mental retardation.

Abstract

Menyegerakan zakat harta yang tertuang dalam Surat Edaran Menteri Agama No.06 Tahun 2020 dilakukan untuk kemaslahatan umat. Teori dlawabith al-Maslahah d al-Buthi dirasa pelu menjadi alat pengukur tentang Batasan seuatu dikatakan sebagai maslahah. Maka dari itu timbulah rumusan masalah sebagai berikut: pertama, bagaimana hukum menyegerakan zakat dalam Undang-Undang zakat?. Kedua, bagaimana kesesuaian menyegerakan zakat perpsektif teori Dlawabith al-Maslahah Al-Buthi. Penelitian ini merpakan penelitian normative dengan menggunakan pendekatan konseptual atau pustaka (Conceptual Approach). Hasil penelitan ini mempunyai kesimpulan bahwa dalam Undang-Undang zakat, bahwa untuk melakukan pembayaran zakat harta harus mencapai Nishab dan haul. Kedua, dalam teori Dlawabith al-Maslahah al-Buthi jika menyegerakan zakat harta demi kemaslahatan dan tidak bertentangan dengan tujuan syariah, al-Qur’an dan Hadis. (hastening the zakat of assets contained in the Circular of the Minister of Religion No. 06 of 2020 is carried out for the benefit of the people. The theory of dlawabith al-Maslahah d al-Buthi feels the need to be a measuring tool about the boundaries of something said to be maslahah. Therefore, the formulation of the problem arises as follows: first, how is the law hastening zakat in the zakat law? Second, how is the suitability of accelerating zakat from the perspective of Dlawabith al-Maslahah Al-Buthi theory. This research is a normative research using a conceptual approach or literature (Conceptual Approach). The results of this research have the conclusion that in the Zakat Act, that in order to pay zakat assets, it must reach the Nishab and haul. Second, in the theory of Dlawabith al-Maslahah al-Buthi, if it hastens the zakat of wealth for the benefit and does not conflict with the objectives of sharia, the Koran and Hadith.)

Abstract

The seller in the shopee application is given various features of the dropship feature that can be easily accessed by the dropshipper to run their business by getting items they want to resell on social media. This research was conducted to determine the law of buying and selling gold by dropship in the opinion of the Indonesian Ulama Council (MUI) of North Sumatra province. This research is classified into doctrinal law research type. This research is called field research and sociological law research. The approach used is a sociological juridical approach and conceptual approach. the gold dropship mechanism in the shopee application has several stages that must be passed by the dropshipper to be able to get the desired gold and directly sent to the buyer by including the dropshipper's identity as the sender and not the identity of the gold owner. There is no relationship between the gold owner in the shopee app and the dropshipper who don't even know each other. Transactions that occur between the two are only buying and selling transactions. According to the Indonesian Ulama Council (MUI) of North Sumatra province, the gold dropship transaction in the shopee application is unlawful. This is because gold is ribawi amwal which has special treatment if it is used as an object of buying and selling. Legitimate buying and selling of gold is done face-to-face and cash.

Abstract

Kerjasama yang kerap dilakukan oleh masyarakat di Desa Dahu adalah kerjasama maroan, yaitu bentuk kerjasama bagi hasil pertanian yang dilakukan oleh penggarap dengan pemilik lahan. Kerjasama maroan dilakukan menurut adat istiadat, hal itu karena masyarakat kurang memahami tentang hukum, dan mempertahankan adat istiadat mereka. Pada perjanjian bagi hasil maroan sering terjadinya ketidaksesuaian dengan hasil yang didapatkan oleh pemilik lahan, pemilik lahan hanya menyerahkan lahan saja, sedangkan bibit tanaman dan biaya-biaya operasional lainnya ditanggung oleh penggarap. Dalam kerjasama bagi hasil maroan belum ada peraturan yang mengatur dengan baik, baik secara nash maupun peraturan lain yang setingkat dengan perundang-undangan, kerjasama pengelolaan lahan pertanian terdapat dalam Kompilasi Hukum Ekonomi Syari’ah yang disebut dengan istilah akad muzara’ah. Penelitian ini bertujuan untuk menjelaskan implementasi bagi hasil dalam kerjasama maroan, dan menjelaskan implementasi bagi hasil dalam kerjasama maroan perspektif Kompilsi Hukum Ekonomi Syari’ah. Jenis penelitian ini adalah yuridis empiris dengan pendekatan kualitatif deskriptif. Hasil dari penelitian ini menunjukan bahwa (1) perjanjian pada kerjasama maroan dilakukan dalam bentuk lisan. Sistem bagi hasil pada kerjasama maroan adalah 1:1 hasil bersih, yakni setelah dipotong zakat pertanian 10%, buruh 15% serta biaya pupuk dan racun hama 10%. (2) apabila ditinjau dari KHES, kerjasama maroan ini belum dikatakan sempurna karena akad kerjasamanya adalah fasid. Adapun dalam KHES kerjasama pengelolaan lahan pertanian disebut dengan akad muzara’ah. Akan tetapi, memiliki perbedaan dan persamaan konsep. Perbedaannya pada kerjasama maroan penggarap bebas memilih jenis benih yang akan ditanam tanpa campur tangan pemilik lahan. Akan tetapi dalam KHES jenis benih tanaman harus dinyatakan pasti dalam akad. Adapun persamaannya adalah apabila penggrap melakukan penyimpangan maka kerjasama berakhir.

Abstract

Abstract: Today, there are many politics issues in the classical-fikh literature which are not relevant in this time. This paper discusses the importance of a reconstruction and renewal of several issues in classical political fiqh that are adapted to the plural and heterogeneous Indonesian context. Therefore, the author combines the theory of Maqasid al-Syariah and the thought of Ahmad Ar-Raisuni which specifically raises political issues as the main of analytical sources. This article analyzed deeply with the qualitative method. The results of this rstudy are able to give birth to a new construction of Indonesian political fiqh which is formulated in four crucial issues, namely democracy, state format, criteria for leaders in Indonesia, and the application of Islamic sharia.
