Abstract

Abstract: The development of today's era requires Muslims to be able to filter the information circulating in the community to be able to examine its truth based on the sources of the Qur'an and hadith. Meanwhile, the paradigm related to Islamic law in Indonesia must have clear shari'ah and creed boundaries. So that it does not cause controversy for Muslims. This paper discusses the perspective of Ar-Raisuni's reflection in Islamic family law in Indonesia. The type of research used is Library Research, by providing data analysis from various sources, both from scientific journals, online news or books. The problems faced are problems in the context of Islamic family law in Indonesia which are studied from the perspective of Ar-Raisuni. The conclusion of this paper provides an understanding that, Islamic law has a function as "Rahmatan Lil Alamin." Thus, Islamic law is very universal, elastic and dynamic. It is proven by making al-mashlahah as one of the legal arguments, because al-mashlahah can accommodate all the benefits of a society, both individually and in groups. Abstract

This study aims to analyze the differences in fatwas among scholars in the Middle East and South East Asia (Indonesia and Malaysia) towards various Islamic Banking Contracts products and assess the implementation of maqâshid al-sharia within the variety of fatwas mentioned. This study employed a qualitative approach and fatwas from the Middle East and South East Asia as the primary data, while the secondary data were obtained from books on Muaamalah Fiqh and Islamic Banking. The data were garnered based on a literature review with a content analysis technique. The descriptive-inductive method with a reflective way of thinking is used for data exposure, leading to the following findings: 1) There are differences in fatwas towards three Islamic Banking contracts: a) The determination of the deposit contract in the Middle East is stipulated in a qardh contract in a non-investment account; meanwhile, in South East Asia it is stipulated in a wadiah contract; b) in terms of Murâbahah contract, some of the Middle East scholars forbid it, while, some of South East Asian scholars and few scholars from Middle East allow it, and; c) in terms of the al-Ijarah al-muntahiyyah bi al-tamlik, most of Middle East Scholars forbid it, but South East Asian scholars allow it; 2) The implementation of maqâshid sharia within differences of fatwas among scholars has been appropriately implemented in accordance with Islamic law specified under contracts in Islamic banking products in Muslim countries.

Abstract

Abstract: Marriage is a sacred worship (holy) which is very influential on human survival. Therefore, authentic evidence is needed, namely a marriage certificate issued by a special authority, the Office of Religious Affairs (KUA). The aim is as a form of legal protection for married husband and wife. Thus, security, justice, and welfare can be realized in the household. In fact, marriage registration is not one of the pillars and conditions of marriage in Islam, so it is considered not important for brides who want to get married. When viewed from an Islamic point of view, marriage is a form of worship that is considered to bring great mashlahah to every ummah. The purpose of this study was to determine the urgency of marriage registration based on istislahi reasoning. The method used in this research is normative juridical and with a social law research approach. In istislahi reasoning, marriage registration is considered to bring benefits to husbands, wives, and children. Therefore, marriage registration is mandatory for every bride and groom who wants to get married.Keywords: Marriage Registration; Marriage Law; Mashlahah.Abstrak: Perkawinan merupakan ibadah sakral (suci) yang sangat berdampak pada keberlangsungan kehidupan manusia. Oleh sebab itu, perlu adanya bukti yang autentik telah terjadinya suatu perkawinan yaitu akta nikah (marriage book) yang diberikan oleh lembaga khusus yang berwenang, Kantor Urusan Agama (KUA). Adapun tujuannya adalah untuk memberikan perlindungan hukum terhadap pasangan suami isteri yang telah menikah. Sehingga dapat terealisasinya keamanan, keadilan serta kesejahteraan di dalam rumah tangga. Akan tetapi pencatatan perkawinan bukanlah termasuk salah satu rukun dan syarat suatu terjadinya perkawinan dalam Islam, sehingga hal ini menjadi salah satu peluang bagi calon pengantin yang akan menikah lalu menghiraukan pencatatan perkawinan tersebut. Jika dilihat dari sudut pandang Islam, perkawinan merupakan salah satu ibadah yang dianggap dapat mendatangkan mashlahah yang besar bagi semua pihak. Adapun tujuan penelitian adalah untuk mengetahui urgensi dari pencatatan perkawinan berdasarkan penalaran istislahi. Metode penelitian adalah yuridis normative dengan pendekatan social legal reseach. Dalam penalaran istislahi bahwa pencatatan perkawinan akan mendatangkan kemaslahtan bagi suami dan isteri beserta anak-anaknya. Oleh sebab itu, pencatatan suatu perkawinan menjadi sesuatu yang wajib untuk dilaksanakan bagi setiap calon pasangan yang akan melangsungkan pernikahan.Kata Kunci: Pencatatan Perkawinan; Undang-Undang Perkawinan; Mashlahah.

Abstract

Illegal abortion remains a problem in many countries, medically, ethically and legally. Although it restricts the practice of abortion, Islamic law does not question its legality. This study aims to analyse the criminalisation of abortion in Islamic criminal law after 120 days of pregnancy. This article is a normative legal research with a conceptual approach. The results of this study indicate that Islamic law gives full respect to the right to life of a person, including the right to life of the foetus. However, Islamic legal scholars differ on the priorities in safeguarding the lives of pregnant women and foetuses. Islamic legal scholars differ on the criminalisation of abortion. For abortions performed under 120 days of age, the perpetrator is not subject to criminal sanctions. Abortion above 120 days is prohibited except where there are compelling medical, ethical and legal reasons to do so. In cases of rape that result in pregnancy, women have the full right to abortion at any gestational age. Nevertheless, women are still subject to sanctions in the form of kaffarat and diyat al-ghurrah. This aims to prevent people from easily performing abortions.

Abstract

Konsep Maqasid Syari’ah sebenarnya telah dimulai dari masa Al-Juwaini yang terkenal dengan Imam Haramain dan oleh Imam al-Ghazali. Lalu kemudian disusun secara sistematis oleh seorang ahli ushul fikih bermazhab Maliki dari Granada (Spanyol), yaitu Imam Al-Shatibi (W. 790 H). Konsep itu ditulis dalam kitabnya yang terkenal, Al-Muwwafaqat Fi Ushul Al-Ahkam, khususnya pada Juz II, yang beliau namakan kitab Al-Maqashid. Menurut al-Syatibi, pada dasarnya Syari’at ditetapkan untuk mewujudkan kemaslahatan hamba (Mashalih Al-‘Ibad), baik di dunia maupun di akhirat. Metode yang digunakan dalam penelitian ini Library Research. Dengan ciri khusus yaitu sebagai dasar untuk mengembangkan pengetahuan; penelitian ini dihadapkan dengan data atau teks yang disajikan, penelitian ini berhadapan langsung dengan sumber yang sudah ada di perpustakaan atau data siap digunakan. Al-Juwaini adalah termasuk ulama’ yang menekankan pentingnya memahami Maqasid Shari’ah dalam memahami hukum Islam. Dia menegaskan bahwa seseorang tidak dikatakan mampu menetapkan hukum Islam sebelum dia memahami secara utuh tujuan Allah mengeluarkan perintah-perintahnya dan larangan-larangannya. Dan Menurut Al-Ghazali, yang dimaksud dengan maslahat adalah upaya memelihara tujuan hukum Islam (Maqasid Shari’ah), yaitu memelihara agama, jiwa, akal, keturunan, dan harta benda. Setiap hal yang dimaksudkan untuk memelihara tujuan hukum Islam yang lima tersebut disebut Maslahat. Kebalikannya, setiap hal yang merusak atau menafikan tujuan hukum Islam yang lima tersebut disebut Mafsadat, yang oleh karena itu upaya menolak dan menghindarkannya disebut Maslahat.

Abstract

Indonesia is experiencing a decline in marriage rates along with a high divorce rate. At the same time, a trend emerged on social media called Marriage Is Scary. The Marriage Is Scary trend expresses the young generation's fear of marriage. This research aims to analyze the Marriage Is Scary phenomenon from the perspective of Islamic law and positive law in Indonesia. The method used is normative legal research with a conceptual and statutory approach. The results of this study show that marriage in Islam has a variety of laws, which can be sunnah, obligatory, makruh, haram, and mubah. The young generation's fear of marriage, when related to the law of marriage in Islam, must first be seen as the cause of this fear. In essence, Islam emphasizes the readiness to carry out marriage from various aspects. In terms of positive law, Indonesia has multiple regulations, such as the Marriage Law, the Law on the Elimination of Domestic Violence, and the Marriage Guidance Program as a form of the government's commitment to creating an environment conducive to healthy and ideal marriages, as well as an answer to the Marriage Is Scary trend.

Abstract

This study aims to examine the absence of the bride-to-be in the practice of marriage ceremony on the marriage administrative process and analyze its impact through the application of Gustav Radbruch's Theory of Legal Certainty. This research is a type of empirical juridical research using a qualitative descriptive approach. The research was conducted at KUA, Ringinrejo District, Kediri Regency with the object of research being the Head of KUA as an informant who can provide information about the absence of the bride-to-be in the practice of marriage rapak. In this study, the researcher used primary and secondary data sources. The data collection methods used are interviews and documentation. The data analysis methods used are data processing, data classification, data analysis, and conclusion. The main findings of this study show that in KUA Ringinrejo District there is flexibility when the prospective husband is unable to attend the practice of marriage cards such as through representatives or confirmation via telephone. Although administratively this allows the continuation of the marriage process, from the perspective of Gustav Radbruch's theory of Legal Certainty, which includes justice, utility, and legal certainty, it is found that the absence of the bride-to-be has the potential to cause legal vulnerability, especially related to the legitimacy and administration of the marriage. This research contributes to the discourse on marriage administration reform and the urgency of establishing more adaptive regulations in ensuring legal certainty in the midst of social dynamics of society.
